Victims’ Rights In An Adversary System, Erin C. Blondel
Victims’ Rights In An Adversary System, Erin C. Blondel
Duke Law Journal
The victims' rights movement argues that because the outcome of criminal prosecutions affects crime victims, the justice system should consider their interests during proceedings. In 2004, Congress passed the Crime Victims' Rights Act (CVRA), giving victims some rights to participate in the federal criminal justice system. This Note probes both the theoretical assumptions and practical implications of the CVRA. It demonstrates that the victims' rights movement revisits a long-acknowledged tension between adversary adjudication and third-party interests. It shows, however, that American law has resolved this tension by conferring party or quasi-party status on third parties. Despite some pro-victims rhetoric, Congress …
The Development And Failure Of Social Norms In Second Life, Phillip Stoup
The Development And Failure Of Social Norms In Second Life, Phillip Stoup
Duke Law Journal
This Note analyzes the development and efficacy of social norms in maximizing the welfare of participants in the virtual community of Second Life. Although some of these norms developed appropriately in response to the objectives and purposes of this virtual world, Second Life is so thoroughly steeped in conditions that have impeded the development of successful social norms in other communities that any system of social norms in Second Life will ultimately fail. Because social norms will likely, fail to successfully maximize resident welfare, regulatory schemes imposed both by the operators of the virtual world and by real-world governing institutions are …

Bias And Controversy In Evaluation Systems, Hady Wirawan Lauw, Ee Peng Lim, Ke Wang

Evaluation is prevalent in real life. With the advent of Web 2.0, online evaluation has become an important feature in many applications that involve information (e.g., video, photo, and audio) sharing and social networking (e.g., blogging). In these evaluation settings, a set of reviewers assign scores to a set of objects. As part of the evaluation analysis, we want to obtain fair reviews for all the given objects. However, the reality is that reviewers may deviate in their scores assigned to the same object, due to the potential bias of reviewers or controversy of objects. The statistical approach of averaging …

Profile-Guided Program Simplification For Effective Testing And Analysis, Lingxiao Jiang, Zhendong Su
Research Collection School Of Computing and Information Systems
Many testing and analysis techniques have been developed for inhouse use. Although they are effective at discovering defects before a program is deployed, these techniques are often limited due to the complexity of real-world code and thus miss program faults. It will be the users of the program who eventually experience failures caused by the undetected faults. To take advantage of the large number of program runs carried by the users, recent work has proposed techniques to collect execution profiles from the users for developers to perform post-deployment failure analysis. However, in order to protect users' privacy and to reduce …

Behavioral Criminal Law And Economics, Thomas S. Ulen, Richard H. Mcadams
Public Law and Legal Theory Working Papers
A behavioral economics literature identifies how behaviorally-derived assumptions affect the economic analysis of criminal law and public law enforcement. We review and extend that literature. Specifically, we consider the effect of cognitive biases, prospect theory, hedonic adaptation, hyperbolic discounting, fairness preferences, and other deviations from standard economic assumptions on the optimal rules for deterring potential offenders and for regulating (or motivating) potential crime victims, legislators, police, prosecutors, judges, and juries.

Model-Driven Remote Attestation: Attesting Remote System From Behavioral Aspect, Liang Gu, Xuhua Ding, Robert H. Deng, Yanzhen Zou, Bing Xie, Weizhong Shao, Hong Mei
Research Collection School Of Computing and Information Systems
Remote attestation was introduced in TCG specifications to determine whether a remote system is trusted to behave in a particular manner for a specific purpose; however, most of the existing approaches attest only the integrity state of a remote system and hence have a long way to go in achieving the above attestation objective. Behavior-based attestation and semantic attestation were recently introduced as solutions to approach the TCG attestation objective. In this paper, we extend behavior-based attestation to a model-driven remote attestation to prove that a remote system is trusted as defined by TCG. Our model-driven remote attestation verifies two …

The 1525 Cromberger Crónica Del Cid: From Press To Lap, Anthony Cárdenas-Rotunno
The 1525 Cromberger Crónica Del Cid: From Press To Lap, Anthony Cárdenas-Rotunno
Research Papers
In light of the 800th anniversary and celebration of the Poema de mio Cid, this study takes into consideration the 1525 version of the Cid legend titled Crónica del muy esforçado cavallero el Cid Ruy Díaz Campeador, exemplar R/26575 of the Biblioteca Nacional in Madrid. It examines the relationship of woodcuts to text, the relationship of the 1525 version to other versions of the Crónica del Cid as these texts are generally known; and finally discusses notions of diffusion and canonicity as regards this particular work, suggesting that this work, along with other Cidian chronicles may have had more to …

Faced with mounting pressures from a changing climate, an increasing population, a transitory populace, and varying access to available natural resources, decision makers, scientists, and resource managers have an immediate need to understand, obtain, and better integrate climate forecasts and observational data in near- and long-term planning. Reducing our societal vulnerability to variabilities and changes in climate depends upon our ability to bridge the gap between climate science and the implementation of scientific understanding in our management of critical resources, arguably the most important of which is water. Our ability to adapt and respond to climate variability and change depends, …

