Confusion And Convergence In Consumer Payments: Is Coherence In Error Resolution Appropriate?, Anita Ramasastry Jan 2008

Confusion And Convergence In Consumer Payments: Is Coherence In Error Resolution Appropriate?, Anita Ramasastry

Articles

At present, there are no uniform rules governing retail payment systems in the United States. Checks, credit cards, debit cards, and new types of payment systems—such as stored-value cards and prepaid cards—are governed by different rules and provide consumers with varying protections. In addition, several phenomena may have confused consumers about the type of consumer protections they have when using different payment systems. First, new types of intermediaries have developed—such as online funds transmission and electronic bill presentment and payment—that piggyback on existing payment systems. Second, electronic check conversion systems may convert customer checks into a different payment system—electronic funds …

“Whites Only Tree,” Hanging Nooses, No Crime?: Limiting The Prosecutorial Veto For Hate Crimes In Louisiana And Across America, Tamara F. Lawson Jan 2008

“Whites Only Tree,” Hanging Nooses, No Crime?: Limiting The Prosecutorial Veto For Hate Crimes In Louisiana And Across America, Tamara F. Lawson

Articles

News coverage of three nooses hanging from the "whites only tree" at Jena High School, in Jena, Louisiana, created public outcry. Criticism rose as the public learned that District Attorney Reed Walters exercised his prosecutorial discretion to decline to press charges against the white students that admitted hanging the nooses, yet over zealously charged black students with attempted murder for conduct normally considered a battery or a school-yard-fight. The apparent lack of equity in the exercise of prosecutorial discretion became the focus of heated debate. Although the Jena High School incidents occurred in 2006, the Jena story is unpleasantly reminiscent …

The Other Famous Marks Doctrine, Xuan-Thao Nguyen Jan 2008

The Other Famous Marks Doctrine, Xuan-Thao Nguyen

Articles

Debates on protection for famous trademarks often center around state and federal antidilution laws. Both the old Federal Trademark Dilution Act of 1995 and the new Trademark Dilution Revision Act of 2006 have generated many law review articles and numerous symposia. The dilution law focuses on trademarks deemed famous within U.S. boundaries. A debate on protection for famous trademarks today is incomplete without a discussion of the other famous marks doctrine. The other famous marks doctrine recognizes marks famous in other countries without actual use in the country where a user adopts the trademark on similar goods and services.

Time Well Spent: An Economic Analysis Of Daylight Saving Time Legislation, Steve P. Calandrillo, Dustin E. Buehler Jan 2008

Time Well Spent: An Economic Analysis Of Daylight Saving Time Legislation, Steve P. Calandrillo, Dustin E. Buehler

Articles

Several nations implemented daylight saving time legislation in the last century, including the United States. The United States briefly experimented with year-round daylight saving time twice—during World War II and the energy crises in the 1970s. Agency studies and congressional hearings from the 1970s show several benefits of year-round daylight saving time, along with potential disadvantages. These studies are dated, and much has changed in the last thirty years. While congressional efforts to extend daylight saving time in 2007 have again focused on the energy savings this legislation would produce, far more meaningful benefits have been largely ignored.

A "New Approach" To Standards And Consumer Protection, Jane Winn, Nicolas Jondet Jan 2008

A "New Approach" To Standards And Consumer Protection, Jane Winn, Nicolas Jondet

Articles

As consumer use of information and communication technology (ICT) products grows, the importance of ICT standards in consumer markets also grows. While standards for manufactured products were once developed at the national level in formal standards bodies, standards for ICT products today are more likely to be developed by informal standards bodies that target global markets, creating new challenges for national consumer protection laws.

As part of the process of creating a single market, the EU developed an innovative and successful form of “coregulation” known as the “New Approach” that coordinated the work of legislators and standards developers to reduce …

Biodiversity, Baking And Boiling, Endangered Species Act Turning Down The Heat, Anna T. Moritz, Kassie R. Siegel, Brendan R. Cummings, William H. Rodgers, Jr.

Today the Earth faces an extinction event on a scale second only to Earth's largest mass extinction, the Permian-Triassic event, which occurred 250 million years ago. Upwards of 70 percent of the Earth's species could be at risk of extinction with a 3.5°C (6.3°F) rise in temperature, which could occur by the end of this century.

