Parental Payment Abuse Within The Supplemental Security Income Program, Darlean Taylor-King Jan 2008

Parental Payment Abuse Within The Supplemental Security Income Program, Darlean Taylor-King

Walden Dissertations and Doctoral Studies

Management of Social Security Administration (SSA) has been challenged by the phenomena of overpayments with its Supplemental Security Income (SSI) program. Oversight authorities of SSA had expressed concerns about the overpayment abuse caused by parents as representative payees for disabled minor children. It was important to address this problem because the amount of overpayments prior to 1998 had caused integrity issues for management of SSA and increased federal debt from SSI claimants. The purpose of this study was to examine how management of SSA and the SSI program had responded to the concerns of the oversight authorities. Theoretical foundations for …

Caregiving And The Case For Testamentary Freedom, Joshua C. Tate Jan 2008

Caregiving And The Case For Testamentary Freedom, Joshua C. Tate

Faculty Journal Articles and Book Chapters

Almost all U.S. states allow individuals to disinherit their descendants for any reason or no reason, but most of the world's legal systems currently do not. This Article contends that broad freedom of testation is defensible because it allows elderly people to reward family members who are caregivers. The Article explores the common-law origins of freedom of testation, which developed in the shadow of the medieval rule of primogeniture, a doctrine of no contemporary relevance. The growing problem of eldercare, however, offers a justification for the twenty-first century. Increases in life expectancy have led to a sharp rise in the …

Changing The Negative Behavioral And Developmental Outcomes To A Toxic Prenatal Environment Through Parent Education, Angela Elieen Laughlin Lebedev

Walden Dissertations and Doctoral Studies

The purpose of this study was to evaluate the effectiveness of current education materials on changing maternal smoking attitudes. Children are affected by prenatal exposure to tobacco smoke. Although there are educational efforts to discourage pregnant women from smoking, the practice continues in a significant number of pregnancies. New materials, based on current research, were also evaluated for effectiveness. The theoretical framework for this study was adult learning theory presented by Knowles which makes the assumption that an individual is shaped by environmental systems, that adult learning is affected by previous knowledge they bring to the learning and that adults …

Examining The Pipeline: A Contemporary Assessment Of Private Investments In Public Equity ('Pipes'), Marc I. Steinberg, Emmanuel Obi

Faculty Journal Articles and Book Chapters

This article analyzes the practical and theoretical underpinnings as well as recent regulatory developments impacting PIPEs. Specifically, the authors examine the traditional capital financing alternatives, primarily the registered offering and private placement option, the PIPE as a relatively new and emerging alternative to traditional avenues of capital formation, and the recent regulatory changes that are bound to have a tremendous impact on the long-term viability of the PIPE as a means for effectively raising capital. The authors conclude that, on balance, the PIPE, as a distinct capital financing mechanism, may be advantageous to both PIPE investors and affected issuers, particularly …

Disney Goes Goofy: Agency, Delegation & Corporate Governance, Marc I. Steinberg, Matthew D. Bivona Jan 2008

Disney Goes Goofy: Agency, Delegation & Corporate Governance, Marc I. Steinberg, Matthew D. Bivona

Faculty Journal Articles and Book Chapters

In the wake of the corporate debacles that have occurred in the last decade, there has been an increasing legislative and judicial focus on the reform of corporate governance standards. Such reforms, including the Sarbanes-Oxley Act, sing the praises of independent directors in effectuating meaningful corporate governance. The Delaware courts as well have emphasized the importance of independent directors in the corporate governance framework.

The Delaware Supreme Court’s decision in Disney seems to be a reaffirmance of the business judgment rule as applied to corporate directors; however, the court’s highly-publicized decision ignores a crucial component of the case: the Delaware …

Portfolio Construction: The Efficient Diversification Of Marketing Investments, Michael P. Haydock

Walden Dissertations and Doctoral Studies

Efforts in the marketing sciences can be distinguished between the analysis of individual customers and the examination of portfolios of customers, giving scarce theoretical guidance concerning the strategic allocation of promotional investments. Yet, strategic asset allocation is considered in financial economics theory to be the most important set of investment decisions. The problem addressed in this study was the application of strategic asset allocation theory from financial economics to marketing science with the aim of improving the financial results of investment in direct marketing promotions. This research investigated the components of efficient marketing portfolio construction which include multiattribute numerical optimization, …

SABAM v. Scarlett is a June 29, 2007 decision from a Belgian trial court ordering an ISP in that country to install filtering software to prevent the ISP's users from accessing unauthorized music downloads via peer-to-peer systems. The court made this order following an expert report on the feasibility of such filtering. The decision has generated a fair amount of controversy and this translation is intended to provide intellectual property teachers and practitioners with a citable, English source for the opinion. Users are welcome to reproduce the translation, in whole or in excerpts, for any non-profit educational, non-profit research, or …

Ruling Out The 'Bad Things:' How Physicians Make Meaning Of Persistent Unexplained Illness In Children, Stefanie Varga Jan 2008

