Excuse Me, Sir; You're Sitting In A No Cell Phone Pornography Section, You'll Have To Put That Away: May The Fcc Regulate The Content Of Wireless Broadband Transmissions, H. William Beseth Iii

This Note will argue that the scope of the FCC's authority to regulate traditional broadcast content does not extend to the content transmitted to wireless devices via broadband transmission. Part II of this Note provides a study of the key cases that characterize the scope of the FCC's statutory authority to regulate traditional broadcast content. Additionally, Part II presents a discussion of the First Amendment and the limits it imposes on the FCC's regulation of broadcast content. Part III evaluates whether content transmitted by new technologies fits into the regulatory scope of the FCC's authority according to the tests set …

In the United States privacy is a hot topic, not least because of the current administration's desire to have unbridled access to its citizens' overseas conversations. But in what follows I do not plan to deal directly with any legal or policy concerns. Instead, I am interested in the philosophical foundations,- if any there be, of privacy as something to which individuals and other groups may be entitled. A Problematic Plurality Precedent: Why The Supreme Court Should Leave Marks Over Van Orden V. Perry, W. Jesse Weins

Nobody likes plurality decisions. Former Chief Justice Rehnquist called them "genuine misfortune [s]," since they are filled with unique and ominous issues. Often arising in cases involving contentious subjects, the reasoning behind these decisions' holdings by definition did not receive majority support. Nevertheless, the fate of any particular plurality decision is an open question, as its initial instability does not always inhibit its ability to solidify as law. While some are discarded over time, others (for better or worse) become legal mainstays. After the Supreme Court hands down a plurality decision, lower courts must discern its precedential value according to …

This study was designed to examine the perceived importance and extent of use of scientific research-based instructional strategies among West Virginia teachers. Specifically, the study investigated the extent to which perceived importance and frequency of use of scientific research-based instructional strategies differ between highly qualified teachers and non-highly qualified teachers. The core of the research was focused on ten scientific research-based instructional strategies identified by the MidContinental Regional Educational Laboratory. Participants were asked to complete a researcher-designed survey, the Instructional Strategies Inventory, to rate perceived importance and frequency of use for each of the ten strategies. Review Of Inge Nielsen, Cultic Theatres And Ritual Drama In American Journal Of Archaeology, On-Line Reviews, Vol. 111.1:, Kenneth S. Rothwell Jr.

Nielsen has done us a great service by collecting the considerable evidence for cultic performance spaces in Egypt, Mesopotamia, Syria, Phoenicia, Asia Minor, Crete, Greece, Sicily, and Italy. A table (340–41) gives an index of the 58 bestpreserved theaters, but dozens of others are discussed as well. Although some of the theaters could also have been used for “secular” literary drama, this volume focuses on cultic use. Nielsen’s observations should be of great interest to students of theater, religion, and ancient architecture.
