Drafting Common Interest Community Documents: Minimalism In An Era Of Micromanagement, Patrick K. Hetrick
Drafting Common Interest Community Documents: Minimalism In An Era Of Micromanagement, Patrick K. Hetrick
Campbell Law Review
Part I of this Article suggests a minimalist approach to the drafting of documentation creating a common interest community. It assumes that the common interest community will be located in a jurisdiction that has passed some form of a comprehensive uniform act. Part II then analyzes the issue of "promises" (covenants, restrictions, and rules) and addresses issues that include the unfortunate contemporary trend toward micromanagement of communities. It goes on to suggest that a legislative and judicial reaction to private community governance is developing. Part III of this Article explains why existing consumer protection devices are little more than mirages …
The Use Of Molecular Scatology To Study River Otter (Lontra Canadensis) Genetics, Barbara Mcelwee
The Use Of Molecular Scatology To Study River Otter (Lontra Canadensis) Genetics, Barbara Mcelwee
Theses
North American river otters (Lontra canadensis) were extirpated throughout all of Western New York due to habitat loss, pollution, and trapping. Between 1995 and 2000, 279 river otters were released throughout Western New York, 31 of which were released in the Genesee river watershed. Since their release there have been no followup studies on the river otters until the RIT River Otter Lab was formed in 2004. Researchers surveyed three local creeks to record data on toilet site locations and collect otter feces in order to perform dietary and genetic analyses. Through the use of molecular scatology I extracted DNA …

Cartels, Agency Costs, And Finding Virtue In Faithless Agents, Christopher R. Leslie
Cartels, Agency Costs, And Finding Virtue In Faithless Agents, Christopher R. Leslie
William & Mary Law Review
Although price-fixing conspiracies are inherently unstable, many cartels manage to endure, often for long periods. Many successful cartels have hierarchical structures made up of high-level executives (principals) and lower-level managers (agents). For these cartels, agency cost theory could provide some insights as to how to destabilize them from within. Agency costs exist when a faithless agent pursues her own interests instead of those of the principal. Although agency costs are generally considered inefficient, when the principal's goals are undesirable, the acts of a faithless agent can be beneficial. Because one traditional approach to reducing agency costs is to align the …

Department of Occupational Therapy Faculty Papers
Children's participation in everyday activities and routines in home and community settings is an important focus of services for infants and young children with disabilities. Data indicate that assistive technology (AT) is not widely used nor do early intervention service providers report frequent use of AT devices with infant-toddlers. Adaptation interventions combine environmental accommodations and AT in ways that promote children's participation in activities and routines and provide functional skill-building learning opportunities. A decision-making process for planning and implementing adaptation interventions is outlined with examples of strategies and formats that service providers can use to create successful interventions for infants …

