Development In International Energy Law, David Van Zandt Jan 2007

Development In International Energy Law, David Van Zandt

Northwestern Journal of International Law & Business

International energy law embodies a matter of keen interest that affects the daily lives of citizens in developing and developed countries worldwide. Among numerous other effects, international energy law influences gas prices, wages, employment rates and domestic market regulations. The weight of these direct consequences of international energy law and policy led to the creation of this year's symposium topic. The goal of this year's symposium is to identify issues arising from various international energy laws as well as to understand the effects that recent international events, including the fall of Enron, the creation of NAFTA and the political unrest …

The Passionate Expression Of Hate: Constitutional Protections, Emotional Harm And Comparative Law, Amnon Reichman Jan 2007

The Passionate Expression Of Hate: Constitutional Protections, Emotional Harm And Comparative Law, Amnon Reichman

Fordham International Law Journal

This Article will examine two possible models that seek to resolve the tension in principle: The U.S. model, under which speech enjoys preeminence, and the Israeli model, that protects human dignity as the principal value. Section I will outline and analyze a recent Israeli case that led to the first criminal conviction for the violation of an Israeli statute prohibiting the infliction of harm on religious sentiments. This case will provide a reference point for a three-part comparative analysis of the U.S. and Israeli models. Section II will address the normative infrastructure that separates the two models, Sections III and …

The Role Of The Introductory Sociology Course On Students' Perceptions Of Achievement Of General Education Goals, Jay R. Howard, Aimee Zoeller Jan 2007

The Role Of The Introductory Sociology Course On Students' Perceptions Of Achievement Of General Education Goals, Jay R. Howard, Aimee Zoeller

Scholarship and Professional Work - LAS

As higher education accreditation agencies emphasize achievement of general education learning goals for undergraduate students, departments are increasingly required to identify and assess the contributions of their disciplines to achievement of these goals. This exploratory study conducted at a large urban university and its satellite campus seeks to identify students' perceptions of the contributions of the Introduction to Sociology course to the general education goals specified by a single university. This study also seeks to identify the most frequently used pedagogies used by introductory sociology instructors. Results indicate students perceive that Introduction to Sociology facilitates achievement of critical thinking skills, …

In this essay, I examine the role of teaching and learning in the culture of the regional association in American sociology. A Maid In Servitude: Filipino Domestic Workers In The Middle East, Kathleen Nadeau Jan 2007

A Maid In Servitude: Filipino Domestic Workers In The Middle East, Kathleen Nadeau

Anthropology Faculty Publications

This paper presents Filipino economic history as a way to provide a brief background to the events that precipitated one Filipino woman’s migration to the Middle East. Her story is not rare but shares in common patterns with the stories of many other female contract workers, especially domestic workers. It chronicles government policies and business practices that profit from their remittances. It is being retold here so that the invisible world of female contract workers and, more often than not, the poor conditions under which they live and labour, might be better understood.

The Public Funding Of Health Care: A Brief Historical Overview Of Principles, Practices, And Motives, Paul Carrick Jan 2007

The Public Funding Of Health Care: A Brief Historical Overview Of Principles, Practices, And Motives, Paul Carrick

Philosophy Faculty Publications

Nationally sponsored programs designed to fund health care for the general public are largely a twentieth century phenomenon. Yet a long glance backward at the medical and public health history of Western civilization, extending from the ancient Greeks to the twentieth century, reveals earlier periods when governments, religious institutions, and other groups provided some measure of medical relief for the sick, the poor, and the homeless. In this essay, I will provide not an exhaustive but rather an illustrative account of this oft forgotten fact. My objectives are threefold.

First, to remind us that the active concern of society for …

The Impact Of Popular Culture On American Perceptions Of The Courts, David Ray Papke Jan 2007

The Impact Of Popular Culture On American Perceptions Of The Courts, David Ray Papke

Faculty Publications

After a brief introduction defining popular culture as the commodities and experiences produced by the culture industry for mass audiences, this essay explores the impact of court-related popular culture on what Americans think of and expect from their courts. The Perry Mason effect from an earlier era and the CSI effect from the present are noted, as is scholarly work by Michael Asimow, Philip T. Dunwoody, Kimberlianne Podlas, Victoria S. Salzmann, and others. The essay concludes with suggestions for what might be done in the courthouse, the community, and the family room to control the impact of court-related popular culture …

The Law And Economics Of Identity, Rafael Gely Jan 2007

The Law And Economics Of Identity, Rafael Gely

Faculty Publications

A growing number of legal scholars have written about the demands that society and particular employers have placed on non-traditional employees to perform their identities, “or make themselves palatable” to their employers, by comporting with the criteria that the institution values. These authors have forcefully made the argument that some of these requirements are actually a form of class subordination; as a response, they argue for various forms of legal intervention.

The Temporal Dimension Of Voting Rights, Adam B. Cox Jan 2007

The Temporal Dimension Of Voting Rights, Adam B. Cox

Faculty Articles

Modern voting rights scholarship agrees on one thing: voting rights are in large part aggregate rights. Accordingly, one cannot evaluate voting rights claims, or the fairness of the electoral system, without establishing the boundaries of appropriate aggregation. This framework has led the literature to focus on spatial aggregation. That is, commentators concentrate on when it is appropriate to aggregate across persons located in different places to determine the fairness (or constitutionality) of a voting rule. Almost entirely overlooked, however, is the possibility of temporal aggregation. To evaluate the fairness of a voting rule, one must also pick a time period …

Ap-Ls Teaching Techniques: Deliberating The Benefits Of Learning Through Focus Groups, Garrett Berman, Judith Platania Jan 2007

Ap-Ls Teaching Techniques: Deliberating The Benefits Of Learning Through Focus Groups, Garrett Berman, Judith Platania

Arts & Sciences Faculty Publications

This article describes how students in an undergraduate legal psychology class utilized focus group research (i.e., a jury simulation exercise) to assist in planning strategies for trial. In addition to conducting the focus group, students were responsible for providing an analysis of the results, and preparing their team for trial. Ultimately, students reported the focus group exercise helped them develop trial strategies, understand the role of trial consultants, and gain a better understanding of scientific jury selection. Rationale, course objectives, and a description of the activity are outlined, as well as suggestions for including this exercise in an upper-level legal …
