A Bulwark Against Anarchy: Affirmative Action, Emory Law School, And Southern Self-Help, William B. Turner

UC Law Journal of Race and Economic Justice

This article demonstrates that Pre-Start, Emory Law School's affirmative action program from 1966 to 1972, provides a useful case study for refraining the current debate around affirmative action in law school admissions. The author performs post-hoc strict scrutiny on Pre-Start, showing that it meets and exceeds the standard set in the leading affirmative action case, Grutter v. Bollinger. The historical context for Pre-Start demonstrates how similar the current arguments against affirmative action in law school admissions are to the arguments used against racial integration of public schools in the first half of the twentieth century. Tracking Human Faecal Contamination In Tropical Reservoirs In Puerto Rico, José A. Amador, David Sotomayor-Ramírez, Gustavo Martínez, Lixian Chen, Dave Bachoon

Using a combination of chemical and microbiological (culture-dependent and -independent) approaches, sources of human faecal contamination were identified in two water reservoirs in Puerto Rico - Guajataca and La Plata. Fluorescence from optical brighteners (OB) - commonly found in laundry detergents - was used as an indicator of contamination from septic systems and other household discharges. Traditional indicators of faecal contamination (e.g. Escherichia coli; faecal enterococci) were enumerated, and human faecal contamination was confirmed through detection of Bifidobacterium adolescentis utilizing polymerase chain reaction (PCR)-based analyses. Simultaneous Incubation By Two Females And Nestling Provisioning By Four Adults At A Savannah Sparrow Nest, Nathan J. Zalik, Noah G. Perlut

We present the first observations of misdirected parental care by Savannah Sparrows (Passerculus sandwichensis) including a rare occurrence of simultaneous incubation. Two females simultaneously incubated eggs, brooded, and fed nestlings, and two males fed nestlings in one nest. These behaviors may have been prompted by strong parental instincts in combination with a stressful breeding environment mediated by hayfield management, as any genetic benefits were unlikely.

Hall thrusters have been under active development around the world since the 1960’s. Thrusters using traditional propellants such as xenon have been flown on a variety of satellite orbit raising and maintenance missions with an excellent record. To expand the mission envelope, it is necessary to lower the specific impulse of the thrusters but xenon and krypton are poor performers at specific impulses below 1,200 seconds.

To enhance low specific impulse performance, this dissertation examines the development of a Hall-effect thruster which uses bismuth as a propellant. Bismuth, the heaviest non-radioactive element, holds many advantages over noble gas propellants from …

The human brain has the capability to determine a person's happiness, effectiveness, and positive relationships with others. This biographical study examined how a young woman diagnosed with Agenesis of the Corpus Callosum (ACC) and agenesis of the cerebellum came to live a productive, happy life. ACC is a low incidence form of brain damage marked by inconsistent behavioral and emotional manifestations throughout the lifespan. The main purpose of this research was to survey Pennsylvania school psychologists regarding their training, knowledge and evaluation practices when assessing and diagnosing Autism Spectrum Disorders (ASD). A 65 question electronic survey focusing on four areas: A) training, B) knowledge, C) current practice and D) demographic information, was distributed to 908 certified school psychologists in Pennsylvania and completed by 243 respondents. Results found that school psychologists in Pennsylvania play a key role with assessment and diagnosis of ASD, yet have limited formal training in important aspects of ASD. The current study focuses on the psychological effects of statin medications. Specifically, this study examines the health related beliefs and behaviors that may be altered by the consumption of this fast acting class of life saving drugs. Although the statin class of medication generally produces favorable physiological results, as evidenced by reduced levels of serum cholesterol, and in some case increases in high density lipoproteins, the health related belief system and heath related behaviors may actually be altered in a negative fashion by engendering a sense of overconfidence; this in turn may alter beliefs and diminish the importance of adhering …

This Review Essay explores the new politics of judicial appointments by addressing the important question whether Senate-specific reforms to the judicial appointments process are likely to succeed. In his recent book, The Next Justice, Chris Eisgruber proposes a two-part plan to repair the Supreme Court appointments process. Like many other scholars that have written in the area, Eisgruber's reforms focus primarily on the Senate. First, he proposes that the Senate get smart by asking penetrating questions about the judicial philosophy of Supreme Court nominees in an effort to ensure that the future Justices are moderates, rather than extremists. Unlike air and water pollution, pollution from dangerous solid and liquid wastes on land remains a relatively concentrated, active hazard for long periods of time. Uncontrolled, land pollution moves through the environment slowly and often without significant diminution of toxicity. Persistence, in fact, is often regarded as the defining quality of dangerous land pollutants. Hazardous and nuclear waste regulation is very much concerned with the problem of maintaining the isolation of solid and liquid materials over decades, centuries, and even millennia, and, the author argues, there is good reason to believe that waste management practices and institutions are not well …

This article examines the implications of the Michael Vick case for the criminal law in general and for the law of victimhood in particular. It takes as its point of departure the NFL star's agreement to pay close to one million dollars to the various entities that assumed custody of the pit bulls in order to "make restitution for the full amount of the costs associated with the disposition of all dogs" that were involved in his illegal operation.
