Markov Processes In Single Molecule Fluorescence, David Talaga Dec 2007

Markov Processes In Single Molecule Fluorescence, David Talaga

Department of Chemistry and Biochemistry Faculty Scholarship and Creative Works

This article examines the current status of Markov processes in single molecule fluorescence. For molecular dynamics to be described by a Markov process, the Markov process must include all states involved in the dynamics and the first-passage time (FPT) distributions out of those states must be describable by a simple exponential law. The observation of non-exponential FPT distributions or other evidence of non-Markovian dynamics is common in single molecule studies and offers an opportunity to expand the Markov model to include new dynamics or states that improve understanding of the system.

Effectiveness Of An Evidence-Based Curriculum Module In Nursing Schools: Targeting Safe Patient Handling And Movement, Nancy Menzel, Audrey L. Nelson, Thomas R. Waters, Nancy Hughes, Pamela C. Hagan, Gail Powell-Cope, Viviam Thompson Dec 2007

Effectiveness Of An Evidence-Based Curriculum Module In Nursing Schools: Targeting Safe Patient Handling And Movement, Nancy Menzel, Audrey L. Nelson, Thomas R. Waters, Nancy Hughes, Pamela C. Hagan, Gail Powell-Cope, Viviam Thompson

Nursing Faculty Research

Nursing schools in the United States have not been teaching evidence-based practices for safe patient handling, putting their graduates at risk for musculoskeletal disorders (MSDs). The specific aim of this study was to translate research related to safe patient handling into the curricula of nursing schools and evaluate the impact on nurse educators and students' intentions to use safe patient handling techniques. Nurse educators at 26 nursing schools received curricular materials and training; nursing students received the evidence-based curriculum module. There were three control sites. Questionnaires were used to collect data on knowledge, attitudes, and beliefs about safe patient handling …

The Political Appropriation Of Caves In The Upper Belize Valley, Michael J. Mirro Dec 2007

The Political Appropriation Of Caves In The Upper Belize Valley, Michael J. Mirro

KIP Theses and Dissertations

The problem of associating caves with specific centers or polities has been a problem in the field of cave archaeology for some time. This thesis explores new methods for documenting the political appropriation of caves distant from centers in the Belize River Valley during the Late Classic Maya period (A.D. 590 to 890). It focuses on polities that may have been utilizing Barton Creek Cave and draws on methods developed in settlement archaeology for assessing relationships between small sites and large centers and for defining political boundaries. Specifically, the thesis examines several ceramic types whose distribution in the Belize Valley …

Criminal Law, Franklin J. Hogue, Laura D. Hogue Dec 2007

Criminal Law, Franklin J. Hogue, Laura D. Hogue

Mercer Law Review

As in previous years, we cannot comment on every development in criminal law in Georgia that occurred this past year through appellate opinions and statutory changes. We cannot even footnote all of them. Instead, we have chosen cases that are the most important or the most interesting or those that may have the widest application to the future course of criminal practice and procedure. We hope this Article is useful to our colleagues who practice criminal law.

The Original Understanding Of The New Hampshire Constitution’S Education Clause, Edward C. Mosca Dec 2007

The Original Understanding Of The New Hampshire Constitution’S Education Clause, Edward C. Mosca

The University of New Hampshire Law Review

[Excerpt] “In 1993, the New Hampshire Supreme Court held that “part II, article 83 [of the state constitution] imposes a duty on the State to provide a constitutionally adequate education to every educable child in the public schools in New Hampshire and to guarantee adequate funding,” and that this duty is enforceable by the judiciary. This decision, known as Claremont I, was the wellspring of a line of decisions that has radically changed both the manner in which public education is funded in New Hampshire and the respective roles of the judicial branch and the representative branches in formulating education …

A Wolf In Sheep’S Clothing: The Unilateral Executive And The Separation Of Powers, Thomas J. Cleary Dec 2007

A Wolf In Sheep’S Clothing: The Unilateral Executive And The Separation Of Powers, Thomas J. Cleary

The University of New Hampshire Law Review

[Excerpt] “The United States Constitution vests all executive powers in a president. This is the unitary executive theory. By virtue of this, many believe the president is vested with the power to act unilaterally. This is the unilateral executive theory. However, the unilateral executive portends more than action. In reality, the unilateral executive theory provides an opportunity to implement a unilateral agenda. Thus, the aim of this paper is to consider executive power, the separation of powers, and the unilateral executive theory to determine if presidential power under the separation of powers doctrine is actually “a wolf in sheep’s clothing.” …

