In the past, communications were much slower than computations. As a result, researchers and practitioners collected different data into huge databases located at a single location such as NASA and US Geological Survey. At present, communications are so much faster that it is possible to keep different databases at different locations, and automatically select, transform, and collect relevant data when necessary. The corresponding cyberinfrastructure is actively used in many applications. It drastically enhances scientists' ability to discover, reuse and combine a large number of resources, e.g., data and services.

An important part of statistical data analysis is hypothesis testing. For example, we know the probability distribution of the characteristics corresponding to a certain disease, we have the values of the characteristics describing a patient, and we must make a conclusion whether this patient has this disease. Traditional hypothesis testing techniques are based on the assumption that we know the exact values of the characteristic(s) x describing a patient. In evolutionary testing of an object-oriented program, the search objective is to find a sequence of method calls that can successfully produce a test object of an interesting state. This is challenging because not all call sequences are feasible; each call of a sequence has to meet the assumption of the called method. The effectiveness of an evolutionary testing thus depends in part on the quality of the so-called fitness function that determines the degree of the fitness of a candidate solution. Many urban areas suffer from traffic congestion. Intuitively, it may seem that a road expansion (e.g., the opening of a new road) should always improve the traffic conditions. However, in reality, a new road can actually worsen traffic congestion. It is therefore extremely important that before we start a road expansion project, we first predict the effect of this project on traffic congestion.

Why Sarbanes-Oxley Whistleblowers Don’T Win, Richard E. Moberly

Whistleblowers played a significant role in revealing and disrupting corporate malfeasance at the beginning of the 21st century, as scandals at corporations such as Enron and WorldCom came to public light through the efforts of whistleblowing employees. Subsequently, Congress recognized the importance of whistleblowing and included strong and unprecedented anti-retaliation protection for corporate employees as part of the Sarbanes-Oxley Act of 2002 (the Act), the mammoth congressional reaction to these corporate scandals.

Despite Sarbanes-Oxley’s pro-whistleblower provisions and a few early employee victories, however, administrative decisions over the first three years of the Act’s life failed to fulfill these expectations that …

An Administrative "Death Sentence" For Asylum Seekers: Deprivation Of Due Process Under 8 U.S.C. § 1158(D)(6)'S Frivolousness Standard, E. Lea Johnston

Washington Law Review

In 1996, Congress amended the Immigration and Nationality Act by providing a new sanction for asylum seekers: if an immigration judge makes a finding that a noncitizen has knowingly filed a fraudulent asylum application, then that person is permanently ineligible for immigration benefits. For eleven years, immigration judges, the Board of Immigration Appeals, and federal courts have imposed and reviewed this sanction without specifying a burden of proof. When it did act to fill the statutory gap in April 2007, the Board held that the government must prove the elements of the statute by a preponderance of the evidence. This …

Reactivity Of Iso-Diiodomethane And Iso-Iodoform, Isomers Of Ch2i2 And Chi3, Toward The Double Bond Of A Variety Of Cycloalkenes, Alexander N. Tarnovsky, Irmin Pascher, Torbjorn Pascher

The metastable CH2I-I and CHI2-I isomers formed by UV photolysis of CH2I2, and CHI3 transfer methylene and iodomethylene groups, respectively, to a variety of cycloalkenes, leading to their cyclopropanation. More than a 100-fold increase of the reaction rate with increasing solvent polarity suggests a dipolar transition state. The fastest second-order rates observed were in CH3CN. However, CH2Cl2 will be the more appropriate reaction medium because the isomer thermal stability is greater in CH2Cl2 than in the more polar CH3CN.

Native American women's autobiographies are complex writings that stretch the very genre itself. As the genre of autobiography is reinvented by both early and contemporary texts, the nature of self expression through that genre is also reinvented. With Leslie Marmon Silko's inventive 1981 autobiography Storyteller as the guide post for what an autobiography can be, I examine other autobiographies by Native American women that come before and after this work, naming some works autobiographies for the first time. Naming a work an autobiography gives credence to the autobiographer's chosen means of writing her life. Native American women reveal who they …

Movies play an integral part in the formation of cultural identity and therefore should be subject to critical examination. This study examines the roles of mothers and fathers in films by looking at several basic techniques used to reinforce patriarchy. The focus will be an examination of post-1990s Hollywood film with relevant background information coming from earlier Hollywood films. Films which ridicule fathers who try to take on traditional female roles are first examined. There exist numerous design rationale systems that convert captured information into structured design rationale while providing rationale representation and retrieval. These systems woefully neglect the design rationale that is present in legacy CAD such as 2D drawings and 3D models. The dissertation addresses the issues that arise when dealing with the capture, representation and retrieval of design rationale from the 2D legacy CAD data, specifically the non-form related data (e.g. text and symbols). The Indian textiles industry is now at the crossroads with the phasing out of quota regime that prevailed under the Multi-Fiber Agreement (MFA) until the end of 2004. In the face of a full integration of the textiles sector in the WTO, maintaining and enhancing productive efficiency is a precondition for competitiveness of the Indian firms in the new liberalized world market. In this paper we use data obtained from the Annual Survey of Industries for a number of years to measure the levels of technical efficiency in the Indian textiles industry at the firm level. Tax motivated takings are takings by a local government aimed purely at increasing its tax base. Such an action was justified by the Supreme Court's ruling in Kelo v. New London, which allowed the use of eminent domain for a private redevelopment project on the grounds that the project promised spillover public benefits in the form of jobs and taxes. This paper argues that tax motivated takings can lead to inefficient transfers of land for the simple reason that assessed values understate owners' true values. We therefore propose a reassessment scheme that greatly reduces the risk of this sort of …

The consumption capital asset pricing model is the standard economic model used to capture stock market behavior. However, empirical tests have pointed out to its inability to account quantitatively for the high average rate of return and volatility of stocks over time for plausible parameter values. Recent research has suggested that the consumption of stockholders is more strongly correlated with the performance of the stock market than the consumption of non-stockholders. We model two types of agents, non-stockholders with standard preferences and stock holders with preferences that incorporate elements of the prospect theory developed by Kahneman and Tversky (1979). Uniform crystalline colloidal cholesterol particles of narrow size distribution were obtained by precipitation. The method consisted of adding a miscible non-solvent (water) into cholesterol solutions of different alcohols and acetone, without any additives. The properties of the resulting particles depended in a sensitive way on the concentration of all reactants, temperature, pH, ionic strength, and aging time. The major observed effects were due to the solubility of cholesterol, which was strongly affected by the solvent mixture and temperature. Precipitation in 1-propanol/water system yielded stable dispersions of well-defined particles, which were used to evaluate the effects of different experimental parameters on …

By conferring on the President the title of "commander in chief," the Constitution created an awkward and undefined area of presidential prerogative. The first President to have to confront this ambiguity was Abraham Lincoln, who developed a presidential "war powers" doctrine based on his presidential oath, the Constitution's "republican guarantee," and the necessity imposed by the novelty of a civil war. This doctrine was seriously contested in Lincoln's time by both Congress and the judiciary, and it continues to be an unresolved constitutional question in the present.
