The Political Origins Of Secular Public Education: The New York School Controversy 1840-1842, Ian C. Bartrum

As the title suggests, this article explores the historical origins of secular public education, with a particular focus on the controversy surrounding the Catholic petitions for school funding in nineteenth-century New York City. The article first examines the development of Protestant nonsectarian common schools in the northeast, then turns to the New York controversy in detail, and finally explores that controversy's legacy in state constitutions and the Supreme Court. It is particularly concerned with two ideas generated in New York: (1) Bishop John Hughes' objection to nonsectarianism as the 'sectarianism of infidelity'; and (2) New York Secretary of State John …

Against Legislation: Garcetti V. Ceballos And The Paradox Of Statutory Protection For Public Employees, Ruben J. Garcia

In Garcetti v. Ceballos, the Supreme Court denied constitutional protection to a deputy prosecutor named Richard Ceballos. In reaching its decision, the Court pointed to the plethora of statutory protections that were available to government whistleblowers. A closer examination of these statutory alternatives reveals that they will not protect Ceballos. This is the paradox of statutory protection in labor and employment law-more sometimes is less for vulnerable workers.
This Article places the Garcetti case in the historical trajectory of worker protection—from no protection to statutory protection. This Article argues for a move toward constitutional and international protection …

Amicus curiae ("friend of the court”) participation in litigation has flourished in recent years as many groups and individuals seek to influence the outcome of litigation. Amicus filers are not parties and judges have wide discretion to reject amicus briefs if they believe that the amicus participation does not add anything to the briefs already filed by the parties. In three recent cases, Seventh Circuit Court of Appeals Judge Richard Posner has rejected amicus filings and promised to closely scrutinize applications to file amicus briefs in the future. In this article, Professor Frank Cooper explores self-actualization, the process whereby people create their own identity by means of experimenting with different behaviors, in the context of Martin Luther King, Jr. and the FBI surveillance he was subjected to in the time leading up to his death. He argues that it is possible for people to live in an environment that is more or less alienating to the way in which they perform their identities. Performativity scholars such as Devon Carbado and Mitu Gulati say that people can have an internal sense of self that is distinct from the identity …

The first research to be done in Jamaica on forensically-important species was conducted at the Government of Jamaica Forensic Laboratory in Kingston and St. Andrew in two phases. Phase 1was conducted from July 5 to July 24, 2007, and phase 2 was conducted from February 11 to February 28, 2008. In the phase 1 study, one local black colored Landrace pig (Sus scrofa L.) carcass that weighed 21kg was used as a model for human bodies to determine the rate of decomposition and the pattern of insect succession on decomposing bodies in Jamaica. Resistant starch (RS) is fermentable dietary fiber. It has been shown that inclusion of resistant starch in the diet causes decreased body fat accumulation and altered gut hormone profile. Gut hormone has complex effect on neuropeptides’ expression in the brain hypothalamic area which is regarded as key factors in regulation of energy homeostasis. In this project, thereby, it is proposed that 1) the hypothalamic neuropeptide Y (NPY), agouti-related peptide (AgRP) and pro-opiomelanocortin (POMC) mRNA expression may be altered by RS feeding; 2) afferent vagal nerves might be involved in this process. This study uses a theoretical framework, the Transtheoretical Model (TTM), to explore school psychologists' readiness to implement Response to Intervention. Measures related to school psychologists' decision making process about implementing RTI were developed based on the TTM. The measures included Stage of Change (readiness to implement RTI), Decisional Balance (pros and cons of implementing RTI), and Situational Self-Efficacy (Confidence to implement RTI). A previously developed Reading Research Knowledge scale was also included. Information was gathered about training and practice as well. Two hundred fifty-six school psychologists completed the survey. Results indicated that school psychologists implementing RTI were more confident about …

Grand Coulee Dam created Franklin D. Roosevelt Lake as part of the Columbia Basin Project. Located in northeastern Washington State, the Project provides economically important hydropower (19 billion kilowatt hours per year), irrigation (225,000 ha), flood control, and sport fishing ($5 to 20 million annually). A good system understanding aids in balancing these beneficial uses for the 230 km long reservoir. The reservoir's atypical 45-day mean residence time is much shorter than a typical lake, and much longer than for a riverine dam. The spring freshet requires drawdowns of 15 to 20 m for flood control—the driving characteristic of reservoir …

