Intolerable Situations And Counsel For Children: Following Switzerland's Example In Hague Abduction Cases , Merle H. Weiner Dec 2008

Intolerable Situations And Counsel For Children: Following Switzerland's Example In Hague Abduction Cases , Merle H. Weiner

American University Law Review

In the twilight days of 2007, Switzerland took decisive action to protect children who were being harmed by the application of the Hague Convention on the Civil Aspects of International Child Abduction ("Hague Abduction Convention" or "Convention"). 1 Its Parliament passed the Federal Act on International Child Abduction and the Hague Conventions on the Protection of Children and Adults ("Swiss Act"). 2 The Swiss Act, which should enter into force in mid-2009, 3 gives important and necessary guidance to Swiss courts about the phrase "intolerable situation" in Article 13(b) of the Hague Abduction Convention. 4 The Swiss Act also directs …

Expressive Minimalism And Fuzzy Signals: The Judiciary And The Role Of Law, Michele Goodwin Dec 2008

Expressive Minimalism And Fuzzy Signals: The Judiciary And The Role Of Law, Michele Goodwin

Chicago-Kent Law Review

The proper role of courts engenders significant debate. Yet, what seems better settled is the principle that courts are the place at which the common law is developed. Its genesis and modifications evolve out of the juridical process and when that process becomes encumbered or deferred to the legislature the role of the judiciary is called into question. This essay makes the case that expressive minimalism too often governs the common law judicial approach to biotechnology. The cases visited in this domain test our capacity to understand whether life is appropriately described as being beyond the definition of property, as …

Human Gene Patents: Proof Of Problems?, Timothy Caulfield Dec 2008

Human Gene Patents: Proof Of Problems?, Timothy Caulfield

Chicago-Kent Law Review

The patenting of human genes has been the focus of intense policy debate. The concerns associated with gene patenting are diverse, ranging from dignity based critiques to suggestions that patents will drive up the cost of health care. But the two concerns that have generated the most policy attention are that they hurt basic research (also known as the "anti-commons" problem) and access to useful technologies. The goal of this short comment is to question the degree to which existing evidence supports the speculation about these two justifications for patent reform. While the issues associated with gene patents are complex …

What Is Owed Participants In Biotechnology Research?, Julie A. Burger Dec 2008

What Is Owed Participants In Biotechnology Research?, Julie A. Burger

Chicago-Kent Law Review

The legal and ethical protections afforded human subjects of research afford individuals who participate in research certain rights. Potential participants must give voluntary and informed consent to participate, they have the right to withdraw from research, they cannot be asked to waive certain rights, and they have the right to choose which studies they will participate in. But researchers, institutions, patient advocacy groups, and ethicists continue to debate how these rules should be applied in the context of genetics research—projects that involve using the individual's tissue or the individual's genetic information, such as gene sequences, and associated medical information. Evidence …

Intellectual Property And The Politics Of Emerging Technology: Inventors, Citizens, And Powers To Shape The Future, Stephen Hilgartner Dec 2008

Intellectual Property And The Politics Of Emerging Technology: Inventors, Citizens, And Powers To Shape The Future, Stephen Hilgartner

Chicago-Kent Law Review

This article argues that there is a mismatch between traditional intellectual property doctrine and the politics of intellectual property today. To examine the nature of the mismatch, I contrast two frameworks that both appear in contemporary debate about intellectual property: the traditional discourse, which focuses on innovation policy, and a newer, less clearly codified discourse that views intellectual property issues from the perspective of the politics of technology. This latter discourse focuses on the challenge of democratic governance in a world where emerging technologies have assumed a central role in constituting the future, raising far-reaching questions about how they should …

Judicial Activism V. Judicial Abdication: A Plea For A Return To The Lochner Era Substantive Due Process Methodology, Brandon S. Swider Dec 2008

Judicial Activism V. Judicial Abdication: A Plea For A Return To The Lochner Era Substantive Due Process Methodology, Brandon S. Swider

Chicago-Kent Law Review

Amid the fierce battles that take place during the confirmation process of a Supreme Court justice, surprisingly little attention is given to the fact that both sides of the political spectrum generally agree on a matter of profound constitutional importance—namely, the proper level of scrutiny courts are to exact with respect to state and federal legislation. Presently, and for the better part of the last 70 years, the dominant attitude among judicial conservatives and liberals alike is that courts have no authority to strictly scrutinize the overwhelming majority of legislation enacted by state and federal legislatures.

