Copyright In An Era Of Information Overload: Toward The Privileging Of Categorizers, Frank Pasquale

Vanderbilt Law Review

What to read? or watch? or listen to? These are hard questions, not because of any scarcity of expression, but rather because of its abundance. Over 100,000 books are published in the United States each year, thousands of movies and CDs are released, and the amount of textual, musical, and visual works on the internet continues to rise exponentially. Whose work can we trust? And who knows what of it will rank among the best that has been thought and said-or even provide a few moments levity?

Admittedly, a bulging bookshelf or surfeit of films prompts an existential crisis in …

The Art Of Perception: Robert Irwin's Central Garden At The J. Paul Getty Center, Jennifer Kay Zell Jan 2007

The Art Of Perception: Robert Irwin's Central Garden At The J. Paul Getty Center, Jennifer Kay Zell

LSU Master's Theses

In this study of The Central Garden at the J. Paul Getty Center was found evidence that the Central Garden designed by Robert Irwin is a postmodern garden. Beginning with an evaluation and description of the individual elements and conditions of the garden, the study then explores the larger body of artistic work produced by Irwin. This investigation also extrapolates how the ideas of modernism and postmodernism have been applied to past works of landscape architecture. The precedents provide a basis for interpretation and analysis of the Central Garden. Direct observation of visitors at the Central Garden provided evidence of …

Stereochemical And Regiochemical Trends In The Selective Spectrophotometric Detection Of Biological Molecules, Shan Jiang Jan 2007

Stereochemical And Regiochemical Trends In The Selective Spectrophotometric Detection Of Biological Molecules, Shan Jiang

LSU Doctoral Dissertations

Useful mechanistic studies to date concerning sugar detection by arylboronic acid chemosensors have mainly involved the elucidation of equilibrium constants and the role of boron-nitrogen interactions in signal transduction. However, several discreet sugarboronate complexes exist in solution. This is due to the complex equilibria between isomeric species of even the simplest monosaccharides. Relatively few reports have been devoted to a systematic study of the structures of each of the corresponding individual sugar-boronate complexes. We have investigated some of the precise regio- and stereochemical features of the various equilibrating sugar isomers that induce selective signal transduction. As a result of this …

News Narratives And Television News Editing, Keren Esther Henderson Jan 2007

News Narratives And Television News Editing, Keren Esther Henderson

LSU Master's Theses

This study seeks to understand how and why television news editors impose meanings onto news packages through montage editing. Through a qualitative content analysis and in-depth interviews, this study will advance the notably few past narrative editing studies by investigating the norms and routines of television news editors. While other researchers recognize the significance of studying montage editing in television news, this is the first study to clarify the relationship between montage techniques and the creation of television news narratives.

What Remains, Cynthia A. Giacheti Jan 2007

What Remains, Cynthia A. Giacheti

LSU Master's Theses

My goal with this body of work was to create an installation that would resemble both a chapel and a shotgun house. The installation was constructed out of mixed media vignettes revealing both memories and constructed commentaries that reflect and document a moment of “real time” for me. The work I have created over the past several years speaks of human frailty and the mystery of existence. My thesis exhibition has allowed me to further develop my own personal symbols, which serve as fragile reminders of hope and transformation in a hostile world. I have created an environment with an …

Special Issues Raised By Rape Trials, Aviva A. Orenstein Jan 2007

Special Issues Raised By Rape Trials, Aviva A. Orenstein

Articles by Maurer Faculty

Rape cases reveal core conflicts in the space where evidence, law, and ethics intersect. Such conflicts include the tension between victim protection and the rights of the accused, the challenges attorneys face trying to negotiate the demands of sensitive and emotionally difficult cases, and the role of the law in counteracting stereotypes and bias.

