Purpose: The ACRL Competency Standards related to learners’ values and value systems has not been interrogated in relation to information literacy theory or practice. This paper analyzes the inclusion of values in these and other guidelines and seeks evidence of the development of this topic in the literature.
Design/Methodology/Approach: A comparative review of information literacy standards related to values/value systems was conducted. An analysis of the literature engaging issues related to personal or community values related to information was completed. Suggestions for continued work were based on these findings.

In federal Indian law, the treaty operates as our foundational legal text. Reflecting centuries-old historical political arrangements between Indian nations and the United States, treaties remain vital legal instruments that decide dozens of legal cases each year. Yet, these treaties--originally drafted in English by the federal government, following negotiations with tribal representatives who usually spoke their own languages--present a number of ambiguities for contemporary courts. The dominant model of treaty interpretation is one in which judges interpret treaties in a manner they they believe to reflect Indians' understanding of treaty terms and, more generally, to promote the interests of Indian …

This Article proposes a theory of real property and peoplehood in which lands essential to the identity and survival of collective groups are entitled to heightened legal protection. Although many Americans are sympathetic to American Indian tribes and their quest for cultural survival, we remain unable to confront the uncomfortable truth that the very thing Indian peoples need is their land, the same land that the U.S. took from them. This is especially the case with regard to the sacred sites of Indian peoples, whose religions and cultures are inextricably linked to those sites. Federal law permits the United States …

Jagannath's Saligram: On Bruno Latour And Literary Critique After Postcoloniality, Amit Ray, Evan Selinger

Bruno Latour has turned to Indian vernacular fiction to illustrate the limits of ideology critique. In examining the method of literary analysis that underlies his appropriation of postcolonial history and culture, we appeal to Edward Said's notion of "traveling theory" in order to discuss critically the aesthetic as well as political stakes of using the technology of the modern novel for the allegorical purposes that Latour has in mind. We argue that Latourian analysis fails to uphold its own rigorous aspirations when it reduces complex literary and cultural representation to universal allegory.

Since the beginning of the modern missionary movement, Christian missionary views of Hinduism have changed significantly, partly as a result of linguistic developments (to which some missionaries contributed in important ways) and partly as a result of theological shifts (themselves also at times inspired by missionary insights and experiences). The views of an eighteenth century Christian missionary thus differ radically from those of missionaries able to profit from the translation efforts of nineteenth and twentieth century scholarship, and the views of a contemporary Roman Catholic missionary may bear little resemblance to that of an Evangelical Protestant.

Studies on the effects of immigration are becoming more important as the number of immigrants into the United States continues to grow. This study was implemented in order to discover the infant feeding practices and beliefs of Haitians living in Central Florida. A food frequency card sort and interview were conducted with thirty-four Haitian mothers. Mothers were asked to identify which foods they fed their children. Foods pictured on the cards included a majority of Haitian staple foods, some of which are primary to the American diet as well. Low food feeding frequencies were generally attributed to lack of access …

UMFC 66 is an anatomical specimen from the Physical Anthropology Lab at The University of Montana-Missoula. It is a nearly complete skeleton that exhibits no trauma. I examined the literature on suitable approaches to estimating age from the skeleton, because age is difficult to estimate for this case and presents an interesting challenge. I also estimated sex, ancestry, stature, and weight. I concluded that UMFC 66 is an American Indian, perhaps 20 to 28 years of age with a relatively short stature of about 1.56m (5’01”), weighing approximately 115 to 129 pounds. There is severe osteomyelitis throughout the left lower …

Hybrid wage-and-hour class actions, which combine a Fair Labor Standards Act ("FLSA ') opt-in collective action and a Federal Rule of Civil Procedure Rule 23 opt-out class action in a single civil action, demonstrate the unusual interplay of opt-in and opt-out rules. The hybrid class action, and its viability as a mechanism for wage law enforcement, raises fundamental questions as to who participates in lawsuits, how we should hold employers accountable for wage-and-hour noncompliance, and the role of the federal courts in enforcing public rights. An opt-in rule tends to produce low participation rates, while an opt-out rule tends to …

In this paper I consider the question of the extent to which sanism and pretextuality - the factors that contaminate all of mental disability law - do or do not equally contaminate the special education process, and the decision to label certain children as learning disabled. The thesis of this paper is that the process of labeling of children with intellectual disabilities implicates at least five conflicts and clusters of policy issues:

