Ideological Cohesion And Precedent (Or Why The Court Only Cares About Precedent When Most Justices Agree With Each Other), Neal Devins

Faculty Publications

This Article examines the profound role that ideological cohesion plays in explaining the Supreme Court's willingness to advance a coherent vision of the law - either by overruling precedents inconsistent with that vision or by establishing rule-like precedents intended to bind the Supreme Court and lower courts in subsequent cases. Through case studies of the New Deal, Warren, and Rehnquist Courts, this Article calls attention to key differences between Courts in which five or more Justices pursue the same substantive objectives and Courts which lack a dominant voting block. In particular, when five or more Justices pursue the same substantive …

Hearts, Minds, Hands: A Dream Team For Mental Health, Julianne Gold Brunson, Judy Molner, Miriam Nathan Lerner

Articles

Interpreting in a mental health setting with hearing staff members and deaf clientele, the ethical situations fly fast and furious, providing the interpreter with a wealth of war stories with which to regale neophyte students of this dynamic profession. Much has been written to improve the many and varied mental health services being extended to deaf populations. The most commonly described dyads are that of hearing therapist and deaf patient. However, consider the case of a deaf psychologist treating hearing clients. In this instance, the interpreter becomes the liaison between the deaf professional and the hearing patient. When an interpreter …

Jagannath's Saligram: On Bruno Latour And Literary Critique After Postcoloniality, Amit Ray, Evan Selinger Jan 2008

Jagannath's Saligram: On Bruno Latour And Literary Critique After Postcoloniality, Amit Ray, Evan Selinger

Articles

Bruno Latour has turned to Indian vernacular fiction to illustrate the limits of ideology critique. In examining the method of literary analysis that underlies his appropriation of postcolonial history and culture, we appeal to Edward Said's notion of "traveling theory" in order to discuss critically the aesthetic as well as political stakes of using the technology of the modern novel for the allegorical purposes that Latour has in mind. We argue that Latourian analysis fails to uphold its own rigorous aspirations when it reduces complex literary and cultural representation to universal allegory.

The Pillar Of The World: The Eschatological Role Of The Seventh Antediluvian Hero In 2 (Slavonic) Enoch, Andrei Orlov Jan 2008

The Pillar Of The World: The Eschatological Role Of The Seventh Antediluvian Hero In 2 (Slavonic) Enoch, Andrei Orlov

Theology Faculty Research and Publications

The later Jewish mystical lore often portrays Enoch-Metatron as the
cosmic foundation sustaining the world or even as the pillar linking the
lower and upper worlds.
The current paper argues that the roots of this tradition about the
righteous antediluvian hero as the cosmic foundation of the world can be
detected already in 2 Enoch where Enoch is portrayed as the first fruit of
the future eschatological aeon of the righteous and the link between the
upper and the lower worlds.
Although in 2 Enoch the seventh antediluvian hero is never directly
named as either the foundation or the pillar, …

Can There Really Be "Free Speech" In Public Schools?, Richard W. Garnett Jan 2008

Can There Really Be "Free Speech" In Public Schools?, Richard W. Garnett

Journal Articles

The Supreme Court's decision in Morse v. Frederick leaves unresolved many interesting and difficult problems about the authority of public-school officials to regulate public-school students' speech. Perhaps the most intriguing question posed by the litigation, decision, and opinions in More is one that the various Justices who wrote in the case never squarely addressed: What is the "basic education mission" of public schools, and what are the implications of this "mission" for officials' authority and students' free-speech rights. Given what we have come to think the Free Speech clause means, and considering the values it is thought to enshrine and …

The Narrowing Of Knowing: What It Means To Be Literate And Learned In Today's Society, Thomas Smith Jan 2008

The Narrowing Of Knowing: What It Means To Be Literate And Learned In Today's Society, Thomas Smith

Journal of Inquiry and Action in Education

Currently, the idea and definition of learning and literacy is being pushed and pulled in competing directions. Current governmental policies, most notably embodied in the No Child Left Behind law, are pushing the definitions to mechanical enterprises aimed at the lowest common denominator. At the same time, the technology race is working to open access to being learned and literate to populations that are traditionally underrepresented in these arenas; however, at the same time, this technology is setting up new barriers that act to limit access. Finally, the student population of schools in the United States is quickly becoming the …

Analysis Of Wnt Signaling During Caenorhabditis Elegans Postembryonic Development, Samantha Van Hoffelen, Michael A. Herman Jan 2008

Analysis Of Wnt Signaling During Caenorhabditis Elegans Postembryonic Development, Samantha Van Hoffelen, Michael A. Herman

