Erisa Misrepresentation And Nondisclosure Claims: Securities Litigation Under The Guise Of Erisa?, Clovis Trevino Bravo

Georgetown Law Student Series

In the wake of recent corporate scandals and dramatic market downturns, many employees whose retirement savings plans were heavily invested in the stock of their employer have seen their account balances substantially depleted. To recover for their losses, plan participants have filed lawsuits under the Employee Retirement Income Security Act (ERISA) alleging that plan fiduciaries made misrepresentations or failed to disclose material information about the suitability of investing in the company stock. These suits are generally derivative or companion cases to securities class actions based on the same allegations of misrepresentations or nondisclosures. Even though there is a significant overlap …

This paper compares properties of the source region with those inferred from satellite observations near Earth of the magnetic cloud which reached 1 AU on 20 November 2003. We use observations from space missions SOHO and TRACE together with ground-based data to study the magnetic structure of the active region NOAA 10501 containing a highly curved filament, and determine the reconnection rates and fluxes in an M4 flare on 18 November 2003 which is associated with a fast halo CME. This event has been linked before to the magnetic cloud on 20 November 2003. We model the near-Earth observations with …

Exploring A Model Of Transcultural Nursing Practice That Promotes Cultural Care Preservation/Maintenance, Margaret Sormana Oct 2008

Exploring A Model Of Transcultural Nursing Practice That Promotes Cultural Care Preservation/Maintenance, Margaret Sormana

Theses and Graduate Projects

Migration is increasing due to instability in most parts of the world. Immigrants are faced with the choice to either maintain their unique cultural heritage or adopt the culture of the host country. Most immigrants desire to maintain their cultural heritage which requires balancing the values of their cultural heritage with those of the host country. Balancing includes silence which can reinforce self-blame when the values are in conflict. This project sought to break these patterns by engaging a group of Somali women in creative artistic activities. Based on Leininger's model of Cultural Care Diversity and Universality (1985), Watson's Human …

Cityland – Vol. 5, No. 9, Center For New York City Law

CityLand - 2008

The October 2008 issue of CityLand covers significant land use and preservation developments in New York City. The City Council postponed a vote on the Hospital for Special Surgery’s expansion plan, while approving the Waldheim rezoning in Flushing despite civic opposition. The City Planning Commission modified the Dutch Kills rezoning to increase FAR for certain uses and approved the East Harlem redevelopment plan. The Fulton Street BID was approved, and the Budget Rent-a-Car rezoning and street demapping in Queens were finalized. The issue includes court decisions upholding landmark designations for the City and Suburban Homes Estate and compelling the NYSDEC …

Genome-Wide Association Studies: Implications For Multiethnic Samples, Richard S. Cooper, Bamidele Tayo, Xiaofeng Zhu Oct 2008

Genome-Wide Association Studies: Implications For Multiethnic Samples, Richard S. Cooper, Bamidele Tayo, Xiaofeng Zhu

Faculty Publications

The current gene mapping for complex diseases is heavily weighted by studies of population samples from northern Europe. To capture the full range of genetic diversity and exploit the potential of genetic epidemiology to identify important variants, multiple additional populations will need to be examined. The conduct of genome-wide association studies will therefore confront many of the challenges identified in the first generation of candidate gene and linkage studies, with a substantial increase in complexity. Initial efforts to map causal effects will have to take account of varying patterns of linkage disequilibrium through careful attention to local haplotype structure. Refined …

Black Holes In Loop Quantum Gravity: The Complete Space-Time, Rodolfo Gambini, Jorge Pullin Oct 2008

Black Holes In Loop Quantum Gravity: The Complete Space-Time, Rodolfo Gambini, Jorge Pullin

Faculty Publications

We consider the quantization of the complete extension of the Schwarzschild space-time using spherically symmetric loop quantum gravity. We find an exact solution corresponding to the semiclassical theory. The singularity is eliminated but the space-time still contains a horizon. Although the solution is known partially numerically and therefore a proper global analysis is not possible, a global structure akin to a singularity-free Reissner-Nordström space-time including a Cauchy horizon is suggested. © 2008 The American Physical Society.

Ambient Temperature Influences Diet Selection And Physiology Of An Herbivorous Mammal, Neotoma Albigula, M. D. Dearing, Jennifer S. Forbey, J. D. Mclister, L. Santos Oct 2008

Ambient Temperature Influences Diet Selection And Physiology Of An Herbivorous Mammal, Neotoma Albigula, M. D. Dearing, Jennifer S. Forbey, J. D. Mclister, L. Santos

Biology Faculty Publications and Presentations

The whitethroat woodrat (Neotoma albigula) eats juniper (Juniperus monosperma), but the amount of juniper in its diet varies seasonally. We tested whether changes in juniper consumption are due to changes in ambient temperature and what the physiological consequences of consuming plant secondary compounds (PSCs) at different ambient temperatures might be. Woodrats were acclimated to either 20ºC or 28ºC. Later, they were given two diets to choose from (50% juniper and a nontoxic control) for 7 d. Food intake, resting metabolic rate (RMR), and body temperature (Tb) were measured over the last 2 d. Woodrats at 28ºC …
