Pound, Roscoe (1870-1964), Michael R. Hill
Department of Sociology: Faculty Publications
Roscoe Pound, sociologist, ecologist, and noted jurist, originated and promulgated the legal movement known as the American school of sociological jurisprudence. This revolutionary perspective remains the single most consequential application of sociological thinking in American society. Pound's sociological theories and empirical methodologies fundamentally transformed the prosecution and administration of US law for a full half-century.

Russian Cultural Factors Related To Perceived Criminal Procedure Fairness: The Juxtaposition Of Policy And Practice, Olga B. Semukhina
Russian Cultural Factors Related To Perceived Criminal Procedure Fairness: The Juxtaposition Of Policy And Practice, Olga B. Semukhina
Electronic Theses and Dissertations
The purpose of this study is to investigate the relationship between the Russian culture and citizens' perceived fairness of the new Criminal Procedural Code of Russia of 2001 (CPC of 2001). The CPC of 2001 is a key policy in the Russian criminal law reform with the purpose of implementing adversarial procedure elements in Russia. The existing literature has documented the lack of public support along with observed violations of the CPC's major provisions which as made this an important area for study. It is theorized that the apparent contradiction between the underlying values of the Russian culture, and CPC's …

Justification And Excuse In The Criminal Law: Defences Under The Indian Penal Code, Ameya Kilkara
Justification And Excuse In The Criminal Law: Defences Under The Indian Penal Code, Ameya Kilkara
National Law School of India Review
George Fletcher's theory, 'Justification and Excuse in the Criminal Law', has contributed to a deeper theoretical understanding of exculpatory defences in the discipline. It is a theory that not only has important practical implications for evidentiary issues related to criminal trials but also has a bearing on the very fulfilment of the objectives of criminal law. In this article, the author applies Fletcher's theory to exculpatory defences under the Indian Penal Code and finds that it demonstrates an inadequate appreciation of the justification-excuse distinction. As a possible remedy, the author suggests certain amendments and additions to the Indian law pertaining …
The Bargain Has Been Struck: A Case For Plea Bargaining In India, Sonam Kathuria
The Bargain Has Been Struck: A Case For Plea Bargaining In India, Sonam Kathuria
National Law School of India Review
Under the traditional model of criminal adjudication, an impartial adjudicator, after a formal adversarial trial, determines guilt and imposes a penalty appropriate for the offender from the range prescribed by legislation. This note discusses a deviation from this model now available under the Indian system, commonly known as "plea bargaining." The author concludes that the model of plea bargaining introduced into the Criminal Procedure Code both reasonable and legal.
Transnational Networks And International Criminal Justice, Jenia I. Turner
Transnational Networks And International Criminal Justice, Jenia I. Turner
Faculty Journal Articles and Book Chapters
The theory of trans-governmental networks describes how elements within the governments of various nations make and affect policy by coordinating with each other informally, without official or formal legal sanction. Anne-Marie Slaughter and others have argued that this sort of coordination is useful in many different areas of cross-border regulation, including banking, antitrust, environmental protection, and securities law.
One area to which the theory has not yet been applied is international criminal law. By its nature, international criminal law transcends national boundaries. But at least until recently, it had not generated the kinds of informal trans-governmental networks that have emerged …
Imaging Body Structure And Mapping Brain Function: A Historical Approach, Stacey A. Tovino
Imaging Body Structure And Mapping Brain Function: A Historical Approach, Stacey A. Tovino
Faculty Articles
Now in its second decade, functional magnetic resonance imaging (fMRI) localizes changes in blood oxygenation that occur in the brain when an individual performs a mental task. Physicians and scientists use fMRI not only to map sensory, motor, and cognitive functions, but also to study the neural correlates of a range of sensitive and potentially stigmatizing conditions, behaviors, and characteristics. Poised to move outside the traditional clinical and research contexts, fMRI raises a number of ethical, legal, and social issues that are being explored within a burgeoning neuroethics literature. In this Article, I place these issues in their proper historical …
