Documenting Aguaje Palm Swamp Area And Conditions In The Peruvian Amazon, Malinda Van Sledright Apr 2008

Documenting Aguaje Palm Swamp Area And Conditions In The Peruvian Amazon, Malinda Van Sledright

Masters Theses

Mauritia flexuosa is the most widespread and economically important palm in western Amazonia and is known as aguaje in Peru. It is found mostly in "aguajales," but little is known about the size and spatial distribution of these permanently wet oligarchic forests. Aguaje is dioecious; only the female trees produce the coveted fruit, and cutting them down leaves a preponderance of unproductive male palms. There exists a consensus in the literature that levels of damage to aguajales is related to distance from settlements where extractors reside. However, no studies exist which show this relationship. By mapping 24 aguajales and conducting …

Character Education And Its Parallels To Biblical Morality, David A. Palmer Apr 2008

Character Education And Its Parallels To Biblical Morality, David A. Palmer

Senior Honors Theses

This paper includes both historical and present day examinations of the state of public education and character in students. Written for the benefit of Christian youth ministers, this paper examines some of the common tenants of modern day character education and seeks to demonstrate their Biblical parallels. Issues regarding the state of character in students and legality of people in a religious profession on a school campus are examined. This paper demonstrates without question that a Christian person can readily support a character education program in the public schools because of the Biblical basis for the values espoused. After examining …

Mechanistic Home Range Models And Resource Selection Analysis: A Reconciliation And Unification, Paul R. Moorcroft, Alex Barnett Apr 2008

Mechanistic Home Range Models And Resource Selection Analysis: A Reconciliation And Unification, Paul R. Moorcroft, Alex Barnett

Dartmouth Scholarship

In the three decades since its introduction, resource selection analysis (RSA) has become a widespread method for analyzing spatial patterns of animal relocations obtained from telemetry studies. Recently, mechanistic home range models have been proposed as an alternative framework for studying patterns of animal space-use. In contrast to RSA models, mechanistic home range models are derived from underlying mechanistic descriptions of individual movement behavior and yield spatially explicit predictions for patterns of animal space-use. In addition, their mechanistic underpinning means that, unlike RSA, mechanistic home range models can also be used to predict changes in space-use following perturbation. In this …

The Evolution Of International Law, Milena Sterio Apr 2008

The Evolution Of International Law, Milena Sterio

Law Faculty Articles and Essays

Globalization, characterized by the inter-connectivity of persons, states, and non-state actors on a global plane, has led to the development of binding international law across several legal fields, namely, international human rights, international criminal law, and private international law. This Article explores the proliferation of actors, norms, and organizations, as well as the expansion of international jurisdiction that has underscored the development of international law over the last half century. The Article focuses on the impact of globalized international law on state actors, as well as on individuals, by reshaping their behavior in the international realm. In particular, this Article …

Sex And Globalization, Berta E. Hernández-Truyol

UF Law Faculty Publications

For some time now, I have focused on a mission to bring together the separate discourses of the human rights and trade fields—certainly not to blend them, but to raise awareness of their myriad interconnections. Indeed, human rights and trade are interlocking pieces of the puzzle we call international law and cannot possibly remain sequestered in the "splendid isolation" in which they have existed since their inception as disciplines. In any study of globalization, especially if one endeavors to pursue its benefits for all persons, not just the elite around the world, one must be aware of and seek to …

Diversity As A Dead-End, Kenneth B. Nunn Apr 2008

Diversity As A Dead-End, Kenneth B. Nunn

UF Law Faculty Publications

Supreme Court cases on diversity could only assist if they defined diversity in a way that allowed institutions to admit significant numbers of the type of individuals that the institutions were lacking. This is precisely what the Supreme Court's cases on diversity do not do. Furthermore, the Supreme Court's view of diversity is flawed because it does not address existing power differentials between Blacks and Whites. As a result diversity, as it is defined by the Supreme Court, is a dead-end for those who are concerned about social justice and equity in higher education.

