The Common Law Genius Of The Warren Court, David A. Strauss

The Warren Court's most important decisions-on school segregation, reapportionment, free speech, and criminal procedure are firmly entrenched in the law. But the idea persists, even among those who are sympathetic to the results that the Warren Court reached, that what the Warren Court was doing was somehow not really law: that the Warren Court "made it up," and that the important Warren Court decisions cannot be justified by reference to conventional legal materials. It is true that the Warren Court's most important decisions cannot be easily justified on the basis of the text of the Constitution or the original understandings. …

The purpose of the study was to determine the effect of a required school year long Character Education and Class-Wide Peer Tutoring program (CE+CWPT) for students who scored at or below proficiency in one, two, or three of their reading fluency, reading comprehension, or writing assessments at the beginning of their 5th-grade school year. The study analyzed performance on criterion referenced tests, performance on norm-referenced tests, behavioral referrals, and attendance to determine what relationship, if any, exists between levels of achievement amongst students participating in a required CE+CWPT program. The importance of providing fresh produce on a local level is becoming a widespread consideration among people concerned with the character of their food. For regions without an opportune growing climate, extending the growing season can drastically advance productivity. High tunnels are one way to effectively and profitably extend the growing season in cold climates. The benefits of growing in a high tunnel go beyond raising the temperature. High tunnels contribute to higher quality small fruits and vegetables. The benefits of growing in high tunnels have been explored in other states and could be exploited by Utah growers. Laryngeal Mask Airway has gained wide acceptance for routine airway management, difficult airway and in emergency situations. The classical method of insertion was recommended by Dr Brain. Over the years various induction and insertion techniques have been described with variable results. Combination of induction agents with narcotics, with or without small dose muscle relaxants has been found to be very effective. There is less also lesser incidence of mucosal trauma with partially inflated cuff. Insertion with cuff facing laterally or backwards and rotating it forwards into position has also been described. Adoptive cell transfer immunotherapy has been utilized to treat EBV related human malignancies including post-transplant lymphoproliferative diseases, Hodgkin's lymphoma and nasopharyngeal carcinoma. However, there are limited options available for tumor antigen-specific T cell purification. Here we describe a novel solid phase T cell selection system, in which monocytes or EBV transformed B-lymphocytes are immobilized on solid support for antigen-specific T cell purification. We hypothesize and prove that antigen-specific T cells recognize their cognate antigens and bind to them faster than non-antigen specific T cells. Role Of Peptidoglycan In The Pathogenesis Of Staphylococcus Saprophyticus In Mice, Harith J.F. Al-Mathkhury, May T. Flaih, Athra S. Fleih

Baghdad Science Journal

The pathogenicity of S. saprophyticus was studied in mice. A group of white mice were injected transurethrally using a catheter with S. saprophyticus S67 cell suspension in a concentration reached 109 CFU/ml. concomitantly, the role of its peptidoglycan in the pathogenicity was studied by injecting another group of mice with 0.3 mg/0.2 ml of partially purified S. saprophyticus S67 peptidoglycan extract. After autopsy, kidneys and urinary bladder showed several histopathological changes both in cells and peptidoglycan injected mice, included: hydropic degeneration, glomerulus shrinkage, congestion of renal vessels, infiltration of inflammatory cells, and dekeratinization in urinary bladder.

Ethical issues are becoming more commonplace in society today and while most industries are taking steps to improve poor ethical decisions through ethics education, aviation is lagging behind in both understanding of ethical issues inherent to the industry and ethics education. In this study three groups of pilots (students, instructors, and faculty) at Embry-Riddle Aeronautical University are examined in an effort to determine moral development level in terms of P score on the Defining Issues Test 2 (DIT2) and two domain specific additional questions. Capping The Mortgage Interest Deduction, John E. Anderson, Jeffrey Clemens, Andrew R. Hanson

Economics Faculty Research and Publications

In this paper we examine the economic implications of several policy options for capping the mortgage interest deduction (MID). We extend the standard user–cost model of owner–occupied housing to include a cap on the mortgage size receiving tax–favored status. Our user–cost estimates for taxpayers with mortgages above the current–law cap are 4.41 percent higher than estimates from a model without the cap. We simulate the share of mortgage dollars that would be subject to three alternative cap policy variants and summarize the distributional impacts of each proposal, computing the share of mortgage dollars impacted across U.S. Metropolitan Areas.

In late 1893, the nascent Indian-backed American Islamic Propaganda movement, led by Mohammed Alexander Russell Webb, fell into discord. Emin L. Nabakoff and John A. Lant left the movement and formed their own Muslim group, the First Society for the Study of Islam in America. For the next two years the leaders of the bitter rival organizations continued to conduct business. However, they also fought a very public war of words in the newspapers, leveling charges and countercharges against each other’s character, integrity, and Islamic legitimacy. The first two terms of Franklin Roosevelt's presidency (1933-1941) were periods of great administrative innovation. Responding to the Great Depression, Congress created scores of new administrative agencies charged with overseeing economic policy and implementing novel social welfare programs. The story of the constitutional difficulties that some of these policy innovations encountered is a staple of both New Deal historiography and the constitutional history of twentieth-century America. There has been very little writing, however, about how courts and the New Deal-era administrative state interacted after these constitutional battles ended. Championed on the Supreme Court by Justice Scalia and Justice Thomas and in academia most prominently by Professor Akhil Amar textualism has emerged within the past twenty years as a leading school of constitutional interpretation. Textualists argue that the Constitution should be interpreted in accordance with its original public meaning, and in seeking that meaning, they closely parse the Constitution's words and grammar and the placement of clauses in the document. They have assumed that this close parsing recaptures original meaning, but, perhaps because it seems obviously correct, that assumption has neither been defended nor challenged. It has been more that two decades since the notorious McMartin Preschool case created a day care ritual abuse master-narrative that recruited many social workers into becoming involved in case-finding, investigations, interviewing and advocacy. The purpose of this article is threefold: it introduces a sample of 22 day care employees who were convicted in day care ritual abuse cases; it updates their current legal status; and it discusses the relevance of these cases to social workers who currently are being recruited by today's new master narratives about extrafamilial sexual threats to children, whether from neighborhood pedophiles, child pornographers, parish priests …