The driver is global warming, caused by anthropogenic greenhouse gas emissions. As such, a rational climate policy is needed immediately to prevent the complete collapse of biodiversity. Yet, the United States—the world's largest cumulative contributor to emissions—is in a state of paralysis when it …

Real Collaborative Context: Opinion Writing And The Appellate Process, Tom Cobb, Sarah Kaltsounis Jan 2008

Real Collaborative Context: Opinion Writing And The Appellate Process, Tom Cobb, Sarah Kaltsounis

Articles

Several questions motivated us to begin experimenting with new and more ambitious forms of collaboration in our teaching. We aimed to infuse the classroom with what might be called “real collaborative context.” We looked for instances of collaboration that actually occur in the legal process and asked students to participate in those processes in order to gain a better understanding of the social aspects of legal practice and jurisprudence.

Our hope is that students will experience collaboration not so much as a classroom performance whose main goal is to assist in learning something else that could also be taught in …

The Ethnomedical Context Of Tuberculosis In A Northern Ecuadorian Province, Yamira Alejandra Araujo Jan 2008

The Ethnomedical Context Of Tuberculosis In A Northern Ecuadorian Province, Yamira Alejandra Araujo

Open Access Theses & Dissertations

ABSTRACT

Background. Tuberculosis (TB) prevention and control remains a major global public health challenge. Ecuador has among the highest estimated population prevalence rates for TB, TB-mortality, and multidrug resistant TB in the Americas (WHO, 2007; PAHO, 2004). However, with the exception of one prior study of a high-risk group of suspected cases and household contacts referred for TB testing (Armijos et al., 2008), very little is known about the disease and treatment knowledge, beliefs, attitudes, and practices of Ecuadorian groups and the various socio-cultural and other factors (e.g., rurality, education, gender, disease experience) that shape these. The improved understanding of …

The Effect Of Hand Position On Maximum Performance Of Push-Ups In Adults, Gregory Douglas Brickey Jan 2008

The Effect Of Hand Position On Maximum Performance Of Push-Ups In Adults, Gregory Douglas Brickey

Open Access Theses & Dissertations

Push-ups are widely used in public school physical education classes, and by military and law enforcement organizations to test upper body muscular fitness. The majority of the test protocols do not specify a hand position. Some research has demonstrated that hand positioning has a significant effect of on electromyographic activity of the working muscles, ground reaction forces and elbow joint loads during single or sub-maximal push-ups. However there are no scientific studies on how a change of hand positions would affect performance in a maximal push-up test to volitional exhaustion. This study examined performance in a maximal push-up test in …

Dual-Language Education: A Longitudinal Study Of Students' Achievement In An El Paso County, Texas School District, Pauline Anne Dow Jan 2008

Dual-Language Education: A Longitudinal Study Of Students' Achievement In An El Paso County, Texas School District, Pauline Anne Dow

Open Access Theses & Dissertations

This Dissertation describes a longitudinal study of one-way and two-way bilingual education programs (also known as dual-language programs) to assess achievement of elementary-aged English learners (ELs) in a school district located in El Paso County, Texas, using both norm-referenced and criterion-referenced tests. The design features assessment for bilingual students' language skills in both English and Spanish, which allows for the examination of the interrelationships among skills in the two languages. The study also compares the achievement of ELs and non-ELs in the two-way program. The work reported in this Dissertation was conducted with a common group of children over a …

ABSTRACT

Objective: The purpose of this study was to examine the change in hamstrings to quadriceps (H:Q) strength ratio between males and females following a 12-week resistance training program.

Design and Setting: We used a pretest-posttest experimental design to determine the amount of change produced by the training intervention in males and females. Isokinetic testing was performed on a Biodex System 3 isokinetic machine at 30°/sec, 60°/sec, 180°/sec and 240°/sec angular velocities, both before and after a 12-week training program.

Subjects: Twenty eight (14 male, 14 female) university recreationally active volunteers.

Variables: The dependent variables of interest were the conventional …

Cervical Cancer Risk Behaviors In Women Attending A Dysplasia Clinic In Chihuahua City, Cynthia Guerrero Jan 2008

Cervical Cancer Risk Behaviors In Women Attending A Dysplasia Clinic In Chihuahua City, Cynthia Guerrero

Open Access Theses & Dissertations

Cervical cancer mortality rates are 3.5 times higher in Chihuahua State than in Texas. Identifying risk behaviors in women living in the state of Chihuahua is important to understand what behaviors might need to be addressed through cultural relevant educational programs. My study uses a dataset collected in the summer of 2007 in a Dysplasia clinic located in Chihuahua City. This dataset provides information on six risk behaviors, two diagnostic methods of detecting cervical cancer, and women's residency by municipios. The number of live births was statistically significant in predicting cervical cancer diagnosis by Pap smear and Colposcopy. There were …

