Review Of Juvenile Delinquency: Causes And Control (2nd Edition) By Robert Agnew, Ryan Spohn

Center on Children, Families, and the Law: Faculty Publications

Juvenile Delinquency: Causes and Control is a comprehensive text addressing the causes of, and responses to, a major social problem in modern American society. Although Robert Agnew is best known for his development of General Strain Theory, an individual level strain theory rooted in classical anomie theory and the more recent literature on stress, his broader record of publication denotes him as one of the premier theoretical analysts in the fields of criminology and juvenile delinquency. This text reflects his command of the discipline.

The book is oriented according to a number of themes. First, it is designed to be …

Development And Confirmatory Factor Analysis Of The Community Norms Of Child Neglect Scale, Rebecca Goodvin, David R. Johnson, Sam A. Hardy, Michelle Graef, Jeff M. Chambers Jan 2007

Development And Confirmatory Factor Analysis Of The Community Norms Of Child Neglect Scale, Rebecca Goodvin, David R. Johnson, Sam A. Hardy, Michelle Graef, Jeff M. Chambers

Center on Children, Families, and the Law: Faculty Publications

This article describes the development of the Community Norms of Child Neglect Scale (CNCNS), a new measure of perceptions of child neglect, for use in community samples. The CNCNS differentiates among four subtypes of neglect (failure to provide for basic needs, lack of supervision, emotional neglect, and educational neglect). Scenarios ranging in seriousness for each subtype were presented to a large community sample (N = 3,809). Confirmatory factor analyses indicated that a four-factor model provided a better fit to the data than did a model specifying only one overall neglect factor, suggesting this sample distinguished among the four subtypes of …

An Rsvp To Professor Wexler's Warm Therapeutic Jurisprudence Invitation To The Criminal Defense Bar: Unable To Join You, Already (Somewhat Similarly) Engaged, Mae C. Quinn Jan 2007

An Rsvp To Professor Wexler's Warm Therapeutic Jurisprudence Invitation To The Criminal Defense Bar: Unable To Join You, Already (Somewhat Similarly) Engaged, Mae C. Quinn

Journal Articles

This Article responds to Professor David 13. Wexler's recent suggestion that adopting Therapeutic Jurisprudence ("V) principles to create a new type of "rehabilitative" defense lawyer could improve the criminal defense bar. Contrary to the empirical foundation of the therapeutic justice movement, many of his proposed changes seem unsubstantiated. Others, such as calls for creative plea bargaining, are already part of the practice of quality defense attorneys. The "rehabilitative," -Pi defense lawyer may be overly paternalistic, imposing his interpretation of the facts and his standards of appropriate behavior on the accused; such a lawyer also may not comport with express ethical …

Human Rights & Human Welfare

“9/11 changed everything.” Not really. In fact, there has been far more continuity than change over the past six years in both international and domestic politics. Nonetheless, human rights often have been harmed—although not by terrorism but by “the war on terror.”

Evaluating The Mandatory Death Penalty Under Section 398 Of The Dangerous Drug Act 1952, P. Tan, Y.H. Lee Jan 2007

Evaluating The Mandatory Death Penalty Under Section 398 Of The Dangerous Drug Act 1952, P. Tan, Y.H. Lee

Research Publications (2006 to 2010)

The mandatory death penalty under section 39B of the Dangerous Drugs Act 1951 is now 23 years old. This paper seeks to evaluate this penalty from two main perspectives: the nature of the death penalty itself, and the mandatory nature of the punishment under section 39B of the DDA. The first section traces the legislative history of section 39B and other provisions related to the offence of drug trafficking. The second section will examine, first, whether the mandatory death penalty has achieved the aims for which it was promulgated, and secondly, whether these aims are in fact-desirable, bearing in mind …

