Ms 671 Anthropology, Michael A. Rynkiewich Jan 2008

Ms 671 Anthropology, Michael A. Rynkiewich

Syllabi

COURSE DESCRIPTION This course is “An introduction to cultural anthropology, with application to Christian evangelization and mission.” From before the beginning (Genesis 1), our Triune God has been in mission, reaching out in self-giving, other-embracing love (John 1 & I John 1). We now call this the missio Dei, “the mission of God” to remind us that it is not our mission, nor does mission belong to the church. How God does mission is best understood in the sending of Jesus the Christ (Ephesians 2:11-15). As the Father has sent Jesus, so Jesus sends us (John 20:21). It is in …

Returning To The Mirror: Reflections On Promoting Constructivism In Three Educational Contexts, Alison Cook-Sather Jan 2008

Returning To The Mirror: Reflections On Promoting Constructivism In Three Educational Contexts, Alison Cook-Sather

Education Program Faculty Research and Scholarship

Since the early 1980s educators have argued that reflection is an essential dimension of good pedagogical practice. This discussion of my attempt to support a constructivist approach to learning for three different groups of learners illustrates one effort to engage in such reflection. I analyze several assignments I have designed for differently positioned learners, all within the context of a liberal arts college in northeastern USA. Referring to the assignments I have developed in each context, I analyze the particular kinds of structures, challenges and supports I try to provide to learners, with the goal of surfacing the convictions I …

Promissory Estoppel And The Protection Of Interpersonal Trust , John J. Chung Jan 2008

Promissory Estoppel And The Protection Of Interpersonal Trust , John J. Chung

Cleveland State Law Review

This paper examines the role of trust in promissory estoppel and the extent to which the law should protect trust when a promise is made. Part II of this Article summarizes some of the scholarship discussing the nature and role of trust. In particular, it discusses the role of trust in a market economy, and the related role of trust in Contracts law. Part III examines whether there is a difference between trust and reliance, and whether it matters. Part III further asserts that a separate discussion of trust is beneficial because it has the potential to guide and inform …

The Rise Of Outsourcing In Modern Warfare : Sovereign Power, Private Military Actors, And The Constitutive Process, Winston P. Nagan, Craig Hammer Jan 2008

The Rise Of Outsourcing In Modern Warfare : Sovereign Power, Private Military Actors, And The Constitutive Process, Winston P. Nagan, Craig Hammer

UF Law Faculty Publications

In this Article, we will examine the world order implications of combat privatization through the prism of the world constitutive process. This process is one of continuing communication and collaboration that examines, refines, and allocates competence in the international system. The process of contextual mapping might shed light on the terms associated with, and concepts communicated by, privatized military combat, which might be better understood when the contexts in which they are used are illuminated in a discriminating manner. Their multiple meanings are given coherence when we appreciate the divergent contexts within which they are used. To develop the appropriate …

Cultural Identity, Communication, And Cultural Reentry: Experiences Of American Students, Yuliya Kartoshkina Jan 2008

Cultural Identity, Communication, And Cultural Reentry: Experiences Of American Students, Yuliya Kartoshkina

Theses and Dissertations

In 2003 the National Education Association annual survey revealed that male teachers currently make up 35% of America's kindergarten through 12 th grade classroom teaching cadre. In grades kindergarten through sixth grade, men comprise 9% of the classroom teachers, and only 2% of classroom teachers inkindergarten through third grade are men. In 1994 Sadker and Sadker published Failing at Fairness, which examined gender biases in American kindergarten through 12th grade classrooms, including the effects of the overwhelmingly-female faculties. At the National Education Association's 2002 Representative Assembly, members adopted a measure to "identify, recognize, recruit and retain," more male teachers, …

Towards A Theology Of Liberation, Angus Brook Jan 2008

Towards A Theology Of Liberation, Angus Brook

Theology Papers and Journal Articles

In 1971 Gustavo Gutierrez was the first theologian to pronounce the advent of the theology of liberation. This book received both praise and criticism for its ‘radical new’ approach to theological endeavour. This paper will attempt to provide a broad overview of the complex processes or possibilities which led to the publishing of this book. In doing so, I will focus my discussion upon what has made liberation theology possible; the cultural environment, the intellectual inspiration, and the events that have played an important role in its development. Of course, I cannot hope to give depth to the breadth of …

Catching The Unique Rabbit: Why Pets Should Be Reclassified As Inimitable Property Under The Law, Kelly Wilson Jan 2008

Catching The Unique Rabbit: Why Pets Should Be Reclassified As Inimitable Property Under The Law, Kelly Wilson

Cleveland State Law Review

This Note introduces a new approach for resolving the issue of inadequate compensation for pet loss by arguing for the adoption of a new classification of personal property called inimitable property. The new categorization takes into consideration the live, conscious, and unique qualities of pets that distinguish them from other sorts of inanimate property.

A Pluralistic Approach To Oppression And Latino Terra Nullius, Valerie J. Phillips Jan 2008

A Pluralistic Approach To Oppression And Latino Terra Nullius, Valerie J. Phillips

St. Thomas Law Review

This paper contains the substance of a talk that I gave at LatCrit XII in Miami, Florida on Panel C4: Coalition Building, Globally and Locally. It is an outgrowth of my observation of the relative lack of participation by indigenous peoples from the Americas, particularly from the South, within LatCrit itself. It draws on my lived experiences at LatCrit's South-North Exchange on Theory, Culture, and Law in San Juan, Puerto Rico in May of 2005 (SNX 2005) as well as the comments of my hotel roommate, June McCue at the University of British Columbia law school in Canada. The topic …

Rethinking Ngos: The Economy Of Survival And Global Governance, Marc Abélès Jan 2008

Rethinking Ngos: The Economy Of Survival And Global Governance, Marc Abélès

Indiana Journal of Global Legal Studies

This article explores the concept of "global politics," an evolving set of systems that undermine our traditional view of government. These underlying systems, including Non-Governmental Organizations (NGOs), exert great influence on the power and actions of nation-states. Thus, while current global politics are largely dependent on the actions and strategies of nation-states, nation-states are not the only actors at work. The article argues for a view of global politics that takes these other systems, particularly NGOs, into account.

