Is That All There Is? "The Problem" In Court-Oriented Mediation, Leonard L. Riskin, Nancy A. Welsh Jun 2008

Is That All There Is? "The Problem" In Court-Oriented Mediation, Leonard L. Riskin, Nancy A. Welsh

UF Law Faculty Publications

The alternative process of mediation is now well-institutionalized and widely (though not universally) perceived to save time and money and satisfy lawyers and parties. However, the process has failed to meet important aspirations of its early proponents and certain expectations and needs of one-shot players. In particular, court-oriented mediation now reflects the dominance and preferences of lawyers and insurance claims adjusters. These repeat players understand the problem to be addressed in personal injury, employment, contract, medical malpractice and other ordinary civil non-family disputes as a matter of merits assessment and litigation risk analysis. Mediation is structured so that litigation issues …

Harnessing The Power Of Science In Environmental Law: Why We Should, Why We Don't, And How We Can, Mary Jane Angelo

UF Law Faculty Publications

To illustrate how legal scholars, lawmakers, environmental agencies, and practicing lawyers have attempted to incorporate new scientific developments into environmental law, particularly in the administrative context, this Article traces the journeys of three distinct scientific developments -- risk assessment, adaptive management, and emergy synthesis -- from scientific academia to environmental administrative law. The Article concludes by making observations about what types of scientific developments are most likely to be incorporated into the law and suggesting ways for improving the likelihood that new beneficial developments will be adopted to inform the law.

Qualitative Nature Of Some Traditional Crude Drugs Available In Commercial Markets Of Mumbai, Maharashtra, India, S. Ganesan, Roopam Y. Bhatt

Ethnobotanical Leaflets

Medicinal plants have been used since ancient times for the treatment of human ailments. Interest in medicinal plants has been shown throughout the world because of the safe and effective constituents of plant products. The increasing demand for herbal medicines, both in the developing and developed countries, has provided the stimulus for the workers in this field to maintain the quality and purity of their herbal raw materials and finished products. The standardization problem relating to herbal drugs arises from the complex composition of drugs that are used in the form of whole plants, plant parts or extracts obtained there …

Swertia L. (Gentianaceae) In Nepal Himalaya: Checklist, Phytogeography, Ethnobotany And Conservation Status, Kunjani Joshi, Ananda Joshi

Ethnobotanical Leaflets

Swertia L., a morphologically diverse but taxonomically distinct genus’s circumscription has often been debated. Four problems still need to be solved: species delimitation, section delimitation, and relation with allied genera and domestication of the species for economic benefits. In the present paper an attempt has been made to prepare a checklist of Swertia species, and documentation of distribution patterns, existing ethnobotanical uses and conservation practices in Nepal. Some integrated measures, which might help to fill up the gaps in our knowledge, are also recommended.

Free Radical Scavenging Activity Of Folklore: Pithecellobium Dulce Benth. Leaves, M. Sugumaran, T. Vetrichelvan, S. Darlin Quine

Ethnobotanical Leaflets

In the present study, the aqueous and alcoholic extract of Pithecellobium dulce leaves were evaluated for radical scavenging activity using reducing power assay method. Aqueous extract showed potent free radical scavenging activity, than alcohol extract. The observed activity could be due to higher phenolic content in the extracts (0.2171& 0.2042 mg/g in aqueous and alcohol extract respectively). HPTLC fingerprint profile of the ethanol and aqueous extracts were developed which would serve as reference standard for quality control of these extracts

Preliminary Phytochemical And Anti-Bacterial Studies On Passiflora Edulis, M. Johnson, Muthia Maridass, V. Irudayaraj

Ethnobotanical Leaflets

Preliminary phytochemical and antibacterial activity of the leaf and callus of Passiflora edulis Sims, were examined using extracts of benzene, methanol, ethanol, isopropanol, chloroform and petroleum ether. Of these, chloroform extract of the leaf and callus showed the maximum solubility and antimicrobial activity with the MIC ranging from 100 to 250 µl. Extracts of benzene, petroleum ether and isopropanol were ineffective in inhibiting the selected bacteria. In addition, this phytochemical study confirmed the presence of alkaloids, saponins, tannins and triterpenes from ethanol and chloroform extracted sources.