This Comment argues that …

Legal Ethics, Patrick Emery Longan Dec 2008

Legal Ethics, Patrick Emery Longan

Mercer Law Review

Georgia's appellate courts made significant decisions during the survey year in matters of attorney discipline, malpractice, and ineffective assistance of counsel. They also issued opinions worth noting in cases concerning attorney and judicial disqualification and several miscellaneous matters.

Workers' Compensation, H. Michael Bagley, Daniel S. Kniffen, Katherine D. Dixon Dec 2008

Workers' Compensation, H. Michael Bagley, Daniel S. Kniffen, Katherine D. Dixon

Mercer Law Review

The Georgia General Assembly made no substantive changes to the Workers' Compensation Act in 2008. Additionally, the Georgia appellate courts took relatively few cases on appeal, and most of these addressed areas of law that are already well-established. Because many workers' compensation cases now require practitioners to address the Medicare Secondary Payer Act, the history, impact, and involvement of that legislation on Georgia claims is also addressed in this Article.

Global Irrigation Water Demand: Variability And Uncertainties Arising From Agricultural And Climate Data Sets, Dominik Wisser, Steve Frolking, Ellen M. Douglas, Balazs M. Fekete, Charles Vorosmarty, Andreas H. Schumann Dec 2008

Global Irrigation Water Demand: Variability And Uncertainties Arising From Agricultural And Climate Data Sets, Dominik Wisser, Steve Frolking, Ellen M. Douglas, Balazs M. Fekete, Charles Vorosmarty, Andreas H. Schumann

Earth Sciences

Agricultural water use accounts for around 70% of the total water that is withdrawn from surface water and groundwater. We use a new, gridded, global-scale water balance model to estimate interannual variability in global irrigation water demand arising from climate data sets and uncertainties arising from agricultural and climate data sets. We used contemporary maps of irrigation and crop distribution, and so do not account for variability or trends in irrigation area or cropping. We used two different global maps of irrigation and two different reconstructions of daily weather 1963–2002. Simulated global irrigation water demand varied by ∼30%, depending on …

Recovery From A Cycling Time Trial Is Enhanced With Carbohydrate-Protein Supplementation Vs. Isoenergetic Carbohydrate Supplementation, John M. Berardi, Eric E. Noreen, Peter W.R. Lemon

Health Sciences Faculty Publications

Background: In this study we assessed whether a liquid carbohydrate-protein (C+P) supplement (0.8 g/kg C; 0.4 g/kg P) ingested early during recovery from a cycling time trial could enhance a subsequent 60 min effort on the same day vs. an isoenergetic liquid carbohydrate (CHO) supplement (1.2 g/kg).

Methods: Two hours after a standardized breakfast, 15 trained male cyclists completed a time trial in which they cycled as far as they could in 60 min (AMex) using a Computrainer indoor trainer. Following AMex, subjects ingested either C+P, or CHO at 10, 60 and 120 min, followed by a standardized meal at …

Transformative Mediation: Empowering The Oppressed Voices Of A Multicultural City To Foster Strong Democracy., Arby Aiwazian Dec 2008

Transformative Mediation: Empowering The Oppressed Voices Of A Multicultural City To Foster Strong Democracy., Arby Aiwazian