A Process Theory Of Natural Law And The Rule Of Law In China, Mark C. Modak-Truran Jan 2008

A Process Theory Of Natural Law And The Rule Of Law In China, Mark C. Modak-Truran

Journal Articles

This Article analyzes China's efforts to implement the rule of law and proposes a constructive, post-modern normative theory of law based on the Process Philosophy of Alfred North Whitehead and the Radical Empiricism of William James. This "process theory of natural law" provides a novel theory of natural law that eliminates the perceived illegitimacy arising from legal indeterminacy and closes the ontological gap between legal theory and practice. Process natural law also mediates many of the cultural differences between the East and the West through the telos of beauty (unity-in-diversity), which entails maximizing both an Eastern aesthetic sense of order …

Introduction: Re-Stating The Standard Of Practice For Death Penalty Counsel: The Supplementary Guidelines For The Mitigation Function Of Defense Teams In Death Penalty Cases, Eric M. Freedman Jan 2008

Introduction: Re-Stating The Standard Of Practice For Death Penalty Counsel: The Supplementary Guidelines For The Mitigation Function Of Defense Teams In Death Penalty Cases, Eric M. Freedman

Hofstra Law Review

This is the Introduction to the Hofstra Law Review symposium issue on the Supplementary Guidelines for the Mitigation Function of Defense Teams in Death Penalty cases, and summarizes its thirteen articles.

A central - indeed, arguably the central - duty of defense counsel in a capital case is to humanize the client in the eyes of those who will decide his fate. The daunting task of imagining, collecting, and presenting such mitigation evidence pervades counsel's responsibilities from themoment of detention on potentially capital charges to the instant of execution.

A truly multi-disciplinary team, with skills in eliciting and documenting sensitive …

Shared Sovereign Immunity As An Alternative To Federal Preemption: An Essay On The Attribution Of Responsibility For Harm To Others, Martin A. Kotler Jan 2008

Shared Sovereign Immunity As An Alternative To Federal Preemption: An Essay On The Attribution Of Responsibility For Harm To Others, Martin A. Kotler

Hofstra Law Review

Beginning with the Supreme Court's 1992 decision in Cipollone, courts have engaged in the practice of parsing the preemption language of federal legislation ostensibly to determine whether Congress intended to preclude the possibility of imposing liability on manufacturers under state products liability law. This article argues that congressional intent is largely a fiction and the cases based on it have been improperly decided. Nevertheless, the results reached in many of the cases are intuitively appealing. The reason for this is that the results commonly are based on the long-standing fairness principle that one should not be subjected to liability in …

Foreword: Biomedical Research And The Law-Embryonic Stem Cells, Clones, And Genes: Science, Law, Politics And Values, Janet L. Dolgin, Joel Weintraub

Hofstra Law Review

The articles presented in this symposium issue developed from papers delivered at the second in a series of conferences at Hofstra University devoted to the study of "Biomedical Research and the Law." The first conference, held in October 2006, focused on conflicts occasioned by industry funding of biomedical research. The second conference, the subject of this issue, occurred in March 2008 and was dedicated to the study of "Embryonic Stem Cells, Clones, and Genes: Science, Law, Politics and Values." This conference provided a productive context for debate among lawyers, physicians, scientists, theologians, philosophers, journalists, and others about a set of …

Improving Knowledge Management Programs Using Marginal Utility In A Metric Space Generated By Conceptual Graphs, Jeffrey A. Schiffel Jan 2008

Improving Knowledge Management Programs Using Marginal Utility In A Metric Space Generated By Conceptual Graphs, Jeffrey A. Schiffel

CCAC Theses and Dissertations

Knowledge management has emerged as a field of endeavor that blends a systems approach with methods drawn from organizational management and learning. In contrast, knowledge representation, a branch of artificial intelligence, is grounded in formal methods. Research in the separate behavioral and the structural disciplines – knowledge management and knowledge engineering - has not traditionally cross-pollinated. This has prevented the development of many practical practices useful in organizations. Organization managers - line and senior - lack guidance in where to direct improvement efforts targeted at specific groups of company knowledge workers. Demonstrated here is Knowledge Improvement Measurement Space (KIMS), a …

Pregnancy, Medicaid, State Regulation, And The Production Of Unruly Bodies, Khiara M. Bridges Jan 2008

Pregnancy, Medicaid, State Regulation, And The Production Of Unruly Bodies, Khiara M. Bridges

Northwestern Journal of Law & Social Policy

This paper represents a concretization of thoughts generated during a year and a half of anthropological fieldwork in the obstetrics clinic of a large, public hospital located on the . As a condition of receipt of Medicaid coverage of prenatal care expenses, poor, uninsured pregnant women are compelled to meet with a battery of professionalsnamely nutritionists, social workers, health educators, and financial officerswho inquire into areas of women's lives that frequently exceed the realm of the medical. This paper argues that, as a result, Medicaid mandates an intrusion into women's private lives and produces pregnancy as an opportunity for state …

The Effects Of Financial Aid Amounts On Academic Performance, Lane Coonrod '08

The Park Place Economist

Much research has been done investigating the impact of various forms of financial aid on college entry, eventual college graduation, and future earnings, yet little if any literature has explored the possibility of the presence of unintended academic outcomes—both positive or negative. This study looks to focus on one specific possible externality—financial aid’s impact on academic performance.
