Varieties Of Capitalism And The Learning Firm: Contemporary Developments In Eu And German Company Law - A Comment On The Strine-Bainbridge Debate About Shared Values Of Corporate Management And Labor, Peer Zumbansen

Comparative Research in Law & Political Economy

Research in corporate governance and in labour law has been characterized by a disjuncture in the way that scholars in each field are addressing organizational questions related to the business enterprise. While labour has eventually begun to shift perspectives from aspirations to direct employee involvement in firm management, as has been the case in Germany, to a combination of 'exit' and 'voice' strategies involving pension fund management and securities litigation, it remains to be seen whether this new stream will unfold as a viable challenge to an otherwise exclusionary shareholder value paradigm. At the same time, recent suggestions made by …

The Ecj, Volkswagen And European Corporate Law: Reshaping The European Varieties Of Capitalism, Peer Zumbansen, Daniel Saam

Comparative Research in Law & Political Economy

On 23 October 2007, the European Court of Justice handed down its much-awaited Volkswagen decision (Case C-112/2005), following a suit launched by the Commission against the Federal Republic of Germany in 2005. The Volkswagen statute, through which first the Federal government together with the Land (federal state) of Niedersachsen (Lower Saxony), later only Lower Saxony, had reserved a veto against majority acquisition while only holding a fifth of all shares, had come into the Commission's purview as part of its large-scale attempts at reforming and modernizing European company law. The preparatory steps in that regard had been the suits brought …

Transactional Law In The Required Legal Writing Curriculum: An Empirical Study Of The Forgotten Future Business Lawyer, Louis N. Schulze Jr. Jan 2007

Transactional Law In The Required Legal Writing Curriculum: An Empirical Study Of The Forgotten Future Business Lawyer, Louis N. Schulze Jr.

Faculty Publications

Legal Writing courses traditionally focus on litigation writing. The course usually includes assignments on writing interoffice memoranda, drafting trial or appellate briefs, and conducting oral arguments - all in the context of a lawsuit. But, how does this exclusive focus on litigation treat students with no interest in that subject? For future transactional lawyers, the dominance of litigation writing might seem to ignore their needs. Should they be learning how to draft contracts, create corporate documents, or write commercial leasing agreements? This Article examines whether legal writing courses, either in the first year of law school or later, sufficiently address …

Rescue Me: Legislating Cooperation Between Animal Control Authorities And Rescue Organizations, Rebecca J. Huss Jan 2007

Rescue Me: Legislating Cooperation Between Animal Control Authorities And Rescue Organizations, Rebecca J. Huss

Law Faculty Publications

Notwithstanding the overwhelming evidence that shows how important pets are to many people in the United States, the leading cause of death for dogs and cats in this country is euthanasia because of the lack of homes. Although progress has been made, conservative estimates are that between three and four million dogs and cats are euthanized each year. A successful program for implementing non-lethal strategies to control the pet population incorporates three prongs: (a) increasing adoptions, (b) increasing the number of animals sterilized and (c) increasing the number of animals retained in homes. This Article focuses on the legislative actions …

The Domestic Violence Experiences Of Women In Community Corrections, Rachel Bridges Whaley, Angela M. Moe, Mark Eddy, Jean Daugherty

Sociology Faculty Publications

A variety of studies indicate high rates of domestic violence in the backgrounds of women offenders. We examine and extend this work through a qualitative study of women on probation or parole in a western U.S. county. In-depth interviews were conducted with 14 women who participated in a larger study in which only questionnaire data were collected. Participants completed a brief telephone interview about prior experiences of partner violence and then a face-to-face extensive in-person interview. In the analyses, several notable themes emerged regarding the women’s histories of child victimization, partner abuse, substance abuse, coercion into crime, and a lack …

Children With Developmental Disabilities : Considering Positive Impact On The Family System, Tracie L. Self Jan 2007

Children With Developmental Disabilities : Considering Positive Impact On The Family System, Tracie L. Self

Graduate Research Papers

Families who have at least one child with a developmental disability face challenges unique to their situation. With reported incidents of developmental disabilities on the rise, research parameters are being expanded to give more complete consideration of growing family needs. While the historical treatment of these families has often been negative, current research trends have begun to consider positive impact on families.

Positive impact includes areas such as quality of life, the child as a source of happiness, and an overall increase in personal family strength. The trend towards positivism is beginning to be reflected in theoretical understanding and in …

Children’S Sport Participation In Canada: Is It A Level Playing Field?, Dawn E. Trussell, William Mcteer

Kinesiology and Physical Education Faculty Publications

In this article a study of children’s sport participation in Canada is presented, examining both children’s participation in organized sport (with a coach or instructor) and informal sport (without a coach or instructor). This was done using a national sample survey. The results indicate that, for participation in organized sport, household income was the strongest predictor variable, followed by parent’s education, gender, regional differences, and age of the child. In informal sport, gender was the strongest predictor variable, followed by regional differences, household income, age of the child, and parent’s education. The findings are discussed in terms of the implications …

Regis University Student Publications (comprehensive collection)

The Use of Expert Search Warrants in the Criminal Investigation of Acquaintance Molestation Child sexual abuse is a critical social problem throughout the U.S. and the world. Often, a competent and thorough investigation can substantiate or discredit an allegation and notably support a subsequent prosecution of a substantiated case. A manual was created to assist law enforcement detectives who investigate allegations of child sex abuse. The investigative process includes: (a) forensic interviews of child victims, (b) collection of corroborative evidence, (c) analysis of offender characteristics and typologies, (d) offender interviews, and (e) search warrants to include expert search warrants.

