Riding A Broomstick Out Of Plato’S Cave: Elements Of Plato Found In J.K. Rowling’S Harry Potter Series, Camille Winegar Parker Jan 2008

Riding A Broomstick Out Of Plato’S Cave: Elements Of Plato Found In J.K. Rowling’S Harry Potter Series, Camille Winegar Parker

Master's Theses and Doctoral Dissertations

J.K. Rowling’s Harry Potter series has become a cultural phenomenon. An analysis of the Harry Potter series reveals that underneath the phenomenon status there is great depth. This paper looks at aspects of the novels that mirror elements found in Plato’s The Republic, specifically his allegory of the cave in Book Seven. Plato’s allegory of the cave can be broken down into “four stages,” and in the Harry Potter novels there are characters who fall in each of these four stages. Through the characters in the four stages we see that the “highest form of knowledge” (Plato 246) to …

The Elementary Persuasive Letter: Two Cases Of Situated Competence, Strategy, And Agency, Diane Downer Anderson Jan 2008

The Elementary Persuasive Letter: Two Cases Of Situated Competence, Strategy, And Agency, Diane Downer Anderson

Educational Studies Faculty Works

Research on persuasive writing by elementary children posits primarily a developmental perspective, claiming that elementary-age children can effectively argue through talk but not through writing. While this view is commonly held, this article presents counterevidence. Drawing on two cases of third and fourth grade children writing persuasive letters gathered during six-month naturalistic studies of literacy practices and social identities in contrastive communities (one urban, one suburban), these data challenge the developmental generalization by showing that children in these settings can write persuasively. Further, this work complicates understandings of children's persuasive writing by showing how assignments and local cultures shape children's …

Family Law In The Twenty-First Century: An Annotated Bibliography, Nancy Levit

Faculty Works

The twenty-first century will bring, among other things, an explosion of technology (in domains ranging from electronic to reproductive), greater personal mobility, and an aging population. Thus, this bibliography emphasizes cutting edge issues in areas as wide-ranging as elder law, electronic discovery, changes in the legal profession (such as internet advertising and provision of legal services), multidisciplinary and multijurisdictional practice, and the new world of reproductive technologies. This bibliography covers law review articles, A.L.R. entries, and some web articles published after 2002, with an emphasis on those in more recent years. The bibliography for the first time expands to include …

Choosing Metaphors, Jessica Litman Jan 2008

Choosing Metaphors, Jessica Litman

Book Chapters

The copyright law on the books is a large aggregation of specific statutory provisions; it goes on and on for pages and pages. When most people talk about copyright, though, they don't mean the long complicated statute codified in title I7 of the U.S. Code. Most people's idea of copyright law takes the form of a collection of principles and norms. They understand that those principles are expressed, if sometimes imperfectly, in the statutory language and the case law interpreting it, but they tend to believe that the underlying principles are what count. It is, thus, unsurprising that the rhetoric …

De-Moralized: Glucksberg In The Malaise, Steven D. Smith Jan 2008

De-Moralized: Glucksberg In The Malaise, Steven D. Smith

Michigan Law Review

Ten years down the road, what is the enduring significance of the "assisted suicide" cases, Washington v. Glucksberg and Vacco v. Quill? The cases reflect an unusually earnest, but nonetheless unsuccessful, attempt by the Supreme Court to grapple with a profound moral issue. So, why was the Court unable to provide a more satisfying justification for its conclusions? This Article, written for a symposium on the tenth anniversary of Glucksberg,, discusses that question. Part I examines some of the flaws in reasoning in the Glucksberg and Quill opinions and suggests that these flaws stem from the opinion writers' …

Packing Factors Of Feed Products In Storage Structures, Samuel G. Mcneill, Michael D. Montross, Sidney A. Thompson, I. Joseph Ross, Thomas C. Bridges

Biosystems and Agricultural Engineering Faculty Publications

Experiments were conducted to measure the changes in bulk density of cracked corn, corn meal, soybean meal, cotton seed meal, and distillers dried grain (without solubles) when subjected to simulated overburden pressures. All materials were tested at two moisture content levels (approximately 8% and 12% w.b.) and seven pressures between 0 and 69 kPa (0 and 10 psi). A mathematical model was fitted to the data to predict the bulk density of each feed ingredient as a function of pressure and moisture content. These relationships were inserted into a previously developed computer model to predict ingredient packing within conventional storage …

Teacher Education and Leadership Faculty Publications

A brief narrative description of the journal article, document, or resource. Informational text is an important resource for classroom teachers that places unique comprehension demands on young students. Research on teaching expository text structure to young children shows that explicit instruction improves student comprehension. This practical article addresses how to use "well-structured" expository trade book titles to teach text structure. A lesson plan template and an extended example of an explicit lesson on order/sequence are provided.