Connecting The Dots Within: Creative Performance And Identity Integration, Chi-Ying Cheng, Jeffrey Sanchez-Burks, Fion Lee
Research Collection School of Social Sciences
In two studies drawing from social identity theory and the creative-cognition approach, we found that higher levels of identity integration - perceived compatibility between two social identities - predict higher levels of creative performance in tasks that draw on both identity-relevant knowledge domains. Study 1 showed that Asian Americans with higher identity integration were more creative in developing new dishes using a given set of ingredients, but only when both Asian and American ingredients were available. Study 2 showed that female engineers with higher identity integration were more creative in designing a product, but only when the product was targeted …

This article seeks to highlight reality television’s most popular re-articulation of the Jezebel and the Sapphire stereotypes while assessing its implications for African American women. Nearly eight decades after their inception in mass mediated culture, the Jezebel and Sapphire stereotypes have been reborn in the form of Tiffany Pollard, better known as “New York,” and her mother “Sister Patterson” (respectively). Television acts as a powerful socialization agent, and thus plays a significant role in how audiences shape their racially stratified and gendered world. Researchers employed discourse analysis to provide the rich contextual data necessary to capture the effects of I …

Vulnerability, Resilience And Well-Being Of Intermarriage: An Ethnographic Approach To Korean Women, Jang-Ae Yang, Kyoung-Ho Shin
Journal of International Women's Studies
Korean women who immigrate into the U.S. following their American husbands face a harsh reality. A new Korean wife and American husband may find themselves in unfamiliar situations that expose their marital life to vulnerability and cause their marriage to end quickly. This study endeavors to describe the diverse patterns of inequality in the marital life of select couples, and the resilience that Korean women display in their American lives after marital crises, such as divorce. The study also explores the relationship between “social factors,” including financial status, familial relations, age, activities in the community, and the situation of “psychosocial …

Deconstructing Masculinity In A ‘Female Bastion’: Ambiguities, Contradictions And Insights, Charles C. Fonchingong
Journal of International Women's Studies
This article is informed by my experiences teaching women’s studies and specifically feminist theory to predominantly female and male students offering Women’s studies. As a mainstream academic discipline at the University of Buea, housing the only such Department in Cameroon’s Higher Education system, this study uncovers the broader polemics regarding gender and women’s studies.
Against the backdrop of a patriarchal society, this study attempts to account for the shifting strands on masculinity and femininity and gender transgressions as played out by students taking women’s studies. It also analyses the notions, misconceptions and stereotypes that characterise the discipline of women’s studies, …

The corn tortilla plays an integral role in the Mexican diet and is an ideal vehicle for micronutrient fortification. Approximately 60% of corn tortillas in Mexico are produced from nixtamal, with the remainder prepared from masa flour. A process for continuous fortification of nixtamal tortillas was evaluated in two commercial mills in Mexico. A commercial powder dosifier was used to add micronutrient premix containing iron, zinc, folic acid, niacin, riboflavin, and thiamin to nixtamal (1 g/kg) as it was milled. After training and preliminary sampling, mills produced fortified tortillas unassisted for four weeks. Masa flow rates over a four-day period …

The Boat Is Full: Swiss Asylum Denied. Markus Imhoof, Director. Switzerland: 1981, Richard Hacken
Faculty Publications
Das Boot ist voll (sometimes translated as "The Lifeboat is Full"), directed by Markus lmhoof, is a notable accomplishment in Swiss cinema of the late 20111 century. It received the Silver Berlin Bear for Outstanding Single Achievement in 1981 at the Berlin International Film Festival, and the following year it was nominated for an Academy Award in the category of Best Foreign Film. These honors presumably sprang not merely from recognition of Imhoof' s courage in recalibrating the past, in putting an alternate face on the Holocaust, and in documenting Swiss refugee policies during the Second World War. These are …
Propositional Knowledge And Know-How, John N. Williams
Propositional Knowledge And Know-How, John N. Williams
Research Collection School of Social Sciences
This paper is roughly in two parts. The first deals with whether know-how is constituted by propositional knowledge, as discussed primarily by Gilbert Ryle (1949) The concept of mind. London: Hutchinson, Jason Stanley and Timothy Williamson (2001). Knowing how. Journal of Philosophy, 98, pp. 411-444 as well as Stephen Hetherington (2006). How to know that knowledge-that is knowledge-how. In S. Hetherington (Ed.) Epistemology futures. Oxford: Oxford University Press. The conclusion of this first part is that know-how sometimes does and sometimes does not consist in propositional knowledge. The second part defends an analysis of know-how inspired by Katherine Hawley' (2003). …

Altering Occlusal Vertical Dimension Provisionally With Base Metal Onlays: A Clinical Report, Soni Prasad, Jennifer Kuracina, Edward A. Monaco, Jr.
School of Dentistry Faculty Research and Publications
This article presents a method for altering occlusal vertical dimension (OVD) to restore dentitions with limited restorative space due to loss of tooth structure. A provisional increase in OVD is achieved using predominately base metal onlays, which offer advantages over conventional techniques. The onlays are resistant to wear, may be bonded well to nonrestored and restored tooth surfaces with resin cements, and provide a fairly reversible method of increasing OVD. A patient situation is presented which demonstrates the use of provisional base metal onlays in complete mouth rehabilitation.

