The Inevitable Demise Of The Implied Employment Contract, Jonathan Fineman

Journal Publications

In this article, Professor Fineman argues that courts' decision in the early 1980s to apply implied contract doctrine to employment relationships did not have the intended results. Employers immediately began restructuring their employment documents, and eventually found a way to essentially avoid liability through careful drafting of personnel documents. Professor Fineman further argues that the failure of contract law was inevitable based on the limitations of contract theory. Finally, Professor Fineman suggests a method to more successfully enforce workplace norms by looking to broader-based norms prevalent in the industry or applicable to the type of job position at issue,

Breaking Ground: Planning And Building In Priority Growth Districts, John R. Nolon, Jessica A. Bacher

It is now understood that compact, mixed use development prevents the ill effects of sprawl and can mitigate climate change significantly. There is an innovative land use technique that can be used by communities to manage and define future growth in a way that provides for such developments and creates more livable places, places that are environmentally, socially, and fiscally sound. Specifically, a community may create Priority Growth Districts, or PGDs, and thereby direct development to selected locations and also specify design standards that meet the needs of the community's current and future residents.

"The carbonatite-hosted apatite deposit of Jacupiranga is located in southeastern Brazil. The major styles of apatite mineralization are veins or veinlets, small pods or patches, disseminated apatite, and massive aggregates (locally). The concentration of apatite involves grinding of the carbonatite, removal of magnetite with a magnet drum, size classification with cyclones, and flotation to suppress carbonates and collect apatite. Samples of carbonatite were collected from more recent exposures of the mine and drill holes. "In today's society, terrorist attacks and accidental explosions pose a major threat to critical infrastructure. Vulnerable to blast loading, structures must be rehabilitated to ensure structural stability and protect human life. The goal of this study is to develop and validate a sandwich composite technology for column retrofitting. The new technology consists of an inner fiber reinforced polymer (FRP) sheet, an outer FRP sheet, and a visco-elastic (VE) layer sandwiched between the two FRP sheets. "In this research, imaging techniques are investigated for the analysis and detection of abnormalities in cervical and lumbar vertebrae. Detecting vertebra anomalies pertaining to osteoarthritis such as claw, traction and anterior osteophytes can aide in treatment plans for the patient. New size invariant features were developed for the detection of claw, traction and anterior osteophytes in cervical spine vertebrae. Using a K-means clustering and nearest centroid classification approach, the results were generated that were capable of discriminating cervical vertebrae for presence of anomalies related to osteophytes. "Sensor data is processed to assess performance and health of complex systems. Proper sensor selection, placement, and implementation are critical to build an effective health management system. For complex systems in which the timely assessment of the health is desired to avoid expensive consequences of failure, sensor placement is vital. "This thesis investigates two materials, SU8 photoresist and RuO₂, for possible incorporation into a self-calibrating microfluidic biosensor. The negative, epoxy based photoresist SU8 has been widely used in the fabrication of micro-electro-mechanical systems (MEMS) devices. This is due to its many desirable features that make it a suitable material for a wide variety of MEMS applications. The effects cross-linking (exposure dose) and bonding time have on bond strength and plasma modification of the SU8 surface were investigated as well as the bond strength of etched SU8. "Two species and one subspecies of salamander in the genus Eurycea, two species of Plethodon and one species of Typhlotriton (recently considered to be Eurycea) salamander currently reside in an area of Onondaga Cave known as the Missouri Caverns section. Due to the presence of two known interbreeding subspecies of salamanders, Eurycea Longicauda (Long-tailed salamander) and Eurycea longicauda melanopleura (Dark-sided salamander), the possibility may exist for interbreeding of one or all of these taxa. Phenylalanine ammonia-lyase (PAL) is an enzyme found in plants. It catalyzes the deamination of phenylalanine to produce cinnamic acid. Genes for PAL have been identified in many different plant species. "The St. Louis metropolitan (STL) area, which spans Missouri and Illinois, currently has no overarching organization of geospatial data (geodata). The two states have their own geodata, using their own individual standards. The development of a virtual geotechnical database (VGDB) encompassing the entire STL area on both sides of the Mississippi River is a solution to the data sharing and standardization problem of this area. The VGDB integrates geodata from disparate sources into a geographic information systems (GIS) database accessible via the internet. "Pesticides and pesticide degradates found in drinking water sources are of particular concern to human health. When treated and disinfected at a drinking water plant, pesticides etridiazole, metribuzin, and diazinon undergo many treatment processes including lime softening, where the water pH is raised to 10 for calcium removal or 11 for magnesium removal. This thesis focuses on modeling the kinetics of hydrolysis of three pesticides that have the potential to undergo hydrolysis in drinking water plants.
