Tax And Economic Policy Responses To The Medicaid Long-Term Care Financing Crisis: A Behavioral Economics Approach, Diane Lourdes Dick
Tax And Economic Policy Responses To The Medicaid Long-Term Care Financing Crisis: A Behavioral Economics Approach, Diane Lourdes Dick
Cardozo Public Law, Policy & Ethics Journal
The article examines the escalating strain on Medicaid due to rising long-term care costs and an aging population, emphasizing the ineffectiveness of current policies promoting private insurance. It critiques traditional economic models for neglecting behavioral factors like emotional resistance to planning for aging and underestimating future care needs. The analysis concludes that voluntary measures, such as tax incentives and partnership programs, are insufficient and advocates for a universal compulsory program to ensure adequate preparation for long-term care, thereby reducing Medicaid reliance.

Chinese Americans And The Borderland Experience On Golden Mountain: The Development Of A Chinese American Identity In The Woman Warrior: Memoirs Of A Girlhood Among Ghosts, Diane Todd Bucci
Ethnic Studies Review
In The Woman Warrior: Memoirs of a Girlhood Among Ghosts, Maxine Hong Kingston tells the story of her immigrant family and their efforts to rise above their working-class status in America, which optimistic Chinese regard as the Golden Mountain. The Hongs' experience is not unlike that of other immigrants who come to America to escape hardship in their homeland and hope to live the American Dream. The road to American success has numerous obstacles, and immigrants encounter many conflicts on their journey. One conflict relates to their cultural identities. Gloria Anzaldúa uses the word "borderland" to refer to the meeting …
The In-Between Places Where Children Are Socialized, Anne Dailey
The In-Between Places Where Children Are Socialized, Anne Dailey
Faculty Articles and Papers
In Between Home and School, Professor Rosenbury makes a splendid contribution to the emerging legal scholarship on the influence of cultural contexts on children's socialization. Scholars in this field have begun to study the effects on children of the media, peer relationships, civic institutions, and early caregiving environments. Professor Rosenbury's is a bold new voice in this genre offering a normative paradigm of space to replace the traditional dyadic model of state-parent authority over children. At the heart of the spatial paradigm is the view that in-between spaces socialize children in ways that differ both procedurally and substantively from the …
The Effects Of Stereotype Activation On Women's Reactions To Leadership Situations, Or, How Reading Cosmo Might Prevent You From Becoming Ceo, Stefanie L. Simon
The Effects Of Stereotype Activation On Women's Reactions To Leadership Situations, Or, How Reading Cosmo Might Prevent You From Becoming Ceo, Stefanie L. Simon
Honors Theses
The present experimental study investigated the effect of stereotype activation on women's responses to a leadership situation. Participants were exposed to either gender-stereotypic or gender-counterstereotypic magazine advertisements picturing women and then performed a leadership task involving two confederate s. Results supported the prediction that participants exposed to stereotypic advertisements would exhibit more negative reactions to the leadership situation than those exposed to counterstereotypic advertisements such that they reported lower perceived performance, self-esteem, and well-being. Sex-role orientation moderated this effect such that' advertisements had a stronger effect on feminine-oriented participants' domain identification, intent to lead in the future, and experienced cognitive …
Shrines And Prayers: Two Missing Elements Of Comprehensive Mass Fatality, Rhonda Keyes Pleasants
Shrines And Prayers: Two Missing Elements Of Comprehensive Mass Fatality, Rhonda Keyes Pleasants
Master's Theses
As a Licensed Funeral Service Provider, I am aware of the special issues which surround mass fatalities. A study of numerous mass fatality plans yielded identification of two missing elements from most plans which are critical to mass fatality management. The first missing element is ritual used in the respectful treatment of the dead. The second missing element is religious precepts regarding caring for and final disposition of the dead based upon the particular belief system of the deceased, their family, surrounding community, and culture. Specific qualitative methods of research used were a review of the professional literature, identification of …
Measuring Factors That Influence The Success Of E-Government Initiatives, Ronnie Park
Measuring Factors That Influence The Success Of E-Government Initiatives, Ronnie Park
CCAC Theses and Dissertations
The success of e-government initiatives is contingent upon its citizens ' willingness to use the services. Citizens are more likely to use e-government services if they believe that they get better value than from the conventional government services. Understanding how citizens value e-government services is critical to the success of these initiatives. This study utilizes two concepts from the field of decision analysis. These are mean-ends chains and value-focused thinking. The research that follows describes the development of a model to identify factors that influence value judgments of citizens.
Based on the data of 21 0 responses from e-government service …

