Falsity, Insincerity, And The Freedom Of Expression, Mark Spottswood
Falsity, Insincerity, And The Freedom Of Expression, Mark Spottswood
William & Mary Bill of Rights Journal
Three decades ago, the Supreme Court announced that false statements of fact are devoid of constitutional value, without providing either a reasoned explanation for that principle or any supporting citations. This assertion has become one of the most frequently repeated dogmas of First Amendment law and theory, endlessly repeated and never challenged. Disturbingly, this idea has provided the theoretic foundation for a regime in which some speakers can be penalized for even honestly believed factual errors. Even worse, this dogma is flat wrong.
False statements often have value in themselves, and we should protect them even in some situations where …

The Prefiguration Of Some Aspects Of The Holocaust In The Armenian Genocide (Revisiting The Comparative Perspective), Vahakn N. Dadrian
Genocide Studies and Prevention: An International Journal
The field of genocide studies has been marked by a comparative tendency, while at the same time scholarship on the Holocaust has tended to focus on its singularity; the Armenian Genocide has often been treated as representing a ‘‘dress rehearsal’’ for the Holocaust. This article examines the parallels and commonalities, as well as the differences, between the two events, with a view to drawing them into a comparative perspective. More specifically, four major factors (vulnerability of the victim group, degradation of victims, war as opportunity, and fear of retaliation on the part of perpetrators) and three subsidiary factors (methods of …
Economists, Value Judgments, And Climate Change: A View From Feminist Economics, Julie A. Nelson
Economists, Value Judgments, And Climate Change: A View From Feminist Economics, Julie A. Nelson
Economics Faculty Publication Series
A number of recent discussions about ethical issues in climate change, as engaged in by economists, have focused on the value of the parameter representing the rate of time preference within models of optimal growth. This essay examines many economists' antipathy to serious discussion of ethical matters, and suggests that the avoidance of questions of intergenerational equity is related to another set of value judgments concerning the quality and objectivity of economic practice. Using insights from feminist philosophy of science and research on high reliability organizations, this essay argues that a more ethically transparent, real-world-oriented, and flexible economic practice would …

K-Sketch: A 'Kinetic' Sketch Pad For Novice Animators, Richard C. Davis, Brien Colwell, James A. Landay
Research Collection School Of Computing and Information Systems
Because most animation tools are complex and timeconsuming to learn and use, most animations today are created by experts. To help novices create a wide range of animations quickly, we have developed a general-purpos informal, 2D animation sketching system called K-Sketch. Field studies investigating the needs of animatorsnd would-be animators helped us collect a library of usage scenarios for our tool. A novel optimization technique enabled us to design an interface that is simultaneously fast, simple, and powerful. The result is a pen-based system that relies on users’ intuitive sense of space and time while still supporting a wide range …

Study Design.
In vivo study of anterior discectomy and fusion using a bioresorbable 70:30 poly(l-lactide-co-d,l-lactide) interbody implant in an ovine model.
Objective.
To evaluate the efficacy of the polylactide implant to function as an interbody fusion device, and to assess the tissue reaction to the material during the resorption process.
Summary of Background Data.
The use of polylactide as a cervical interbody implant has several potential advantages when compared with traditional materials. Having an elastic modulus very similar to bone minimizes the potential for stress shielding, and as the material resorbs additional loading is transferred to the developing fusion mass. …

Imag(In)Ing September 11: Ward Churchill, Frame Contestation, And Media Hegemony, Erika G. King, Mary Deyoung
Peer Reviewed Articles
This study analyzes the Denver Post’s reportage on the frame contest between the dominant narrative of the September 11 terrorist attacks set out by President Bush and a challenge to that narrative in an Internet essay by Professor Ward Churchill. The authors find that by refusing to interrogate Churchill’s sociopolitical argument, reducing it to the offensive rhetorical trope “little Eichmanns” he used to describe the victims of the attacks, and pillorying Churchill as a person and scholar, the Post assured his counterframe would not achieve parity with the dominant frame. The authors interpret this as an example of media …
When Do Facts Persuade? Some Thoughts On The Market For “Empirical Legal Studies”, Elizabeth Chambliss
When Do Facts Persuade? Some Thoughts On The Market For “Empirical Legal Studies”, Elizabeth Chambliss
Law and Contemporary Problems
Chambliss talks about how Marc Galanter has devoted himself to combating the "jaundiced view" of the civil-justice system. Armed initially with great faith in the power of social science, Galanter and other socio-legal scholars of his generation, as well as many who have followed, have tried to combat misinformation in law and policy with the findings from systematic research--as if the facts would speak for themselves.

