Domestic Violence And Human Rights: Local Challenges To A Universal Framework, Karen Morgaine Mar 2007

Domestic Violence And Human Rights: Local Challenges To A Universal Framework, Karen Morgaine

The Journal of Sociology & Social Welfare

Over the past 15-20 years there has been a dramatic increase in transnational social movements including the movement to eradicate violence against women. This paper examines the development of the transnational women's movement and the prioritizing of violence against women (VAW) as a universal women's agenda using the United Nations (U.N.) human rights conferences as a focal point. As one form of VAW, domestic violence (DV) has been placed into the human rights context by many organizations globally. The implications and possible limitations of universalizing a framework for DV are explored using salient examples from various areas of the world. …

Undermining Progress In Early 20th Century North Carolina: General Attitudes Towards Delinquent African American Girls, Tanya Smith Brice

The Journal of Sociology & Social Welfare

This article examines efforts made to challenge progress towards adequate service provision for delinquent African American girls in early 20th century North Carolina. This article seeks to explore the nuances of aid, from the African American community and by progressive whites, as it relates to legislative efforts, economic backing and public health issues. It also seeks to examine motivations for engaging in undermining activities.

Sex Panic And The Welfare State, Benjamin Shepard Mar 2007

Sex Panic And The Welfare State, Benjamin Shepard

The Journal of Sociology & Social Welfare

2006 marked the tenth anniversary of the Personal Responsibility and Work Opportunity Reconciliation Act. The 1996 law was the culmination of decades of erosion in backing for basic provisions of the U.S. social safety net. The following reviews the political campaign that undermined thefoundationfor this vital component of the New Deal/Great Society income supports. A series of panics diminished approval for the welfare state, leading to the 1996 "reform." Panic discourse increasingly accompanies policy debate. Examples of anti welfare, anti outsider panic discourses are explored.

Cultural Rage: A Severe Threat To Gay Men, Rhoda Howard-Hassmann Mar 2007

Cultural Rage: A Severe Threat To Gay Men, Rhoda Howard-Hassmann

Human Rights & Human Welfare

Men who have sex with men have become a world cultural flashpoint. Fomenting and exploiting cultural rage at the West is a useful way for Islamists to gain electoral and other types of support, even though the motives of the Islamists may have more to do with the drive for power, regional influence, or economic benefit.

How Qualitative Research Changed Me: A Narrative Of Personal Growth, Avital Feuer Mar 2007

How Qualitative Research Changed Me: A Narrative Of Personal Growth, Avital Feuer

The Qualitative Report

This piece recounts personal changes I underwent while collecting data for my dissertation. Stemming from my own personal experiences of anomie and feelings of not belonging to the languages and cultures of either Canada or Israel , this inquiry examined the collusion of my attitudes with the attitudes of advanced Hebrew learners of diverse backgrounds and beliefs in a Canadian undergraduate university class. As the themes of claims and ownership of the Hebrew language emerged between clashing sub-groups in the classroom, I examined my own biases and stereotypes regarding language, and ultimately grew into a peaceful acceptance of my position …

Towards An Understanding Of Excellence In Ur Ban Pedagogy: A Portrait Of A High School, Renu Ahuja Mar 2007

Towards An Understanding Of Excellence In Ur Ban Pedagogy: A Portrait Of A High School, Renu Ahuja

The Qualitative Report

This case study describes processes in an urban high school, which contribute to excellence in urban pedagogy, and investigates teachers’ and educational leaders’ perceptions of the factors influencing their commitment to school success. Six themes related to excellence in urban pedagogy were identified. Data in the form of semi-structured interviews, observations, and document review de scribe a school in which the leadership strives to develop human capability at all levels through empowerment and shared decision-making. The study indicates that students’ achievement is a collective responsibility and strong instructional leadership is a key for success in urban schools. More studies may …

Combining Historical Research And Narrative Inquiry To Create Chronicles And Narratives, Richard A. Wilson Mar 2007

Combining Historical Research And Narrative Inquiry To Create Chronicles And Narratives, Richard A. Wilson

The Qualitative Report

Stories about the Idaho State Library, chronicles and narratives, are reported in my doctoral dissertation (Wilson, 2005). The chronicles, reconstructed from documents and records, provided a presentation of the people, events, and activities to frame the stories. The narratives, excerpted from interviews, provided the rich description and unique perspectives of the two living State Librarians who directed the agency between 1962 and 2005. The focus of this paper is a presentation and discussion of the use of historical research and narrative inquiry to create chronicles and narratives.