Haunting Experiences: Ghosts In Contemporary Folklore, Diane E. Goldstein, Sylvia Ann Grider, Jeannie B. Thomas Jan 2007

Haunting Experiences: Ghosts In Contemporary Folklore, Diane E. Goldstein, Sylvia Ann Grider, Jeannie B. Thomas

All USU Press Publications

Ghosts and the supernatural appear throughout modern culture, in any number of entertainment, commercial, and other contexts. Popular media's commodified representations of ghosts can be quite different from what people believe about them, based on tradition or direct experience. Belief and tradition and the popular or commercial nevertheless continually feed off each other. They frequently share space in how people think about the supernatural. In Haunting Experiences, three well-known folklorists broaden the discussion of ghost lore by examining it from multiple angles in various modern contexts. Diane E. Goldstein, Sylvia Ann Grider, and Jeannie Banks Thomas take ghosts seriously. They …

Folklore/Cinema: Popular Film As Vernacular Culture, Sharon R. Sherman, Mikel J. Koven Jan 2007

Folklore/Cinema: Popular Film As Vernacular Culture, Sharon R. Sherman, Mikel J. Koven

All USU Press Publications

Interest in the conjunctions of film and folklore is stronger and more diverse than ever. Documentaries on folk life and expression remain a vital genre, but scholars such as Sharon Sherman and Mikel Koven also are exploring how folklore elements appear in, and merge with, popular cinema. They look at how movies, a popular culture medium, can as well be both a medium and type of folklore, playing cultural roles and conveying meanings customarily found in other folkloric forms. They thus use the methodology of folklore studies to analyze films made for commercial distribution. The contributors to this book look …

Cultural Factors As Co-Determinants Of Participation In River Basin Management, Bert Enserink, Mita Patel, Nicole Kranz, Josefina Maestu Jan 2007

Cultural Factors As Co-Determinants Of Participation In River Basin Management, Bert Enserink, Mita Patel, Nicole Kranz, Josefina Maestu

All UNF Research

Finding a place for public participation in the policies and practices of European river basin management planning is a challenge for the authorities in the participating countries and territories. Understanding the relation between national culture, the historical and political differences in the respective countries, and their practical experience with participation is considered important to support the implementation of the EU Water Framework Directive. Knowledge and understanding of this relation is important to provide a context and basis from which new participatory practices can be designed and experiences evaluated and to identify conditions necessary for social learning. Within the context of …

Irish Gay Men And Tourism: Behaviours And Motivations, Bruce Carolan Jan 2007

Irish Gay Men And Tourism: Behaviours And Motivations, Bruce Carolan

Conference Papers

This paper is an exploratory study of the holiday practices of an increasingly important segment of the Irish tourism market: gay men. Studies show that gay men are, in many respects, desirable tourists: they tend to be more highly educated, have greater disposable incomes and a higher propensity to travel. Yet there has been relatively little research – and virtually none in an Irish context – concerning gay male holiday destination choice, behaviours, and motivations. After reviewing the existing literature on gay men and tourism, this paper employs qualitative research methods – primarily focus group, depth interviews and observation – …

Social Support And Thriving Health: A New Approach To Understanding The Health Of Indigenous Canadians, Chantelle A.M. Richmond, Nancy A. Ross, Grace E. Egeland Jan 2007

Social Support And Thriving Health: A New Approach To Understanding The Health Of Indigenous Canadians, Chantelle A.M. Richmond, Nancy A. Ross, Grace E. Egeland

Aboriginal Policy Research Consortium International (APRCi)

Objectives. We examined the importance of social support in promoting thriv- ing health among indigenous Canadians, a disadvantaged population.

Methods. We categorized the self-reported health status of 31 625 adult indig- enous Canadians as thriving (excellent, very good) or nonthriving (good, fair, poor). We measured social support with indices of positive interaction, emotional support, tangible support, and affection and intimacy. We used multivariable lo- gistic regression analyses to estimate odds of reporting thriving health, using social support as the key independent variable, and we controlled for educational attainment and labor force status.

Results. Compared with women reporting low levels of …

Learning From The Grandmothers: Incorporating Indigenous Principles Into Qualitative Research, Charlotte Loppie Jan 2007

Learning From The Grandmothers: Incorporating Indigenous Principles Into Qualitative Research, Charlotte Loppie

Aboriginal Policy Research Consortium International (APRCi)

In this article, the author describes the process she undertook to incorporate Indigenous principles into her doctoral research about the midlife health experiences of elder Aboriginal women in Nova Scotia, Canada. By employing qual- itative methods within the context of an Indigenous worldview, she gained knowledge of and developed competence in Aboriginal health research. The emergent partnership among Aboriginal community research facilitators, participating Mi’kmaq women, and the researcher provided many opportunities for the researcher to incorporate the paradigmatic and methodological traditions of Western science and Indigenous cultures. The application of these principles to this study might provide a useful example …