Shake & Bake: Dual-Use Chemicals, Contexts, And The Illegality Of American White Phosphorus Attacks In Iraq, Joseph D. Tessier

The University of New Hampshire Law Review

[Excerpt] “On November 29, 2005, in a Department of Defense press conference with Secretary of Defense Donald Rumsfeld and Gen. Peter Pace, Chairman of the Joint Chiefs of Staff, General Pace stated that white phosphorus “is a legitimate tool of the military,” and can be used for illumination, smoke, and incendiary purposes. Incredibly, the Department of Defense released an addendum to the press conference clarifying that white phosphorus was not used as an incendiary weapon. According to General Pace, “it was well within the law of war to use white phosphorus . . . for marking and screening.” This was …

Sold Downstream: Free Speech, Fair Use, And Anti-Circumvention Law, R. Terry Parker Dec 2007

Sold Downstream: Free Speech, Fair Use, And Anti-Circumvention Law, R. Terry Parker

The University of New Hampshire Law Review

[Excerpt] “Here’s a hypo. Living in Asia, I purchased a shameful amount of music and movies, all legit purchases through reputable stores, HMV and Tower Records, but little of which will get reissued. I wanted to preserve my collection but software in the discs prevented me from ripping backup copies to my computer. Lacking the technological savvy to get around this software myself, I purchased and used a product to help me circumvent these controls. Discuss.

Courts agree that copying the music and movies here is infringement but that fair use may provide a defense. However, courts do not agree …

Growth/Decline Of Employment Subcenter In Polycentric Regions: The Case Of The Dallas-Fort Worth Metropolitan Area, Maher Sayel Al-Shammari

Public Affairs Dissertations - Archive

This research is concerned with explaining the variation in growth rates among employment subcenters. The purpose of the study is to find answers to the question: What factors/variables contribute to the growth or decline of employment subcenters? More specifically, the study aims to 1) identify and describe employment subcenters in the Dallas-Fort Worth metropolitan area, and 2) explain the variation in their growth rate over a specified period of time through testing a set of variables extracted from related literature. A multiple regression analysis technique is employed to complete the empirical analysis. The DFW metropolitan area was chosen as a …

Factors Influencing The Relationship Between Nonprofit Child Care Providers And The Texas Department Of Family And Protective Services As A Predictor Of Policy Outcomes, Larry Watson Dec 2007

Factors Influencing The Relationship Between Nonprofit Child Care Providers And The Texas Department Of Family And Protective Services As A Predictor Of Policy Outcomes, Larry Watson

Public Affairs Dissertations - Archive

Over the past 30 plus years, there has been a shift in public administration responsibilities from providing direct services to the complex functions of contract management. Public administrators must now perform functions across jurisdictional lines to accomplish the purposes of the state (Frederickson & Smith, 2003). Public administrators can no longer be concerned only with the functions of government but must accomplish their work through the private and nonprofit sectors as well. The movement from the provision of direct services to the management of contracts is evident in Texas, where state legislators are working to privatize the state's child welfare …

Planning For Growth In Cities And Metropolitan Regions: An Empirical Study Of Impact Fees And Choice, Chi-Hyoung Park Dec 2007

Planning For Growth In Cities And Metropolitan Regions: An Empirical Study Of Impact Fees And Choice, Chi-Hyoung Park

Planning Dissertations - Archive

This research examines what city factors relate to the likelihood of adopting impact fees by local governments within metropolitan regions using data from the U.S. Census Bureau. More and more cities are adopting different types of impact fees for financing public facilities and infrastructure to accommodate their cities' growth without full understanding of issues, public and private criticisms of impact fees, and the empirical information needed. This dissertation investigates a random sample of 278 cities out of 827 cities populations over 25,000 located within 97 MSAs to understand what variables within their settings relate to impact fee adoptions using five …

A Comparative Study Of Performance Measurement In Korean Local Governments Using Data Envelopment Analysis And Stochastic Frontier Analysis, Dong Jin Lim Dec 2007

A Comparative Study Of Performance Measurement In Korean Local Governments Using Data Envelopment Analysis And Stochastic Frontier Analysis, Dong Jin Lim

Planning Dissertations - Archive

This study examines efficiency as a key component of performance, applies new performance measurement techniques to the measurement of local government performance, and verifies theoretical debates on economic, financial, political, and environmental factors related to performance in local government. Improving performance and promoting efficiencies in local government are important issues in both academic and practical public administration. Despite the remarkable development of performance measurement in local government since the 1990s, empirical evidence is still limited on the extent of the utility and practicability of performance measurement in local government.

Results of this research are developed from a study of Korean …
