To What Extent Can Congress Change The Patent Right Without Effecting A Taking, Jesse S. Chui

UC Law Constitutional Quarterly

The Constitution confers upon Congress the power to "promote the ... useful Arts, by securing for limited Times to... Inventors the exclusive Right to their... Discoveries." Since the Patent Act of 1790, Congress has continued to define and redefine the metes and bounds of the patent right. This tradition continues with the Patent Reform Act of 2005, introduced in the House of Representatives on June 8, 2005.

Measuring The Effect Of Intimate Partner Violence On Health-Related Quality Of Life: A Qualitative Focus Group Study, Eve Wittenberg, Manisha Joshi, Kristie A. Thomas, Laura A. Mccloskey

Wayne State University Associated BioMed Central Scholarship

Abstract

Background

Health related quality of life (HRQOL) can be measured by a wide range of instruments, many of which have been designed for specific conditions or uses. "Preference-based" measures assess the value individuals place on health, and are included in economic evaluations of treatments and interventions (such as cost effectiveness analysis). As economic evaluation becomes more common, it is important to assess the applicability of preference-based health related quality of life (HRQOL) measures to public health issues. This study investigated the usefulness of such instruments in the context of intimate partner violence (IPV), a public health concern that that …

Rescue The Americans With Disabilities Act From Restrictive Interpretations: Alcoholism As An Illustration, Judith J. Johnson Jan 2007

Rescue The Americans With Disabilities Act From Restrictive Interpretations: Alcoholism As An Illustration, Judith J. Johnson

Journal Articles

The Supreme Court has narrowed the doorway into the protected class for the Americans with Disabilities Act of 1990 (ADA) in virtually every employment case. Taking their cue from the Supreme Court, the lower courts have been concerned principally with who is "disabled" and thus protected by the ADA. The answer today is not many people. The courts generally have been so hostile to ADA plaintiffs that it is difficult now to find a case in which the plaintiff was able to prove that he was disabled. Congress contemplated that some impairments would always be disabling. The Supreme Court, however, …

At the dedication of BYU’s new Joseph F. Smith Building on September 20, 2005, President Gordon B. Hinckley said of President Joseph F. Smith, “It is my opinion that no man, save the Prophet Joseph only, has had a greater and better understanding of the origin and history of the Church and of its doctrines—not only concerning this life but also concerning the eternities.” Of the “Vision of the Redemption of the Dead,” which comprises Doctrine and Covenants 138, he said, “It is a document without parallel. . . . There is nothing quite like it in all of our …

Pandemonium: A Review Essay Of Douglas J. Robinson, Who Translates? Translator Subjectivities Beyond Reason, Daryl R. Hague

BYU Studies

In 1975, Cambridge’s George Steiner published After Babel. That book, now in its third edition, is considered a classic for several reasons. For translation scholars, however, After Babel’s principal contribution is that it legitimized translation studies as a discrete academic field rather than as a mere appendage to comparative literature, linguistics, or language studies. Shortly after Steiner’s work was published, two other influential works on translation appeared: Louis Kelly’s The True Interpreter (1979) and Susan Bassnett-McGuire’s Translation Studies (1980). Together, these three works provided a historical and theoretical foundation on which translation scholars could build.

Direct Links: Using E-Mail To Connect Preservice Teachers, Experienced Teachers, And High School Students Within An Undergraduate Teacher Preparation Program, Alison Cook-Sather

Education Program Faculty Research and Scholarship

Much of preservice teacher education at the undergraduate level is based on indirect links between those preparing to teach and those who spend their days in schools. This article describes two kinds of direct links based in the culminating courses required for state certification to teach at the secondary level through an undergraduate teacher education program: one between preservice teachers and experienced teachers and one between preservice teachers and high school students. Consisting primarily of weekly e-mail exchanges, these dialogues constitute a unique forum for learning and teaching for all participants. The benefits participants identify-including the creation of a space …

Dimensions Of Internet Commerce Trust, D. Aiken, Robert Mackoy, B. Liu, Richard Fetter, Gregory E. Osland

Scholarship and Professional Work - Business

Trust is a central construct and plays a critical role in understanding Internet consumer behavior. This research seeks to directly address the subject of Internet Commerce Trust (ICT) by developing a valid, reliable, and generalizable scale to measure this multifaceted subject. Two separate studies reveal a common five-factor structure. These dimensions are labeled (1) Certification, (2) Resources and Capabilities, (3) Shopping Method, (4) Reliability, and (5) Communication Viability. An accurate measurement of ICT will serve as a viable control factor in future studies of Internet consumer behaviors, segmentation analyses, and in marketing strategy research.

Seasonal Affective Disorder And The Pricing Of Ipos, Steven D. Dolvin, Mark K. Pyles Jan 2007

Seasonal Affective Disorder And The Pricing Of Ipos, Steven D. Dolvin, Mark K. Pyles

Scholarship and Professional Work - Business

Purpose - It has been found that stock market returns vary seasonally with the amount of daylight, and they attribute this effect to seasonal affective disorder (SAD), which is a psychological condition that causes depression and heightened risk aversion during the fall and winter months. The goal of this study is to examine whether this effect also manifests itself in the pricing of initial public offerings (IPOs).

Design/methodology/approach - The authors conduct an empirical analysis on IPO data

collected over the period 1986-2000. Specifically, we examine potential pricing differences between IPO that go public during the fall and winter months, …

Synecdoche And Surprise: Transdisciplinary Knowledge Production, Anne Dalke, Elizabeth Mccormack Jan 2007

Synecdoche And Surprise: Transdisciplinary Knowledge Production, Anne Dalke, Elizabeth Mccormack

Literatures in English Faculty Research and Scholarship

Using contemporary insights from feminist critical theory and the literary device of synecdoche, we argue that transdisciplinary knowledge is productive because it maximizes serendipity. We draw on student learning experiences in a course on “Gender and Science” to illustrate how the dichotomous frameworks and part-whole correspondences that are predominant in much disciplinary discourse must be dismantled for innovative intellectual work to take place. In such a process, disciplinary presumptions interrogate and unsettle one another to produce novel questions and answers.

The Transition From Preschool To School For Children In Ireland: Teachers Views, Mary O'Kane Jan 2007

The Transition From Preschool To School For Children In Ireland: Teachers Views, Mary O'Kane

Articles

There is a wealth of international research on the transition from preschool to school from a range of perspectives. Following on from such research, the issue of transition is emerging as an important new construct in early childhood care and education (ECCE), with a transition-to-school framework replacing the construct of school readiness as a focus of research interest. There has been limited research into transition practices in Ireland and this study is the first comprehensive research looking at this area from an Irish perspective1. Phase I of this study involved conducting a questionnaire on the transition from preschool to formal …

Content Analysis Of Computer Conferencing Transcripts, Roisin Donnelly Jan 2007

Content Analysis Of Computer Conferencing Transcripts, Roisin Donnelly

Papers, presentations and other resources

As conferencing tools become an increasingly common feature in students’ experience, tutors need to have an understanding of how these tools facilitate the formation and maintenance of collaborative learning communities. Inevitably the pursuit of this understanding requires some form of analysis of the interactions involved. This analysis of the written transcripts, created by students during computer mediated conferencing (CMC), invariably takes the form of a systematic content analysis. For small-scale work the analysis can be undertaken manually but when the volume is large, as might arise from courses delivered wholly online or in a blended learning approach for example, some …