In this essay, I will begin by presenting the cultural milieu surrounding rape allegations, briefly reviewing attitudes towards perpetrators and victims. Next, I will attempt to capture the legal zeitgeist concerning rape, focusing on two recent phenomena: the reversal of false rape convictions based on DNA …

What Is Natural Resources Law?, Robert L. Fischman Jan 2007

What Is Natural Resources Law?, Robert L. Fischman

Articles by Maurer Faculty

A recent flurry of new natural resources law casebooks, coming a quarter-century since the publication of the last significant new teaching materials, is an occasion to revisit the boundaries that define the field. The similarities among the casebooks are stronger than their differences, and represent a consensus about what composes natural resources law. The published teaching materials as well as an informal poll of natural resources law professors show a substantial overlap between natural resources and environmental law course coverage. Administrative implementation of statutes dominates both subjects. Both courses typically cover environmental impact analysis and endangered species protection. The new …

Synthesis Of Quaternary Dendronized Cellulose Derivatives And Their Potential Biological Applications, Changde Zhang Jan 2007

Synthesis Of Quaternary Dendronized Cellulose Derivatives And Their Potential Biological Applications, Changde Zhang

LSU Doctoral Dissertations

In this dissertation, novel dendronized cellulose derivatives with biodegradable backbones were created by using sodium carboxymethyl cellulose (CMC) as the starting material. CMC was first transformed into its corresponding tetrabutyl ammonium salt, which reacted with 2-chloro-N-methylpyridinium iodide (CMPI) to produce an activated ester of [2-(N-methyl pyridium) carboxymethyl cellulose] iodide (MPCMCI). The reaction of MPCMCPI and di-tert-butyl 4-[2-(ter-butoxycarbonyl)ethyl]-4-aminoheptanedicarboxylate (BA) produced a new derivative with BA dendron elaborated on cellulose backbone (CMCBA). The degree of substitution (DS) of CMCBA was adjusted by controlling the relative concentration of CMPI and by choosing CMC with different DS or different molecular weights. Thermogrametric analysis (TGA) …

Measurement Of Metal Migration In Sediment Caps With X-Ray Fluorescene, Ming Yin Jan 2007

Measurement Of Metal Migration In Sediment Caps With X-Ray Fluorescene, Ming Yin

LSU Doctoral Dissertations

ABSTRACT Sand is often used as a passive barrier to slow release of metals from the sediment and to separate benthic organisms from the sediment. Materials that effectively adsorb metals have the potential to provide significantly greater effectiveness by further retarding metal release. In this thesis, the effectiveness of apatite and Phosphil®, which contain phosphate in a form that can absorb many metals, is evaluated with a series of sorption and migration column experiments using Cr, Cu, Zn and Pb. Langmuir shape isotherms were observed suggesting that the effectiveness of these materials decreases at high concentration. The sorption isotherm experiments …

Scholarly Discourse, Public Perceptions, And The Cementing Of Norms: The Case Of The Indian Supreme Court And A Plea For Research, Jayanth K. Krishnan Jan 2007

Scholarly Discourse, Public Perceptions, And The Cementing Of Norms: The Case Of The Indian Supreme Court And A Plea For Research, Jayanth K. Krishnan

Articles by Maurer Faculty

For economic and nuclear reasons, India has received considerable attention over the last decade from observers in the United States. But attuned Americans are well-aware of India's rich culture and status as a shining constitutional democracy for most of its post-1947 independent history. For all that India has accomplished, however, its public has long viewed its government officials with great disdain. At the same time, a fascinating norm exists in this society which holds one institution in exceedingly high regard - the Indian Supreme Court.

In this article, I seek to examine what accounts for this counter-intuitive norm. As opposed …

Synthesis And Evaluation Of Derivatives And Analogs Of Xanthene Dyes, Xiangyang Xu Jan 2007

Synthesis And Evaluation Of Derivatives And Analogs Of Xanthene Dyes, Xiangyang Xu

LSU Doctoral Dissertations

Xanthene dyes are one of the oldest synthetic dyes. Fluorescein was first synthesized by von Baeyer in 1871. Since its discovery, it has been extensively studied. Fluorescein can exist as four different ionic forms (cationic form, neutral form, monoanionic form and dianionic form). Under physiological conditions (pH 7.4), fluorescein mainly exists as the dianionic form which grants it large quantum yield and excellent solubility in water. This renders fluorescein and its derivatives useful for studies in biological media. Cysteine (Cys) and homocysteine (Hcy) are of the few amino acids which contain sulfur and both of them are believed to be …

