Hurricane Katrina destroyed the homes of many people living in parts of the Gulf Region. The storm displaced as many as 800,000 victims and it is still difficult for them to return home. Consequently, many homeowners have turned to renting because of the slow recovery process. Renters face added difficulties; they are often the last in line for government benefits and other assistance. There is much hostility towards the rights of renters, creating even more difficulties for them.

Organizational Trauma: A Phenomenological Study Of Leaders In Traumatized Organizations, Shana D. Lynn Hormann

While some organizations die when trauma erupts, others do not succumb. They live and even thrive. The purpose of this study was two-fold: 1. To learn from leaders their perspectives about key conditions that allow organizations to withstand and heal from organizational trauma; and, 2. To inform practice about building and strengthening these conditions in organizations. Participants were leaders who led their organizations during an organizational trauma or who came into programs after the trauma occurred to facilitate recovery. Nine executive directors for sexual assault programs participated in this hermeneutic phenomenological study, sharing their experiences and reflections. Two composite depictions …

This paper traces the history of the ancillary police powers doctrine in Canadian police law/ constitutional law over the past 40 years. It identifies a doctrine creep wherein a heading of police power which had modest origins has expanded massively. The expansion is spatial and conceptual and reached its reductio ad absurdum when the entire central area of Quebec city was zoned into no-go areas by police acting without legislative authority, claiming the right to erect barricades in public streets, to issue passes (or not) as necessarily ancillary to police powers. The focus of this project was on the development of a software tool for analysis of crime data at the West Virginia State Police Forensics Laboratory (WVSPFL). The tool enables users to conduct statistical analysis on criminal activity; in addition, data mining methods are implemented to identify possible crime patterns. A Crime database was implemented; it contains information on incidents submitted to WVSPFL over the last fifteen years. The WVSPFL database was integrated with a hypothetical conviction database. he most recent trend in historic preservation has led many in the field to pay attention to cultural landscapes as historic resources. Considering buildings, structures, or objects within a given spatial and physical setting, or landscape, endows them with historic significance and context that would be absent if viewed individually. The military occupation of Nicaragua was one of the Calvin Coolidge administration’s most unpopular foreign policies. Upon the death of President Warren G. Harding in 1923, Coolidge inherited the White House and a Nicaraguan withdrawal plan set up years earlier. As planned, the United States monitored the Nicaraguan national elections in 1924, and withdrew its occupation force in 1925. When the country collapsed into civil war a few months later, the Coolidge administration ordered the Marines back into Nicaragua to restore order. Coolidge and his Secretary of State, Frank B. Kellogg, argued the occupation was necessary to protect American economic …

Protecting Constitutionalism In Treacherous Times: Why 'Rights' Don't Matter, W. Wesley Pue

Common lawyers have focused too much on rights talk and especially on constitutionally entrenched Bills of Rights in critiquing Anti-Terrorism legislation enacted by democratic common law countries since September 11, 2001. This paper illustrates the ways in which rights talk acts as a distraction from fundamental principles of legality when Anti-Terrorism laws are considered, arguing that embedded rights play three roles antithetical to sustaining governance in accordance with fundamental principles of legality: the roles of paper tiger, Trojan horse, and narcotic.

Federalism, Multi-Level Governance And Tobacco Control: Comparative Public Policy In The United Kingdom And South Africa., Bossman E. Asare

The dissertation investigates the effects of federalism and multi-level governance on tobacco control policy in the United Kingdom and South Africa. It uses theories of federalism and multi-level governance, as well as policy transfer (diffusion) and interest groups politics to investigate their effects on tobacco control policy adoption. Methodologically, the research uses comparative case analyses augmented by elite interviews and secondary sources. The study found that each of the various explanations have influenced the adoption of comprehensive tobacco control policies in the two countries. In the end, the study argues that the policies of the two countries are converging, except …

Regardless of whether organizations are in the private sector or in the public sector, there is a general agreement that human resources are critical to keeping organizations effective as well as maintaining a high level of organizational performance. What effect has Professor Henkin's work had upon your own thoughts or scholarship in the human rights field?

My scholarly work spans the fields of international human rights and U.S. foreign relations law. I am particularly interested in the process by which human rights norms are implemented into domestic legal systems, the role the United States plays in promoting the internalization of human rights norms by other states, and the mechanisms by which the values of the international human rights regime are incorporated into the United States domestic legal system.

The School-To-Work Transition Of Students With Learning Disabilities: The Influence Of Identity Status, Personality, And Career Decidedness On Career Decision Making, Jennifer L. Merry

Students with learning disabilities have higher dropout rates and have lower wages and employment rates. Furthermore, students with learning disabilities are less likely to have a full-time job and are more likely to attend a two-year college rather than a four-year college compared to those without disabilities. Approximately three million students are classified as having a specific learning disability in the United States. The challenges and struggles they deal with during the school years continues into the world of work. The core element for emergency involuntary commitment is dangerousness to oneself or others. Statutes typically also mandate immediate or near immediate petition to the courts, and require immediate or near immediate professional psychiatric review. This chapter reviews the case law associated with civil commitment statutes, both historically and in terms of current issues.

The Problem Of Official Discretion In Anti-Terrorism Law: Comment On Khawajah, W. Wesley Pue, Robert Russo

This paper assesses the first judicial ruling on key provisions of the Anti Terrorism Act. Rutherford J.'s ruling struck down provisions creating a motive requirement in the definition of terrorist activity while upholding the overall structure of the act against challenges on the basis of overbreadth and vagueness. A fault-line divides the two sides of the ruling. On one side the court looked to the lived-experience of legal rules, concluding that including motive requirements would mislead officials in the direction of improper and unconstitutional racial or religious profiling. Individualism And Collectivism In America: The Case Of Gun Ownership And Attitudes Toward Gun Control, Katarzyna Celinska

A number of sociologists and cultural psychologists claim that the United States is a predominantly individualistic country. This article uses a unidimensional index of individualism and collectivism to analyze one of the most debated sociopolitical issues in America: gun ownership and gun control. It tests the hypothesis that the widespread gun ownership in the United States and prevailing attitudes toward gun control represent competing individualistic and collectivistic cultural traditions, respectively. The findings indicate that the index is one of the predictors of gun ownership and of attitudes about gun permits.

The Boston University International Law Journal is publishing, for the first time, an English version of the 2004 Arab Charter on Human Rights. A very brief review of how the 2004 Arab Charter came into being introduces this English translation. The drafting history of the Arab Charter on Human Rights begins in 1960. In that year, members of the Union of Arab Lawyers (the oldest NGO in the Arab world) requested the League of Arab States (created in 1945) during their meeting in Damascus to adopt an Arab Convention on Human Rights. Measuring The Impact Of Urban Amenities On Average Wages In Metropolitan Areas, Benjamin Burry '07

This paper seeks to quantify the impacts of climate, crime, population density, and travel time on median hourly wage in urban areas using the hedonic approach. In accordance with theory of utility equalization across urban areas, worker ski11level, job composition, and intercity cost of living differences are held constant. This study's sample size consists of thirty-one metropolitan statistical areas in the continental U.S. with a population greater than five hundred thousand. Results support a significant impact ofurban amenities on wages.