An Analysis Of The Stereotypes Of Preacher’S Kids And Its Application On Their Spouses, Tara J. Allman
An Analysis Of The Stereotypes Of Preacher’S Kids And Its Application On Their Spouses, Tara J. Allman
Theses, Dissertations and Capstones
The purpose of this study is to discover the results of the effects of stereotypes and under what conditions certain stereotypes occur. The focus of this study is to examine stereotypes connected to the children of a Protestant minister and the spouses of those children. Ethnographic interviews and surveys show that the stereotype does exist in two distinct ways. Children of ministers are expected to either be rebellious hellions or they are expected to be perfect role models. The stereotypes affect the respondents more as children and teenagers than as adults unless as an adult the child still attends the …

Beyond Theocracy And Secularism (Part I): Toward A New Paradigm For Law And Religion, Mark C. Modak-Truran
Journal Articles
As part of a larger project challenging and moving beyond the premodern and modern paradigms, this article focuses on the modern paradigm and its notion of secularization. Section II will discuss the origin of the modern paradigm as a reaction to the religious pluralism and the religious wars in the sixteenth and seventeenth century such as the Thirty Years War in Europe (1618-48) and the English Civil War (1642-51) resulting from the Protestant Reformation. The Reformation divided the Western part of the Christian tradition into separate confessional institutions based on different theological interpretations of Christianity such as Lutheran, Calvinist, and …

I will provide a brief summary of each article and essay and indicate the methods or disciplinary perspectives employed by them in their analysis.
Lawyers Not In Love, The Defenders And Sixties Tv, Steven Classen
Lawyers Not In Love, The Defenders And Sixties Tv, Steven Classen
Faculty Publications - Department of Communication and Cinematic Arts
This essay offers a social history and examination of The Defenders as a popular, criti- cally acclaimed television text that negotiated anxieties regarding crime, law, justice, lib- eralism, and masculinity in the 1960s and 1990s. Both The Defenders television series (1961–1965) and the Showtime motion picture series (1997–1998) by the same name rearticulated enduring tensions between law’s formalism and just desires for compassion and mercy, depicting defense attorneys as men who work both inside and outside of “law” to ensure justice and confront the lack of humanism in “the rule of law.” Such discourses are understood and appreciated in different …

Discovering The Logic Of Legal Reasoning, Vern R. Walker
Discovering The Logic Of Legal Reasoning, Vern R. Walker
Hofstra Law Review
The rule of law rests on the quality of legal reasoning. The rule of law requires that similar cases should be decided similarly, that each case should be decided on its merits, and that decision-making processes should comply with applicable rules of procedure and evidence. Making the reasoning behind such decision-making transparent and open to scrutiny shifts the decisions away from mere subjective preference and toward objective rationale. An important means, therefore, of achieving the rule of law is articulating and evaluating the various elements of legal reasoning-the reasoning involved in interpreting constitutions, statutes, and regulations, in balancing fundamental principles …

Unethical Obedience By Subordinate Attorneys: Lessons From Social Psychology, Andrew M. Perlman
Unethical Obedience By Subordinate Attorneys: Lessons From Social Psychology, Andrew M. Perlman
Hofstra Law Review
This Article explores the lessons that we can learn from social psychology regarding a lawyer's willingness to comply with authority figures, such as senior partners or deep-pocketed clients, when they make unlawful or unethical demands. The Article reviews some of the basic literature in social psychology regarding conformity and obedience, much of which emphasizes the importance of context as a primary factor in predicting people's behavior. The Article then contends that lawyers frequently find themselves in the kinds of contexts that produce high levels of conformity and obedience and low levels of resistance to illegal or unethical instructions. The result …