P-Glycoprotein And Membrane Permeability As Determinants Of Xenobiotic Bioavailability And Bioaccumulation, Xiaobing Tan Jan 2007

P-Glycoprotein And Membrane Permeability As Determinants Of Xenobiotic Bioavailability And Bioaccumulation, Xiaobing Tan

LSU Doctoral Dissertations

The ABC transporter P-glycoprotein (Pgp) and membrane permeability are determinant factors for absorption and disposition of xenobiotics. These studies investigated the effects of potential modulators of Pgp and/or membrane function on the disposition, bioavailability and bioaccumulation of environmentally relevant pharmaceuticals, tetracycline and ivermectin, and the carcinogen benzo[a]pyrene in catfish. The pesticide dieldrin and surfactant linear alkylbenzene sulfonate (LAS) were selected as mixture components thought to have potential interactions with these determinants of disposition. Initial in situ experiments demonstrated dieldrin and tetracycline both significantly inhibited biliary excretion of Pgp prototypic substrate Rhodamine-123 in isolated perfused livers. Further, dieldrin (20µM) reduced movement …

Electrodeposition Of Multilayered Nanostructures For Giant Magnetoresistance And Thermoelectric Applications, Despina Davis Jan 2007

Electrodeposition Of Multilayered Nanostructures For Giant Magnetoresistance And Thermoelectric Applications, Despina Davis

LSU Doctoral Dissertations

The electrodeposition of novel materials such as multilayer nanotubes for giant magneto resistance (GMR) applications and bismuth telluride nanotubes for thermoelectric applications are presented in this dissertation. The motivation for the multilayer electrodeposition is the investigation of giant magnetoresistance (GMR), a change in the material resistance in an applied magnetic field as a consequence of antiferromagnetic coupling. The nanowire high aspect ratio geometry allows the measurement of GMR with the current applied perpendicular to the plane (CPP) of the multilayers, which has been theoretically identified as being larger than the GMR in the (CIP) configuration (current in plane of multilayers). …

Denitrification Capacity And Denitrifying Bacteria In A Restored Bottomland Hardwood Forest, Mississippi River Alluvial Valley: Hydrological Impacts, Yan Li

LSU Master's Theses

Mississippi River Alluvial Valley (MAV) is one of the most important ecosystems in the United States, and bottomland hardwood forests (BLHs) are a major components of this ecosystem. The ecological and hydrological functions of BLHs can help maintain the diversity of species, groundwater balance, and nutrient removal etc. However, due to the increased human activities in the area, most of the BLHs were converted to agricultural land. Realizing the seriousness of the situation of the ecosystem, a series of programs have been carried out by the U.S. Fish and Wildlife Service (USFWS) and the U.S. Department of Agriculture (USDA) to …

Understanding Americans' Attitudes Toward Latino And Asian Immigration, Betina Cutaia Wilkinson Jan 2007

Understanding Americans' Attitudes Toward Latino And Asian Immigration, Betina Cutaia Wilkinson

LSU Master's Theses

The purpose of this paper is to explore the determinants of Americans’ attitudes toward immigration. I develop a measure of general support for immigration based on individuals’ responses to four immigration items: (1) support for increases in (legal) immigration; (2) feeling thermometer scores for illegal immigrants; (3) support for spending on border security to prevent illegal immigration; and (4) having “controlling illegal immigration” as a foreign policy goal. These items load on a single factor and permit us to generate a global pro-immigration scale that reflects Americans’ general views toward immigration. Further, I develop a comprehensive model of immigration attitudes …

Public Relations And Political Controversy: A Case Study Of The Assembly Of Turkish American Associations' Public Relations Campaign Regarding The Ottoman Empire's Deportation Of The Armenians, Tamar Grace Meguerditchian

