The Un Declaration On The Rights Of Indigenous Peoples: A Flexible Approach To Addressing The Unique Needs Of Varying Populations, Viniyanka Prasad
The Un Declaration On The Rights Of Indigenous Peoples: A Flexible Approach To Addressing The Unique Needs Of Varying Populations, Viniyanka Prasad
Chicago Journal of International Law
Differences among civilizations are a critical consideration in the development and enforcement of public international law. As "non-Western" countries gain a more sophisticated and influential presence in the UN and other intergovernmental bodies, these bodies are forced to reconcile their historic and elemental positions with those of member states that may have fundamental differences in their views of governmental power, human rights, and the role of international authority. Religion is one area of particular interest because of its divisive implications for major players on the world stage. Religious beliefs inform the moral frameworks of many of the world's most prominent …
Wittgenstein And Worship: Investigations Of Liturgical Language-Games And Their Formative Role In Christian Identity, Michelle Kathleen Weber
Wittgenstein And Worship: Investigations Of Liturgical Language-Games And Their Formative Role In Christian Identity, Michelle Kathleen Weber
School of Theology and Seminary Graduate Papers/Theses
I argue that the Christian community’s religious language games, particularly liturgical action (theologia prima) and theological reflection (theologia secunda), mutually shape and correct one another. I demonstrate this using Wittgenstein’s philosophical method, adapting his approach to philosophy for theological use. The first part of this essay explains and demonstrates Wittgenstein’s philosophical method. The second part is an application of his method (with my own adaptation of this method for theology) with Christian liturgy as its subject. The third part of this essay discusses ways in which Wittgenstein’s approach might be adapted further in a fruitful way …

Framing Collaborative Behaviors: Listening And Speaking In Problem-Based Learning, Louisa Remedios, David Clarke, Lesleyanne Hawthorne
Framing Collaborative Behaviors: Listening And Speaking In Problem-Based Learning, Louisa Remedios, David Clarke, Lesleyanne Hawthorne
Interdisciplinary Journal of Problem-Based Learning
PBL is described as small-group collaborative learning; however, literature on how collaboration is enacted in PBL contexts is limited. A two-year ethnographic study examined the experiences and responses of Asian students to the obligations of PBL in a Western context. Participant-observation, videotape data, and video-stimulated recall interviews provided insights into collaborative behaviors in PBL classrooms. Even though students recognized that listening and speaking were important to collaboration, speaking was clearly privileged over listening in this PBL setting. A framework was developed that incorporated both collaborative and noncollaborative listening and speaking behaviors. This Collaborative Listening/Speaking (CLS) framework provides a structure for …
Critical Impairments To Globalizing The Western Human Rights Discourse, Nikitah O. Imani
Critical Impairments To Globalizing The Western Human Rights Discourse, Nikitah O. Imani
Black Studies Faculty Publications
This article focuses on the philosophical implications of Euro-centrism and Eurocentric discourse for the Western human rights narrative. It is argued that there is insufficient theoretical and practical consideration of those implications, particular for advocacy and activity in the so-called “Third World” where such arguments frequently become mere vehicles for the advance of economic and political neocolonialism. In many ways, colonialism with a humanistic, liberal democratic “face”. Finally, a proposition is advanced that if the Western human rights discourse is to be effectively corrected and evolve into a global one, critiques of Euro-centrism from outside the Western discursive world must …
In The Spirit Of Ubuntur. Enforcing The Rights Of Orphans And Vulnerable Children Affected By Hiv/Aids In South Africa, John D. Bessler
In The Spirit Of Ubuntur. Enforcing The Rights Of Orphans And Vulnerable Children Affected By Hiv/Aids In South Africa, John D. Bessler
UC Law SF International Law Review
The author discusses the traditional African concept of ubuntu, which is frequently cited in South African jurisprudence, and analyzes South Africa's violation of the human rights of orphans and vulnerable children affected by HIV/AIDS. South Africa's Constitution explicitly protects children's rights and various socio-economic rights of concern to children. The Constitutional Court of South Africa has held such rights to be justiciable, yet the rights of South African children have continually been violated. The author discusses how the existence of these rights may assist orphans and vulnerable children as well as those advocating on their behalf, and identifies legal strategies …
Broadcast Profanity And The Right To Be Let Alone: Can The Fcc Regulate Non-Indecent Fleeting Expletives Under A Privacy Model, Edward L. Carter, R. Trevor Hall, James C. Phillips
Broadcast Profanity And The Right To Be Let Alone: Can The Fcc Regulate Non-Indecent Fleeting Expletives Under A Privacy Model, Edward L. Carter, R. Trevor Hall, James C. Phillips
UC Law SF Communications and Entertainment Journal
This manuscript examines the issue of broadcast profanity regulation in light of the Supreme Court's March 2008 decision to grant certiorari in an appeal from the U.S. Court of Appeals for the Second Circuit. The Second Circuit in 2007 held that the FCC was arbitrary and capricious in its decision to begin prohibiting single profanities, or fleeting expletives, on broadcast television. However, the common law of nuisance and the law of privacy may provide justification for the FCC to regulate broadcast profanity under 18 U.S.C. § 1464. Although some argue that regulating broadcast profanity would induce a chilling effect on …