Justice In Many Rooms Since Galanter: De-Romanticizing Legal Pluralism Through The Cultural Defense, Mitra Sharafi
Law and Contemporary Problems
Sharafi explores the emergence of legal pluralism during 1970s and 80s and discusses its relation in the cultural defense. Legal pluralism was more than a methodological stance intended to help lawyers and anthropologists talk to each other; it was an ideological commitment. In the 1980s, scholars like Marc Galanter and Sally Merry inaugurated the legal-pluralist sequel to the "what-is-law" debate between legal positivists and natural-law advocate. There are two major changes in the conception of legal pluralism brought about by the works of Galanter and his colleagues. The first was the shift from the understanding of legal pluralism as a …
Legal Theoretic Inadequacy And Obesity Epidemic Analysis, David Yosifon
Legal Theoretic Inadequacy And Obesity Epidemic Analysis, David Yosifon
Faculty Publications
This Article explores crucial analytic and normative limitations in presently dominant and ascendant approaches to legal theory. The approaches' failure to provide a satisfying framework for analyzing the obesity epidemic presently raging undeterred in American society reveals these limitations. Conventional law and economics scholars writing on the subject have deployed familiar frameworks to reach predictable conclusions that are neither intellectually nor morally justifiable. This Article argues that recent theoretical innovations promulgated within the burgeoning law and behavioralism movement have thus far provided no more reliable a framework for legal analysis of the obesity epidemic than has conventional law and economics. …

A Carboxyl-Terminal Sequence In The Lutropin Β Subunit Contributes To The Sorting Of Lutropin To The Regulated Pathway, Albina Jablonka-Shariff, Christopher A. Pearl, Anna Comstock, Irving Boime
Peer Reviewed Articles
Although synthesized in the same pituitary gonadotropes, the secretion profiles of lutropin (LH) and follitropin (FSH) differ. LH is secreted through a regulated pathway and associated with a bolus release at mid-estrous cycle. In contrast, the majority of FSH is secreted constitutively with an incremental increase until ovulation. Both share an identicalα subunit, and thus theβ subunit contains determinants for sorting into the regulated pathway. Previously, we demonstrated that a hydrophobic carboxyl-terminal heptapeptide of the LHβ subunit (Leu-Ser-Gly-Leu-Leu-Phe-Leu), not found in the FSHβ subunit, influences the intracellular behavior of the LH dimer. To test the hypothesis that the peptide contributes …

Community Response To Habitat Restoration In Sickle And Bear Creeks, With Emphasis On Mottled Sculpin In Sickle Creek, Jason Andrew Deboer
Masters Theses
Habitat restoration is employed by biologists and managers to improve the natural functionality and value of aquatic resources. Systems suffer impairment from many sources, including excessive fine sediment, which negatively affects substrate composition, channel morphology, aquatic invertebrate habitat, and fish reproduction and recruitment. Primary objectives included monitoring the biophysical response to sediment abatement in the Big Manistee River watershed. Secondary objectives included (1) placing the biophysical response to the restoration in the context of a much larger watershed plan, (2) quantifying seasonal mottled sculpin movement and habitat use in Sickle Creek for 1-year, and (3) determining habitat variables which may …

To determine the role of Ca2+ signaling in activation of the Mitogen-Activated Protein Kinase (MAPK) pathway, we subjected MC3T3-E1 pre-osteoblastic cells to inhibitors of Ca2+ signaling during application of fluid shear stress (FSS). FSS only activated ERK1/2, rapidly inducing phosphorylation within 5 min of the onset of shear. Phosphorylation of ERK1/2 (pERK1/2) was significantly reduced when Cai2+ was chelated with BAPTA or when Ca2+ was removed from the flow media. Inhibition of both the L-type voltage-sensitive Ca2+ channel and the mechanosensitive cation-selective channel blocked FSS-induced pERK1/2. Inhibition of phospholipase C with U73122 significantly reduced …

Fat embolism syndrome is a rare complication occurring in 0.5 to 2% of patients following a long bone fracture. It is believed to be caused by the toxic effects of free fatty acids. Diagnosis is clinical, based on respiratory, cerebral and dermal manifestations. Treatment is only supportive, directed mainly at maintaining respiratory functions.

Why some invasive plant species transmogrify from weak competitors at home to strong competitors abroad remains one of the most elusive questions in ecology. Some evidence suggests that disproportionately high densities of some invaders are due to the release of biochemicals that are novel, and therefore harmful, to naïve organisms in their new range. So far, such evidence has been restricted to the direct phytotoxic effects of plants on other plants. Here we found that one of North America's most aggressive invaders of undisturbed forest understories, Alliaria petiolata (garlic mustard) and a plant that inhibits mycorrhizal fungal mutualists of North …

Not Just For Children's Television: Anime And The Changing Editing Practices Of American Television Networks, Laurie Cubbison
Reconstruction: Studies in Contemporary Culture
[First paragraph]
Each fall season brings a new set of cartoons to children's television, and over the past several years more and more of these cartoons are coming from Japan. While Japanese animation serves as the medium for television series and movies aimed at everyone from very young children to adult men and women, the primary American animation audience is still considered to be young boys, even with the advent of animation blocks aimed at older viewers. As a result, anime that is aired on American television has often been edited in order to appeal to that audience and to …

Technological Determinism And The Poisoned Apple: The Case Of Snow White And The Seven Dwarfs, Sean Chadwell
Reconstruction: Studies in Contemporary Culture
[First paragraph]
Writing about animation - especially for popular audiences - traditionally has sublimated its celebration of the anarchic illusionism of early cartoons to descriptions of technology and precise factory-like production processes; this becomes especially clear in historical narratives that address Disney's multiplane camera or Fleischer's Rotoscope. Often this kind of discourse appears in accounts of mechanical production in animation studios themselves, principally those accounts that locate narrative developments - and even narrative "advances" - in cartoons in the context of such emerging technologies. And cartoons frequently narrativize a similar preoccupation with the uneasy relationship between technology, labor, and creativity …
