Reinventing Appellate Jurisdiction, Adam N. Steinman

Appellate jurisdiction in the federal system has been properly criticized for both its doctrinal incoherence and its procedural complexity. Although these critiques are well-founded, this Article reveals that, as applied in practice, federal courts have drawn sensible lines between interlocutory orders that are immediately appealable and those that are not. A limited category of interlocutory orders, primarily those rejecting immunities from suit, are immediately appealable as of right. All other interlocutory orders are potentially eligible for discretionary appellate review. The doctrinal morass of the present framework, however, has obscured this basically sensible structure and has led to inefficient procedures for …

In recent years there has been a considerable growth in scholarship on the Gothic and on supporting reference materials. There has also been a growth in single volume introductory guides to the form which have been crucial in supporting our pedagogic practices (at least in the early weeks of Gothic courses). However, this book, published as part of the MLA's Approaches to Teaching series, provides a much needed analysis of how we go about teaching the Gothic. Reclaiming The Moral In The Dispositions Debate, Terry J. Burant, Sharon Chubbuck, Joan Whipp

This article addresses the current debates about the definition and assessment of dispositions in teacher education. Competing perspectives on the definitions and assessment of dispositions in teacher education are examined and critiqued, and a renewed commitment to foregrounding the moral nature of teaching is suggested. Recommendations for understanding and assessing the moral in teacher education, including the development of a code of ethics for the profession, are provided.

Much has been learned from electrochemical properties of boron-doped diamond (BDD) thin films synthesized using microwave plasma-assisted chemical vapor deposition about the factors influencing electrochemical activity, but some characteristics are still not entirely understood, such as its electrical conductivity in relation with microscale structure. The Drosophila dec-1 gene produces three proproteins required for female fertility and eggshell assembly. The three proproteins are distinguished by their C termini. Fc106, the most abundant proprotein, is cleaved within the vitelline membrane to three mature derivatives in a developmentally regulated manner. To define sequences within fc106 that are critical for its function, we created wild-type and mutant versions of an fc106 cDNA transgene. The functional consequences of the mutations were assessed in dec-14, a female-sterile splicing mutant that does not produce the fc106 isoform. Deference As A Form Of Reciprocity Among Residents In Assisted Living, Cindy A. Beel-Bates, Berit Ingersoll-Dayton, Erika Nelson

Although the ability to provide support to others may diminish with age, the desire to reciprocate persists. Using social exchange theory, this article examines deference as one form of exchange. Based on a sample of 31 residents age 85 and older in assisted living facilities, data were gathered via a semi-structured interview that was audio-taped and transcribed. This study analyzes their responses to open-ended questions using qualitative methods. Findings indicate that these “oldest old” respondents reciprocate for the support they receive from family and staff via deference. Four forms of deference are identified: participation, pleasantness, cooperation, and gratitude. In addition, …

Although researchers have noted that interactions among people from different cultural backgrounds can result in interpersonal conflict, little is known about the nature of this conflict and its effects on the individuals involved. The current study attempts to address this gap in the literature. It conceptualizes interpersonal, intercultural conflict as a stressor and proposes and tests a model of conflict experiences, using data from graduate students representing approximately 50 countries. Results of path analyses of the model indicate that although cultural distance does not predict interpersonal, intercultural conflict, conflict strongly predicts poor work-related and sociocultural adaptation, and these negative effects …

Recent studies have found negative correlations between mystery and preference for forest settings. Our reanalysis of earlier data suggested that those findings may have stemmed from a failure to examine setting categories within the forest domain. In the current study of 70 within-forest settings, factor analysis of preference ratings revealed two setting categories corresponding to high- and low-visual-access settings. In the high-access category, preference was positively correlated with mystery but uncorrelated with visual access. In the low-access category, preference was uncorrelated with mystery but positively correlated with visual access. We also examined an expanded definition of mystery that made explicit …