The persistent riddle of health-care policy is how to control the costs while improving the quality of care. The riddle's oncepromising answer-managed care-has been politically ravaged, and consumerist solutions are now winning favor This Article examines the legal condition of the patient-as-consumer in today's health-care market. It finds that insurers bargain with some success for rates for the people they insure. The uninsured, however, must contract to pay whatever a provider charges and then are regularly charged prices that are several times insurers'pricesa nd providers' actual costs. Analogizing Oz to Law School, this article discusses the role of orientation in the law school curriculum and offers implementation strategies to develop an effective orientation. An effective and comprehensive orientation program for law school would have many goals: it should attempt to construct the profession as a calling; create syntactical, substantive, and pedagogical context; communicate care and model empathy and compassion; cultivate community to promote mutual respect, cultural competence, and interdependence; and confirm student self-confidence. In many non-Western societies, moderate to high levels of body fat in women have long been equated with health, physical attractiveness, social status, and fertility. In recent times, however, many Western cultures have emphasized the idea that slender women are most attractive. This emphasis on thinness has led to increased levels of body dissatisfaction and dieting in Western cultures and in cultures that have imported Western media and ideals. The current study examines the body ideals in two cultures that have recently undergone increased contact with Western nations: Ghana and the Ukraine. In recent years, the public health sector has recommended that healthcare practitioners become culturally competent in order to reduce health disparities in minority groups. It was reported later in the Surgeon General's Report (1999) on mental health, that culture shapes the healthcare experience for minority groups and in turn may influence the treatment course. Cultural competence models have been proposed in conjunction with the development of ethnic-specific mental health clinics, where practitioners and patients are ethnically similar, and programs are designed with the groups’ unique cultural needs in mind. Wilderness managers are charged with the challenging goal of balancing resource protection and experience quality across a broad, value-laden landscape. While research has provided insight into visitor motivations, psychological outcomes, and meanings, a struggle exists to implement experiential concepts within current management frameworks. Research documents that breast cancer is the leading cause of death in Latina females. The exact numbers are unknown, but studies reveal that Latinas with breast cancer underuse recommended follow-up chemotherapy, decreasing their rates of survival. Although several factors may be responsible, cultural influences are a possible barrier. However, there is a gap in the literature about how culture affects decisions about breast cancer treatment. This focused ethnographic study examined the role of cultural beliefs and perceptions in the decision-making process for Latina women about whether or not to receive chemotherapy following a breast cancer diagnosis. Sovereignty has long been the dominant lens through which we view both federalism and international law. From the perspective of sovereignty, both federalism and international law are primarily about drawing clear boundaries and demarcations between separate, autonomous power centers. Recently, however, a group of scholars have embraced a more pluralist approach to both American federalism and international law. They have touted the important virtues of jurisdictional redundancy and inter-systemic governance models in which multiple legal and regulatory authorities weigh in regarding the same acts and actors. Throughout this autoethnography, the author weaves personal memories of her early life in the San Francisco Bay Area during the 1960s and 70s into a larger set of social and historical events of that turbulent era. Using the metaphor of "crossing over," she traces her growing awareness of racial inequality and white privilege during a period in which she must also come to terms with a series of deaths by disease, fire, and assassination. While literally crossing bridges and terrain, she figuratively crosses class and color lines that have long separated generations of her once-wealthy white family from the people …

This article addresses a striking contrast at the center of contemporary social and legal views of family. The traditional family, forged in the early years of the Industrial Revolution to support the interests of the marketplace, has largely collapsed. In its place, the law and society have increasingly recognized the significance of autonomous individuality in the construction of family relationships. At the same time, however, society has become obsessed with the apparent significance of DNA in determining individual and familial identity.

There are more than 300,000 child soldiers in the world today. Complex economic and psychological factors have contributed to this large number; while some of these child soldiers qualify as slaves, many do not. Although there are several United Nations (U.N.) conventions that protect the rights of the child, many states have had difficulty implementing such protections. This has led to the perpetuation of the child slavery problem. Unfortunately for the children involved, their troubles do not end with the fighting. After the conflict, former soldiers must undergo the oftentimes-painful process of rehabilitation and integration back into society.
