Customary International Humanitarian Law And Multinational Military Operations In Malaysia, Drew R. Atkins
Washington International Law Journal
The International Committee of the Red Cross published a study in 2005 identifying rules of customary international law applicable to armed conflict and theoretically binding on all nations. This study found that customary state practice has come to encompass and in some cases exceed protections contained in the Additional Protocols of 1977 to the Geneva Conventions of 1949, regardless of their applicability to a given conflict. These findings may impact the domestic law enforcement practices of states not parties to Additional Protocol II, which regulates non-international armed conflict. Furthermore, the study may have indirect effects on military cooperation and legal …

The bankruptcy of the Enron Corporation in December 2002 is the biggest corporate bankruptcy in U.S. history. The Houston-based company, formed in 1985, became the nation's seventh-largest company in revenue by buying electricity from generators and selling it to consumers. Because Enron made the market in energy trading, its collapse fundamentally altered the U.S. energy trading industry. Equally important, the disclosure of Enron's role in California's power market crisis shattered confidence in deregulated wholesale-electricity and natural gas markets, creating obstacles for new players seeking to restore confidence in energy trading markets. The gap between the affluent and the global poor has increased during the past few decades, whether it is measured in terms of private consumption, income, or wealth. One would expect that severe poverty in a world of abundance would constitute a moral challenge to the affluent, but in fact it hardly seems a serious ethical concern. Affluent citizens seem so little morally concerned with global poverty. However, the most promising approach seems to be to explore and divulge factually and conceptually the numerous ways in which the affluent are implicated in a wholly unjust world of growing inequality. Cystic fibrosis (CF), the most common lethal autosomal recessive disease in Caucasians resulting in a median life span of approximately 35 years, is caused by mutations in the cystic fibrosis transmembrane conductance regulator (CFTR). The primary cause of morbidity and mortality is respiratory failure caused by progressive obstructive lung disease. CF airway disease is characterized by the abundance of pro inflammatory cells, chemokines and cytokines with a deficiency of regulatory/anti-inflammatory cytokine interleukin 10 (lL10). We hypothesized that CF airway obstruction originates from excessive inflammation and gene transfer of IL-I0 would decrease inflammation in the airways of mice infected with Pseudomonas …

Surface Associated Amoebae On The Ctenophore, Mnemiopsis Sp., Connie S. Versteeg

Previous work by Moss et al. (2001) reported surface associated protists on the ctenophore Mnemiopsis sp. They frequently observed the ciliate Trichodina ctenophorii and a Flabellula-like amoeba attached to the comb plate surface. They noted that the ciliate and the amoeba were found on the subsagittal, subtentacular, and the auricular comb plates. The amoeba had a maximum width of about 15 μm and cells were crescent shaped. Ultrastructural evidence suggested that these protists were parasites although the exact nature of the association remained to be determined. This was the background for the present study.

Soils are viewed in the context of ecosystem services, soil processes and properties, and key attributes and constraints. The framework used is based on the premise that the natural capital of soils that underlies ecosystem services is primarily determined by three core soil properties: texture, mineralogy, and soil organic matter. Up-to-date descriptions and geographical distribution of soil orders as well as soil attributes and constraints are given, along with the relationships between soil orders, properties, and biomes. We then relate ecosystem services to specific soil processes, soil properties, and soil constraints and attributes. Soil degradation at present is not adequately …

A Search For The Counter-Immune Mechanisms Of Mycobacterium Tuberculosis, Meghan Alida Kirksey

Tuberculosis is characterized by dynamic interactions between M. tuberculosis (Mtb) and the human immune response. The cytokine IFN-γ triggers macrophage production of bactericidal nitric oxide by inducible nitric oxide synthase (NOS2) and is essential for mammalian control of Mtb infection. Mice lacking NOS2 are unable to control replication of Mtb and rapidly succumb to infection. The persistent nature of TB infection suggests that Mtb has evolved counter-immune mechanisms to survive in the face of NOS2 and other pathways downstream of IFN-γ. A differential signature-tagged transposon mutagenesis screen was conducted to identify mutants attenuated in NOS2-/- mice, but retaining virulence in …

Winning By A Neck: Tall Giraffes Avoid Competing With Smaller Browsers, E. Z. Cameron, Johan T. Du Toit

With their vertically elongated body form, giraffes generally feed above the level of other browsers within the savanna browsing guild, despite having access to foliage at lower levels. They ingest more leaf mass per bite when foraging high in the tree, perhaps because smaller, more selective browsers deplete shoots at lower levels or because trees differentially allocate resources to promote shoot growth in the upper canopy. We erected exclosures around individual Acacia nigrescens trees in the greater Kruger ecosystem, South Africa. After a complete growing season, we found no differences in leaf biomass per shoot across height zones in excluded …

This Essay argues that the current trend focusing on the law and economics theory does a disservice to the full-spectrum of legal issues. Law and economics, according to the author, is a value -neutral approach to the law. It fails to take into account poverty and other social values when thinking about the law. Finally, law schools should recalibrate their approach and, in some instances, take social values into account when teaching the law.