Stochastic Calculations For Computation Of Radiation Effects And Cell Survivability Under Voltage Pulsing, Madhuri Ganapathiraju
Stochastic Calculations For Computation Of Radiation Effects And Cell Survivability Under Voltage Pulsing, Madhuri Ganapathiraju
Electrical & Computer Engineering Theses & Dissertations
Statistical computations are an important tool for the analysis of stochastic phenomena and processes that are characterized by variability. Biological systems (e.g., cells, tissues etc.) are perfect examples wherein response to a given external stimulus can be varied and needs to be adequately considered. The Monte Carlo method of analysis has now been recognized as the most effective way of treating stochastic variability.
This thesis uses Monte Carlo based simulations to probe two problems that require the quantification and modeling of effects caused by energy deposition onto biological matter from external sources. One problem involves the probabilistic study of the …
The Regulation Of Endothelial And Neuronal Nitric Oxide Synthase Expression In The Preglomerular Vessels By The Increase In Intracellular Calcium Concentration, Stephanie Thomas Montgomery
The Regulation Of Endothelial And Neuronal Nitric Oxide Synthase Expression In The Preglomerular Vessels By The Increase In Intracellular Calcium Concentration, Stephanie Thomas Montgomery
Chemistry & Biochemistry Theses & Dissertations
This purpose of this study was to examine the regulation of endothelial and neuronal nitric oxide synthase expression in the preglomerular vessels of mature and immature porcine kidneys by the increase in intracellular calcium concentration. Angiotensin II can increase intracellular calcium concentrations in two ways; either through the mobilization of intracellular calcium stores or through the influx of calcium from the extracellular fluid through calcium channels. The aim of this study was to determine the effects of a calcium control, a calcium-free control, L- and T-type voltage-gated calcium channel blockers, an internal calcium store release agent, KCI, and EDTA on …
A Study Of Body Scent As A Social Identifier Among Members Of The Arabic Culture, Mia M. Wilson
A Study Of Body Scent As A Social Identifier Among Members Of The Arabic Culture, Mia M. Wilson
Masters Theses
Body scent plays a major factor in how individuals interact with one another. While Americans have their own perception of what is "proper" body scent, they still remain uninformed about the various ways body scent is used to deliver social messages and form interpersonal relationships within other cultures. With many immigrants continuing to move to the United States (Frey, 2004), American societies need to become educated on other cultures' social aspects of body scent to avoid alienation of foreign communities. This qualitative research study explores how individuals of the Saudi Arabian culture use body scent as a social identifier to …
Documenting Aguaje Palm Swamp Area And Conditions In The Peruvian Amazon, Malinda Van Sledright
Documenting Aguaje Palm Swamp Area And Conditions In The Peruvian Amazon, Malinda Van Sledright
Masters Theses
Mauritia flexuosa is the most widespread and economically important palm in western Amazonia and is known as aguaje in Peru. It is found mostly in "aguajales," but little is known about the size and spatial distribution of these permanently wet oligarchic forests. Aguaje is dioecious; only the female trees produce the coveted fruit, and cutting them down leaves a preponderance of unproductive male palms. There exists a consensus in the literature that levels of damage to aguajales is related to distance from settlements where extractors reside. However, no studies exist which show this relationship. By mapping 24 aguajales and conducting …

Spatial And Trophic Dynamics Of A Macrofaunal Community On A High Energy Intertidal Sandflat, Sharon Ann Tatem
Spatial And Trophic Dynamics Of A Macrofaunal Community On A High Energy Intertidal Sandflat, Sharon Ann Tatem
Biological Sciences Theses & Dissertations
Spatial and trophic interactions between macrofaunal species were studied in a high energy intertidal system during spring-summer low tides. Bioturbation by the enteropneust hemichordate, Balanoglossus aurantiacus (Girad), as evidenced by large fecal mounds, was a conspicuous feature on the sandflat Sediment characteristics were compared between ambient (non-fecal) and B. aurantiacus fecal mound types (fresh-oxidized, fresh-reduced, aged-oxidized, and aged-reduced). Fecal material was differentiated by age based on the presence or absence of mucus and the time of fecal deposition. The color of fecal material was used to assign oxidative state. Multiple isotopes (carbon, nitrogen, sulfur) were used to determine the origins …

Impact Of Airline Business Models On Fuel Efficiency Of Aircraft Operations In The National Airspace System (Nas), Trisha R. Khetia
Mechanical & Aerospace Engineering Theses & Dissertations
This is a documentation of the research that has been conducted by T. Khetia of the Batten College of Engineering and Technology at Old Dominion University in Norfolk, Virginia. The report summarizes fuel efficiency studies of aircraft operations in the National Airspace System (NAS).
This research was conducted to analyze the Hub-and-Spoke (H&S) system operations in the NAS and how a change in the balance of the H&S system would affect fuel efficiency metrics in the NAS. Several fuel metrics were calculated during the research in order to find out which metric would best represent the desired operation of the …
The Mechanical Hour, Ryan Thomas Fulcher
The Mechanical Hour, Ryan Thomas Fulcher
English Theses & Dissertations
Each of the five stories in this collection presents a character who feels compelled to do something out of the ordinary. In "Rock Creek Bridge," a lonely man interferes with a stranger's bleak plan. In "The Day Room," young married man suffers the lingering pangs of an old attachment. "The Mechanical Hour" features a man who suspects himself of harboring an unhealthy impulse. In "Occoquan," a young lobbyist falls lower than he thought possible. In "Ballplayers," an alternate take on the classic form of the baseball story, a man recounts his version of a theft he committed as a youth. …
Practice Style And Successful Legal Mobilization, Anne Bloom
Practice Style And Successful Legal Mobilization, Anne Bloom
Law and Contemporary Problems
Bloom talks about the making of a great cause lawyer. Perhaps not surprisingly, dedication, strong political ties, and superb legal skills all play a role in the making of a great cause lawyer, but so does a somewhat less obvious quality, which Marc Galanter described several years ago as practice "style." However, in these case studies, it suggests that the making of a great cause lawyer depends, in part, on practice style. Put differently, how a lawyer approaches legal practice seems to matter for purposes of legal mobilization. In these cases, cause lawyers were more effective at using the law …
An Appreciation Of Marc Galanter’S Scholarship, John Lande
An Appreciation Of Marc Galanter’S Scholarship, John Lande
Law and Contemporary Problems
Lande highlights three of Marc Galanter's works to illustrate qualities that seem especially worth emulating. He includes extended excerpts of his writing because his concepts and language are so evoctive that paraphrasing often does not do them justice. Galanter's works that Lande focuses, include the classic articles, "Why the "Haves" Come Out Ahead: Speculations on the Limits of Legal Change"; and "Case Congregations and Their Careers". The professor's recent book, Lowering the Bar: Lawyer Jokes and Legal Culture, is also featured. The book is the culmination of much of his work on American law.