The Scholar: St. Mary's Law Review on Race and Social Justice

Transformative mediation’s promotion of understanding, acceptance, and inclusion fosters a purer democracy by cultivating the individual self-empowerment of traditionally disempowered individuals that is vital to strong and robust democracies. By transforming relationships and empowering individuals, transformative mediation helps foster an arena for self-governance, which inevitably leads to self-empowerment and a purer democracy. Optimistically, as more individuals are empowered through transformative mediation, communities plagued with violence, hatred, and misunderstanding could also reap the benefits by fostering acceptance, communication, inclusion, and understanding. The nature of the United States’ current passive and procedural democratic system further perpetuates inequality by placing political power solely …

Changing The Negative Behavioral And Development Outcomes To A Toxic Prenatal Environment Through Maternal Education, Angela Eileen Laughlin Lebedev Dec 2008

Changing The Negative Behavioral And Development Outcomes To A Toxic Prenatal Environment Through Maternal Education, Angela Eileen Laughlin Lebedev

Walden Dissertations and Doctoral Studies

The purpose of this study was to evaluate the effectiveness of current education materials on changing maternal smoking attitudes. Children are affected by prenatal exposure to tobacco smoke. Although there are educational efforts to discourage pregnant women from smoking, the practice continues in a significant number of pregnancies. New materials, based on current research, were also evaluated for effectiveness. The theoretical framework for this study was adult learning theory presented by Knowles which made the assumption that an individual is shaped by environmental systems, that adult learning is affected by previous knowledge they bring to the learning and that adults …

Neuropsychiatric Features Of Parkinsonian Tauopathies And Alpha-Synucleinopathies., Megan Rayne Thompson 1985-

Electronic Theses and Dissertations

The goal of this thesis is to determine if neuropsychiatric features can differentiate parkinsonian patients with: tauopathies from those with alpha-synucleinopathies and explore caregiver distress. Three hundred and four patients (62 with tauopathies and 242 with alpha-synucleinopathies) diagnosed according to published diagnostic criteria were evaluated using the Neuropsychiatric Inventory (NPI), Mini-Mental State Examination (MMSE), and Unified Parkinson's Disease Rating Scale (UPDRS). To control for between-group differences a subsample of 235 patients were analyzed. Patients with tauopathies had significantly higher NPI total scores, more apathy, less hallucinations, lower MMSE scores and higher UPDRS scores than those with alpha-synucleinopathies. Hallucinations and delusions …

A Comparison Of Faculty And Administrator Perceptions Of The Merger Of Kentucky's Community Colleges And Vocational/Technical Institutes., Jason Douglas Warren

Electronic Theses and Dissertations

One of the most nationally-recognized, two-year legislative reform initiatives in the U.S. began in Kentucky with the passage of the Kentucky Postsecondary Education Improvement Act of 1997 (HB1). This exploratory, cross-sectional, correlational study was administered at the 10-year anniversary of the HB1-legislated formation of the Kentucky Community and Technical College System (KCTCS), which originally combined 13 community colleges formerly governed by the University of Kentucky and 25 vocational/technical institutes previously governed by the Kentucky Cabinet for Workforce Development. This dissertation examined faculty and administrator perceptions of the merger of Kentucky's community colleges and vocational/technical institutes that resulted from HB1. Two …

Energy Efficient Geographic Routing For Wireless Sensor Networks., Gang Zhao Dec 2008

Energy Efficient Geographic Routing For Wireless Sensor Networks., Gang Zhao

Electronic Theses and Dissertations

A wireless sensor network consists of a large number of low-power nodes equipped with wireless radio. For two nodes not in mutual transmission range, message exchanges need to be relayed through a series of intermediate nodes, which is a process known as multi-hop routing. The design of efficient routing protocols for dynamic network topologies is a crucial for scalable sensor networks. Geographic routing is a recently developed technique that uses locally available position information of nodes to make packet forwarding decisions. This dissertation develops a framework for energy efficient geographic routing. This framework includes a path pruning strategy by exploiting …