Leadership, Communication And Religiosity In Higher Education Administration: Distinctions That Make A Difference, G. L. Forward, Kathleen Czech, Patrick Allen

This project investigated the communicative and religious components of transformational leadership and job satisfaction in the context of higher education. Specifically, 224 CAO members of the Council of Independent Colleges completed a survey assessing their own leadership style, communication behavior, and religiosity. A stepwise multiple regression procedure revealed seven significant predictors of transformational leadership. The most important variables included attentiveness, openness, role negotiation, and intrinsic religious orientation. Additionally, a t-test compared a subset of CAOs from institutions affiliated with the Council of Christian Colleges and Universities with CAOs in non-affiliated institutions. In the 1960s, Brain published on a series of taphonomic studies in which he observed the destruction of goat bones by pastoralists and domestic dogs. Those studies were notable and novel for a variety of reasons: 1) the attempt to control for complex parameters through the use of what we now recognize as experimental and naturalistic actualism, 2) documentation of the destructive impact on skeletal element abundance by secondary carnivore consumers, and 3) the attempt to understand the mechanical aspects of this process, and thus establish the foundation for justifiable uniformitarianism. This Article proposes a three-part approach to improve the food supply. Specifically, it explores government taxing and spending, two traditional public health tools, and suggests that both of these governmental powers can be used to make healthier foods more readily reasonable prices, while increasing the cost of less healthy alternatives. Finally, it proposes that we promote a true “food democracy” through the creation of an education and awareness campaign. This campaign would not only better educate Americans about proper nutrition but would also focus on how we can change our entire relationship with food. It would encourage consumption of locally …

Failures to establish coherent legal regimes and workable market systems, often in developing countries and those transitioning from non-market economies, have led to thriving informal economies. In such, the costs are simply lower for the individual to remain outside of the law. By analyzing the informal phenomenon, its consequences, and effects upon many of the most important human rights, it is demonstrated that virtually the entire human rights corpus is frustrated by the idea of people living outside of the law. Rapeseed (Brassica napus) is a bright yellow flowering member of the family Brassicaceae (mustard or cabbage family). Industrial rapeseed is high in erucic acid or H.E.A.R, with greater than 45 per cent erucic acid, which is mildly toxic to animals especially poultry. Erucic acid at levels beyond 0.605 per cent in diet is known to cause growth depression, reduction in feed intake and efficiency in growing chicks. Natural rapeseed meal also contains glucosinolates (the 'hot' in mustard seeds, when this compound is broken down with water it reacts and provides the heat felt on the tongue, characteristic in all Brassicaceae …

Color, Cooking Loss And Textural Properties Of Patties As Affected By Catfish Belly Flap Mince Size And Cooking Method, Jin M. Kim, Bartholomew W. Green

Patties were prepared with different sizes of channel catfish belly flap mince. Belly flap meat was minced using four different sizes of openings of plate, mixed with salt, formed, and cooked by two methods, in water and oven. Results indicated no differences (P>0.05) in Kramer shear break force in the patties cooked by different methods for same size of mince. As size of meat particles for patties decreased, increased were hardness and gumminess, and color difference from fillet, but decreased were Kramer shear break force as well as percent cooking loss (p< 0.05). Patties cooked in an oven showed greater color difference from fillet, percent cooking loss, hardness, and gumminess than those cooked in water for the same size of meat particles (p < 0.05).

Current soil conservation programs are built upon an established research legacy. Hugh H. Bennett, chief of the USDA Soil Conservation Service from 1935 to 1951, was instrumental in the establishment of a network of 35 soil conservation experiment stations (SCES). Research projects were initiated at the SCES in the 1930s to investigate the principal factors causing erosion and to identify the most effective and practical methods of controlling soil loss from agricultural areas. Information obtained from the SCES, and selected other locations, was assembled at the National Runoff and Soil Loss Data Center (NRSLDC) established on the campus of Purdue …
