Everything You Wanted To Know About Justice Scalia But Were Afraid To Ask, Or Don't Look Now But Justice Scalia's Originalism Approach Is Fatally Flawed, Arthur R. Landever
Law Faculty Presentations and Testimony
I do not deny Justice Scalia's valiant efforts to vote based upon his originalist principles. But both a justice and an observer are well advised to understand the implications of the culture surrounding the Supreme Court. Originalism, in assuming present culture plays little part, and in seeking to operate in a closed universe, distorts the reality of judicial decision-making, and to that extent, risks unsound constitutional interpretations.

Our previous study documented expression of a male-transmitted cytochrome c oxidase subunit II protein (MCOX2), with a C-terminus extension (MCOX2e), in unionoidean bivalve testes and sperm mitochondria. Here, we present evidence demonstrating that MCOX2 is seasonally expressed in testis, with a peak shortly before fertilization that is independent of sperm density. MCOX2 is localized to the inner and outer sperm mitochondrial membranes and the MCOX2 antibody’s epitope is conserved across >65 million years of evolution. We also demonstrate the presence of male-transmitted mtDNA and season-specific MCOX2 spatial variation in ovaries. We hypothesize …

Estimation Of Dose-Response Functions For Longitudinal Data, Erica E M Moodie, David A. Stephens

In a longitudinal study of dose-response, the presence of confounding or non-compliance compromises the estimation of the true effect of a treatment. Standard regression methods cannot remove the bias introduced by patient-selected treatment level, that is, they do not permit the estimation of the causal effect of dose. Using an approach based on the Generalized Propensity Score (GPS), a generalization of the classical, binary treatment propensity score, it is possible to construct a balancing score that provides a more meaningful estimation procedure for the true (unconfounded) effect of dose.
