Public-Private Health Law: Multiple Directions In Public Health, Nan D. Hunter

No public law is more public than public health law. Its defining subject is the use of state power to control and prevent death and disease. Its primary institutions are a cluster of state actors, the governmental agencies that comprise the American public health "system.,, The system grew out of the eighteenth century boards of health that produced the beginnings of administrative law. Public health law is grounded on statutory provisions that authorize various forms of state action and on judicial decisions that resolve constitutional challenges to those actions.

This Article addresses one of the most difficult issues under the reasonable accommodation provision of the Americans with Disabilities Act (ADA): how to resolve the conflict that arises when accommodating a disabled employee negatively affects or interferes with the rights of other employees. Several scholars and the Supreme Court (in U.S. Airways, Inc. v. Barnett) have weighed in on this debate, but their analyses fall short of the ultimate goal of this Article--to achieve equal opportunity for individuals with disabilities without unnecessarily interfering with the rights of other employees. Upon experiencing conflict in a relationship, individuals have a variety of response options. While one can seek revenge or avoid that person, another option – forgiveness – can repair the relationship and foster health for both relationship partners. In coming together to confront the conflict and move beyond it, relational partners negotiate forgiveness in interpersonal interactions to accommodate face needs. In doing so, individuals must communicate by seeking forgiveness from and granting it to their relational partners. This essay discusses a debated word form gaglviðr occurring in stanza 42 of the Old Icelandic poem VÄluspá 'The Prophesy of the Seeress'. The noun gaglviðr is problematic both from the semantic point of view (Old Icelandic gagl 'gosling', viðr 'tree; forest' 'gosling forest'?), and because it possesses a variant spelling galgviðr ('gallows' tree;’gallows' forest') which occurs in another manuscript containing the same poem. In the present paper, the form gaglviðr is considered to be the correct and the original form of this word, whereas the form galgviðr is interpreted as a scribal error. Kyoka draws upon his inspiration of the past and seeks, in his own words, “not to portray reality as reality, but to seek beyond reality for some more powerful truth” (Carpenter 154). Izumi Kyoka (1873–1939) was a prolific writer in the Meiji Era of Japan who depicted the literature of his past from the kusazoshi (illustrated fiction of the Edo Era), the ghostliness of Ueda Akinari, and the supernatural of the No Theater (Carpenter 154). One of the most emotionally charged issues related to American immigration, past and present is the question of how quickly and completely immigrants should be expected to assimilate into mainstream American culture. Throughout the nineteenth century, the prevailing attitude in America was that assimilation of immigrants would happen naturally and gradually, but the first decades of the twentieth century saw the rise of nativism and a much more aggressive approach to the Americanization of immigrants.1 While these trends peaked during World War I, their reverberations continued to impact immigrant groups throughout America throughout the decades preceding World War II. The purpose of this article is to introduce a model for a meaning-based functional syntax. A full description of the model may be found in our recent monograph (Mustajoki 2006b). Work on the model has been carried out in the Department of Slavonic and Baltic Languages and Literature at the University of Helsinki over the last fifteen years. The elicitation of language usage in the present study was carried out by means of a survey. Language utilization was surveyed in the home, in school, at work, and in government institutions to ascertain whether a functional hierarchy of domains in Belarusian and/or Russian obtains in Belarus. In addition, the study examines whether domain-specific language utilization varies according to participants’ sex. Respondents were asked to evaluate choice of language as “useful” or “necessary” for each domain. Findings reflect self-reports from 559 students born in Belarus and attending eight different institutions of higher education, cumulatively. Data were collected in three cities, …

Recent research in the field of second language acquisition is reconsidering the relationship between learning context and language gain, and is reevaluating study abroad programs compared to home-based immersion programs (Collentine and Freed 2004; Freed et al 2004, Segalowitz et al 2004). These researchers and others (Pellegrino 2005, Rivers 1998, Davidson et al 1995) point out that learners in study abroad programs often do not achieve expected language gains across major thresholds as measured by ACTFL oral proficiency standards, and a large proportion of students make no measurable gain, even after four months of study abroad in Russia (Davidson 2007, …