The Role Of Protein Disulfide Isomerase (Pdi) In Oxidative Folding, Veronica Gonzalez Jan 2008

The Role Of Protein Disulfide Isomerase (Pdi) In Oxidative Folding, Veronica Gonzalez

Open Access Theses & Dissertations

Protein Disulfide Isomerase is a highly evolved oxidoreductase enzyme that has the capability of oxidizing, reducing, and isomerizing disulfides in substrate. PDI is organized into several domains denoted a, b, b', a' and c. These domains are believed to have different functions but all must be present for full PDI activity. In this manuscript we recorded the ability of PDI b' to catalyze oxidative folding in fully reduced RNase A. We also examined competition between thiol-disulfide shuffling and conformational folding by PDI. This competition creates a rough effect of a highly efficient enzyme in two different substrates: RNase A and …

Shakespeare And The Interhuman: The Mimetic Chrysalis Of Buber's Between, Elizabeth Burford Lang Jan 2008

Shakespeare And The Interhuman: The Mimetic Chrysalis Of Buber's Between, Elizabeth Burford Lang

Open Access Theses & Dissertations

Shakespeare's plays survive and thrive from age to age in large part due to the incomparably mimetic "rightness" of his characters. However, the various schools of post-modern literary criticism - New Historicist, Cultural Materialist, most variations of cultural theory as applied to literature - definitively deny the possibility of an essential humanity, the very concept on which discussions of character and mimesis must stand.

The work of Martin Buber contributes a means of moderating that conversation. Buber, a self-described "believing" humanist, sought and achieved a semantic framework capable of describing the intersection of man, fellow man, and spirit while obviating …

The Effects Of Using A Scripted Or Unscripted Interview In Forensic Interviews With Interpreters, Nicole Pruss Jan 2008

The Effects Of Using A Scripted Or Unscripted Interview In Forensic Interviews With Interpreters, Nicole Pruss

Open Access Theses & Dissertations

The current study set out to replicate and expand the results of a study by Pruss (2007) which found that information is lost when interviews are conducted through interpreters. In the present study, Viewers (i.e., mock eyewitnesses) fluent in Spanish watched a video of a burglary and then were interviewed in Spanish about what they had seen. Half of Viewers were randomly assigned to be interviewed by an English-speaking Interviewer through a bilingual Interpreter (Interpreter condition), and the other half were randomly assigned to be interviewed directly by a Spanish speaking Interviewer with no Interpreter (No Interpreter condition). Within each …

Effectiveness Of Peer-Led Eating Disorders Prevention: A Replication Trial, Carolyn Becker, Stephanie Bull, Katherine Schaumberg, Adele Cauble, Amanda Franco Jan 2008

Effectiveness Of Peer-Led Eating Disorders Prevention: A Replication Trial, Carolyn Becker, Stephanie Bull, Katherine Schaumberg, Adele Cauble, Amanda Franco

Psychology Faculty Research

The aim of this study was to replicate and extend results of a previous trial that investigated the effectiveness of two peer-led eating disorders prevention interventions on reducing eating disorder risk factors in undergraduate women (Becker, Smith & Ciao, 2006). In order to extend findings from the previous study by allowing for investigation of differential response, we randomly assigned a larger sample of both higher- and lower-risk sorority members (N = 188; age M = 18.64, range = 18-21; 20% minority) to either a cognitive dissonance (CD) or a media advocacy (MA) intervention under naturalistic conditions. Interventions were delivered by …

Depression-Related Differences In Learning And Forgetting Responses To Unrelated Cues, Paula T. Hertel, A. Mahan Jan 2008

Depression-Related Differences In Learning And Forgetting Responses To Unrelated Cues, Paula T. Hertel, A. Mahan

Psychology Faculty Research

Using the think/no-think paradigm, we examined the effect of a meaningful connection between emotionally neutral cues and targets on initial learning and later recall by students in dysphoric or nondysphoric mood states. Compared to meaningfully connected cue-target pairs, unrelated pairs were less easily learned and more easily forgotten, even when initial learning was controlled. Depressive deficits were obtained in initial learning (only marginally) and final recall. When examined separately within each cuing condition, the recall deficit associated with depressed mood was restricted to the unrelated condition, but when initial learning differences were controlled this deficit was only marginally significant. Results …
