Critical evaluations of audio mash-ups and remixes tend to congregate around two poles. On the one hand, these often clever recombinations of recorded music are celebrated as innovative and creative interventions in the material of bland commodity culture. On the other hand, they are often reviled as derivative, inauthentic, and illegal because they do nothing more than appropriate and reconfigure the intellectual property of others. This essay does not side with either position but identifies and critiques the common understanding and fundamental assumptions that make these two, opposed positions possible in the first place. A bedrock principle of patent law is that an applicant must sufficiently disclose the invention in exchange for the right to exclude. The essential facet of the disclosure requirement is enablement, which compels a patent applicant to enable a person having ordinary skill in the art (PHOSITA) how to make and use the full scope of the claimed invention without undue experimentation. Enablement problems may arise when the applicant claims an invention broadly with a dearth of supporting data or examples. This is problematic in unpredictable fields like chemistry because a PHOSITA often needs a specific and detailed teaching in …

In the Spring 2008 issue of the Tennessee Law Review, I wrote an essay questioning whether Tennessee's merit system for selecting appellate judges - the Tennessee Plan - satisfies the requirements of the Tennessee Constitution. The Tennessee Constitution requires all judges to be elected by the qualified voters of the state, yet, under the Plan, all appellate judges are initially selected by gubernatorial appointment and then retained in uncontested referenda. I argued that both the appointment and retention features of the Plan are unconstitutional, and I recommended that the legislature refuse to reauthorize the Plan when it expires in June …

The metaphor of a “living” Constitution imports terms from biology into law and, in the process, relies on biology for its meaning. A proper understanding of biology is therefore central to understanding the idea of “living” constitutionalism. Yet despite its rampant use by both opponents and proponents of living constitutionalism, and despite the current fervent debate over whether biology can be useful to the law, no one has evaluated the metaphor from a biological perspective. Among the many cutting edge technologies law enforcement agencies increasingly covet is radio frequency identification ("RFID"). Researchers predict RFID will become the most pervasive computer technology in history. Among the more extraordinary and controversial government uses of RFID-and the focus of this Paper-include implantation of subdermal RFID transmitters. Privacy concerns abound. Not surprisingly, critics and privacy advocates are wary of subdermal RFID implants, fearful that only afine line separates relatively innocuous, voluntary implantation from arbitrary government-mandated implantation. In the last generation, executives have engaged in a sort of moral arbitrage, replacing fiduciary with market norms to justify allocating to themselves an ever-increasing share of the corporate pie. The private equity sector has taken this process to its logical conclusion; it has completely abandoned the notion that corporate office brings with it obligations. Instead, it openly celebrates self-enrichment over institution building or public service. Unfortunately, corruption is just as corrosive in the private sector as in the public sector. We present in this paper an investigation of a special class of wireless sensor networks for monitoring critical infrastructures that may extend for hundreds of miles in distances. Such networks are fundamentally different from traditional sensor networks in that the sensor nodes in this class of networks are deployed along narrowly elongated geographical areas and form a chain-type topology. Based on careful analysis of existing sensor network architectures, we first demonstrate the need to develop new architecture and networking protocols to match the unique topology of chain-type sensor networks. This investigation focused on the study of Hambre Cero (meaning “Zero Hunger”), an anti-poverty program funded by the Nicaraguan government which gives voucher packages to poor rural women. Items given include pregnant cows, pigs, chickens, seeds, and technical assistance with the goal of generating profit for use by the families and women’s cooperatives. Chemosignaling – passing information by means of chemical compounds that can be detected by members of the same species – is a very important form of communication for most mammals. Flying fox males have odiferous marking secretions on their neck-ruffs that include a combination of secretion from the neck gland and from the urogenital tract; males use this substance to establish territory, especially during the mating season. The prevalence of coral disease appears to be increasing worldwide, although little is known about how these diseases are transmitted between coral colonies. To examine whether corallivorous fishes could potentially act as disease vectors, this study examined whether and which fish species feed on diseased coral, and whether these fishes actively target diseased coral sections. Branches of Acropora muricata with brown band disease were filmed in the field, and bites taken by fishes on different sections of the coral (live tissue, tissue margin, disease band, dead skeleton, and algae) were recorded. Taking into consideration past history of the area this report aims to examine the views of Hinchinbrook Area boaters and fishermen regarding conservation initiatives and indigenous hunting. A combination of surveying local boaters using a questionnaire and interviews conducted with local experts and people involved in dugong conservation resulted in both numeric results and many personal opinions.

Conservation initiatives include voluntary speed guidelines, voluntary transit lanes, and a Traditional Use of Marine Resource Agreement. Behavioral Disparities Between Two Troops Of Lemur Catta That Occupy Different Habitats, Laura Saucier

The present study was conducted during the early wet season at Berenty Private Reserve. It investigates behavioral disparities between two troops of Lemur catta that occupy different habitats—gallery forest and scrub. Methods included density and phenology analysis to evaluate relative food availability in each territory. Behavioral observations were collected across eleven full-day troop follows. Results show extensive, statistically significant differences between behavior in the gallery and the scrub, many of which can be explained by relative food abundance within a troop’s home range. Some trends included greater intra-troop discord and fewer inter-troop conflicts in the scrub. In addition, the troops …

The women’s artisan group, Kilombo do Kioiô, part of the Ação Social da Paróquia Sao Bras (Sao Bras Parochial Social Action Group) in the neighborhood of Plataforma, Salvador, Bahia, works to insert poor Afro-Brazilian women into the economic market and wider society. This community of women is struggling to survive in a society in which they are marginalized by their gender, race and socio-economic position. They are also struggling to survive two types of violence that are pervasive in Plataforma: domestic violence and violence related to drug trafficking.

“How Can I Stay Silent?”: One Woman’S Struggles For Environmental Justice In Lesotho, Yvonne A. Braun

Journal of International Women's Studies

This article explores one woman’s activism in the context of a large scale dam and infrastructure project in Southern Africa. Since 1986, Lesotho and South Africa are building one of the largest multi-dam water schemes in the world, the Lesotho Highlands Water Project (LHWP). Local communities impacted by the LHWP face resettlement, increased risk of impoverishment, and changed access to natural resources. Much like with other projects of this type and scale (Scudder, 2006), the multidimensional costs of the $8 billion dollar World Bank funded water scheme will fall hardest on rural women.