Exploration Of Tribal Knowledge Of Entada Pursaetha Dc: An Endangered Gigantic Medicinal Legume In Eastern Ghats, K. Sai Vishnu Priya, Srinivasa Rao
Ethnobotanical Leaflets
The third largest family of flowering plants is the legume family, with more than 18, 000 species. Legumes play an important role in daily human diet, and an array of compounds which can be useful in curing diseases. Tribals utilize many species in their daily lives; most of the uses are still unknown to researchers. Entada pursaetha is a gigantic creeper with giant pods among legumes, and is an endangered species. Many uses for this legume were discovered as a result of the surveys conducted by the authors at five localities in Eastern Ghats. These surveys helped to considerably sharpen …

A Trickster’S Oaths In The Homeric Hymn To Hermes, Judith Fletcher
A Trickster’S Oaths In The Homeric Hymn To Hermes, Judith Fletcher
Ancient Studies Faculty Publications
Hermes’ maturation into a god of commerce and diplomacy is punctuated by a series of oaths. At first he uses tricky or unsworn oaths in the investigation of his theftof Apollo’s cattle, but eventually he and Apollo exchange oaths that evoke the protocols of ritualized friendship. Although the ceremony suggests that Hermes has achieved adulthood, a narrative sleight of hand leaves some ambiguity about the completion of the ritual.

Contested Morality: Judge Posner On Infanticide, Slavery, Suttee, Female Genital Mutilation, And The Holocaust, Anthony D'Amato
Contested Morality: Judge Posner On Infanticide, Slavery, Suttee, Female Genital Mutilation, And The Holocaust, Anthony D'Amato
Faculty Working Papers
Judge Richard Posner locates his moral theory between moral absolutism and the "anything goes" kind of moral relativism. He analyzes whether five contested topics are subject to useful moral debate: infanticide, slavery, suttee, female genital mutilation, and the Holocaust. Each topic presents a different perspective on his own moral theory. But each one fails in a different way to place his own moral theory on a sound footing.
Generating Spatial Surplus: The Politics Of Zoning In The Mumbai Metropolitan Region, Alpen Suresh Sheth
Generating Spatial Surplus: The Politics Of Zoning In The Mumbai Metropolitan Region, Alpen Suresh Sheth
Open Access Theses
The study explores the implications of new forms of zoning in India. In particular, emerging development projects in the Mumbai Metropolitan Region serve as cases and instances of broader rezoning processes throughout the region. One is the Dharavi Redevelopment Project, a slum redevelopment project in central Mumbai on Dharavi, the largest slum in Asia; the other is the Mumbai Special Economic Zone, a private economic enclave spanning an area of 10,000 hectares (100 sq km) on agricultural land in the northern Raigad district of Maharashtra. Despite being unique and spatially-circumscribed projects, I argue that together they constitute a critical departure …
Responding To Joint Attention: Growth And Prediction To Subsequent Social Competence In Children Prenatally Exposed To Cocaine, Shira Kolnik
Responding To Joint Attention: Growth And Prediction To Subsequent Social Competence In Children Prenatally Exposed To Cocaine, Shira Kolnik
Open Access Theses
Responding to Joint Attention (RJA) involves an infant's ability to follow a gaze or point by a partner. Prenatal cocaine exposure (PCE), which places a child in danger of numerous risks, has been accepted as having subtle effects on developmental outcomes such as social competence and associated socio-emotional outcomes. The current study looked at a sample of 166 children prenatally exposed to cocaine who were attending an early intervention program. The study established group and individual trajectories of responding to joint attention from 12, 15, and 18 months of age. Hierarchical modeling identified two groups, a delay group and an …
Developmental Patterns Of Responding To Joint Attention In Infants Prenatally Cocaine Exposed And Predictions To Language, Dolores Farhat
Developmental Patterns Of Responding To Joint Attention In Infants Prenatally Cocaine Exposed And Predictions To Language, Dolores Farhat
Open Access Theses
The current study examined the development of responding to joint attention (RJA), a prelinguistic skill, in a sample of children prenatally cocaine exposed. The sample used was part of a larger population of children randomly assigned to three levels of intervention. The growth of RJA in the current sample was best characterized by two linear growth groups determined by a semi-parametric growth modeling program. Each trajectory group was differentially associated with three language outcomes. Gender, treatment group, and birthweight were three risk factors that influenced the likelihood of belonging to either growth cluster. RJA?s predictive significance in terms of concurrent …

The type of commentary a narrative is able to make is fully dependent on the type of narrator who is relating it. The visual elements present in a film are the true narrational forces which guide it. The presence of the camera, the use of lighting, the architecture, and the objects present in the film each have their own meaning. These elements come together to make a greater commentary than the dialogue. How these meanings interact with each other is what defines what type of narrator is present in the film. By analyzing what type of narrator is relating the …

Shibboleths And Ceballos: Eroding Constitutional Rights Through Pseudocommunication, Susan Stuart

Recently, the Supreme Court rendered an inexplicable First Amendment decision that has far-reaching effects on the way government is held accountable to the public. In Garcetti v. Ceballos, the Court determined that a government employer can retaliate against an employee for doing his job correctly, notwithstanding the Constitution, so long as the employer targets speech that was part of the employee’s official duties. Inasmuch as government employees are often responsible for reporting government misconduct and other matters of public concern, this opinion essentially leaves the public unprotected from the unbridled discretion of government supervisors. The possible motivations for this …