LSU Master's Theses

An organization will almost always use persuasive communication tactics to influence public opinion. Persuasive communication tactics can be either pubic relations or propaganda. The definitions of both public relations and propaganda, as well as a study of the relevant models, reveals that neither practice heavily stresses the importance of social responsibility. Using the importance of social responsibility in honest persuasive communication tactics, this qualitative case study of the Assembly of Turkish American Associations’ (ATAA) determined that the efforts of the ATAA’s persuasive communication efforts are in line with the methods of propaganda, as stated in the operational definition of propaganda …

Soliciting Desire: The Ad-Man As Narrative Negotiation Between Art, Desire, And Consumer Capitalism In Twentieth-Century Novels, Jessica Mckelvie Kemp Jan 2007

Soliciting Desire: The Ad-Man As Narrative Negotiation Between Art, Desire, And Consumer Capitalism In Twentieth-Century Novels, Jessica Mckelvie Kemp

LSU Doctoral Dissertations

My dissertation identifies ways in which novelists have used an ad-man protagonist as means to investigate the social and psychological implications of advertising in the twentieth and twenty-first centuries. Soliciting Desire takes as its primary subjects H.G. Wells’s Tono-Bungay, Theodore Dresier’s The “Genius,” Frederick Wakeman’s The Hucksters, Jonathan Dee’s Palladio, and William Gibson’s Pattern Recognition and demonstrates that the ad-man character’s particular constellation of traits provides a rich vehicle for fictional explorations of desire and subjectivity as they are formed in relation to ideologies of consumer capitalism and art. Guided by Theodor Adorno and Walter Benjamin’s theories of cultural/ capitalist …

Probing The Association Behavior Of Hydrophobic Organic Compounds With Dissolved Humic Materials, Hadi M. Marwani Jan 2007

Probing The Association Behavior Of Hydrophobic Organic Compounds With Dissolved Humic Materials, Hadi M. Marwani

LSU Doctoral Dissertations

The association mechanism between hydrophobic organic compounds (HOC) and dissolved humic materials (DHM) has continued to be one of the interesting areas in environmental applications. The goal of the research reported in this dissertation is to investigate the association behavior of HOC with DHM. The first part of this research involves steady-state fluorescence measurements of these multi-component systems to study the effect of DHM content on the association mechanism of HOC, in particular using pyrene as a model. Results showed that steady-state fluorescence alone may not provide enough information about the quenching mechanism of pyrene with DHM. Lifetime based fluorescence …

Understanding The New York Rabies Epizootic 1985-2005, David Dorrell Jan 2007

Understanding The New York Rabies Epizootic 1985-2005, David Dorrell

LSU Doctoral Dissertations

Surveillance data are an important part of medical geography. These data are used to produce much of the analyses that define the subdiscipline. It is understood that surveillance data may contain biases, but there have only been limited studies devoted to determining in what ways the data are not representative of actual disease prevalence. New York was selected for this research for several reasons. First, it has a strong rabies data set. Second, it has a centralized system of licensing animal and dog control officers. Third, it is well-represented in terms of local media. This dissertation attempts to better understand …

The Spectral And Photophysical Characterization Of Water Solubilizing Metal Phthalocyanines For Highly Sensitive Detection In Biological Studies, Vera Tamisha Verdree Jan 2007

The Spectral And Photophysical Characterization Of Water Solubilizing Metal Phthalocyanines For Highly Sensitive Detection In Biological Studies, Vera Tamisha Verdree

LSU Doctoral Dissertations

Efforts to improve the technology for DNA analyses stimulated the work presented here to develop a series of fluorescent probes that would aid in the increased multiplexing capabilities allowing the ability to detect multiple targets in a single measurement. Typically, spectral discrimination has been used to identify each DNA fragment in sequencing or diagnostic applications by means of unique emission properties from several labeling dyes. This has been accomplished with labels that fluoresce in the visible region. The limitations with these dyes is the broad emission profile making discrimination difficult, high intrinsic biological fluorescence and structural differences of the dyes …