Social Security Reform: Lessons From Private Pensions, Karen C. Burke, Grayson M.P. Mccouch
Social Security Reform: Lessons From Private Pensions, Karen C. Burke, Grayson M.P. Mccouch
UF Law Faculty Publications
Widespread concerns about the long-term fiscal gap in Social Security have prompted various proposals for structural reform, with individual accounts as the centerpiece. Carving out individual accounts from the existing system would shift significant risks and responsibilities to individual workers. A parallel development has already occurred in the area of private pensions. Experience with 401(k) plans indicates that many workers will have difficulty making prudent decisions concerning investment and withdrawal of funds. Moreover, in implementing any system of voluntary individual accounts, it will be important to design default settings that provide appropriate guidance for workers with heterogeneous levels of financial …
Introducing A Takedown For Trade Secrets On The Internet, Elizabeth A. Rowe
Introducing A Takedown For Trade Secrets On The Internet, Elizabeth A. Rowe
UF Law Faculty Publications
This Article explores, for the first time, an existing void in trade-secret law. When a trade-secret owner discovers that its trade secrets have been posted on the Internet, there is currently no legislative mechanism by which the owner can request that the information be taken down. The only remedy to effectuate removal of the material is to obtain a court order, usually either a temporary restraining order or a preliminary injunction. When a trade secret appears on the Internet, the owner often loses the ability to continue to claim it as a trade secret and to prevent others from using …
Public Law And Private Process: Toward An Incentivized Organizational Justice Model Of Equal Employment Quality For Caregivers, Rachel Arnow-Richman
Public Law And Private Process: Toward An Incentivized Organizational Justice Model Of Equal Employment Quality For Caregivers, Rachel Arnow-Richman
UF Law Faculty Publications
This article considers the relationship between prescriptive law and voluntary employer behavior in redressing the structural exclusion of working caregivers. In the last decade, several courts interpreting the Americans with Disabilities Act have held that employers are statutorily required to engage in an interactive process with workers to identify ways of accommodating their disabilities. In so doing, they have created procedural rights for workers that are distinguishable from and supplemental to the substantive right to reasonable accommodation afforded by the statute. This move resonates with developments in Title VII jurisprudence, such as the creation of an affirmative defense to harassment …
Cubewrap Contracts: The Rise Of Delayed Term, Standard Form Employment Agreements, Rachel Arnow-Richman
Cubewrap Contracts: The Rise Of Delayed Term, Standard Form Employment Agreements, Rachel Arnow-Richman
UF Law Faculty Publications
Modern companies increasingly use standard form agreements, such as arbitration and non-compete agreements, to “contractualize” discrete aspects of their workers’ obligations. Frequently such agreements provided to the worker after an initial oral agreement of employment has been reached, what the article refers to as “cubewrap” contracting practices. Courts and scholars have yet to develop a consistent contractual theory of the enforceability of these documents. In contrast, consumer contracts have been standardized for decades, and the problem of “terms in the box” contracts, in which key terms are similarly delayed, has been extensively debated. This article draws insights from the “terms …

Rights Relationships And The Experience Of Children Orphaned By Aids, Jonathan Todres
Rights Relationships And The Experience Of Children Orphaned By Aids, Jonathan Todres
Faculty Publications By Year
The global AIDS pandemic has left more than fifteen million children orphaned. These children constitute one of the most vulnerable populations, yet their situation has received relatively little scrutiny from legal scholars. This Article intends to fill that void by explicating the experience of children orphaned by AIDS, situating it in the broader context of the HIV/AIDS pandemic, and evaluating protections available under international human rights law. Analyzing human rights law as applied to children orphaned by AIDS exposes the extent to which rights are interrelated, particularly for marginalized populations.
In current scholarship, the interrelationship among rights, for the most …

Actually, We Are Leaving Children Behind: How Changes To Title I Under The No Child Left Behind Act Have Helped Relieve Public Schools Of The Responsibility For Taking Care Of Disadvantaged Students' Needs, Emily F. Suski
Faculty Publications By Year
This article calls attention to the changes to Title I under NCLB that do a disservice to disadvantaged students. Under NCLB, Title I has shifted from its original focus on meeting the needs of disadvantaged students. These changes have removed almost any responsibility at all for taking care of the needs of disadvantaged students so they can learn in school, something this article terms ‘dynamic caretaking.’ It calls for revising Title I to require this kinds of dynamic caretaking in order to improve disadvantaged students’ access to education in public schools.
