Ap-Ls Teaching Techniques: Deliberating The Benefits Of Learning Through Focus Groups, Garrett Berman, Judith Platania

This article describes how students in an undergraduate legal psychology class utilized focus group research (i.e., a jury simulation exercise) to assist in planning strategies for trial. In addition to conducting the focus group, students were responsible for providing an analysis of the results, and preparing their team for trial. Ultimately, students reported the focus group exercise helped them develop trial strategies, understand the role of trial consultants, and gain a better understanding of scientific jury selection. Th Politics Of Hate: Ultranationalist And Fundamentalist Tactics And Goals, Joan Davison

Ultranationalist and religious fundamentalist movements frequently use hate to mobilize people. These groups possess a sophisticated understanding of the importance of appealing to the emotions. Leaders often employ xenophobic language intended to inspire fear and justify a defensive reaction. The movements also rely heavily upon symbols, myths, and public events to simplify and communicate the "truths" of their ideologies. The leaders convey messages with tremendous affective appeal. Yet, measures exist to counter and contain the politics of hate. The development of civil society, group rights, a free media, and integrated institutions can contribute to a durable solution in cases of …

What Are Aboriginal Rights?, Brian Slattery
Comparative Research in Law & Political Economy
Aboriginal rights in Canada are often viewed as specific rights - rights that are grounded in the specific practices and customs of particular aboriginal peoples and that differ from people to people. This article argues that these specific rights are in fact concrete instantiations of a panoply of generic aboriginal rights that are presumptively held by all aboriginal groups under Canadian common law. They include the right to conclude treaties, the right to customary law, the right to honourable treatment by the Crown, the right to an ancestral territory, the right of cultural integrity, and the right of self-government. This Note will analyze the two opposing interests of property owners and of cities in the context of the Supreme Court's Public Use Clause jurisprudence and show that while the Court's decision in Kelo may have diminished property rights, the decision could render an overriding positive impact on combating urban sprawl. Part II defines urban sprawl and identifies some of its associated costs. Part III briefly describes Public Use Clause jurisprudence prior to the Supreme Court's ruling in Kelo. Last February, the International Court of Justice issued a judgement adjudicating claims by Bosnia and Herzegovina that Serbia breached the 1948 Genocide Convention – the case marks the first time a state has made such claims against another. The alleged genocidal acts were the same as those that have been the subject of several criminal trials in the Yugoslav Tribunal. The judgment contained several landmark rulings – among them, the Court found that a state, as a state, could commit the crime of genocide and the applicable standard of proof for determining state responsibility is comparable to the standard used …

Obesity, Public Health, And The Food Supply, Barbara L. Atwell

This Article proposes a three-part approach to improve the food supply. Specifically, it explores government taxing and spending, two traditional public health tools, and suggests that both of these governmental powers can be used to make healthier foods more readily reasonable prices, while increasing the cost of less healthy alternatives. Finally, it proposes that we promote a true “food democracy” through the creation of an education and awareness campaign. This campaign would not only better educate Americans about proper nutrition but would also focus on how we can change our entire relationship with food. It would encourage consumption of locally …

This paper examines the feast of All Saints, encompassing the beloved dead, both known and unacclaimed, as expressive of the paschal mystery in their partaking of the promise of life in the resurrection; it also poses the challenge for the living faithful to see themselves as saints in a recovery of the Pauline understanding of the term. Since 1991, more than 50,000 people have been killed and over one million persons displaced in Sierra Leonedue to civil war. The purpose of this phenomenological study was to explore experiences that undergraduate students and recent graduates who are White social justice activists for Africa perceive as contributing to their development as activists committed to addressing humanitarian crises in Africa and how they interpret these experiences. In-depth interviews were conducted with six undergraduate students, or recent graduates, who considered themselves social justice activists for Africa and who identified with White culture more strongly than any other ethnic culture. These participants ranged from ages 21 to 25 and were found to share demographic similarities such as intact families of origin and middle …

This Essay, in order to offer up something to that appetite, is divided into five parts. After this introduction, the author, A. John Radsan, describes a Hegelian impulse, the perpetual drive to find unity in disorder. That impulse, for better or worse, creates the train and the track for many of the academy's journeys. Radsan then defines what is meant by "intelligence activities" for purposes of this Essay, after which Radsan surveys the scholarship that existed before this symposium on the relationship between espionage and international law. Recently, national fire policy has been redirected from a primary focus on suppression towards a more integrated and comprehensive approach developed at the community level. As part of this policy shift, Congress passed the Healthy Forest Restoration Act (P.L. 108-148) in 2003 encouraging communities to develop community wildfire protection plans (CWPPs) to guide fuel reduction and wildfire mitigation efforts on both federal and nonfederal lands. This research examines U.S. Forest Service (USFS) and community collaboration in the development of CWPPs through a case study analysis of four communities in two western states. Warfare has become a legal institution. Law organizes and disciplines the military, defines the battlespace, privileges killing the enemy, and offers a common language to debate the legitimacy of waging war — down to the tactics of particular battle. At the same time, law is no longer a matter of firm distinctions — combatant and non-combatant, war and peace. It has become a flexible and strategic partner for both the military and for humanitarians seeking to restrain the violence of warfare. Fabrication And Characterization Of Particulate Polymer Nanocomposites, Ying Du

A comprehensive series of experiments are conducted to study dynamic crack initiation and propagation in nanocomposite materials. The nanocomposites are fabricated using ultrasonics with an in-situ polymerization technique to produce materials with excellent particle dispersion, as verified by transmission electron microscopy and scanning electron microscopy. Dynamic fracture toughness testing is carried out on three-point bend nanocomposite specimens using a modified split-Hopkinson pressure bar. Dynamic photoelasticity coupled with high-speed photography has also been used to obtain crack tip velocities and dynamic stress fields around the propagating cracks. Review Of Indians And Emigrants: Encounters On The Overland Trail By Michael L. Tate, Susan Badger-Doyle

Relations between emigrants and the Indians they encountered along the central route of trails ro Oregon, California, and the Salt Lake Valley were a significant aspect of overland travel, particularly on the segment crossing the Great Plains. Emigrants and Indians is a comprehensive study of the complex history of these intercultural relations from 1840 to 1870. In contrast to popular stereotypical images of "savage" Indians and a focus on conflict, Michael Tate shows that cooperation, aid, and mutual benefit dominated Indian-white relations throughout the period.
