Media Policy And Free Speech: The First Amendment At War With Itself, Ellen P. Goodman

Two principal pillars of media policy are communications and copyright law. In each discipline, there are pluralists who seek greater public access to the means of communications (communications policy pluralists) and communicative content (copyright pluralists). Historically, communications policy pluralists have sought government interventions in the marketplace in order to increase access to mass communications. Copyright pluralists, by contrast, have fought against regulatory interventions they argue unduly strengthen the rights of copyright holders to deny access to content. In pursuing these strategies, the pluralists have used First Amendment arguments that are in tension with each other and ultimately unavailing in the …

Due Process Land Use Claims After Lingle, J. Peter Byrne

The Supreme Court held in Lingle v. Chevron U.S.A. Inc. that challenges to the validity of land use regulations for failing to advance governmental interests must be brought under the Due Process Clause, rather than the Takings Clause, and must be evaluated under a deferential standard. This Article analyzes and evaluates the probable course of such judicial review, and concludes that federal courts will resist due process review of land use decisions for good reasons but not always with an adequate doctrinal explanation. However, state courts can use due process review to provide state level supervision of local land use …

Maybe consists of an installation space embracing three video projections, each presenting the viewer with a series of distilled moments. Every connected element in the installation provides an opportunity for engagement with the intangible memories of adolescence. The video pieces present fragments of narratives and invite viewers to fill in the gaps with their own memories, reflections and experiences. The point of view of the camera in each video positions the viewer as a voyeur—and as such the viewers are granted the opportunity to pause, consider and reflect, and hopefully realize something new about themselves while participating in the actions …

Contrary to past opinions William Andrews Nesfield's garden layouts were not solely designed to provide appropriate accompaniments to the Elizabethan and Jacobean revival architecture of his brother-in-law Anthony Salvin (1799-1881). Nor were they conceived chiefly to provide his wealthy patrons with a variation on the French seventeenth-century parterre-de-broderie. Undoubtedly, this device helped to forge a sympathetic bond between Nesfield and his patrons, for it had been a symbol of power and status in seventeenth-century France when it was associated with the upper echelons of French society. It therefore represented to the aristocracy and upper gentry of nineteenth-century Britain, during the …

Whilst the harbour porpoise {Phocoena phocoena) is the most j&equently observed cetacean in the UK, it. is at risk from habitat degradation, pollution, incidental capture in fishing nets and anthropogenic disturbance. UK, European and International initiatives have highlighted the conservation need to obtain a better understanding of this species. This research, conducted over 5 years (1999-2004) aimed to fiirther the scientific knowledge of the harbour porpoise in order to influence fiiture conservation initiatives. Studies into the relative abundance, density, distribution, habitat use and behaviour were conducted through combinations of shore- and boat-based research. Introduction Increasingly, population modeling and systems analysis are being used to examine the complex issues that are at the heart of CP/IPM (crop production and integrated pest management) and biological control. The design of economically sound and sustainable crop management strategies requires a thorough understanding of the whole production system including arthropod pests, pathogens, and weeds. More than three decades ago, Huffaker and Croft (1976) stressed the need to rely on systems analysis and interdisciplinary collaboration to accomplish this task. Because tobacco smoking causes 430,000 U.S. deaths annually, wide-reaching smoking bans are needed. Bans reduce cigarette consumption, encourage cessation, protect nonsmokers from second-hand smoke, and promote an attitude that smoking is undesirable. Therefore, bans may prevent future generations from suffering many smoking-related health problems. The federal government has not implemented widereaching smoking bans so it falls on individual states, counties, or communities to devise appropriate smoking policy. To date, smoking policy has been determined by legislators, who may have conflicts that prevent them from acting in the publics best interest. However, this method of implementing smoking policy may be changing. …

In the present work superplastic forming (SPF) is used as part of a process to create medical implants out of titanium. SPF is a forming process which offers many advantages over conventional forming processes. It allows for greater complexity in shape as well as the ability to work with difficult to form metals such as titanium which is a key metal in the biomedical field. SPF has been used extensively in the aerospace and automobile industry, however in recent years it has been shown to be a viable means in creating medical implants. It seems to be a common assumption that physical places like parks, sidewalks, and public squares, and "cyber-places" like the Web, constitute separate locations of communication. In reality, however, the intersection and collision of these two spaces is imminent. In some respects it has already occurred. Entire cities and counties are erecting wireless "clouds" that will bring the Internet to vast public spaces. Technologies of surveillance continue to proliferate. What one does and says in public places is increasingly subject to surveillance by means of a combination of hand-held devices and official surveillance tools like closed circuit television cameras (CCTV). …

Noise-induced hearing loss (NIHL), or hearing damage from regular exposure to loud noise, can profoundly affect a person's hearing capabilities and overall well-being. Many individuals continue to expose themselves to hazardous levels of noise, and, in turn, put themselves at risk of developing a NIHL. This review critically examines the existing literature presented on NIHL. Emphasis is placed on the increasing prevalence of NIHL in young adults from exposure to loud recreational noise. The effectiveness of current educational strategies that have been employed to reduce or prevent the occurrence of NIHL in this cohort is also examined. Research indicates that …

Bernard Herrmann (1911-1975) has long been regarded as one of the most important composers of film music. Emerging during a time when the majority of film scores worked primarily with the physical action onscreen or what was immediately obvious in the dramatic narrative, Herrmann's innovative compositional style instead focused on the unconscious and the psychological states at work. The following thesis is a discussion of the key elements of Herrmann's unique film score style and, via case studies of the three lonely male protagonists in the films Citizen Kane (Welles, USA, 1941), Vertigo (Hitchcock, USA, 1958) and Taxi Driver (Scorsese, …

This exploratory study of community perceptions of tourism impacts and host guest relations in a Least Developed Country (LDC) was undertaken in the Boeung Keng Kang I region of Phnom Penh city, Cambodia. A mixed methodology approach, with quantitative questionnaires of the local community and semi structured interviews with both the community and key informants from stakeholder groups, was used to investigate the appropriateness of social exchange theory and economic dependency theory to the LDC sustainable tourism development agenda set by the World Tourism Organization (WTO).