Ethnobotanical Leaflets

The emphasis of this paper is upon the sensitivity of the crude leaf extracts of Melia azedarach against some of the hospital isolated human pathogenic bacterial strains. Five plant extracts (Petrol, Benzene, Methanol, Ethyl acetate and Aqueous) under five different concentrations (1mg/ml, 2mg/ml, 5mg/ml, 10mg/ml and 15mg/ml) were tested by the Disk diffusion method. Methanol, Ethyl acetate and Aqueous extracts of the plant showed significant inhibition against bacteria tested. A comparison was made among the sensitivity demonstrated by the leaf extracts and known medicinal and ethnobotanical uses.

Performing Art: National Endowment For The Arts V. Finley, Randall P. Bezanson Jun 2008

Performing Art: National Endowment For The Arts V. Finley, Randall P. Bezanson

Federal Communications Law Journal

In this modified version of a chapter in his forthcoming book, ART AND FREEDOM OF SPEECH (Univ. of Illinois Press, 2008-09), Professor Bezanson begins to probe the nature of art and its relation to the first amendment free speech guarantee. The essay uses the Finley v. NEA case, and specifically its discussion of Finley's performance art, to critique the Supreme Court's very approach to the Finley case, and to view the issues from the perspective of art, artistic freedom, and the Supreme Court's role in fashioning constitutional protection for art as art, and not simply as cognitive speech.

Mistake And Disclosure In A Model Of Two-Sided Informational Inputs, Michael J. Borden Jun 2008

Mistake And Disclosure In A Model Of Two-Sided Informational Inputs, Michael J. Borden

Missouri Law Review

This paper will examine some theoretical aspects of contractual non-disclosure and the related doctrine of unilateral mistake. These two legal rubrics are conceptually similar; each is concerned with the degree to which parties must communicate their understandings about the nature of the contract into which they are about to enter. If one party fails to reveal enough information, the other party may enter into the agreement under a misunderstanding and consequently may attempt to avoid contractual liability on the basis of mistake or on a theory of nondisclosure. The law of contracts clearly attaches a great deal of importance to …

Written Solutions Of Mathematical Word Problems, Marcia J. Smith Jun 2008

Written Solutions Of Mathematical Word Problems, Marcia J. Smith

Action Research Projects

In this action research study of my classroom of ten ninth grade algebra students, I investigated how my students expressed written solutions of mathematical word problems. I discovered that my students writing and performance improved as they experienced different strategies to attack problem solving. These experiences helped improve the confidence of my students in their problem solving skills and in their mathematical writing. I also discovered that my teaching style changed, as my students took on more responsibility for their learning. As a result of this research, I plan to implement problem solving activities in all my classrooms next year. …

Water sample quality data were collected from The Water Resource Department of Eritrea and water quality reports indicated that high levels of fluoride content were found for some villages' groundwater sources. The highest concentration was found in Aquar, 7.7 mg/L; Northern Red Sea region, above the 1.5 mg/L Maximum concentration recommended by The World Health Organization.

Waters with high fluoride concentrations occur in …

Skeletal Abnormalities In Mice Lacking Extracellular Matrix Proteins, Thrombospondin-1, Thrombospondin-3, Thrombospondin-5, And Type Ix Collagen, Karen L Posey, Kurt Hankenson, Alka C Veerisetty, Paul Bornstein, Jack Lawler, Jacqueline T Hecht Jun 2008

Skeletal Abnormalities In Mice Lacking Extracellular Matrix Proteins, Thrombospondin-1, Thrombospondin-3, Thrombospondin-5, And Type Ix Collagen, Karen L Posey, Kurt Hankenson, Alka C Veerisetty, Paul Bornstein, Jack Lawler, Jacqueline T Hecht

