The Pluralistic Universe Of Law Towards A Neo-Classical Legal Pragmatism, Susan Haack

After a brief sketch of the history of philosophical pragmatism generally, and of legal pragmatism specifically (section 1), this paper develops a new, neo-classical legal pragmatism: a theory of law drawing in part on Holmes, but also on ideas from the classical pragmatist tradition in philosophy. Main themes are the "pluralistic universe" of law (section 2); the evolution of legal systems (section 3); the place of logic in the law (section 4); and the relation of law and morality (section 5).

Non-suicidal self-injury (NSI) represents a growing area of concern in a variety of clinical settings, yet remains a poorly understood phenomenon. An influx of research on the functions of NSI over the past decade has suggested a biopsychosocial emotional regulation model of this behavior. This model proposes that self-injurers engage in NSI to reduce negative emotions, and presupposes that self-injurers are characterized by emotional dysregulation. The present study evaluated the biological component of this model by assessing hypothalamic-pituitary-adrenocortical axis (HPAA) functioning in a group of self-injurers(n=26) and non-injuring healthy controls (n=28). Pharmacognostical parameters for the leaves of Tridax procumbens L. were studied with the aim of drawing the pharmacopoeial standards for this species. Macroscopical and microscopical characters, physico-chemical constants, extractive values, fluorescence analysis of dry powder and its reaction after treatment with chemical reagents under visible light and UV light at 254 nm and 366 nm were studied. The pericarp of Punica granatum Linn. has been commonly employed as a crude drug in Indian traditional medicine for the treatment of diarrhoea as well as for use as an astringent, antihelminthic, asphrodisacs, laxative, diuretic, stomachic, cardiotonic and refrigerant. Antibacterial activity of P. granatum pericarp extracts was evaluated against ten Gastro Intestinal Tract (GIT) infection causing bacterial strains using paper disc agar diffusion method. The result indicated that the extracts obtained from P. granatum pericarp exhibited antimicrobial activity against all organisms except the crude extract used against Pseudomonas aeruginosa. The immunomodulatory properties of coconut protein were investigated in Swiss albino mice by immune suppressed with cyclophosphamide (CP). CP is a commonly used anti-cancer drug which causes toxicity by its reactive metabolites such as acrolein and phosphoramide mustard. In this study, the animals were grouped into four of 6 mice per group. Assessment of immunomodulatory activity was carried out by testing the RBC, WBC, Platelet and differential counts. Two golf courses in the Bloomington-Normal community in central Illinois were tested for nitrate and phosphate concentrations in their ponds. One golf course (The Den) is Audubon International certified while the other golf course (Ironwood) is not. This study tries to establish if differing environmental management practices can contribute to significantly different concentrations of nutrients. It was determined that the nitrate concentration was higher at the non-certified golf course, while the phosphate concentrations at both courses were essentially negligible. Constructed wetlands for wastewater treatment have become a sustainable alternative to environmentally harmful traditional wastewater treatment methods. This case study evaluated the Schroeder Wildlife Sanctuary, a wetland area constructed for removal of nutrients from wastewater. An environmental evaluation of the wetland was completed that addressed three parameters: the water quality of wetland effluent, the avian biodiversity within the sanctuary, and an assessment of community outreach and education initiatives. Water quality testing was conducted using rudimentary LaMotte and Hach testing kits. The data was contrary to the literature and showed no nutrient removal occurring. The degree attainment of college students is a critical issue that institutions of higher education are considering. Colleges want to improve their retention, progression, and graduation rates for all students. Over the past decades men, based on the literature reviewed, have earned fewer degrees than women. In addition, men are not enrolling in college at the same rates as women. This study uses the NELS Database to analyze the factors that contribute to the degree attainment of men. Determining the occurrence and potential adverse effects of antibiotic pharmaceuticals released into the environment is a critical step towards responsible environmental stewardship. Under aqueous conditions typically found in soils and natural waters, the antibiotic agent sulfamethoxazole (SMX) was transformed in the presence of pyrolusite MnO2 via oxidative pathways. At least 50% loss of SMX was observed after 269 hr in acidic and basic solutions (pH 3-9). A maximum of 100% loss was recorded at pH 3 and 66% loss was recorded at circumneutral pH. This Essay examines the methodological upheaval created by the quartet of constitutional election law cases decided during October Term 2007. Prior to this Term, the ascendant analytic approach called for a threshold characterization of the burden on the plaintiff's rights, which characterization determined whether the court would apply strict scrutiny or lax, rational-basis-like review. The characterization was generally formal in nature. We explored distributions of Asian nuthatch species in ecological and geographic space using ecological niche modeling based on occurrence data associated with specimens and observations. Nuthatches represent a well-defined clade occurring throughout the Northern Hemisphere, but are most diverse in southern Asia where 15 of the 24 species occur and where the lineage is believed to have evolved. Species richness was focused in a narrow east-west band corresponding to the forested parts of the Himalayas with a maximum number of nine species predicted present in these foci. Fort St. Joseph is a 17th-18th century French (and later English) mission-garrison-trading post complex located in southwest Michigan. A geophysical survey was performed and the results of the survey were tested through archaeological excavation. The geophysical methods included ground penetrating radar, electromagnetic induction, electrical resistivity, magnetic gradiometry, and magnetic susceptibility. The results of the archaeological excavations demonstrate that magnetic gradiometry was the preferred geophysical method at this particular site. The magnetic gradiometer survey included both terrestrial and possible submerged portions the site. Laboratory analysis of the magnetic susceptibility and magnetic viscosity of soils and rocks demonstrated that the archaeological features …

Previous studies in fire visualization have required high end computer hardware and specialized technical skills. This study demonstrated fire visualization is possible using Visual Nature Studio and standard computer hardware. Elevation and vegetation data were used to create a representation of the New Jersey pine barren environment and a forest compartment within Hobcaw Barony. Photographic images were edited to use as image object models for forest vegetation. The FARSITE fire behavioral model was used to model a fire typical of that area. Identifying the initial sugar sensing and response activating mechanisms in plants has been difficult due to the dual functions of sugars as nutrients and as signaling molecules. In this study, we have examined transcript expression and promoter features of different genes encoding proteins for actin remodeling that have been implicated as targets of plant glucose signaling. Using Reverse Transcription PCR analysis, we confirmed that expression of two actin-associated genes, actin depolymerizing factor 9 (ADF9) and actin related protein 8 (ARP8), are repressed following a short-term glucose treatment of Arabidopsis thaliana seedlings. On the other hand, starch films are often limited by their poor mechanical properties, and water resistance. The addition of montmorillonite clays have improved these properties in both petroleum and biodegradable films.

Confessions have historically been the most compelling evidence the state could offer at a criminal trial. However, improvements in forensic technologies have led to increased use of scientific evidence, such as DNA typing, videotapes, pattern-recognition software, location tracking devices, and the like, with very impressive rates of reliability. The reliability of these methods has become so impressive, in fact, that it far outstrips confessions. This should lead to a reduced reliance on confessions (and other nonscientific evidence, such as eyewitness identifications) over time.