Irrelevance, Polymorphism, And Erasure In Type Theory, Richard Nathan Mishra-Linger
Dissertations and Theses
Dependent type theory is a proven technology for verified functional programming in which programs and their correctness proofs may be developed using the same rules in a single formal system. In practice, large portions of programs developed in this way have no computational relevance to the ultimate result of the program and should therefore be removed prior to program execution. In previous work on identifying and removing irrelevant portions of programs, computational irrelevance is usually treated as an intrinsic property of program expressions. We find that such an approach forces programmers to maintain two copies of commonly used datatypes: a …

Columbia, Missouri is a fitting venue at which to continue the conversation about Missouri v. Holland and explore the intersection of law-making at the international, national and sub-national levels. This symposium revisits the debate over national and local control over foreign affairs and brings together the constitutional doctrinal discussion and accounts of the globalization of regulation that consider the complexity of influences operating within and between multiple systems of law. Both the factual background of Holland (primarily a case about environmental regulation) and the doctrinal context in which it arose (a Supreme Court poised to move toward constitutional endorsement of …

Missouri V. Holland's Second Holding, Carlos Manuel Vazquez
Missouri Law Review
This legitimate federalism problem, however, does not warrant a complete rethinking of Treaty Power doctrine. It just requires some tinkering around Missouri v. Holland's edges. The solution I propose is far narrower than those proposed by Bradley and Rosenkranz, and unlike their proposed solutions, it is consistent with the Founder's design. I argue that the power to implement treaties under the Necessary and Proper clause is the power to require compliance with treaty obligations. Because aspirational treaty provisions do not impose obligations in any meaningful sense of the term, the clause does not give Congress the power to implement such …

Resurrecting Missouri V. Holland, Peter J. Spiro
Missouri Law Review
This brief essay sketches the constitutional dormancy of Missouri v. Holland and the potential for its activation. The essay first describes how the treatymakers declined the Treaty Power offered them by the Court. In the near century since the ruling, no treaty appears to have depended on the decision for authority. The treatymakers have worked from contrary constitutional premises, establishing a sort of parallel constitutional universe in which the ruling was never handed down. Through these years, Missouri v. Holland has failed accurately to represent prevailing constitutional norms on the question. In other words, arguably, the decision is no longer …

Federalism And International Law Through The Lens Of Legal Pluralism, Paul Schiff Berman
Missouri Law Review
In this brief Essay, then, I wish to engage in a thought experiment by looking at both federalism and international law through a pluralist rather than a sovereigntist lens. First, I summarize the pluralist literature and some of its core insights and suggest that scholars interested in international law (and its relationship with domestic law) would do well to consider this literature. Second, I provide a few examples of jurisdictional redundancy operating in the transnational, international, and federalist realm and show how the existence of multiple fora can both empower voices that might otherwise be silenced and effect changes of …

Direct Threat Defense Under The Ada: Posing A Threat To The Protection Of Disabled Employees, The, Rene L. Duncan
Missouri Law Review
The Americans with Disabilities Act was passed with intentions of eliminating stereotypes and fear towards disabled individuals and their ability to function and contribute to society. In the employment context, the Act will not permit an employer to refuse to hire an individual solely because of that person's disability. However, it will permit the employer to defend such action when limitations caused by an individual's disability rise to the level of a direct threat to the safety of others. When an employer raises such a defense, circuit courts are split as to whether the burden of proving the existence or …

Reluctantly, John Adams mailed the envelope addressed to his wife, Abigail, knowing the contents could bring about his death. This letter, mailed to his "dear friend," contained a description of his pleas for independence to the Continental Congress, a description that if located by the British, would most certainly subject him to charges of treason. Immediately after Mr. Adams dispatched his letter, he was approached by a British intelligence officer requesting to review the letter. Mr. Adams denied the officer's request and sent him on his way. Later, when the letter arrived to the unsuspecting Abigail, it was accompanied by …

Missouri Law Review
In recent years, an increasing number of pro sel litigants have appeared in federal courts. Between October 2003 and September 2004, federal district courts had over 20,000 cases filed by pro se litigants. In fact, "pro se litigants appeared in thirty-seven percent of all cases.' The increase of pro se litigation is attributed to several factors, including the rising cost of litigation combined with the decrease of funding for legal services, the negative public perception of lawyers, and the rise of do-it-yourself legal resources. Once pro se litigants enter the federal court system, their presence multiplies the resources spent by …
