Should Parties’ Disclosure Requirements For Arbitrators Be Honored By Courts: Positive Software Solutions, Inc. V. New Century Mortgage Corporation, Leonard E. Gross, Howard L. Wieder

Courts should refuse to confirm arbitrators’ awards when arbitrators fail to comply with the terms of an arbitration agreement requiring them to disclose significant information about themselves. When Congress enacted the FAA, it made it clear that it wanted contracts to arbitrate enforced according to the parties’ agreement. The parties’ agreement includes the disclosure requirements to which the parties have negotiated themselves or to which they have agreed by electing to follow the procedures of an arbitration association such as the AAA. Determining the financial feasibility of a South Valley municipality requires developing estimates of the revenues that might be raised, and this in turn requires a careful reading of NM statutes to see what the city may be entitled to and what authority it has under state law, as well as estimating the tax bases and the levels of activity against which fees and charges for services will be assessed. The end point in the access to justice debate often focuses on expanding the availability of legal services for the poor. This article argues that true access to justice requires greater focus on the quality of legal services provided. It tells the story of the introduction of peer review in Canada as a quality assurance tool for evaluating the legal work of a group of criminal lawyers. Law Commissions And Access To Justice: What Justice Should We Be Talking About?, Patricia Hughes

In addition to their explicit mandates, law reform commissions have a generic mandate to make recommendations that are designed to increase access to justice. Moreover, contemporary commissions ought to interpret the concept of access to justice broadly. Even though they undertake topics of 'lawyers' law,' or at times limit their focus to the narrower legal system, commissions should also consider how law can be employed to realize economic or social justice.