Understanding Total Quality Management In Context: Qualitative Research On Managers’ Awareness Of Tqm Aspects In The Greek Service Industry, Alexandros G. Psychogios, Constantinos Vasilios Priporas Mar 2007

Understanding Total Quality Management In Context: Qualitative Research On Managers’ Awareness Of Tqm Aspects In The Greek Service Industry, Alexandros G. Psychogios, Constantinos Vasilios Priporas

The Qualitative Report

This study addresses managers’ awareness and familiarity with Total Quality Management (TQM). Eighteen (18) semi-structured, in-depth interviews were conducted with managers working in a variety of service organizations in Greece. The major argument of the study is that although the acronym TQM and some of its concepts and practices are known by a range of public and private sector managers, actual awareness of its “soft” side is often superficial, and managers have a relatively poor understanding of it. TQM is neither resisted nor directly absorbed by them, but they tend to see it from the technical point of view, being …

Mentoring Qualitative Research Authors Globally: The Qualitative Report Experience, Ronald J. Chenail, Sally St. George, Dan Wulff, Maureen Duffy, Martha Laughlin, Kate Warner, Tarmeen Sahni

The Qualitative Report

Authoring quality qualitative inquiry is a challenge for most researchers. A lack of local mentors can make writing even more difficult. To meet this need, The Qualitative Report ( TQR ) has helped authors from around the world develop their papers into published articles. TQR editorial team members will discuss the history of the journal, their philosophy of author development; manuscript development strategies; solutions for managing differences; challenges working worldwide; authors’ feedback; and the collective global futures of TQR and qualitative researcher

Embracing The Practical, The Pragmatic, And The Personal: A Review Of Clive Seale, Giampietro Gobo, Jaber F. Gubrium, And David Silverman’S Qualitative Research Practice, Ronald Chenail

The Qualitative Report

In their 2007 book, Qualitative Research Practice: Concise Paperback Version, Clive Seale, Giampietro Gobo, Jaber F. Gubrium, and David Silverman have offered students, teachers, and researchers a practical guide for understanding and conducting qualitative research. In doing so, they and their chapter contributing colleagues have also taken us as readers into their insiders’ worlds of being qualitative researchers, so we can benefit from their self-narratives of the “nitty-gritty of research practice.” The result is an excellent text that is both pragmatic and personal.

Oral History As A Social Justice Project: Issues For The Qualitative Researcher, Valerie J. Janesick Mar 2007

Oral History As A Social Justice Project: Issues For The Qualitative Researcher, Valerie J. Janesick

The Qualitative Report

I am writing this to assist researchers in training and experienced researchers in understanding ways to view oral history as a social justice project. This paper will illuminate the importance of oral history in terms of enriching the knowledge base of qualitative research methods as well. Oral history provides us with an avenue of thick description, analysis, and interpretation of people’s lives through probing the past in order to understand the present .The postmodern appreciation of the study of people and their stories, those stories from persons generally on the outside or periphery of society, offer a unique opportunity to …

Qualitative Research In Counseling: A Reflection For Novice Counselor Researchers, Randolph Bowers, Victor Minichiello, David Plummer Mar 2007

Qualitative Research In Counseling: A Reflection For Novice Counselor Researchers, Randolph Bowers, Victor Minichiello, David Plummer

The Qualitative Report

Counselors practice in a wide range of disciplines, but also represent a distinct discipline separate from medicine, psychology, and social work. Particularly in countries like Australia, Canada, and the Asia Pacific nations, as a relatively new field, counseling is taking up the challenges of encouraging a research culture that can both critique and support clinical practice and counselor education. This paper is thus written to support novice counselor researchers, and to inspire an emerging research culture through sharing formative experiences and lessons learned during a qualitative research project exploring minority issues in counseling.

