Suffolk University Law School Faculty Works

As experts in the pedagogy and substance of legal writing, full-time legal writing faculty who serve as writing consultants to law firms help fill an increasing need for training and support of lawyers. This article discusses generally the practice of legal writing consulting in law firms by full-time legal writing faculty. The article provides background in theory and practice, addressing why law firms seek outside consultants for this type of training and support and …

Mapping The Social Life Of The Law: An Alternative Approach To Legal Research, Ian Gallacher Apr 2008

Mapping The Social Life Of The Law: An Alternative Approach To Legal Research, Ian Gallacher

International Journal of Legal Information

As the law moves inexorably to a digital publication model in which books no longer play a role, the problem of how to continue to make the law available to all becomes more acute. Open access initiatives already exist, and more are on the way, but all are limited by their inability to provide more than self-indexed search options for their users. Self-indexing, although a powerful alternative to the traditional pre-indexed searching made possible by systems like West’s “Key Number” digests, has inherent limitations which make it a poor choice as the sole means of researching the law. But developing …

Fortaleza’S Feminisms: Searching For Feminist Theory In The Centro De Referência Da Mulher And The Delegacia De Defesa Da Mulher, Paige Sweet Apr 2008

Fortaleza’S Feminisms: Searching For Feminist Theory In The Centro De Referência Da Mulher And The Delegacia De Defesa Da Mulher, Paige Sweet

Independent Study Project (ISP) Collection

This study attempts to focus on the issue of how violence against women is combated in Brazil through interviewing the women who work at the Delegacia de Defesa da Mulher and the Centro de Referência da Mulher. I attempt to compare and contrast the policies and procedures of these two institutions, as well as the opinions of the women who work there, to understand how they reflect and/or resist feminist theory values. As the basis of this analysis, I am using feminist domestic violence theory, which states that the cause of domestic violence is rooted in sexism and patriarchal power …

The Right To Counsel: Policy Reasons For Fundamental Reforms To Promote Access To Justice, Adrian Scotchmer Apr 2008

The Right To Counsel: Policy Reasons For Fundamental Reforms To Promote Access To Justice, Adrian Scotchmer

Osgoode Hall Review of Law and Policy

This article argues that it is highly undesirable that legal costs impede, and often preclude access to counsel. Even if access to counsel is not a constitutional right in itself, as the Supreme Court of Canada held in Christie, the arguments advanced by the plaintiff in Christie when supplemented by other considerations, establish the importance of access to counsel as a matter of policy. As such, the law societies and the governments of Canada ought to do more to promote access to counsel. Specifically, the law societies ought to reduce market-entry and market-conduct restrictions and increase the use of existing …

The Legal World Is Flat: Globalization And Its Effect On Lawyers Practicing In Non-Global Law Firms, Laurel Terry Apr 2008

The Legal World Is Flat: Globalization And Its Effect On Lawyers Practicing In Non-Global Law Firms, Laurel Terry

Faculty Scholarly Works

While lawyers in these large global law firms usually are aware of why globalization is relevant to them, other U.S. lawyers may not think that the globalization phenomenon affects them. A comment frequently heard is "Law is local so I don't have to worry about globalization affecting me or my practice." The goal of this article is to look at Friedman's work through the lens of legal services and to answer several questions, including: Whether Friedman's analysis is relevant to what has happened in the field of legal services; Whether a U.S. lawyer who doesn't practice in a global law …

Human Rights & Multilateral Development Banks: Evaluating Recipient Records & Lending Practices, Geneva J. Román Apr 2008

Human Rights & Multilateral Development Banks: Evaluating Recipient Records & Lending Practices, Geneva J. Román

McNair Scholars Research Journal

This study examines the role of recipient human rights records in the loan allocation of multilateral development banks. Correlating the loan amounts awarded to recipients with their human rights environments determines whether or not human rights are a substantial consideration in multilateral lending practices. By analyzing the African Development Bank, African Development Fund, Inter-American Bank and the International Monetary Fund this study also sheds light on whether international financial institutions are upholding their legally bound human rights obligations. This study uses Ordinary Least Squares and General Least Squares regression models and finds that human rights have little effect on the …