Researchers in the domain of Russian as a foreign and a second language have paid relatively little attention to proverbs as units of linguistic and cultural expression. Due to this neglect and the overall scarcity of statistical data on current Russian proverbial language, many Russian textbooks and dictionaries offer at best some outdated proverbs that have fallen into disuse in contemporary Russia and at worst, disregard proverbial language altogether. However, this expressive language deserves much more serious consideration from both researchers and teachers of Russian. In the construction of a part-of-speech annotated corpus, we are constrained by a fixed budget. A fully annotated corpus is required, but we can afford to label only a subset. We train a Maximum Entropy Markov Model tagger from a labeled subset and automatically tag the remainder. This paper addresses the question of where to focus our manual tagging efforts in order to deliver an annotation of highest quality. In this context, we find that active learning is always helpful. We focus on Query by Uncertainty (QBU) and Query by Committee (QBC) and report on experiments with several baselines and …

Dworkin V. The Philosophers: A Review Essay On Justice In Robes, Michael S. Green

In this review essay, Professor Michael Steven Green argues that Dworkin's reputation among his fellow philosophers has needlessly suffered because of his refusal to back down from his "semantic sting" argument against H. L. A. Hart. Philosophers of law have uniformly rejected the semantic sting argument as a fallacy. Nevertheless Dworkin reaffirms the argument in Justice in Robes, his most recent collection of essays, and devotes much of the book to stubbornly, and unsuccessfully, defending it. This is a pity, because the failure of the semantic sting argument in no way undermines Dworkin's other arguments against Hart.

This dissertation consists of three separate, but inter-related, studies overarching a common theme labeled "the role played by social and environmental accounting disclosures using different methodologies and framed within legitimacy theory." The first study investigates the use of different language techniques in social and environmental disclosures (SED) and tests whether the impression management hypothesis holds when disclosures are measured as such. Postcolonial theory aims at a critical interrogation of legitimizing knowledge claims put forward by proponents of the resurgent Empire. This article undertakes such an interrogation at the intersection of geography and international law. It aims to demonstrate that both modern geography and modern international law were constituted in, by, and through imperatives of Empire and unavoidably bear traces of their formative origin. This thesis explores how cultural differences manifest themselves in computermediated intercultural communication (CoMIC). This study particularly looks at the role and use of digital nonverbals (DNVs) and their regulatory functions. The data analyzed is from a global virtual team working together for a period of three months. The grounded theory method has been employed to code the electronic transcript of the team's communication. Furthermore, the participants were surveyed regarding their personal backgrounds, their work, and their perception of the communication processes that took place. It also examines how the perception of Russian has changed in post-Soviet Uzbekistan and Uzbeks now view their own language as a direct result of language policy. This Article corrects widespread misconception about whether complex regulatory systems can be fairly described as either "rules-based" or "principles-based" (also called "standards-based"). Promiscuous use of these labels has proliferated in the years since the implosion of Enron Corp. While the concepts of rules and principles (or standards) are useful to classify individual provisions, they are not scalable to the level of complex regulatory systems. Motivating Genocide: Indirect Colonial Rule As A Motivator Of Genocidal Ideology And Policy, Trevor Bruce Rockstad

In this study I have explored indirect colonial rule as a motivation of genocide. I use case studies of the 1994 Rwandan and 1975 Cambodian genocides to illustrate the way that indirect colonially rule divided societies, creating colonially relegated and colonially elevated sections of society. Genocide becomes a more likely possibility if the colonially relegated group gains power after decolonization. If this group does gain power, it will pursue a policy of retribution for oppression suffered during the colonially period, repression of the colonially elevated group, and minimization of the return to the colonially order in which they were the …

In this article, I expand upon a happy coincidence (for scholars) in reconciling the overlap between contract and fraud. Both the recent book by Ian Ayres and Gregory Klass and the opinion by the Delaware Court of Chancery in Abry Partners Acquisition V, L.P. v. F & W Acquisition, LLC addressed the matter of lies within contractual promises, whether as to the promisor's intention to perform or as to the state of the business being sold. A comparison of two approaches to academic writing and research pedagogies demonstrates that, for Vyhmeister, truth is to be found outside and above us--it is a process of discovery, while Hamilton's approach focuses on the spiritual formation of the writer and can be understood as reflecting a process of spiritual growth. A third approach, which I develop in this article, views academic writing and theological inquiry as a ministry, in which the writer is served by and, in turn, serves the community of faith for the purpose of building a corporate knowledge of God.