School of Biological Sciences: Faculty Publications

Wnts play a central role in the development of many cells and tissue types in all species studied to date. Like many other extracellular signaling pathways, secreted Wnt proteins are involved in many different processes; in C. elegans these include cell proliferation, differentiation, cell migration, control of cell polarity, axon outgrowth, and control of the stem cell niche. Perturbations in Wnt signaling are also key factors in cancer formation, and therefore of interest to oncobiologists. Wnts are secreted glycoproteins, which bind to Frizzled transmembrane receptors and signal either through, or independently of β-catenin. Both β-catenin-dependent (Wnt/β-catenin) and -independent pathways function …

Offender Profiling And Expert Testimony: Scientifically Valid Or Glorified Results?, James A. George Jan 2008

Offender Profiling And Expert Testimony: Scientifically Valid Or Glorified Results?, James A. George

Vanderbilt Law Review

A hallmark of Sherlock Holmes is his ability to solve complex crimes with well-staged performances. His flair for the shrewd and dramatic apprehension of a suspect in an inscrutable case often left his loyal companion Watson in awe, the local police investigators mystified, and the perpetrator thwarted. Holmes's admirers speculated that he must have had a special gift, maybe even psychic powers, which allowed him to solve any case. In reality, as Holmes always explained to his slow-witted companions, it was his insightful, rational, and logical approach to solving the mystery that inexorably led him to the solution.

Hiv, Hepatitis B And Hepatitis C Coinfection In Kenya, Reena Shah, Jane Karuru, Mark Nelson, Justin Stebbing Jan 2008

Hiv, Hepatitis B And Hepatitis C Coinfection In Kenya, Reena Shah, Jane Karuru, Mark Nelson, Justin Stebbing

Internal Medicine, East Africa

There are few data regarding hepatitis and HIV coinfection in Africa. In 378 HIV seropositive individuals in Nairobi, 23 (6%) were hepatitis B virus (HBV) and HIV coinfected, four (1%) were hepatitis C virus (HCV) and HIV coinfected and one patient was infected with all three viruses. Coinfected individuals were more likely to be men and older; a lack of HBV vaccination was a risk factor for HIV/HBV coinfection (PU0.001) and tenofovir containing regimens appeared most effective at reducing HBV viral load.

Shell Utilization Pattern By The Hermit Crab Isocheles Sawayai Forest And Saint Laurent, 1968 (Anomura, Diogenidae) From Margarita Island, Caribbean Sea, Venezuela, Lee A. Galindo, Juan A. Bolanos, Fernando L. Mantelatto

Gulf and Caribbean Research

Isocheles sawayai is a hermit crab that is occasionally mentioned in the literature, and recently its distribution was extended to Venezuelan waters. Because no information on the biology and shell use patterns of this species inhabiting Caribbean waters is available, we provide the first information on shell occupation patterns of I. sawayai from Venezuela. Specimens were collected monthly from January to December 2000 along the sandy shore of Margarita Island, Venezuela. The 942 specimens collected showed different shell use patterns between the sexes and according to the reproductive condition of the females. The gastropods Leucozonia nassa (37.37%), Engoniophos unicinctus (25.37%), …

Behavior Of An Escolar Lepidocybium Flavobrunneum In The Windward Passage As Determined By Popup Satellite Archival Tagging, D.W. Kerstetter, P.H. Rice, E.D. Prince

Gulf and Caribbean Research

In June 2003, fisheries research was conducted in the Windward Passage using a chartered commercial pelagic longline vessel (Rice and Snodgrass 2003). This paper describes the habitat use by an escolar in this location tagged with a pop-up satellite archival tag (PSAT) that remained attached to the fish for 14 d. Data recovered from the PSAT were used to directly document diel vertical migration and ambient temperature range for the first time in a mesopelagic teleost.

Still Life: A Dramaturgical Study Of A Vietnam War Play, Lauren Fajerski Jan 2008

Still Life: A Dramaturgical Study Of A Vietnam War Play, Lauren Fajerski

Electronic Theses and Dissertations

Emily Mann's play Still Life is a story of a Vietnam War veteran who returns home to a less than enthusiastic welcome. Like most veterans from this war, he struggles to come to terms with the atrocities he witnessed and even carried out himself. The play consists of three characters: Mark, a Vietnam veteran, Cheryl, his wife, and Nadine, his lover. Both women believe they intrinsically understand Mark, but neither truly can. Mark has returned from the war violent, irrevocably broken, and feeling that he has been abandoned by society. Emily Mann interviewed real people and transcribed their words into …

Sexuality And Courtships Of 19th Century Vienna Vs 21st Century America Through The Roles Of Alfred And Sam In Romance, Romance, James Haynie

Electronic Theses and Dissertations

For my thesis, I plan to research the sexuality and the process of courtship, and the differences between 19th century Vienna and modern America, specifically as to how it relates to my characters in Romance, Romance. My interest in the topic springs directly from the script. What I mean is, my initial idea of sexuality of the 19th century is very Victorian and straight-laced, where as I think of modern day as very sexually liberated. However, in the script, the first act, set in Vienna, is much more sexually explicit and active. In fact, the second act is all building …
