Constructing 'Health', Defining 'Choice': Legal And Policy Perspetives On The Post-Pgd Embryo In Four Jurisdictions, Estair Van Wagner, Roxanne Mykitiuk, Jeff Nisker

Articles & Book Chapters

Through Preimplantation Genetic Diagnosis, embryos created by IVF are selected for transfer to a woman based on particular characterisations, including the presence of genetic markers or a tissue match for a sibling. In this paper we examine the precise language used in the recent policy and regulatory documents of four jurisdictions (the United Kingdom, Australia, Canada and New Zealand) that in any way characterises the post-PGD embryo. We then explore the mutually constructed relationship between how that embryo is characterised and the purposes for which PGD is applied, as well as the types of uses to which the post-PGD embryo …

Are Eu Trade Sanctions On Burma Compatible With Wto Law?, Robert L. Howse, Jared M. Genser Jan 2008

Are Eu Trade Sanctions On Burma Compatible With Wto Law?, Robert L. Howse, Jared M. Genser

Michigan Journal of International Law

This Article will explore the European Union's approach to Burma. The European Union, until recently, has implemented quite limited trade sanctions against the Burmese junta. According to the most recent figures, E.U. countries still import €306 million ($454 million) of commodities and products, ninety-five percent of which are textiles, timber, gems, and precious metals. However, the Common Position of November 19, 2007, strengthens considerably E.U. measures against the Burmese regime and contains a ban on the importation of these goods from Burma. Further, the Common Position requires E.U. countries to prohibit intentional and knowing "participation" in activities that "directly or …

The Generative Structure Of Aboriginal Rights, Brian Slattery Jan 2008

The Generative Structure Of Aboriginal Rights, Brian Slattery

Articles & Book Chapters

Are aboriginal rights historical rights -- rights that gained their basic form in the distant past? Or are they generative rights -- rights that, although rooted in the past, have the capacity to renew themselves, as organic entities that grow and change? Section 35(1) of the Constitution Act, 1982 provides little guidance on the point, referring ambiguously to "existing aboriginal and treaty rights". In the Van der Peet case, decided in 1996, the Supreme Court of Canada characterized aboriginal rights primarily as historical rights, moulded by the customs and practices of aboriginal groups at the time of European contact, with …

The Human Dignity Of Clients, Katherine R. Kruse Jan 2008

The Human Dignity Of Clients, Katherine R. Kruse

Scholarly Works

This essay reviews David Luban's forthcoming book, Legal Ethics and Human Dignity. At the heart of this new book is an argument that interactions between lawyers and clients ought to be at the center of jurisprudential inquiry. Pointing out that most cases do not go to trial and that much transactional work occurs outside the litigation context, he argues that law's defining moments occur when a "client sketches out a problem and a lawyer tenders advice," rather than when a judge decides a litigant's case. This review essay examines how Luban might elaborate a new "jurisprudence of lawyering" by examining …

A Multiscale Approach To Breeding Habitat Model Development And Evaluation For The Common Loon, Gavia Immer, In New Hampshire, Usa, Anne Kuhn-Hines

Open Access Dissertations

The common loon, Gavia immer, is considered an emblematic and ecologically important example of aquatic-dependent wildlife in North America. The northern breeding range of loons has contracted over the last century, presumably as a result of habitat degradation from human disturbance and lake shore development. The common loon population in New Hampshire is distributed throughout the state and experiences a wide range of lake-specific habitats, water quality conditions, and varying levels of human disturbance. Identifying critical habitat that supports and enhances individual fitness for loons is an important component of loon conservation management. I used an empirical landscape-habitat modeling approach …

What We Have Here Is A Failure To Communicate: Using A Model To Explain Textbook Representations Of Human Evolutionary Theory, Ben Winegard Jan 2008

What We Have Here Is A Failure To Communicate: Using A Model To Explain Textbook Representations Of Human Evolutionary Theory, Ben Winegard

McNair Scholars Journal

In this paper we develop a general model to explain the hostility toward, and ignorance of, human evolutionary theory (ET) in the social sciences. We first provide relevant theoretical background explaining the basics of ET. We then briefly describe the history of, and reasons for, social science attacks against ET. After providing this background, we turn to our study of social science textbooks, describe the logic of our model, and specify four explicit predictions derived from it. Finally, we present the results of our study and discuss the significance of our findings.

