Sovereignty As Discourse, Robert L. Tsai Apr 2008

Sovereignty As Discourse, Robert L. Tsai

Faculty Scholarship

This is a review of Howard Schweber's book, "The Language of Liberal Constitutionalism" (Cambridge University Press, 2007). Schweber argues that "the creation of a legitimate constitutional regime depends on a prior commitment to employ constitutional language, and that such a commitment is both the necessary and sufficient condition for constitution making." I critique the power and limits of this reformulated Lockean thesis, as well as Schweber's secondary claims that, for constitutional language to remain legitimate, it must increasingly become autonomous, specialized, and secular.

What Lurks Beneath: Nsa Surveillance And Executive Power Symposium: The Role Of The President In The Twenty-First Century, Gary S. Lawson

Faculty Scholarship

It is not surprising that, nearly two and a quarter centuries after ratification of the Federal Constitution, people are still actively arguing about the extent of the American President's powers.' The concept of executive power is notoriously murky,2 so disputes about its scope and character are virtually unavoidable. It is, however, at least a tad surprising that, nearly two and a quarter centuries after ratification of the Federal Constitution, people are still arguing about the constitutional sources of presidential power. 3 It is one thing to disagree about how far the President's power extends, but it is quite another thing …

The Academic English Literacy Acquisition Experiences Of Deaf College Students, Kathryn Schmitz Apr 2008

The Academic English Literacy Acquisition Experiences Of Deaf College Students, Kathryn Schmitz

Theses

The purpose of this dissertation was to describe deaf college students’ perceptions of their experiences learning academic English literacy. The study examined the narrated academic English literacy acquisition experiences and practices of 11 deaf and hard-ofhearing students at a hearing university with a large deaf student population. Through paradigmatic analysis of narrative data, the study located common themes that revealed their perceptions of academic English literacy acquisition. The study was conducted with deaf students attending a college for deaf and hardof- hearing students, which is one of eight colleges at a major northeastern university. Methods employed in the study were …

Language Death Within The Atlantic Group Of West Africa, George Tucker Childs Apr 2008

Language Death Within The Atlantic Group Of West Africa, George Tucker Childs

Applied Linguistics Faculty Publications and Presentations

This article presents an overview of the less widely spoken languages of the Atlantic Group (Niger-Congo), as representing the most seriously threatened language group in West Africa. Study of this group indicates that language endangerment is real and widespread. The basis for this claim comes from the literature on these languages, from personal research on the Atlantic languages dating back to 1984, and from recent and ongoing fieldwork on several highly endangered languages of Sierra Leone and Guinea.

Cob Building: Movements And Moments Of Survival, Jeanine Marie Minge Apr 2008

Cob Building: Movements And Moments Of Survival, Jeanine Marie Minge

USF Tampa Graduate Theses and Dissertations

Cob, as an arts-based research process, creates movements and moments of survival. Survival is an ideological construction and an actual, local practice. Survival is also about desiring and fulfilling arts-based desires to work with the land through academic and material scavenging. Cob creates strategies for surviving, for working with our respective environments wisely. Cob building teaches people how to negotiate the natural economy and their relationships to labor and each other through an artistic and intimate practice. From a feminist poststructural lens, survival happens on the local level, between and with people. Cob building creates knowledge through creative, kinesthetic, and …

Badiou's Nocturnal Jurisprudence, Igor Stramignoni Apr 2008

Badiou's Nocturnal Jurisprudence, Igor Stramignoni

Cardozo Law Review

How, in the philosophy of Alain Badiou, is the relation between thought and language, the true and the legal, between philosophy itself and the impersonal transcendental field made possible through the occurrence of unexpected events? With and against Badiou, I argue that such a relation is one of subtraction and so similar to that which from time immemorial has permitted the somewhat enigmatic dominion of night and day in nature and culture alike. What then might be at stake in Badiou's nocturnal jurisprudence, in his subtractive discourse of the truth of the legal?