“Forward” In Recent Developments In Minnesota Law, Eric S. Janus Jan 2008

“Forward” In Recent Developments In Minnesota Law, Eric S. Janus

Faculty Scholarship

Introduction to Issue 4 of Volume 34 of the William Mitchell Law Review. The issue has a dual focus. The first part of the issue examines an eclectic collection of Minnesota laws and cases. The issue begins with a retrospective on the opinions of Associate Justice Sam Hanson, then turns to the Law Review’s traditional—and critical—look at selected (mostly recent) Minnesota Supreme Court decisions, and finally scans and audits the state’s animal protection laws. The second part of the issue has a decidedly more international scope, reflecting the robust work of William Mitchell’s Tobacco Law Center, particularly the work product …

Teaching Basic Counseling Skills To Aspiring School Leaders: Active Listening Skills As Critical Components Of Team Building And Collaboration, Paul T. Hackett, L. Christopher Ross, Irene Asuncion Jan 2008

Teaching Basic Counseling Skills To Aspiring School Leaders: Active Listening Skills As Critical Components Of Team Building And Collaboration, Paul T. Hackett, L. Christopher Ross, Irene Asuncion

Perspectives In Learning

The preparation of school leaders in educational leadership programs provides multiple challenges in terms of a set course of study with discrete skills for the leader. Programs in educational leadership have been criticized for curricular disarray (Levine, 2005). Deficiencies cited by an American Enterprise Institute study of 31 educational leadership programs found that a small percentage of instruction in those programs focused on issues such as data analysis, public relations, marketing, and parent and school board relations (Hess & Kelly, 2005). A Southern Regional Education Board (SREB) study of educational leadership programs found that the majority of universities “fall short …

Acquiring Anatomical Representation Of Human Maxilla For Rapid Maxillary Expansion, F.A. Zabir, A.S. Abdullah, Noor Azuan Abu Osman, Z. Radzi, N.A. Yahya, Noor Hayaty Abu Kasim

Research Publications (2006 to 2010)

The purpose of the study is to model and provide a better understanding of maxilla bone involved in the treatment for rapid maxillary expander (RME) for dento-facial applications. The treatment is recommended for patients presented with an arch width deficiency named cross bites. Cross bites often cause abnormal physical forces that disrupt the balance of the occlusal relationship. More commonly, the maxilla or the upper jaw appears to be narrow and contributes to significant degree of crowding in the mouth. Early investigators [1-4] discovered that rapid maxillary expansion resulted in a splitting of the median palatal suture. The expansion is …

Money Or Nothing: The Adverse Environmental Consequences Of Uncompensated Law Use Controls, Jonathan H. Adler Jan 2008

Money Or Nothing: The Adverse Environmental Consequences Of Uncompensated Law Use Controls, Jonathan H. Adler

Faculty Publications

The conventional wisdom holds that requiring compensation for environmental land-use controls would severely limit environmental protection efforts. There are increasing reasons to question this assumption. Both economic theory and recent empirical research demonstrate that failing to compensate private landowners for the costs of environmental regulations discourages voluntary conservation efforts and can encourage the destruction of environmental resources. The lack of a compensation requirement also means that land-use regulation is underpriced as compared to other environmental protection measures for which government agencies must pay. This results in the "overconsumption" of land-use regulations relative to other environmental protection measures that could be …

Anti-Conservation Incentives, Jonathan H. Adler Jan 2008

Anti-Conservation Incentives, Jonathan H. Adler

Faculty Publications

Several recent empirical studies have indicated that the Endangered Specifies Act (ESA) discourages species conservation on private land. This is because the law encourages landowners to shoot, shovel and shut up before federal authorities discover the species are present or may move onto the land. Most worrisome, the studies suggest that the net effect of the ESA on private land could be negative. Habitat loss and fragmentation represent the greatest threat to endangered species because private land is indispensable to environmental conservation.

East Asia Institutionalizes: China, Japan And The Vogue For Free Trade, Timothy Webster Jan 2008

East Asia Institutionalizes: China, Japan And The Vogue For Free Trade, Timothy Webster

Faculty Publications

In the past decade, East Asia has taken steps to increase regional integration. This paper examines the vogue for Free Trade Agreements (FTAs) currently raging in China and Japan. After mapping the regional links that knit East Asia together during the 1990s and 2000s, the focus then shifts to the specific trade agreements that China and Japan have signed. Both countries exhibit a particular FTA “style;” Japan has adopted a more orthodox and comprehensive approach to its treaties, while China has shown greater flexibility and gradualism when dealing with FTA partners. It is still unclear whether these efforts will lead …

Computer-Based Instruction And Cognitive Load, Jui-Long Hung, Brandon Randolph-Seng, Kittikunanant Monsicha, Steven M. Crooks

Educational Technology Faculty Publications and Presentations

Following cognitive load theory, we used a computer-based software training paradigm to determining the optimal number of steps or information chunks to present before practice opportunities. Results demonstrating that the size of information chunks presented and the type of practice used individually influenced participants' ability to effectively learn via computer-based instruction. These findings contribute to the literature by showing the importance of practice and optimal segment sizes for learning via a computer.
