The United States And Asean-China Relations: All Quiet On The Southeast Asian Front, Ian Storey Dr. Oct 2007

The United States And Asean-China Relations: All Quiet On The Southeast Asian Front, Ian Storey Dr.

Books, Monographs & Collaborative Studies

While the overall security situation in Southeast Asia is something of a mixed bag, with grounds for both optimism and pessimism, one of the most encouraging trends in recent years has been the development of ASEAN’s relations with major external powers. Relations between China and ASEAN in particular have demonstrated a marked improvement over the past decade, thanks to a combination of burgeoning economic ties, perceptions of China as a more constructive and responsible player in regional politics, and Beijing’s "charm offensive" toward Southeast Asia. Overall, the development of ASEAN-China relations poses few security challenges to the United States today: …

A March Of Moral Panic?: An Examination Of Reaction To Crime In Ireland In March 2006, Robin Maginn Oct 2007

A March Of Moral Panic?: An Examination Of Reaction To Crime In Ireland In March 2006, Robin Maginn

Dissertations

Moral Panic is a concept that examines disproportionate reaction towards an event or persons. In March of 2006, several events occurred which provoked strong reactions from the media and from politicians. This thesis explores and examines those reactions, and will try to determine if a moral panic could be said to have occurred. This is accomplished through a qualitative reading of the reactions, by identifying themes running through the discourse on crime of the time in question, and by applying indicators of moral panic to the data. The study finds that though the reactions may not necessarily indicate moral panic, …

Judging Genes: Implications Of The Second Generation Of Genetic Tests In The Courtroom, Diane E. Hoffmann, Karen H. Rothenberg Oct 2007

Judging Genes: Implications Of The Second Generation Of Genetic Tests In The Courtroom, Diane E. Hoffmann, Karen H. Rothenberg

Faculty Scholarship

The use of DNA tests for identification has revolutionized court proceedings in criminal and paternity cases. Now, requests by litigants to admit or compel a second generation of genetic tests – tests to confirm or predict genetic diseases and conditions – threaten to affect judicial decision-making in many more contexts. Unlike DNA tests for identification, these second generation tests may provide highly personal health and behavioral information about individuals and their relatives and will pose new challenges for trial court judges. This article reports on an original empirical study of how judges analyze these requests and uses the study results …

The Digital Titanic: The Sinking Of Youtube.Com In The Dmca's Safe Harbor, Trevor Cloak Oct 2007

The Digital Titanic: The Sinking Of Youtube.Com In The Dmca's Safe Harbor, Trevor Cloak

Vanderbilt Law Review

In today's technologically advanced world, video-sharing Internet sites ("VSIs"), such as Grouper.com, Bolt.com, and YouTube.com, provide free, unfettered access to clips of your favorite television shows and artistic performances, from Animaniacs to ZZ Top. With movie clips viewed over 100 million times each day, YouTube is the behemoth of these sites5-a major accomplishment considering the site entered the video-sharing market in May 2005. Two friends, Steve S. Chen and Chad Hurly, created YouTube after they experienced difficulty posting a video online. Taking advantage of online blogging's popularity, the two distinguished their site by coupling quick and easy video posting with …

Migration To And Through Yemen: The Case Of Migrant Domestic Workers, Marina De Regt Oct 2007

Migration To And Through Yemen: The Case Of Migrant Domestic Workers, Marina De Regt

Faculty Journal Articles

Regarding migration, Yemen is primarily known as a sending country. Large numbers of Yemenis have migrated abroad in different periods of Yemen’s history, and labour migration was one of the main sources of income since the oil boom in the 1970s. Since 1990, however, Yemen has turned into a receiving country. Not only were hundreds of thousands of Yemeni migrants expelled from Saudi Arabia and the Gulf States after Iraq’s invasion in Kuwait in 1990, but the political changes that took place in the Horn of Africa, in particular in Ethiopia and Somalia, in the early 1990s led to the …

Computers at the institution were used by all students for tutorials to prepare them for the FCAT and to obtain a high school diploma. The research questions for this study were as follows: 1. Is the education technology …

Wigner Distribution Of A Transducer Beam Pattern Within A Multiple Scattering Formalism For Heterogeneous Solids, Goutam Ghoshal, Joseph A. Turner, Richard Weaver Oct 2007

Wigner Distribution Of A Transducer Beam Pattern Within A Multiple Scattering Formalism For Heterogeneous Solids, Goutam Ghoshal, Joseph A. Turner, Richard Weaver

Department of Engineering Mechanics: Faculty Publications

Diffuse ultrasonic backscatter measurements have been especially useful for extracting microstructural information and for detecting flaws in materials. Accurate interpretation of experimental data requires robust scattering models. Quantitative ultrasonic scattering models include components of transducer beam patterns as well as microstructural scattering information. Here, the Wigner distribution is used in conjunction with the stochastic wave equation to model this scattering problem. The Wigner distribution represents a distribution in space and time of spectral energy density as a function of wave vector and frequency. The scattered response is derived within the context of the Wigner distribution of the beam pattern of …