The Extravaganza Awaits, Kathryn Lorraine Rodriguez Jan 2008

The Extravaganza Awaits, Kathryn Lorraine Rodriguez

Graduate Student Theses, Dissertations, & Professional Papers

Abstract The Extravaganza Awaits This paper addresses ideas in my thesis work, consisting of a series of paintings which evolved into installation. My ideas concern notions of spectacle, consumption of information, and self-gratifying selection. I lighten these ideas with humor and treat them with a carnivalesque aesthetic, appropriate to the absurdity that I see characteristic of them. Painting places the issues in a narrative context, but the story remains open- ended to allow the viewer to bring personal associations to the work. I specifically selected images of friends and family unfamiliar to the viewer and a lexicon of personal symbols …

Role Of Variant Sialylation In Regulating Tumor Cell Behavior, Faheem M. Shaikh Jan 2008

Role Of Variant Sialylation In Regulating Tumor Cell Behavior, Faheem M. Shaikh

All ETDs from UAB

Many different tumors have been documented to have elevated levels of the enzyme ST6Gal I, a Golgi glycosyltransferase that adds α2-6 sialic acids to glycoproteins. Concurrently, upregulated ST6Gal I is associated with metastasis and poor patient prognosis. We initially showed that HD3 colonocytes made to express oncogenic-ras, a common mutation in colon carcinoma, have increased expression of ST6Gal I and elevated α2-6 sialylated integrins. Having established that ras regulates ST6Gal I expression in colon epithelial cells, we found that colonocytes carrying hyper α2-6 sialylated β1 integrins exhibit increased adhesion to and migration toward collagen I. Further, we found that β1 …

Evidence Of Self-Correcting Spiral Flows In Swimming Boxfishes, I. K. Bartol, M. S. Gordon, P. Webb, D. Weihs, M. Gharib Jan 2008

Evidence Of Self-Correcting Spiral Flows In Swimming Boxfishes, I. K. Bartol, M. S. Gordon, P. Webb, D. Weihs, M. Gharib

Biological Sciences Faculty Publications

The marine boxfishes have rigid keeled exteriors (carapaces) unlike most fishes, yet exhibit high stability, high maneuverability and relatively low drag given their large cross-sectional area. These characteristics lend themselves well to bioinspired design. Based on previous stereolithographic boxfish model experiments, it was determined that vortical flows develop around the carapace keels, producing self-correcting forces that facilitate swimming in smooth trajectories. To determine if similar self-correcting flows occur in live, actively swimming boxfishes, two species of boxfishes (Ostracion meleagris and Lactophrys triqueter) were induced to swim against currents in a water tunnel, while flows around the fishes were quantified …

A Simple Gis Approach To Predicting Rare Plant Habitat: North Central Rocky Mountains, United States Forest Service, Region One, Erin Elizabeth Nock Jan 2008

A Simple Gis Approach To Predicting Rare Plant Habitat: North Central Rocky Mountains, United States Forest Service, Region One, Erin Elizabeth Nock

Graduate Student Theses, Dissertations, & Professional Papers

Understanding the potential distribution of rare species is a key component in managing and regulating land-use activities. Predictive modeling of plant distributions rests on the assumption that correlations exist between the presence or absence of a species and selected climate, topographic, substrate, and land-cover variables. Using the DOMAIN algorithm along with Geographic Information Systems (GIS) techniques, a biophysical envelope model was applied to 21 rare plant species listed on the Region One Regional Forester’s Sensitive Species List. Environmental variables, including annual precipitation, mean May temperature, slope, aspect, elevation, geologic material and dominant vegetation type, were used as predictors. Model output …

Optimum Stand Density Of Spring Triticale For Grain Yield And Alfalfa Establishment, Lance R. Gibson, Jeremy W. Singer, Ronald Vos, Brock C. Blaser

Faculty Work Comprehensive List

Triticale (×Triticosecale Wittmack) has potential as a feed crop in the north central United States and could also function as a companion crop for alfalfa (Medicago sativa L.) establishment. The objectives of this research were to assess the suitability of a short-statured spring triticale as a companion crop and determine optimum triticale seeding rates for grain yield and alfalfa establishment. Spring triticale ‘Trimark 37812’ and alfalfa were grown in companion at Ames and Sioux Center, IA during 2004 and 2005. Triticale was seeded at 198, 297, 396, 495, and 594 pure live seeds (PLS) m−2 and alfalfa …

Shame, Paul Campos Jan 2008

Shame, Paul Campos

Here are some observations drawn from nearly seventeen years spent as a legal academic, using a particular device: the depiction of several fictional yet all-too-familiar legal academic characters. With one exception these characters are imaginary - yet their name is legion. The characters are The Drone, The Bully, The Hack, and The Fraud.

What can be done about them - or about us? Answering this question at all satisfactorily requires confronting more than the personal flaws of particular individuals: it necessitates grappling with the structural failures of the contemporary law school. It's true that some of what is wrong with …