Evidence-based practice (EBP) has become the predominant model of training and is emerging as a common model of practice for many nonpsychology health care professions. Recognizing the relevance of EBP to psychology, the American Psychological Association (APA) developed and endorsed an official policy statement on EBP for the practice of professional psychology. There is now a pressing need to consider ways that EBP can inform scientist–practitioner training. The present article proposes clinical competencies associated with the practice of EBP, and describes initial efforts to implement elements of EBP into training at the University of Nebraska-Lincoln. This paper presents latest results from the combined use of SAR (Synthetic Aperture Radar) remote sensing and GIS providing detailed insights into recent volcanic activity under Vatnajökull ice cap (Iceland). Glaciers atop active volcanoes pose a constant potential danger to adjacent inhabited regions and infrastructure. Besides the usual volcanic hazards (lava flows, pyroclastic clouds, tephra falls, etc.), the volcano-ice interaction leads to enormous meltwater torrents (icelandic: jökulhlaup), devastating large areas in the surroundings of the affected glacier. Cilia and basal bodies are essential organelles for a broad spectrum of functions, including the development of left-right asymmetry, kidney function, cerebrospinal fluid transport, generation of photoreceptor outer segments, and hedgehog signaling. Zebrafish fleer (flr) mutants exhibit kidney cysts, randomized left-right asymmetry, hydrocephalus, and rod outer segment defects, suggesting a pleiotropic defect in ciliogenesis. Positional cloning flr identified a tetratricopeptide repeat protein homologous to the Caenorhabditis elegans protein DYF1 that was highly expressed in ciliated cells, flr pronephric cilia were shortened and showed a reduced beat amplitude, and olfactory cilia were absent in mutants, flr cilia exhibited ultrastructural defects in …

Yueh proposed a method of using the third Stokes parameter TU to correct brightness temperatures such as Tv and Th for polarization rotation. This paper presents an extended error analysis of the estimation of Tv , Th, and TQ equiv Tv - Th by Yueh's method. In order to carry out the analysis, we first develop a forward model of polarization rotation that accounts for the random nature of thermal radiation, receiver noise, and (to first order) calibration. This paper is a direct empirical examination of the fundamental claim that use of templates enhances the effectiveness of knowledge transfer. We explore the effect of template use through an eight-year, in-depth field investigation of Rank Xerox (now Xerox Europe). The field investigation covers three sequential transfer efforts in 15 western European countries. The investigation reveals a naturally occurring, repeated-treatment quasi experiment that allows us to test the hypothesis that the use of templates enhances the effectiveness of knowledge transfer. The Zeeman line components of the magnetic-dipole (M1) 1s2 2s2 2 P1/2 -2P3/2 transition in boronlike Ar13+ were experimentally resolved by high-precision emission spectroscopy using the Heidelberg electron beam ion trap. We determined the gyromagnetic (g) factors of the ground and first-excited levels to be g1/2 =0.663(7) and g3/2 =1.333(2), respectively. This corresponds to a measurement of the g factor of a relativistic electron in a bound non- S state of a multielectron ion with a 1.5 parts-per-thousand accuracy. Impacts Of Large-Scale Oscillations On Pan-Arctic Terrestrial Net Primary Production, Ke Zhang, John S. Kimball, K. C. Mcdonald, John Cassano, Steven W. Running

Numerical Terradynamic Simulation Group Publications

Analyses of regional climate oscillations and satellite remote sensing derived net primary production (NPP) and growing season dynamics for the pan-Arctic region indicate that the oscillations influence NPP by regulating seasonal patterns of low temperature and moisture constraints to photosynthesis. Early-spring (Feb–Apr) patterns of the Arctic Oscillation (AO) are proportional to growing season onset (r = −0.653; P = 0.001), while growing season patterns of the Pacific Decadal Oscillation (PDO) are proportional to plant-available moisture constraints to NPP (Im) (r = −0.471; P = 0.023). Relatively strong, negative PDO phases from 1988–1991 and 1998–2002 coincided …