The Andrea Yates Case: Insanity On Trial, Phillip J. Resnick Jan 2007

The Andrea Yates Case: Insanity On Trial, Phillip J. Resnick

Cleveland State Law Review

On June 20, 2001, Andrea Yates drowned each of her five children in her bathtub. The nation struggled to understand how a loving mother could systematically kill her children in apparent cold blood. No crime evokes more intense feelings than a mother killing her own children. There was extraordinary media coverage of her trial in Houston, Texas in 2002. Her defense attorneys, George Parnham and Wendell Odom entered a defense of not guilty by reason of insanity (NGRI) to multiple counts of first degree murder with death penalty specifications. The 2002 trial jury verdict of guilty was overturned on appeal. …

Prosecutors, Ethics, And Expert Witnesses, Paul C. Giannelli, Kevin C. Mcmunigal

Commentators who have examined the DNA exonerations have noted the disturbing role that prosecutors have played in these wrongful convictions. Another significant contributor to these miscarriages of justice is the misuse of expert testimony, a third of the cases according to some sources. This Article examines the intersection of these two factors - the prosecutor's role in using and presenting expert testimony.

Prosecutorial misconduct may occur during most stages of a trial, beginning with the selection of witnesses, including the improper "shopping" for experts. Additional abuses occur when prosecutors fail to abide by rules governing the pretrial disclosure of scientific …

Effects Of Individual Characteristics On Plea Negotiations Under Sentencing Guidelines, Erika Davis Frenzel, Jeremy Ball Jan 2007

Effects Of Individual Characteristics On Plea Negotiations Under Sentencing Guidelines, Erika Davis Frenzel, Jeremy Ball

Criminal Justice Faculty Publications and Presentations

Research conducted on the decision points between arrest and sentencing is scarce. The current study attempts to fill this gap by focusing on plea negotiations, examining the effects of individual characteristics on plea bargaining decisions by using two dependent variables – a two-category dependent variable analyzing negotiated pleas vs. non-negotiated pleas and a three-category dependent variable analyzing negotiated pleas, non-negotiated pleas, and bench/jury trial convictions. The results from the multinomial logistic regression indicate that individual characteristics are predictors of negotiated guilty pleas compared to a trial conviction. Black offenders were more likely than white offenders to have their case go …

Public Finance : Differences, Similarities, And No Quick Fixes, Steve Novick Jan 2007

Public Finance : Differences, Similarities, And No Quick Fixes, Steve Novick

Institute of Metropolitan Studies Publications

Candidates for office, in every place and at every level of government, often talk as if they think they will be able to revolutionize both government services and the local (or state, or national) economy by, in some way, changing the structure of public finance. They’ll improve funding for basic services by prioritizing government spending. They’ll boost the economy by cutting taxes. They’ll replace an outdated, irrational structure by reforming taxes. They’ll make corporations and the rich pay their fair share. Et cetera. A review of the structure of public finance in the Portland metropolitan region suggests that any and …

Restorative Justice In Post-Disaster Situations: Untapped Potential, Maria R. Volpe Jan 2007

Restorative Justice In Post-Disaster Situations: Untapped Potential, Maria R. Volpe

Cardozo Journal of Conflict Resolution

Post-disaster situations can provide a wide range of opportunities for restorative justice. Depending on the nature of the disaster, man-made or natural, the potential of using restorative justice practices to assist in rescue, recovery, and rebuilding efforts can be significant. The challenges, however, can be even more significant.

My interest in examining restorative justice efforts in post-disaster situations grew out of my earlier research on dispute resolution responses to 9/11. In the aftermath of the 9/11 terrorist attacks, countless questions arose about the role and relevance of dispute resolvers. 9/11 also triggered a wide range of hate crimes, which seemed …

Exploring The Limits Of The Restorative Justice Paradigm: Restorative Justice And White-Collar Crime, Zvi D. Gabbay

Cardozo Journal of Conflict Resolution

Part I of this article introduces the restorative justice paradigm. It defines restorative justice and its basic values and principles and presents two theories which illustrate the goals of restorative interventions and the basic requirements for their commencement. Part II introduces white-collar crime and focuses on high-profile white-collar crime committed by corporate executives. This part discusses the centrality of white-collar crime within the criminal justice system and society in general and reviews the latest developments in legislation and sentencing policies on white-collar crime. Part III argues that the restorative justice paradigm should be applied to high-profile white-collar crime as a …