Kurds In Turkey And In (Iraqi) Kurdistan: A Comparison Of Kurdish Educational Language Policy In Two Situations Of Occupation, Tove Skutnabb-Kangas
Genocide Studies and Prevention: An International Journal
This article describes, compares, and analyzes two educational situations for Kurds from the point of view of linguistic human rights, using prodigious exemplification. In Turkey, Kurdish-medium schools are not allowed, and Kurdish children do not even have the right to study their mother tongue as a subject in school. In addition to physical genocide through low-intensity warfare, including unacceptable living conditions, Turkey continues to commit linguistic and cultural genocide (according to definitions of genocide in articles 2(b) and 2(e) in the UN Convention on the Prevention and Punishment of the Crime of Genocide) in relation to the Kurdish nation/minority. Under …
The Three “Switches” Of Identity Construction In Genocide: The Nazi Final Solution And The Cambodian Killing Fields, Maureen S. Hiebert
The Three “Switches” Of Identity Construction In Genocide: The Nazi Final Solution And The Cambodian Killing Fields, Maureen S. Hiebert
Genocide Studies and Prevention: An International Journal
If we want to understand why political elites choose to commit genocide, we need to inquire into how elite perpetrators reconstruct the collective identity of the victim group such that genocide becomes the only possible policy option. This article argues that elites decide to commit genocide, and not some other less catastrophic policy of repression or violence, when three conceptual ‘‘switches’’ concerning the identity, interests, and future actions of the victim group are ‘‘turned on’’ by the perpetrators. First, members of the victim group lose their (often marginal) status within the political community and are constructed as outsiders, to whom …
The United States’ Response To Genocide In The Independent State Of Croatia, 1941–1945, Rob Mccormick
The United States’ Response To Genocide In The Independent State Of Croatia, 1941–1945, Rob Mccormick
Genocide Studies and Prevention: An International Journal
In April 1941, Ante Pavelic ́, the fascist leader of the Independent State of Croatia, and his paramilitary force, the Ustasˇe (‘‘rebels’’), began a genocide that killed at least 330,000 Serbs and essentially eliminated Jews and Roma from Croatia. The American response to genocide in Croatia provides a fuller context for examining Washington’s reaction to the Nazi genocide. By the summer of 1941, the US government had reliable information that genocide was taking place in Croatia. Washington expressed little interest in this slaughter, except insofar it affected Croatian–American and Serbian–American relations; made no direct public statement condemning the Ustasˇe’s actions; …

Cytochrome P450 (P450) is a super-family of drug metabolizing enzymes. P450 enzymes have dual function; they can metabolize drugs to pharmacologically inactive metabolites facilitating their excretion or biotransform them to pharmacologically active metabolites which may have longer half-life than the parent drug. The variable pharmacological response to psychoactive drugs typically seen in population groups is often not accountable by considering dissimilarities in hepatic metabolism. Metabolism in brain specific nuclei may play a role in pharmacological modulation of drugs acting on the CNS and help explain some of the diverse response to these drugs seen in patient population. P450 enzymes are …
