Despite of having been studied for several decades the phenomena of combustion instabilities are not well understood. Pressure waves due to the combustion instabilities can become violent being detrimental for both the performance and combustor life. A good prediction of the pressure distribution inside the combustor is important in order to prevent theoccurrence of this phenomenon. In this work a technique for solving the wave equation with discrete sources (or sinks) using the Green's functions was developed. Corporations present an interesting illustration of the authority versus accountability dilemma. Shareholders elect the directors of the corporation and the law vests those directors with almost unlimited authority to manage the corporation. Yet, shareholders have few effective means for holding directors accountable for their decisions other than through shareholder derivative litigation. In such litigation, the business judgment rule serves as the mechanism by which courts attempt to balance directors' authority to make decisions for the corporation against shareholders' right to hold directors accountable for those decisions.

Google and other search engines allow anyone with Internet access the ability to obtain a wealth of information about their neighbors, acquaintances, employees, or even adversaries. Although easy access to information is generally a positive development, the easy discovery of highly personal and stigmatizing information often is not. It is particularly disconcerting when the information is being purveyed by appellate courts around the nation when they post hundreds of opinions to court websites every day. Some Things Are Better Left Said: Pleading Practice After Bell Atlantic Corp. V. Twombly, Matthew A. Josephson

In May 2007 the Supreme Court issued a landmark procedural decision construing and applying Federal Rule of Civil Procedure 8(a)(2). In Bell Atlantic Corp. v. Twombly the Court boldly retired the plaintiff-friendly pleading standard established over fifty years ago in Conley v. Gibson and replaced it with a potentially more stringent plausibility standard that requires a plaintiff to plead facts demonstrating the plausibility of each claim. Considerable confusion has surfaced in the lower courts over the extent of Twombly's influence, with some courts limiting the decision to its antitrust context and others applying the decision to all civil cases. On May 20, 2006, for the first time in U.S. history, federal agents executed a search warrant in raiding the Capitol Hill office of a sitting member of Congress. The raid was the culmination of a fourteen month corruption and bribery investigation into Representative William J. Jefferson's business dealings in Africa. Supported by bipartisan outcry, Jefferson sought the return of the documents seized in the raid under the legislative immunity protection of the Speech or Debate Clause. In United States v. Rayburn House Office Building, the D.C. Circuit agreed with Jefferson that the FBI violated his constitutional rights and granted …

Federal district court judges today have a level of sentencing discretion that has been unknown since the adoption of the United States Sentencing Guidelines. This Note reviews the history of the Guidelines and outlines the problems that have resulted from the Supreme Court's decisions in Booker, Rita, and Gall This Note argues that the confusion may be clarified by giving effect to the text of 18 U.S.C. §3553(a), which requires that federal district court judges impose sentences that are sufficient, but not greater than necessary, and requires them to examine all the factors provided in the statute. The UK's Treasury's "Stern Review: The Economics of Climate Change" (Oct. 2006) reached dramatically different conclusions and policy recommendations than most earlier economic analyses of climate change. It found that the costs of climate change, as well as the potential net benefits of greenhouse gas reductions, were much higher that previously estimated, and consequently recommended more rapid and extensive cuts in emissions than other economist analysts. The Stern Review estimated that a 1% annual investment of global GDP in mitigation could prevent a 5% (or more) reduction in annual global GDP from climate change harm, forever. To test the premise that optimal learning and development require a constructivist education of the whole person, this research examined outcomes of instruction using an approach called Innate Health which claims that awareness of the dynamics of thought will stimulate healthy, productive behavior (presumably innate). While much has been written about socio-moral education; little research has addressed the role of thought, innate qualities, or attention to the whole person as mediators of learning and development. This qualitative case study examined the process for including students with disabilities in elementary physical education settings. Specifically, effective teaching skills, environmental factors, and differences between an experienced and a novice elementary physical education teacher as they pertain to inclusion were examined. Data were collected over a two month period via field-based observations and semi-structured interviews. The case study participants included an experienced elementary physical education teacher (29 years teaching experience), a novice elementary physical education teacher (first year teaching physical education full-time), two elementary school principals, a special education teacher, and a director of special education. Studies conducted on Latino immigrants and political participation primarily focuses on their large population groups such as Puerto Ricans, Cubans and Mexicans. However, this study centers on Central American Hondurans, also a group with substantial populations in U.S. cities. Three response reduction procedures commonly employed in applied behavior analysis are extinction, differential-reinforcement-of-other-behavior (DRO) schedules, and time-based schedules of event delivery such as the fixed-time (FT) schedule. Each of these three procedures holds promise for the amelioration of canine behavior problems, yet none has been studied systematically, alone or in comparison with other procedures, with domestic dogs. In this research, the buoy-touching responses of eleven dogs were shaped and maintained using edible reinforcers. Responding then was exposed either to extinction, a fixed or an escalating DRO schedule, or an FT schedule. Extinction reduced responding more rapidly than the escalating DRO …