"Whores And Other Feminists" Recovering Deadwood's Unlikely Feminisms, Anne Helen Petersen Oct 2007

"Whores And Other Feminists" Recovering Deadwood's Unlikely Feminisms, Anne Helen Petersen

Great Plains Quarterly (through 2013)

The very first vision of the female form in Deadwood is one of ultimate despair: the woman sits alone in the corner of a room, hysterically weeping, her face swollen and bruised with beating. A man sits across the room, a bullet through the temple, barely alive. He was beating her; she responded with a Derringer shot to the head. Moments later, the woman is on the ground in her pimp's office, his boot square on her neck. She writhes beneath him, nearly strangling to death before whispering through bloodied lips: "I'll be good." Meanwhile, the other prominent female character …

Emphasizing The User In The Usability Study: Investigating Activity Theory And Website Navigation, Heidi Trost Oct 2007

Emphasizing The User In The Usability Study: Investigating Activity Theory And Website Navigation, Heidi Trost

Theses

The effects of organizational schemes in website design have been studied using measures of speed, number of mouse-clicks, accuracy, and user recollection of website content information. This study investigates self-reported user confidence and satisfaction of websites using two different organizational schemes. Users were randomly assigned to one of the two sites and asked to perform a series of information-retrieval tasks. Time taken to complete the tasks was recorded and participants completed a survey measuring their confidence and satisfaction using a website. No significant differences were found between the two websites in respect to user self-reported confidence and satisfaction. The results …

Open Innovation And Strategy, Henry W. Chesbrough, Melissa M. Appleyard Oct 2007

Open Innovation And Strategy, Henry W. Chesbrough, Melissa M. Appleyard

Business Faculty Publications and Presentations

The article discusses a process of business innovation known as open innovation and its relation to traditional business strategy. The competitive strategy developed by Michael Porter emphasized rivalry, buyer power, and barriers to entry as forces that could enhance a producer's surplus. The authors discuss the impact of the Porterian value chain, the processes of production through to the consumer, on subsequent business practices. However, this theory does not account for external sources of value to a company, such as innovation communities, volunteer contributors and surrounding networks, including social networking web sites, open source software and the Wiki model of …

Reining In The Minister Of Justice: Prosecutorial Oversight And The Superseder Power, Abby L. Dennis Oct 2007

Reining In The Minister Of Justice: Prosecutorial Oversight And The Superseder Power, Abby L. Dennis

Duke Law Journal

Virtually immune from judicial sanction, professional discipline, and civil liability, prosecutors enjoy limitless, unmonitored, and, for the most part, unreviewable power. This power and insulation from review invite abuse and public mistrust, shaking confidence in the criminal justice system. With the system in need of a means of curbing errant prosecutors and restoring public confidence, this Note explores a neglected mechanism of prosecutorial oversight-the superseder power-and argues for increased use of this oversight mechanism, coupled with explicit guidelines for its use and a public review process.

Black And White And Read All Over: Press Protection After Branzburg, Sean W. Kelly Oct 2007

Black And White And Read All Over: Press Protection After Branzburg, Sean W. Kelly

Duke Law Journal

In 1972, the Supreme Court handed the press an apparent resounding defeat in Branzburg v. Hayes, declaring that the Constitution provided reporters no privilege from testifying about their confidential sources. This Note uses previously unpublished materials from the Justices' personal files to illustrate the behind-the-scenes deliberations as the Court shifted in ideology from the propress posture established by Justice Hugo Black in the Pentagon Papers case to the anti-privilege position established by Justice Byron White one year later in Branzburg. It also examines the curious concurring opinion of Justice Lewis Powell in Branzburg and subsequent efforts to craft a qualified …

Norming "Moderation'' In An "Iconic Target'': Public Policy And The Regulation Of Religious Anxieties In Singapore, Eugene K. B. Tan Oct 2007

Norming "Moderation'' In An "Iconic Target'': Public Policy And The Regulation Of Religious Anxieties In Singapore, Eugene K. B. Tan

Research Collection Yong Pung How School Of Law

The proposed research will examine Singapore’s response to terrorism post September 11, in particular the maintenance of a “moderate mainstream” Muslim community as a bulwark against the fraying of harmonious ethnic relations. In light of the global concern—and often paranoia—with diasporic Islam, Islamic religious institutions and civil society have been portrayed in the popular media as hotbeds of radicalism, promoters of hatred, and recruiters for a ‘conflict of civilization’ between the Muslim world and the modern world. Islamist attacks in Madrid and London have since brought increased urgency to the question of how to contain or moderate Islamic radicalism among …