A Tale Of Two Poles: A Comparative Look At The Legal Regimes In The Arctic And The Antarctic, Erika Lennon Apr 2008

A Tale Of Two Poles: A Comparative Look At The Legal Regimes In The Arctic And The Antarctic, Erika Lennon

PEEL Alumni Scholarship

Currently, the world is in the midst of the International Polar Year, a project to conduct research in the Polar Regions, which has increased focus on the poles. Given the physical manifestations of climate change, for example melting glaciers and ice caps, it appears as though the Antarctic and the Arctic will continue to be regions of concentration and concern. While the Antarctic has a treaty in place to protect it, the Arctic remains vulnerable due to its lack of comprehensive laws to determine a uniform governance system and environmental protections. Moreover, in the Arctic, competition between nations in the …

Re-Possessing "Home": A Re-Analysis Of Gender, Homeownership, And Debtor Default For Feminist Legal Theory, Lorna Fox Apr 2008

Re-Possessing "Home": A Re-Analysis Of Gender, Homeownership, And Debtor Default For Feminist Legal Theory, Lorna Fox

William & Mary Journal of Race, Gender, and Social Justice

The current credit crisis has brought the subject of subprime and other problematic debt to the forefront of many agendas - both political and personal. This article explores some of the underlying legal, theoretical, economic, and phenomenological issues associated with default and foreclosure, particularly as they affect women homeowners. The analysis is embedded in feminist discourse on home, from traditional critiques of the association between women and home to evolving conceptions of the benefits and the burdens of home for contemporary feminist theory. This article traces the ideas of "home" and "homeownership" for American women and considers how it might …

Using Formative Assessment Results To Predict Student Achievement On High Stakes Tests, Lisa W. Smith Apr 2008

Using Formative Assessment Results To Predict Student Achievement On High Stakes Tests, Lisa W. Smith

Doctoral Dissertations and Projects

The purpose of this study was to examine whether comprehensive post formative assessments can accurately predict student academic achievement on AYP (Adequate Yearly Progress) indicators as measured by standardized criterion-referenced tests.

The primary participant populations for this study were sixth, seventh, and eighth grade students enrolled in a middle school in north Georgia from 2004-2007. Over 2,900 student assessments were used to conduct the statistical research and variables such as gender, race, and socio-economic levels were not disaggregated in the data collection compilation. The data sources included the first quarter, second quarter, and third quarter post formative assessments which are …

Fixed-Effect Estimation Of Highly-Mobile Production Technologies, William C. Horrace, Kurt E. Schnier Apr 2008

Fixed-Effect Estimation Of Highly-Mobile Production Technologies, William C. Horrace, Kurt E. Schnier

Center for Policy Research

We consider fixed-effect estimation of a production function where inputs and outputs vary over time, space, and cross-sectional unit. Variability in the spatial dimension allows for time-varying individual effects, without parametric assumptions on the effects. Asymptotics along the spatial dimension provide consistency and normality of the marginal products. A finite-sample example is provided: a production function for bottom-trawler fishing vessels in the flatfish fisheries of the Bering Sea. We find significant spatial variability of output (catch) which we exploit in estimation of a harvesting function.

Hothouse Flowers: The Vices And Virtues Of Climate Federalism, Jonathan H. Adler Apr 2008

Hothouse Flowers: The Vices And Virtues Of Climate Federalism, Jonathan H. Adler

Faculty Publications

Although economic theory would predict that states would lag behind federal efforts to control environmentally harmful emissions, there has been far more action on climate change in state capitols than in Washington, D.C. Without federal action, states have stepped in to fill the policy void on climate change. State-level action on climate change is unlikely, in itself, to have much impact on atmospheric concentrations of greenhouse gases or projected rates of future warming. Nonetheless, the level of state activity is significant.

