The Crab Nebula's Dynamical Age As Measured From Its Northern Filamentary Jet, G. C. Rudie, R. A. Fesen, T. Yamada

We present a deep [O III] 4959,5007 image of the northern filamentary jet in the Crab Nebula taken with the 8.2m Subaru telescope. Using this image and an image taken with the KPNO 4m in 1988 (Fesen & Staker 1993), we have computed proper motions for 35 locations in the jet. The results suggest that when compared to the main body of the remnant, the jet experienced less outward acceleration from the central pulsar's rapidly expanding synchrotron nebula. The jet's apparent expansion rate yields an undecelerated explosion date for the Crab Nebula of 1055 plus or minus 24 C.E., a …

Presently, the federal government subsidizes the higher education expenses of individual college students through two distribution channels: the tax system and the transfer system. Under each subsystem, there are a multitude of programs available to assist students in meeting their postsecondary educational expenses. The proliferation of so many forms of federal student aid raises issues of intra- and inter-program effectiveness. In their current form, the tax benefits for higher education do not get the right amount to the right people at the right time. The author argues for expanded coverage of corporate social responsibility in the U.S. law school curriculum. Corporate social responsibility is of increasing importance for businesses, particularly for those companies that conduct multinational operations. Current national legal and regulatory regimes fail to adequately address the social and environmental issues that arise in business operations. As a result, intergovernmental organizations, non-governmental organizations and businesses have begun to promulgate voluntary codes ofconduct. These codes touch on such subjects as core labor standards, environmental protection, bribery offoreign government officials in international business and human rights. In its oversight of union representation elections, the National Labor Relations Board seeks to create laboratory conditions to determine "the uninhibited desires" of employees. Despite its comprehensive regulation of union and employer campaign conduct, however, the Board fails to insure that employees get basic information relating to their decision. This Article proposes a new paradigm for the representation decision: that of a purchase of representation services. This "purchase of services" model demonstrates that the market for union representation lacks the standard features required under economic theory to drive information into the marketplace. We commonly think of presumptions as second-best inferential tools allowing us to reach conclusions, if we must, under conditions of limited information. Scholarship on the topic across the disciplines has espoused a common conception of presumptions that defines them according to their function within the decisionmaking process. This focus on the “private” face of presumptions has generated a predominantly critical and grudging view of them, perpetuated certain conceptual ambiguities, and, most important, neglected the fact that what we refer to as “presumptions” have distinguishing features other than the defeasibility and burden-shifting effects associated with their use as inferential tools. The Two Faces Of Justice In The Post-Soviet Legal Sphere: Adversarial Procedure, Jury Trial, Plea-Bargaining And The Inquisitorial Legacy, Stephen C. Thaman

This essay focuses on adversary procedure, plea-bargaining, and jury trial in the 1991 Concept of Judicial Reform of the Russian Republic. It discusses the impact of these reforms and assesses whether they have led to an improvement in the quality of evidence presented to the trier of fact, liberation of the trial and appellate judges from the juggernaut of hierarchical Soviet ‘crime control’ policies, and the development of a culture where acquittals of guilty and innocent will be tolerated when the evidence lacks credibility or is insufficient to constitute proof beyond a reasonable doubt.

Corporations present an interesting illustration of the authority versus accountability dilemma. Shareholders elect the directors of the corporation and the law vests those directors with almost unlimited authority to manage the corporation. Yet, shareholders have few effective means for holding directors accountable for their decisions other than through shareholder derivative litigation. In such litigation, the business judgment rule serves as the mechanism by which courts attempt to balance directors' authority to make decisions for the corporation against shareholders' right to hold directors accountable for those decisions.