In recent years, domestic violence legislation has migrated out of its traditional locus in family law and criminal law to include a rapidly growing body of employment law. The new laws respond to a relatively simple problem: Economic security is one of the most important factors in whether a victim of domestic violence will be able to separate from an abusive partner, but domestic violence often interferes with victims' ability to maintain jobs, thus causing job loss that further traps victims in abusive relationships. Over the past 30 years America has experienced both a substantial increase in the percentage of blacks multiracial blacks and an unprecedented influx of voluntary immigration of blacks primarily from Africa and the Caribbean. The percentage of foreign-born black immigrants reached 8% of the black population in 2005, and no doubt is higher today. There is evidence that suggests not only that multiracial blacks and foreign-born black immigrants and their sons and daughters constitute a disproportionate percentage of black students in selective higher education programs, but their percentages are larger than most people realize. Nixtamalization is the process of steeping dried corn in hot water with calcium hydroxide (lime) with subsequent removal of all or most of the pericarp through washing. The resulting product is called nixtamal. Approximately 60% of corn tortillas in Mexico are produced from nixtamal, with the remainder prepared from nixtamalized corn flour. Nixtamal was fortified with micronutrient premix containing iron, zinc, folic acid, niacin, riboflavin, and thiamin. Premix composition followed a proposed Mexican regulation for corn flour fortification, adjusted for moisture. This study examines the impact of state health insurance regulations on the price of high-deductible family and individual polices in the nongroup market. We use a unique and rich data set on actual insurance policies sold through a large Internet health insurance distributor to examine the impact of various regulations on policy prices, controlling for policy characteristics, demographic characteristics of the purchasers, and state-level demographics. We also use data from a single major insurance firm that provided offer prices for a family policy from a set of randomly selected zip codes. The Czech Republic and Slovakia, like other transition countries in Central and Eastern Europe, have given significant lip service to fiscal decentralization and engaged in public administration reforms. But the subnational governments of their public finance systems still lack relative autonomy, which could be addressed partly through developing independent revenue sources for their municipalities and regions. Currently, such independent revenue sources include the proceeds of a strictly nominal property tax as well as those of a small set of local user fees and taxes designed and approved by the central governments. Inhibitor of differentiation protein-2 (Id2) is a dominant negative helix-loop-helix (HLH) protein, and a positive regulator of proliferation, in various cells. The N-terminal region of Id2 contains a consensus cdk2 phosphorylation sequence SPVR, which may be involved with the induction of apoptosis, at least in myeloid 32d.3 cells. However, the role of Id2 phosphorylation at serine 5 in skeletal muscle cells is unknown. The purpose of this dissertation was to determine if the phosphorylation of Id2 at serine 5 alters its cellular localization and role in apoptosis in C2C12 myoblasts. This dissertation is a collection of essays examining the secondary effects of state and local public policies. The first chapter provides an introduction and outlines the research agenda for the dissertation. Chapter 2 analyzes the effects of the gasoline unit and ad valorem excise taxes on consumption of gasoline by grade. The results show that, while the unit excise tax can cause consumers to substitute toward higher quality (higher octane) gasoline, the opposite effect can also occur as prices rise and the income effect outweighs the substitution effect. There is need for an anesthetic to sedate fishes that does not require a mandatory post-exposure withdrawal period. Such an anesthetic could be used to sedate handled fishes as they are moved from tank to tank on the farm, surveyed in the wild, released from state and federal hatcheries, or harvested for human consumption. A proprietary form of clove oil, AQUI-S® , was recently submitted to the U.S. Food and Drug Administration for approval as a 0-day withdrawal anesthetic for use on aquatic organisms. Diesel engines constitute a valuable solution to the growing demand for higher fuel efficiencies, especially in relation to the rapid growth of fuel prices in recent years. However, the substantially lean conditions typical of diesel exhaust pose a serious challenge to the traditional exhaust aftertreatment devices. The Selective Catalytic Reduction (SCR) technology has proven to be a viable technology for reducing emissions of oxides of nitrogen (NOx) from heavy-duty diesel engines. The diesel particulate filter (DPF) significantly reduces particulate matter (PM); primarily, the solid carbon component of total PM.