The aggressiveness of state climate policy initiatives, and potential conflict between federal and state regulatory measures, provides an opportunity …

Legal Limits On Religious Conversion In India, Laura Dudley Jenkins Apr 2008

Legal Limits On Religious Conversion In India, Laura Dudley Jenkins

Law and Contemporary Problems

In contemporary India, government assessments of the legitimacy of conversions tend to rely on two assumptions: first, that people who convert in groups may not have freely chosen conversion, and second, that certain groups are particularly vulnerable to being lured into changing their religion. These assumptions, which pervade the anticonversion laws as well as related court decisions and government committee reports, reinforce social constructions of women and lower castes as inherently naive and susceptible to manipulation. Here, Jenkins contends to carefully scrutinized the assumptions since like "protective" laws in many other contexts, such laws restrict freedom in highly personal, individual …

Why We Should Stop Teaching Dodge V. Ford, Lynn A. Stout Apr 2008

Why We Should Stop Teaching Dodge V. Ford, Lynn A. Stout

Cornell Law Faculty Publications

What is the purpose of a corporation? To many people, the answer to this question seems obvious: corporations exist to make money for their shareholders. Maximizing shareholder wealth is the corporation's only true concern, its raison d'être. Devoted corporate officers and directors should direct all their efforts toward this goal.

Some find this picture of the corporation as an engine for increasing shareholder wealth to be quite attractive. Nobel Prize-winning economist Milton Friedman famously praised this view of corporate purpose in his 1970 New York Times essay, "The Social Responsibility of Business Is to Increase Its Profits." To others, the …

Shared Land Use Impacts Between Military Installations And Contiguous Communities (Post-Brac): Fact And Opinion Differences In Planning And Public Policy, Rumanda Kay Young Apr 2008

Shared Land Use Impacts Between Military Installations And Contiguous Communities (Post-Brac): Fact And Opinion Differences In Planning And Public Policy, Rumanda Kay Young

Planning Dissertations - Archive

How a policy or planning tool (e.g. BRAC) contributes to real and perceived conclusions from policy implementation is the main focus of this research. This research examines differences between real and perceived encroachment issues and concerns through study of military installations and their contiguous communities using post-BRAC opinion data compared to conclusions drawn from pre-BRAC and post-BRAC empirical data. A study of six (6) supporting research topics from current literature leads to a hypothesis that there are no differences between the same variables using empirical data (reality) and opinions (perception) with respect to variable descriptors of encroachment in the post-BRAC …

Constructing A Home On The Range: Homemaking In Early Twentieth Century Plains Photograph Albums, Christina E. Dando Apr 2008

Constructing A Home On The Range: Homemaking In Early Twentieth Century Plains Photograph Albums, Christina E. Dando

Geography and Geology Faculty Publications

Oh, give me a home where the buffalo roam,
Where the deer and the antelope play,
Where seldom is heard a discouraging word
And the skies are not cloudy all day.1

These lyrics capture a yearning for a place to call home. But what landscape is associated with this longing? For people living near the coasts or mountains of America, it must be hard to imagine longing for a "home on the plains"-but many Americans have had, and still have, a home on the Plains. The stereotypical American image of the Plains is flatness, austerity, emptiness. Not all would …

Governance Reforms In Pakistan, Ishrat Husain Dr. Apr 2008

Governance Reforms In Pakistan, Ishrat Husain Dr.

Faculty Research - Newspaper and Magazine Articles

The link between good governance and economic and social development has been well established in the last few decades. Although it is hard to have a precise definition of governance there is a wide consensus that good governance must lead to broad-based inclusive economic growth and social development. It must enable the state, the civil society and the private sector to enhance the well being of a large segment of the population. If this definition is accepted then economic growth in Pakistanis likely to become unsustainable if a widespread perception persists that the majority of the population has not been …

A Strategy For Evangelism With Samoans, Tauileata Moli

Doctor of Ministry

This paper will provide an evangelism plan designed to carry out this mandate among traditional Samoans in Samoa. The plan supports and utilizes the Samoan communal patriarchal family system. The thesis of this paper is that a Christian evangelistic model can be designed that is compatible with the Samoan communal, patriarchal family system. Chapter 1 of this dissertation describes conflicts caused by using individual evangelism style in the Samoan community, which is community oriented. Chapter 2 will provide historical information about the country of Samoa and its cultural background. Change and especially change that destroys the cultural system is very …