Missing Privacy Through Individuation: The Treatment Of Privacy Law In The Canadian Case Law On Hate, Obscenity, And Child Pornography, Jane Bailey Apr 2008

Missing Privacy Through Individuation: The Treatment Of Privacy Law In The Canadian Case Law On Hate, Obscenity, And Child Pornography, Jane Bailey

Dalhousie Law Journal

Privacy is approached differently in the Canadian case law on child pornography than in hate propaganda and obscenity cases. Privacy analyses in all three contexts focus considerable attention on the interests of the individuals accused, particularly in relation to minimizing state intrusion on private spheres of activity However, the privacy interests of the.equality-seeking communities targeted by these forms of communication are more directly addressed in child pornography cases than in hate propaganda and obscenity cases. One possible explanation for this difference is that hate propaganda and obscenity simply do not affect the privacy interests of targeted groups and their members. …

Cultural Competency In Capital Mitigation, Christopher Seeds, Scharlette Holdman Apr 2008

Cultural Competency In Capital Mitigation, Christopher Seeds, Scharlette Holdman

Cornell Law Faculty Publications

Cultural factors so pervasively influence the interactions of the client with other people - including all of those with whom he comes into contact at significant times in his life (e.g. in educational, medical, and correctional institutions), those surrounding him in the community in which he develops, and, critically, the members of the defense team - that it is imperative for the defense team to have the talents necessary to conduct a mitigation investigation that is culturally competent. The investigation must recognize and surmount an array of barriers, overt and subtle, to obtaining information from people of variegated backgrounds. As …

Particular attention is paid to the implications for the security of the United States. Chapters 4 and …

Disassembly Planning And Costing Through Petri Net Approach, Chunhsi Lei Apr 2008

Disassembly Planning And Costing Through Petri Net Approach, Chunhsi Lei

Mechanical & Aerospace Engineering Theses & Dissertations

In the current consumer oriented environment, many new products appear in the market almost on a daily basis. Lured by advertisements and tempted by new product features, customers are constantly purchasing newer products. Acquiring newer products for often leads to throwing out older ones, but it is a totally different story for manufacturers. They need to consider the best way to reuse a product both for economic purposes and for environmental protection. Considerations for them often include: how to minimize total disassembly cost, how to achieve the lowest total disassembly time at each processing step, and how to sort valuable …

Uncertainty Assessment Of Aircraft Maintenance Times By Using Evidence Theory And Expert Judgment Elicitation, Huseyin Kudak Apr 2008

Uncertainty Assessment Of Aircraft Maintenance Times By Using Evidence Theory And Expert Judgment Elicitation, Huseyin Kudak

Engineering Management & Systems Engineering Theses & Dissertations

The goal of this study is to demonstrate the use of the Dempster-Shafer Theory of evidence as a decision aid to predict aircraft maintenance times during wartime operations using expert judgment elicitation. Increased precision in time estimation enables the jet engine aircraft maintenance facility commander to make more accurate decisions for the Air Force's wartime tactical operations allowing the commander to gain a decisive advantage. A questionnaire was designed to elicit judgments from experts in the Aircraft Maintenance Facility (AMF) to investigate maintenance times of the major failure modes (Ignition, Fuel, and Electrical). Results of the expert judgment elicitation were …

Kurds In Turkey And In (Iraqi) Kurdistan: A Comparison Of Kurdish Educational Language Policy In Two Situations Of Occupation, Tove Skutnabb-Kangas

Genocide Studies and Prevention: An International Journal

This article describes, compares, and analyzes two educational situations for Kurds from the point of view of linguistic human rights, using prodigious exemplification. In Turkey, Kurdish-medium schools are not allowed, and Kurdish children do not even have the right to study their mother tongue as a subject in school. In addition to physical genocide through low-intensity warfare, including unacceptable living conditions, Turkey continues to commit linguistic and cultural genocide (according to definitions of genocide in articles 2(b) and 2(e) in the UN Convention on the Prevention and Punishment of the Crime of Genocide) in relation to the Kurdish nation/minority. Under …

The Three “Switches” Of Identity Construction In Genocide: The Nazi Final Solution And The Cambodian Killing Fields, Maureen S. Hiebert Apr 2008

The Three “Switches” Of Identity Construction In Genocide: The Nazi Final Solution And The Cambodian Killing Fields, Maureen S. Hiebert

Genocide Studies and Prevention: An International Journal

If we want to understand why political elites choose to commit genocide, we need to inquire into how elite perpetrators reconstruct the collective identity of the victim group such that genocide becomes the only possible policy option. This article argues that elites decide to commit genocide, and not some other less catastrophic policy of repression or violence, when three conceptual ‘‘switches’’ concerning the identity, interests, and future actions of the victim group are ‘‘turned on’’ by the perpetrators. First, members of the victim group lose their (often marginal) status within the political community and are constructed as outsiders, to whom …

Baloch Nationalism And The Geopolitics Of Energy Resources: The Changing Context Of Separatism In Pakistan, Robert J. Wirsing Dr. Apr 2008

Baloch Nationalism And The Geopolitics Of Energy Resources: The Changing Context Of Separatism In Pakistan, Robert J. Wirsing Dr.

