Against Legislation: Garcetti V. Ceballos And The Paradox Of Statutory Protection For Public Employees, Ruben J. Garcia

In Garcetti v. Ceballos, the Supreme Court denied constitutional protection to a deputy prosecutor named Richard Ceballos. In reaching its decision, the Court pointed to the plethora of statutory protections that were available to government whistleblowers. A closer examination of these statutory alternatives reveals that they will not protect Ceballos. This is the paradox of statutory protection in labor and employment law-more sometimes is less for vulnerable workers.

This Article places the Garcetti case in the historical trajectory of worker protection—from no protection to statutory protection. This Article argues for a move toward constitutional and international protection …

Amicus curiae ("friend of the court”) participation in litigation has flourished in recent years as many groups and individuals seek to influence the outcome of litigation. Amicus filers are not parties and judges have wide discretion to reject amicus briefs if they believe that the amicus participation does not add anything to the briefs already filed by the parties. In three recent cases, Seventh Circuit Court of Appeals Judge Richard Posner has rejected amicus filings and promised to closely scrutinize applications to file amicus briefs in the future. The elimination of childhood lead poisoning is a national health policy objective to be attained by the year 2010. A full understanding of the poisoning risks that lead poses for young children and infants evolved as more research focused upon its effects. Some of the first warnings of the potential dangers associated with lead began with studies conducted as early as the 1940s and 1950s. Over time, the link between exposure to lead and reduced cognitive function and impulse control in young children was firmly established. Air Pollution, Economic Development Of Communities, And Health Status Among The Elderly In Urban China., Rongjun Sun, Danan Gu

In Western societies, the impact of air pollution on residents' health is higher in less wealthy communities. However, it is not clear whether such an interaction effect applies to developing countries. The authors examine how the level of community development modifies the impact of air pollution on health outcomes of the Chinese elderly using data from the third wave of the Chinese Longitudinal Health Longevity Survey in 2002, which includes 7,358 elderly residents aged 65 or more years from 735 districts in 171 cities. Dietary Resistant Starch Increases Hypothalamic Pomc Expression Independent Of Capsaicin-Sensitive Neurons In Rats, Li Shen

Resistant starch (RS) is fermentable dietary fiber. It has been shown that inclusion of resistant starch in the diet causes decreased body fat accumulation and altered gut hormone profile. Gut hormone has complex effect on neuropeptides’ expression in the brain hypothalamic area which is regarded as key factors in regulation of energy homeostasis. In this project, thereby, it is proposed that 1) the hypothalamic neuropeptide Y (NPY), agouti-related peptide (AgRP) and pro-opiomelanocortin (POMC) mRNA expression may be altered by RS feeding; 2) afferent vagal nerves might be involved in this process. Coping is defined as the actions and cognitions used to manage stressful demands. As children develop, coping becomes more refined and situation-specific. Children’s coping styles have been found to relate to distress and adjustment. Despite the importance and implications of children’s coping responses, there is no accepted standard in measuring children’s coping. Past research has had to utilize the few measures in existence, despite possible psychometric inadequacies. This paper discusses the role of education in preventing HIV in children and young people in sub-Sahara Africa and presents the results of policy advisory research conducted on behalf of the Belgian Development Cooperation. The research consisted of a literature review and a field study in Rwanda. Relative to the high number of HIV prevention activities in sub-Sahara Africa, there is a limited number of scientific data on HIV risk reduction interventions for young people in this region. Longitudinal studies are especially scarce. Preliminary results show that many interventions have only a marginal impact on reducing sexual risk behaviour. Factors …

Laparoscopic myomectomy is now widely used as an alternative to laparotomy in the management of symptomatic uterine fibroids. The advantages of this minimal access approach outweigh those of the open techniques. The pregnancy outcomes between the two methods have been studied and are comparable, but there still exists a lot of scepticism locally concerning this. It is against this background that we present a 31 year old nulliparous lady who had a two year history of primary infertility secondary to multiple uterine fibroids, the largest being fundal and measuring 6.6cm. Athletic training clinical education combines didactic education with practical experiences. Athletic training education programs facilitate the development of this instruction by preparing the clinical instructors affiliated with the program. Primarily through one-time workshops, this effort provides limited delivery of content to prepare these clinical instructors. In an attempt to identify which method of content delivery would most benefit clinical instructors, this research creates a unique methods to further investigate this issue. This study explored the multicultural training practices within Pepperdine University's PsyD program in clinical psychology and provided a template for other training programs attempting to conduct a cultural audit. Utilizing a bounded case study design, the current investigation gathered data from faculty in the PsyD program, currently enrolled doctoral students, course syllabi and prospective student recruitment materials. Aggression And Spirituality Among Veterans With Chronic Combat-Related Posttraumatic Stress Disorder, Lea M. Didion

Spirituality negatively correlates with aggression among the general population, but few studies have examined this relationship in the high-risk population of veterans with combat-related PTSD. Those that have found that incorporating spirituality into treatment may inversely relate to aggression; yet, most studies utilize single-item measures of spirituality. This project expands current research by using a multidimensional measure of spirituality to evaluate which dimensions best predict aggression. Scales were Daily Spiritual Experiences, Forgiveness, and Religious Support from the BMMRS. Participants were 472 male combat veterans in residential PTSD treatment. Aggression was best predicted by Forgiveness, with higher levels less likely to …

Coping With Everyday Classism: Exeriences Of Low-Income People In A Southeastern Rural Community, Susan Faye Ritz

The present research provided an in-depth look at experiencing and coping with everyday classism in a sample of low-income. people in a mid-size southeastern rural United States community. The study employed a qualitative methodology consisting of semi-structured interviews and analyzing the collected data using Grounded Theory Method. Of 50 participants selected for an interview, 40 described experiences with classism, each discussing two incidents, for a total of 80 incidents shared. Seven of the remaining 10 participants felt that they had not experienced class ism, but at the same time, they provided insight into one proactive coping strategy that they appeared …