Wildlife damage to crops is a widespread concern among agricultural producers and wildlife professionals. In the United States, raccoon (Procyon lotor) damage to field corn (Zea maize) has become a serious concern, as raccoon depredation to corn has increased significantly in recent years. However, little information is available to suggest the underlying factors responsible for recent increases in raccoon depredation on agricultural crops because there is a limited understanding of the ecological factors influencing wildlife damage to crops at local scales. We evaluated the efficacy of an oral rabies vaccination (ORV) program conducted in Erie County, New York, from July through September, 2002–2005. Ingress of the raccoon (Procyon lotor) rabies variant first occurred along the southern border of Erie County, New York, during 1992 and began to spread northward at a velocity of 31 km/year. Fixed-wing aircraft dropped ORV baits in rural landscapes; helicopters, hand baiting, and bait stations distributed baits in suburban landscapes (&#;x bait densities ranged 59–118 baits/km2). Comprehensive information on crop damage by wildlife species is critical if effective strategies for controlling wildlife damage are to be formulated. Discriminating how landscape composition and configuration attributes influence crop damage is important for implementing landscape management techniques to resolve human–wildlife conflicts. We analyzed crop damage data from 100 corn fields and 60 soybean fields located in the Upper Wabash River Basin of northern Indiana during 2003 and 2004. We used negative binomial regression to model the rate of damage to corn and soybean crops in response to local and landscape variables. Rate of crop damage was best predicted by …

Before immunocontraceptives can be considered safe to use on wildlife species, potential health risks should be assessed. Gonadotropin-releasing hormone (GnRH) immunocontraceptive has successfully reduced fertility of white-tailed deer (Odocoileus virginianus); however, associated deer physiology has rarely been examined. We conducted gross necropsy examinations, histology, and blood chemistry comparisons on euthanized deer previously vaccinated with immunogenic GnRH (n = 18 females and n = 4 males), or left as untreated controls (n = 7 females and n = 6 males).

Although good data are lacking, published estimates suggest that >1.5 million deer– vehicle collisions (DVCs) occur annually in the United States. The estimated losses exceed 1 billion dollars. In some states, DVCs are a major cause of reportable accidents. Federal, state, and private partners have cooperated in monitoring trends in DVCs and implementing mitigation measures. Most of this information about such measures is readily available via the Internet. The purpose of this paper is to provide the reader with a broad overview of and a guide to the information currently available online to mitigate DVCs.

In June 2007 a black bear (Ursus americanus) took an 11-year-old boy from the tent in which he was sleeping at a semi-wilderness campsite in the Uinta National Forest in Utah and killed him. The off ending bear, a 381-pound adult male, subsequently was destroyed by personnel of the Utah Division of Wildlife Resources and USDA/APHIS/Wildlife Services. The tragic incident, raises the number of recorded human fatalities caused by black bears during the period 1900–2007 to about 52. The continuing development of prediction markets is important because of their success in foretelling the future in politics, economics, and science. In this article, we identify the expressive elements inherent in prediction markets and explore how legislation such as the Unlawful Internet Gambling Enforcement Act of 2006 might harm such predictive speech. This article is the first to explore First Amendment protections for prediction markets in such depth, and in so doing, we distinguish prediction markets from other regulated areas such as gambling and securities trading. Employment discrimination laws in the United States have not created full equality in the workplace, although that was their goal. Real change requires greater accountability for those who make employment decisions and greater transparency to bolster that accountability. To provide that transparency and accountability, we need greater federal involvement in enforcement and a mechanism to publicize the state of the nation's workplaces. To accomplish this, I propose taking private sector employment discrimination disputes away from the Equal Employment Opportunity Commission entirely, and starting with a new agency. In a series of articles and now in their new book, Religious Freedom and the Constitution, Lawrence Sager and Christopher Eisgruber (E&S) defend an interpretation of the religion clauses of the First Amendment which, they write, "denies that religion is a constitutional anomaly, a category of human experience that demands special benefits and/or necessitates special restrictions." This article explores a common but essentially unexplored feature of appellate decision-making: decisions by irregular panels. Decisions in the federal courts of appeals are usually reached by panels of three statutorily authorized judges. But appellate panels are often irregular in practice, either because an authorized judge becomes unavailable or because an unauthorized judge is assigned as a panel member. The traditional approach, supported by both statute and case law, has been to accept the former while rejecting the latter. When considered functionally, however, decisions by quorum are at least as problematic as those by panels with unauthorized members. The absence …