Books, Monographs & Collaborative Studies

The author examines the energy context of the simmering Baloch separatist insurgency that has surfaced in recent years in Pakistan’s sprawling Balochistan province. In particular, he looks at how Pakistan’s mounting energy insecurity--a product of rapid increase in demand coupled with rising scarcity and the region’s intensified energy rivalry--has both magnified the economic and strategic importance of this province while at the same time complicating Pakistan’s efforts to cope with the province’s resurgent tribal separatism. The author concludes that Pakistan’s government needs to overhaul its counterinsurgent policies to avoid protracted conflict and to enlist the Baloch as partners in energy …

An Investigation Of Kavilorai: A Hero Stone Site In The Nilgiri Mountains Of South India, Jacob Landon Bach Apr 2008

An Investigation Of Kavilorai: A Hero Stone Site In The Nilgiri Mountains Of South India, Jacob Landon Bach

Masters Theses

This study explores the hero stones of the Nilgiri Mountains of South India. This project has focused on the site of Kavilorai for developing a stylistic base to compare other sites of the region with. After analysis it was determined that Kavilorai contained four separate, but connected stylistic expressions carved on the hero stones. The findings when compared with other upper elevation sites corresponded to a high quality/low quality theme, often incorporating the ritual suicide sati. When comparing the stylistic representation of the carved figures to the Badaga Lingayat temple of Seminatum there surfaced strong thematic and stylistic connections. The …

Watch Out For The Freshman 15: An Investigation And Interpretation Of Memorable Health Messages Received By College Students, Lindsey Marie Rose Apr 2008

Watch Out For The Freshman 15: An Investigation And Interpretation Of Memorable Health Messages Received By College Students, Lindsey Marie Rose

Masters Theses

Using the memorable messages framework as a guide (Knapp, Stohl & Reardon, 1981), this thesis examines the memorable health messages that college students are able to recall. The survey design queried respondents about the structure and form of the message, circumstances surrounding the message, the source of the message, and the content of the message. The data was assessed quantitatively through use of one-sample chi-square tests, and qualitatively utilizing grounded theory. The results of the study were generally supported by previous memorable message studies. The research findings are discussed based on the memorable messages framework and the implications for future …

Multicultural Experience Enhances Creativity: The When And How, Angela K. Y. Leung, William W. Maddux, Adam D. Galinsky, Chi-Yue Chiu Apr 2008

Multicultural Experience Enhances Creativity: The When And How, Angela K. Y. Leung, William W. Maddux, Adam D. Galinsky, Chi-Yue Chiu

Research Collection School of Social Sciences

Many practices aimed at cultivating multicultural competence in educational and organizational settings (e.g., exchange programs, diversity education in college, diversity management at work) assume that multicultural experience fosters creativity. In line with this assumption, the research reported in this article is the first to empirically demonstrate that exposure to multiple cultures in and of itself can enhance creativity. Overall, the authors found that extensiveness of multicultural experiences was positively related to both creative performance (insight learning, remote association, and idea generation) and creativity-supporting cognitive processes (retrieval of unconventional knowledge, recruitment of ideas from unfamiliar cultures for creative idea expansion). Furthermore, …

Does Dworkin Commit Dworkin’S Fallacy?: A Reply To Justice In Robes, Michael S. Green Apr 2008

Does Dworkin Commit Dworkin’S Fallacy?: A Reply To Justice In Robes, Michael S. Green

Faculty Publications

In an article entitled ‘Dworkin’s Fallacy, Or What the Philosophy of Language Can’t Teach Us about the Law’, I argued that in Law’s Empire Ronald Dworkin misderived his interpretive theory of law from an implicit interpretive theory of meaning, thereby committing ‘Dworkin’s fallacy’. In his recent book, Justice in Robes, Dworkin denies that he committed the fallacy. As evidence he points to the fact that he considered three theories of law—‘conventionalism’, ‘pragmatism’ and ‘law as integrity’—in Law’s Empire. Only the last of these is interpretive, but each, he argues, is compatible with his interpretive theory of meaning, which he describes …