Ruling Out The 'Bad Things:' How Physicians Make Meaning Of Persistent Unexplained Illness In Children, Stefanie Varga

Other Faculty of Health Theses

This was a study of physicians' narratives regarding their medical experiences with children with persistent medically unexplained physical illness. The goal was to better understand those attitudes and beliefs that are involved in the construction of meaning regarding the child's symptoms of illness or pain. The study also sought to learn more about physicians' early life experiences with health and illness and their potential to shape diagnostic thinking and treatment. Ten physician participants were interviewed using an open-ended, semistructured interview methodology. Interviews were analyzed using an alternative narrative approach described by Mishler (1986, 1991) to identify key themes within and …

Going All In: The Gamble Of Globalization And European Economic Integration, Lauren S. Koffs Jan 2008

Going All In: The Gamble Of Globalization And European Economic Integration, Lauren S. Koffs

Pepperdine Policy Review

Globalization is a complicated concept. It has vast effects due to its political, social, and economic connotations. To politicians, globalization is an ideal interaction between states. They characterize globalization to suit their political needs. For instance, Bill Clinton referred to it as the “world without walls”; to Tony Blair it was “inevitable and irresistible”; while George W. Bush labels it “ties of trade and trust." While these alliterations are catchy and appealing to an uninformed and therefore unsuspecting public, to the economic mind globalization comprises much more. This article focuses on globalization and its effects on European economic integration, as …

Constructing Meaning In The Face Of Suffering: Theodicy In Lamentations, Elizabeth Boase Jan 2008

Constructing Meaning In The Face Of Suffering: Theodicy In Lamentations, Elizabeth Boase

Theology Papers and Journal Articles

This article explores the existence of theodic elements within the book of Lamentations. Drawing on the typology outlined by A. Laato and J. C. de Moor (Th eodicy in the World of the Bible [Leiden, 2003]) it is identified that Lamentations explores both retributive and educative theodicy within its poems. Other theodic solutions are not, however, present. Although these theodic solutions are present, it cannot be argued that Lamentations constitutes a theodicy as such. Rather, the poems raise and in turn subvert a range of possible theodic assertions in response to the existential crisis which emerged in the wake of …

To Imprecate Or Not: Psalm 137 And Its Appropriation In Music, Elizabeth Boase Jan 2008

To Imprecate Or Not: Psalm 137 And Its Appropriation In Music, Elizabeth Boase

Theology Papers and Journal Articles

Psalm 137 opens with lament and closes with one of the most strident imprecations in the Psalter. Read against the backdrop of the Babylonian exile, the imprecation incorporates both Edom and Babylon, concluding with the words “Happy shall they be who take your little ones and dash them against the rock.”

The closing verses have proven to be problematic for commentators. The tension is well expressed by R. Clifford, who states “Psalm 137 has the distinction of having one of the most beloved opening lines and the most horrifying closing line of any psalm. If the psalm ended at verse …

Christian Service Learning In Catholic Schools, Shane D. Lavery, Chris Hackett

Education Papers and Journal Articles

Four categories of community outreach by Catholic schools are outline, these being community service, Christian service, service-learning within a Christian context, and faith-focused Christian service-learning. Finally, various implications for promoting Christian service-learning in Catholic schools are considered in the light of the principles of charity and service as outlined in the encyclical letter Deus Caritas Est.

Developing Student Leadership Through Service-Learning, Shane D. Lavery Jan 2008

Developing Student Leadership Through Service-Learning, Shane D. Lavery

Education Papers and Journal Articles

Adolescents possess enormous potential as leaders. They have the capacity to become leaders in the workplace, in their families, in the community, and in government.

Increasingly, schools have taken on the important responsibility of the developing leadership in young people. Schools are, what van Linden and Fertman call, “hotbeds of leadership development” (1998, p. 224). For instance, Catholic schools have a commendable reputation for preparing, promoting, developing and nurturing elected student leaders. Fair and just elections, leadership camps, leadership reflection days, mixed school leadership programs, and leadership seminars, all form valid and valuable ways of preparing students for the challenges, …

Preparing Nebraska Teachers To See Demographic Change As An Opportunity, Jenelle Reeves, Edmund T. Hamann

Department of Teaching, Learning, and Teacher Education: Faculty Publications

This paper reflects on an effort to support Nebraska teachers, both practicing and preservice, to become more ready for the state‘s changing demographics, notably for the growth in Latino and Spanish-speaking populations. To that end, it describes an effort funded by the University of Nebraska-Lincoln‘s Initiative on Teaching and Learning Excellence called, ―Schooling in Nebraska‘s Demographically Transitioning Communities.‖ That initiative makes mentors of practicing teachers who have enrolled in summer courses in second language acquisition. In the fall of 2006, ten such teachers mentored 44 undergraduates enrolled in TEAC 331 ―Cultural Foundation of American Education‖ or TEAC 413A ―Second Language …
