The Assertion Of Attorney Client Privilege By Counsel In Legal Malpractice Cases - Policy, Privilege And The Search For Truth In Cases Involving Implied Waivers, Lawrence M. Steckman Jan 2007

The Assertion Of Attorney Client Privilege By Counsel In Legal Malpractice Cases - Policy, Privilege And The Search For Truth In Cases Involving Implied Waivers, Lawrence M. Steckman

ExpressO

Waiver of attorney-client privilege frequently arises as an issue in legal malpractice cases. Discovery or privileged communications between client and counsel may show that attorneys other than the malpractice defendant played a substantial role in bringing about the client's loss.

Adolescents’ Negative Experiences In Organized Youth Activities, Jodi Dworkin, Reed Larson Jan 2007

Adolescents’ Negative Experiences In Organized Youth Activities, Jodi Dworkin, Reed Larson

Journal of Youth Development

Research indicates that organized youth activities are most often a context of positive development. However, there is a smaller body of evidence suggesting that these activities are sometimes a context of negative experiences that may impede learning or lead to dropping out. To better understand negative experiences in youth activities, we conducted ten focus groups with adolescents. Youths’ descriptions provide an overview of the range of types of negative experiences they encountered, as well as how they responded to them. The most frequent types of negative experiences involved peers and peer group dynamics and aversive behavior attributed to the adult …

Sex Discrimination In The Labor Market, Joni Hersch Jan 2007

Sex Discrimination In The Labor Market, Joni Hersch

Vanderbilt Law School Faculty Publications

This paper examines sources of gender pay disparity and the factors that contribute to this pay gap. Many researchers question the role of discrimination and instead attribute the residual pay gap to gender differences in preferences. The main issue considered in this paper is whether gender differences in choices, especially with respect to the family and household, are indeed responsible for the gender pay gap, or whether discrimination plays a role. On balance, the evidence indicates that sex discrimination remains a possible explanation of the unexplained gender pay gap. This is consistent with the continuing high profile sex discrimination litigation …

Implicit Affinity Networks, Matthew Scott Smith Jan 2007

Implicit Affinity Networks, Matthew Scott Smith

Theses and Dissertations

Although they clearly exist, affinities among individuals are not all easily identified. Yet, they offer unique opportunities to discover new social networks, strengthen ties among individuals, and provide recommendations. We propose the idea of Implicit Affinity Networks (IANs) to build, visualize, and track affinities among groups of individuals. IANs are simple, interactive graphical representations that users may navigate to uncover interesting patterns. This thesis describes a system supporting the construction of IANs and evaluates it in the context of family history and online communities.

Is Marriage Education Effective? A Meta-Analytic Review Of Marriage Education Programs, Elizabeth Brinton Fawcett Jan 2007

Is Marriage Education Effective? A Meta-Analytic Review Of Marriage Education Programs, Elizabeth Brinton Fawcett

Theses and Dissertations

In the past few decades, several meta-analytic studies have attempted to answer the question: Is marriage education effective (Carroll & Doherty, 2003; Halford, Markman, Kline & Stanley, 2003; Reardon-Anderson, Stagner, Macomber, & Murray, 2004)? However, previous meta-analytic studies have been somewhat limited in their conclusions because they have reviewed a narrow portion of the marriage education spectrum (e.g. premarital education only, Carroll & Doherty, 2003), because they focused only on one particular program (e.g, Couples Communication, Butler & Wampler, 1999), because they failed to differentiate marital therapy from marital education programs (Reardon-Anderson et al., 2005), or because they excluded much …

The Respite And Recreation: An Innovative Recreation Service To Adopted Children With Special Needs, Heewon Yang, Jennifer M. Howard

Journal of Youth Development

Often youth in the foster care system have traumatic experiences associated with abuse and separation from their biological family. These experiences may lead to emotional, psychological, and behavioral problems that challenge the new adoptive family dynamic. This article introduces the Respite and Recreation (R & R) program in a Midwestern area. R & R combines faculty, staff, and graduate students from a local University, local community resources, and staff from a local adoption agency to provide recreation, respite, and professional support services for children with special needs and their adoptive parents. The R & R program provides the adopted children …

Social Pathogenic Sources Of Poor Community Health, Hayden Smith Jan 2007

Social Pathogenic Sources Of Poor Community Health, Hayden Smith

Electronic Theses and Dissertations

The United States currently provides a health care system that is neither efficient nor equitable. Despite outspending the world on health care, over three-fourths of developed countries produce better health outcomes (Auerbach et al., 2000). Simultaneously, the "Ecological School of Thought" has documented the large impact that social, economic, and environmental circumstances play in health outcomes. Unfortunately, these 'ecological" studies are frequently conducted without theoretical justification, and rely solely on a cross-sectional research design and a myriad of unrelated variables. This study represents an important step towards the development of a true theory of "ecology". More specifically, we argue that …

The Impact Of Service Delivery Models On Non-Disabled Peers Intent To Include Their Peers With Disabilities, Michael Campbell Jan 2007

The Impact Of Service Delivery Models On Non-Disabled Peers Intent To Include Their Peers With Disabilities, Michael Campbell

Electronic Theses and Dissertations

In much the same way as the racial integration movement, advocates for students with disabilities (SWD) have cultivated an active and vocal lobby seeking to establish and then implement legal mandates to integrate classrooms in the hope that social acceptance would follow. Through federal mandates such as the Individuals with Disabilities Education Act (IDEA), conceptually initiated in 1975 and revised in 2004 as the Individuals with Disabilities Education Improvement Act (IDEIA) along with Section 504 of the Rehabilitation Act of 1973, these students have a voice to cry out for access to the experiences of work, conversation and play with …