Mapping Change Management: A Co-Citation Analysis, Brian R. Low Mar 2007

Mapping Change Management: A Co-Citation Analysis, Brian R. Low

Theses and Dissertations

Today's organizations are continually undergoing changes to make improvements in their efficiency and effectiveness. The ability of organizations to effectively implement and sustain successful change, however, has been limited, with most change initiatives failing to attain the desired success. To counter this trend, researchers across several disciplines have worked to provide practitioners better insight into how to facilitate change within their organizations. This research has resulted in many theories as to what constitutes change and how best to implement it, but it lacks a unifying theory that encompasses all aspects of change research. This effort takes a step toward a …

The Chaos Of Katrina: A Nonlinear Analysis Of Federal Logistics Support During Hurricane Katrina Relief Operations, Gerald W. Morris Jr. Mar 2007

The Chaos Of Katrina: A Nonlinear Analysis Of Federal Logistics Support During Hurricane Katrina Relief Operations, Gerald W. Morris Jr.

Theses and Dissertations

This thesis presents a case study of federal logistics support during Hurricane Katrina disaster relief operations. Data from federal contracts covering the first 10 weeks of Katrina are used to measure federal logistics activity. The study investigates whether chaos theory, part of complexity science, can extract information from Katrina contracting data to help managers make better logistics decisions during disaster relief operations. The study uses three analytical techniques: embedding, fitting the data to a logistic equation, and plotting the limit-cycle. Embedding and fitting a logistic equation to the data were used to test for deterministic chaos. The logistic equation and …

Examining Clandestine Social Networks For The Presence Of Non-Random Structure, Joshua S. Seder Mar 2007

Examining Clandestine Social Networks For The Presence Of Non-Random Structure, Joshua S. Seder

Theses and Dissertations

This thesis develops a tractable, statistically sound hypothesis testing framework for the detection, characterization, and estimation of non-random structure in clandestine social networks. Network structure is studied via an observed adjacency matrix, which is assumed to be subject to sampling variability. The vertex set of the network is partitioned into k mutually exclusive and collectively exhaustive subsets, based on available exogenous nodal attribute information. The proposed hypothesis testing framework is employed to statistically quantify a given partition's relativity in explaining the variability in the observed adjacency matrix relative to what can be explained by chance. As a result, valuable insight …

Romance And Sexual Initiation Among Unmarried Young People In Vietnam: A Multi-Method Approach, Bussarawan Teerawichitchainan Mar 2007

Romance And Sexual Initiation Among Unmarried Young People In Vietnam: A Multi-Method Approach, Bussarawan Teerawichitchainan

Research Collection School of Social Sciences

Young men represent the highest proportion of sexually experienced unmarried population in Vietnam. Increasing levels of sexual activity, combined with reported low levels of knowledge about sex, HIV/AIDS, and STIs and an aversion to using contraceptives, suggest that they are ill-prepared to deal with Vietnam's emerging HIV epidemic. This study uses a multi-method approach to assess sexual activity and attitudes concerning romantic love among never-married men. I analyze the nationally representative Survey Assessment of Vietnamese Youth to examine patterns of emotional relationships and physical behaviors preceding young men's sexual initiation as well as determinants of premarital sex and an aversion …

Contracts As Organizations, D. Smith, Brayden King Mar 2007

Contracts As Organizations, D. Smith, Brayden King

Faculty Scholarship

Empirical studies of contracts have become more common over the past decade, but the range of questions addressed by these studies is narrow, inspired primarily by economic theories that focus on the role of contracts in mitigating ex post opportunism. We contend that these economic theories do not adequately explain many commonly observed features of contracts, and we offer four organizational theories to supplement – and in some instances, perhaps, challenge – the dominant economic accounts. The purpose of this Article is threefold: first, to describe how theoretical perspectives on contracting have motivated empirical work on contracts; second, to highlight …

Inside The Law School Classroom: Toward A New Legal Realist Pedagogy, Elizabeth Mertz Mar 2007

Inside The Law School Classroom: Toward A New Legal Realist Pedagogy, Elizabeth Mertz

Vanderbilt Law Review

In recent years, the legal academy has been experiencing a strong renewed interest in empirical legal research. Referred to by various analysts as a "new legal realism" or as "empirical legal studies," this restored focus on the social sciences in many ways echoes an earlier era of legal realism in American law, with some important differences.' . . .