Faculty, Staff and Student Publications

Thrombospondin-5 (TSP5) is a large extracellular matrix glycoprotein found in musculoskeletal tissues. TSP5 mutations cause two skeletal dysplasias, pseudoachondroplasia and multiple epiphyseal dysplasia; both show a characteristic growth plate phenotype with retention of TSP5, type IX collagen (Col9), and matrillin-3 in the rough endoplasmic reticulum. Whereas most studies focus on defining the disease process, few functional studies have been performed. TSP5 knockout mice have no obvious skeletal abnormalities, suggesting that TSP5 is not essential in the growth plate and/or that other TSPs may compensate. In contrast, Col9 knockout mice have diminished matrillin-3 levels in the extracellular matrix and early-onset osteoarthritis. …

Black Women, Beauty, And Labor: Towards An Archaeology Of African-American Women In Indianapolis, Indiana, Genesis M. Snyder Jun 2008

Black Women, Beauty, And Labor: Towards An Archaeology Of African-American Women In Indianapolis, Indiana, Genesis M. Snyder

Masters Theses

For two consecutive summers (2002 and 2003), I conducted fieldwork in the Ransom Place Archaeology neighborhood on the near Westside of Indianapolis, Indiana. I found myself increasingly drawn to the material culture left behind by the African-American women who had lived in the area roughly 100 years ago. Such material culture begs many questions: What social and political forces influenced the construction of African-American women's understandings of self in the early twentieth century? Who was responsible for the construction and dissemination of beauty ideals, notions about women's work, and how did those ideals differ across the color line? Using as …

The Possibility Of Producing Biodiesel Fuel From Wood Pulping By Products, Yan Pu Jun 2008

The Possibility Of Producing Biodiesel Fuel From Wood Pulping By Products, Yan Pu

Masters Theses

Biodiesel fuel produced from biomass material is a renewable and promising substitute fuel for petroleum diesel fuel, and it is relatively environmentally friendly. The Pulping process involves a huge amount of lignocellulosic materials. There may be a great potential of combining this fact with the biodiesel production, as well as the present biodiesel technologies.

This thesis focuses on the esterification reaction behavior of three main components of tall oil fatty acids, which are byproducts of paper manufacture. They are stearic acid, palmitic acid and oleic acid. Three levels of both catalyst and methanol were employed in the esterification for each …

The Architecture Of Instructional Theory, Andrew S. Gibbons, Clint P. Rogers Jun 2008

The Architecture Of Instructional Theory, Andrew S. Gibbons, Clint P. Rogers

Faculty Publications

This chapter joins a discussion of instructional theory that has been ongoing for nearly a century. It departs in some ways from prior discussions: (1) it considers instructional theory as a species of technological theory rather than as a type of scientific theory, a view expressed more fully elsewhere (Gibbons, 2003a), (2) it adopts the viewpoint articulated in earlier chapters of this book that there are multiple distinct bodies of technological theory that pertain to the work of instructional designers, (3) it attempts to articulate a particular view of the nature of two of those bodies of theory by describing …

Alaska's Pavlof Volcano Ends 11-Year Repose, Christopher F. Waythomas, Stephanie G. Prejean, Stephen R. Mcnutt Jun 2008

Alaska's Pavlof Volcano Ends 11-Year Repose, Christopher F. Waythomas, Stephanie G. Prejean, Stephen R. Mcnutt

School of Geosciences Faculty and Staff Publications

After an 11-year period of repose, Pavlof volcano on the Alaska Peninsula (Figure 1) began an episode of Strombolian eruption lasting 31 days, from 14 August to 13 September 2007.

The eruption began abruptly on 14 August after a minor increase in seismicity the previous day. Nearly continuous lava fountaining, explosions, and lahars caused by minor disruption of the ice and snow cover on the volcano characterized the eruption. The eruption also produced diffuse ash plumes that reached 5–6 kilometers above sea level, but the plumes were too small and did not extend high enough to affect local or regional …
