Kentucky Transportation Center Research Report

The Federal Highway Administration (FHWA) requires state transportation agencies to submit a biennial report on local highway finances. The purpose of these reports is to provide FHWA with the data it needs to capture the financing of highway activities at the local level. Based on this information, it can identify trends in revenue, expenditures, investments, and program development, and in turn make decisions about future investments. The report, FHWA-536, asks agencies to report on four areas of local highway finance: 1) disposition of highway-user revenues; 2) revenues used for roads and streets identified by source and funding type; 3) road …

Economic Efficiency Versus Public Choice: The Case Of Property Rights In Road Traffic Management, Jonathan Remy Nash

Public Law and Legal Theory Working Papers

This Article argues, using the case of responses to traffic congestion, that public choice provides a greater explanation for the emergence of property rights than does economic efficiency. While the traditional solution to traffic congestion is to provide new roadway capacity, that is not an efficient response in that it does not lead to internalization of costs. Moreover, over time new capacity may serve to exacerbate congestion problems: New roadway capacity may induce additional travel that would not have taken place but for the new construction. By contrast, congestion charges—that is, imposing tolls designed to force drivers to internalize the …

The Georgia Appellate Courts continue to consider and clarify the impact of the Tort Reform Act of 2005 on trial practice and procedure while addressing other legislation and case law similarly imperative to litigation in Georgia courts. Although the Georgia General Assembly enacted less legislation related to trial practice and procedure during this survey period than in recent years, the few laws passed are noteworthy.

This thesis compares the HIV/ AIDS policies in the United States of America and the United Kingdom since the emergence of the virus in 1981. Despite a privatized health care system in the U.S. and the universal system in the UK, which lie on opposite ends of the policy care spectrum, similar populations have recently emerged as those most in need of health care services, preventative programs, and financial assistance. This thesis employs several quantitative and qualitative data to highlight the emergence of women and minorities in both nations as those that are most in need of resources. Data has …

Evaluation Of The Role Of Driver’S Knowledge Of Who Has The Right-Of-Way Contributes To Interstate On-Ramp Crashes, Deogratias Eustace, Vamsi Krishna Indupuru

Civil and Environmental Engineering and Engineering Mechanics Faculty Publications

The knowledge of drivers on who has the right-of-way between the one on mainline lanes of a freeway and the one entering the freeway through on-ramp junction lane was evaluated. In addition, drivers’ opinions on how to make the on-ramp junctions safer were collected. A survey instrument with 21 items requesting drivers’ information in regard with demographics, freeway driving experience, knowledge of right-of-way and merging practices was used for data collection. The results show that crashes are relatively rare events and for some reasons, most of them never happen but result into near misses, which can not be reported and …

In her paper, "Literary and Cinematic Responses to the Crime Story in Contemporary France," Deborah Streifford Reisinger examines society's relationship to violence in an era of increased media dominance. Reisinger's interdisciplinary approach integrates media, cinema, and literary studies to analyze how the crime story functions as a site of discursive struggle. Reisinger focuses on the sensational Paulin and Succo affairs that became mobile signifiers about crime, insecurity and the Other in France in the 1980s. The Empire Of Illness: Competence And Coercion In Health-Care Decision Making, Marsha Garrison

The law's willingness to take account of factors that interfere with volition tends to vary in accordance with its underlying goals. The law of wills is dominated by the principle of freedom of testation; it has thus developed doctrines aimed at detecting coercive influences that interfere with the testator's free agency. The law of medical decision making, dominated by the analogous principle of patient autonomy, has not developed doctrines aimed at detecting coercive influences despite a large and growing body of evidence showing that disordered insight and major depression, two common medical conditions, often have a coercive, negative effect on …