This Article combines these two themes: empirical research on law and careful examination of legal education. It reports on an empirical study of legal education, which I have been conducting under the auspices of the American Bar Foundation (a research institute …

A Damn Hard Thing To Do, John H. Schlegel Mar 2007

A Damn Hard Thing To Do, John H. Schlegel

Vanderbilt Law Review

Back in the mid-eighties, I offered a first year, second semester "un-elective" called American Legal Theory and American Legal Education. It scrunched together two history courses I had taught irregularly before. I liked the way the two topics fit together and still do, but with so many recalcitrant law students enrolled in it, the course was an unmitigated disaster. As is always the case with such attempts at offering perspective, amidst the shambles I had acquired at least a few devoted students. At the end of the last class one of them came up to the front to ask a …

Can Law Survive Legal Education?, Ernest J. Weinrib Mar 2007

Can Law Survive Legal Education?, Ernest J. Weinrib

Vanderbilt Law Review

Legal education exists at the confluence of three activities: the practice of law, the enterprise of understanding that practice, and the study of law's possible understandings within the context of a university. The first of these, the practice of law, consists of the activities consciously governed by law, including, for example, lawyers giving legal advice, citizens contemplating the legality of prospective actions, legislators creating law within the limits of their jurisdiction, and judges determining the rights and duties of litigants. It thus comprehends the entire field of legal institutions, legal doctrine, and legal interaction. The second activity, the enterprise of …

Goodbye To All That? A Requiem For Neoconservatism, Kenneth Anderson Mar 2007

Goodbye To All That? A Requiem For Neoconservatism, Kenneth Anderson

Scholarly Articles in Law Reviews & Journals

American University, WCL Research Paper No. 2008-74 Abstract: The war on terror and the war in Iraq have occasioned a ferocious debate over the Bush administration's commitment to neo-conservatism as the guiding philosophy behind war aiming at democratic transformation. Two recent, widely noticed 2006 books have attacked neo-conservatism - one, by a former neoconservative, Francis Fukuyama (After the Neocons: America at the Crossroads), and a second, by a centrist liberal, Peter Beinart (The Good Fight). Each seeks to anatomize neo-conservatism and what, in each author's view, has gone wrong with it; each seeks to offer an alternative foreign policy. This …

On Logic In The Law: Something, But Not All, Susan Haack Mar 2007

On Logic In The Law: Something, But Not All, Susan Haack

Articles

In 1880, when Oliver Wendell Holmes (later to be a Justice of the U.S. Supreme Court) criticized the "logical theology" of law articulated by Christopher Columbus Langdell (the first Dean of Harvard Law School), neither Holmes nor Langdell was aware of the revolution in logic that had begun, the year before, with Frege's Begriffsschrift. But there is an important element of truth in Holmes's insistence that a legal system cannot be adequately understood as a system of "axioms and corollaries"; and this element of truth is not obviated by the more powerful logical techniques that are now available.

Backlash's Travels, Cass R. Sunstein Mar 2007

Backlash's Travels, Cass R. Sunstein

Public Law and Legal Theory Working Papers

Sometimes the public greatly opposes the decisions of the Supreme Court; sometimes the Court seems to anticipate public backlash and even to respond to it when it occurs. Should a social planner want the Court to anticipate or to respond to backlash? No abstract answer is possible; the appropriate conclusion depends on assumptions about the capacities of courts and the capacities of those who engage in backlash. This point is demonstrated through an exploration of four imaginable worlds: Olympus, the Land of the Ancients, Lochnerland, and Athens. The four worlds reflect radically different assumptions about judicial and public capacities. The …

On Becoming A Qualitative Researcher: The Value Of Reflexivity, Diane Watt Mar 2007

On Becoming A Qualitative Researcher: The Value Of Reflexivity, Diane Watt

The Qualitative Report

Learning how to conduct qualitative research may seem daunting for those new to the task, especially given the paradigm ’s emphasis on complexity and emergent design. Although there are guidelines in the literature, each project is unique and ultimately the individual researcher must determine how best to proceed . Reflexivity is thus considered essential, potentially facilitating understanding of both the phenomenon under study and the research process itself . Drawing upon the contents of a reflective journal, the author provides an inside view of a first project, making connections between theory and practice. This personal narrative highlights the value of …