Brown trout (Salmo trutta) are widely introduced throughout Patagonia, though their distribution and impact in the region remain poorly documented. Life history flexibility, and particularly partial migration play a major role in the ability of this species to adapt to Patagonian rivers. Consequently, this study explored habitat, distribution and life history of a partially migratory population of brown trout in the Rio Grande in Tierra del Fuego, Argentina. It described what is known of the history of the invasion. Constructed wetlands have been investigated for use in the treatment of municipal wastewater. Species of nitrogen and phosphorus are the nutrients of focus and biochemical oxygen demand (BOD), total suspended solids (TSS) and fecal coliform are the pollutants. Prior work has focused on design concepts, plant effects on nutrient and pollutant treatment, and annualized treatment performance characteristics. Paternal care has been neglected in behavioral studies because it is rare among most animals. Birds express wide variation in male care across a broad life-history gradient, but such variation among species remains poorly explored. At the same time, contributions of male assistance with incubation have been largely overlooked with the assumption that incubation is a time of low parental energy expenditure. We compared male versus female biparental incubation effort between two tropical antbird species in the northern Andes of Venezuela. We found that males and females apportion reproductive effort differently between these two species, but that male contributions of …

Self control is defined as choosing a larger, delayed reinforcer over a smaller, more immediate reinforcer with the opposite defined as impulsivity. In general, results from self-control research involving avian and non-primate mammalian subjects have shown a strong to moderate impulsive choice bias whereas studies using adult humans and non-human primates have shown a strong self-control bias. While the non-human self-control literature is rich with studies using select avian and mammalian species, there is very little self-control literature on the choice behaviors of fish or social reward. This thesis explores the development in the pictorial representation of four important French royal mistresses. It looks at works depicting Agnès Sorel, mistress to Charles VII; Diane de Poitiers, mistress to Henri II; Gabrielle d’Estrées, mistress to Henri IV; and Madame de Pompadour, mistress to Louis XV. By placing the portrayals of these women within a historical context, it becomes apparent that there are links between the strength of the crown and the depictions of the mistresses. An issue with many poaching investigations is the discovery of carcasses in advanced stages of decomposition with little information to indicate time of death (TOD). To address TOD issues of carcasses found in a state of decomposition, and to provide training materials and field tools for investigating officers, this project was initiated to identify decomposition stages and to monitor decomposition rates for those stages in the west central area of Montana. Rock climbing affects public lands through erosion, destruction of vegetation, and disturbance to historical sites. Minimum impact messages can help reduce impacts but requires understanding characteristics of the message recipient. The purpose of this study was to understand the motivations of rock climbers to help land managers design more effective minimum impact messages. This study assesses the motivations of rock climbers using a social worlds approach, focusing on the sub-worlds of. traditional climbers, sport climbers, and boulderers. This work describes the synthesis and initial characterization of the biological activity of a family of EAAT3 preferring inhibitors, L-β-benzyl aspartate (L-β-BA) and L-β-BA derivatives. L-β-BA and derivatives were initially synthesized in an approximate 2:1 ratio of diasteromers (threo:erythro), using base promoted enolate addition. Kinetic analysis of 3H-D-aspartate uptake into C17.2 cells expressing the hEAATs demonstrated that L-threo-β-BA is the more potent diastereomer (Ki values of 9 µM for EAAT1, 10.0 µM for EAAT2 and 0.8 µM for EAAT3), acts competitively, and exhibits a 10-fold preference for EAAT3 compared to EAAT1 and EAAT2. Wildfire triggers an increase in deer mouse (Peromyscus maniculatus) abundance. Here, I describe this phenomenon, investigate its causes, and explore the consequences of the postfire increase in mice for conifer recruitment in burned forest. I documented a shift in small mammal communities away from more specialized species such as red-backed voles (Myodes gapperi) and shrews (Sorex spp.) and towards greater abundance of generalist deer mice after a wildfire in montane forest. I conducted a meta-analysis of published studies on the abundance of small mammals in disturbed versus undisturbed forests and established that the pattern of increased deer mouse abundance holds …

Changes in bone morphology have always been a concern of physical anthropologists who are trying to explain a culture's everyday activity. These types of changes, including arthritic and musculoskeletal, are based on subjective observation of the researcher and therefore subject to observer error. I used three samples; the Indian Knoll sample, the Nutwood and Rosedale Mound sample, and a control sample from the Terry collection I was able to employ a scoring method based on Hawkey (1988). As a way to deal with his loss, this eulogy honors Henry Johnson (1942-2008) by focusing on ten good things about him. As a former English teacher, he valued clarity and precision, which reflects another good thing about Henry: the importance of strong organization. His zest for travel enabled him to share voluminous details about countless countries around the world, including where the best restaurants and wineries were. No description would be complete without emphasizing his love for golf, but the most important thing about Henry was the way he cared for his family, friends, and animals.

In this article, we discuss project-based learning in the context of a wheel garden as an instructional tool in science and mathematics education. A wheel garden provides multiple opportunities to teach across the curriculum, to integrate disciplines, and to promote community involvement. Grounded in the theoretical framework of constructivism, the wheel garden provides a multidisciplined educational tool that provides a hands-on, non-traditional arena for learning. We will examine some of the cultural, art, science, and mathematics connections made with this project
