Imagining Sovereignty, Managing Secession: The Legal Geography Of Eurasia's "Frozen Conflicts", Christopher J. Borgen Jan 2007

Imagining Sovereignty, Managing Secession: The Legal Geography Of Eurasia's "Frozen Conflicts", Christopher J. Borgen

Faculty Publications

The interrelated concepts of sovereignty, self-determination, and the territorial integrity of states form a Gordian knot at the core of public international law. These concepts encompass not only how we define the classic actors of the international system—states—but also how seriously international law takes claims of civil and political rights. This Article considers how geographic concepts can be used to try to untangle—or slice through this knot of issues.

The frozen conflicts of Eurasia are a series of ongoing secessionist crises in the post-Soviet states of Moldova, Georgia, and Azerbaijan. I will use the example of the so-called "frozen conflict" …

"Prisoner Never Gave Me Anything For What He Done:" Aboriginal Voices In The Criminal Court, Shelley A. M. Gavigan Jan 2007

"Prisoner Never Gave Me Anything For What He Done:" Aboriginal Voices In The Criminal Court, Shelley A. M. Gavigan

Articles & Book Chapters

Aboriginal people participated in different ways in the criminal process in the earl years of the North- West Territories region of Canada, including, as accused persons, as Informants, and as witnesses. Their participation was often mediated by the police, Indian agents and sometimes their Chiefs. Their word were also mediated by interpreters, both linguistic and cultural and their signatures were invariably marked as "X" on their depositions. Scholarship that has examined the relationship of Aboriginal peoples to the criminal law has tended to interrogate the criminalization and moral regulation strategies implicit in the process of colonization and domination of the …

A Redefined Feminine From Paleolithic To Twenty-First Century Through Children's Literature & Film, Pamela Dee Mccombs Jan 2007

A Redefined Feminine From Paleolithic To Twenty-First Century Through Children's Literature & Film, Pamela Dee Mccombs

Master's Theses and Doctoral Dissertations

The intention of my critical discourse is to redefine the knowledge of the feminine that Western tradition, through “master narratives,” silenced, subverted, and deferred. My guidelines were drawn from the deconstruction of philosophical works by Jacques Derrida and redefined the unique circle of “Being and beings” to be not just God and man, but God, Goddess, and Human, the Goddess being the original feminine. I discovered the feminine beginning, through archaeomythologists Gimbutas, Dever, and Davis-Kimball, with the unearthing of female figurines, temple models, and warrior priestesses. I found examples of the feminine survival through the Dark Ages in Lithuanian Dainos …

Going Private At The Intersection Of The Market And The Law, Faith Stevelman Jan 2007

Going Private At The Intersection Of The Market And The Law, Faith Stevelman

Articles & Chapters

Delaware's fiduciary doctrine governing going private transactions by controlling stockholders is presently in disarray. Controllers generally select between single step cash-out mergers and tender offers followed by short-form mergers to do these freezeouts, and they are subject to very different equitable standards depending on the format selected. Further disarray arises because the courts' longstanding commitment to strict scrutiny in freezeouts is in tension with the popular disfavor towards private class-action litigation. This disarray threatens minority investors' interests in freezeouts, and capital market values more broadly. First, the disparities in freezeout doctrine have encouraged controllers to arbitrage the legal standards for …

The Whitening Of Brown Skins And The Darkening Of Whiteness, Elaine Laforteza Jan 2007

The Whitening Of Brown Skins And The Darkening Of Whiteness, Elaine Laforteza

Reconstruction: Studies in Contemporary Culture

This paper draws on the interrelation of whiteness and Orientalism to provide a framework for examining the use of skin-bleaching lotions and soaps by some Filipino men and women. Through this focus, I investigate the ways in which skin-bleaching negotiates the "threatening" existence of brown flesh upon the contours of Filipino bodies and within the corpus of western(ised) nations. These threats are negotiated through the skin wherein various chromatic inflections of the flesh become processed as a part of or a threat to normative comfort zones. Skin-colour is thus the site of and for discursive construction and a domain of …

The Rhetoric Of Picasso, Matthew R. Sharp Jan 2007

The Rhetoric Of Picasso, Matthew R. Sharp

Theses and Dissertations

Pablo Picasso was arguably the most famous and controversial artist of the twentieth century, and some of his most famous pieces were created during the Spanish Civil War (1936-1939) in response to the horrible atrocities taking place in his homeland. "The Rhetoric of Picasso" by Matthew R. Sharp, filed December 2007, examines some of these works—including paintings such as Guernica and Weeping Woman —and theorizes their rhetorical force, using speech act theory as the theoretical lens. Based on common images and themes in Picasso's symbolism, it is determined that Picasso's works during the Spanish Civil War are expressive speech acts …

Attacking The Body Politic: The Terroristin In 1970s German Media, Clare Bielby Jan 2007

Attacking The Body Politic: The Terroristin In 1970s German Media, Clare Bielby

Reconstruction: Studies in Contemporary Culture

In a 1977 special feature on female terrorism, the German weekly newsmagazine, Der Spiegel, published a photograph of a woman with a bomb strapped to her front, masquerading as a pregnant woman. This image perfectly encapsulates the "paradoxical" quality of the female terrorist, who instead of giving life takes it. Furthermore, if, according to Tamar Mayer, women are represented in national and cultural narratives as "the nation's social and biological womb," the threatening quality of such representations for the body politic of the nation starts to become clear. As Mayer asserts "an attack on these [female] bodies becomes an …

Aesthetic Judgment And Legal Justification, Guyora Binder Jan 2007

Aesthetic Judgment And Legal Justification, Guyora Binder

Journal Articles

Although criticized as illegitimate, literary elements are necessary features of legal argument. In a modern liberal state, law motivates compliance by justifying controversial prescriptions as products of an appropriate process for representing the will of society. Yet because law constructs the will of individual and collective actors in representing them, its representations are necessarily figurative rather than mimetic. In evaluating law's representation of society, citizens of the liberal state are also shaping their own ends. Such self-expressive choices, subjective but non-instrumental, entail aesthetic judgment. Thus the literary elements of rhetorical figuration and aesthetic appeal are fundamental, rather than merely ornamental, …

Blog Analysis With Fuzzy Tfidf, Chi-Shu Ho

Master's Projects

These days blogs are becoming increasingly popular because it allows anyone to share their personal diary, opinions, and comments on the World Wide Wed. Many blogs contain valuable information, but it is a difficult task to extract this information from a high number of blog comments. The goal is to analyze a high number of blog comments by clustering all blog comments by their similarity based on keyword relevance into smaller groups. TF-IDF weight has been used in classifying documents by measuring appearance frequency of each keyword in a document, but it is not effective in differentiating semantic similarities between …

Use Of Learning Styles In The Selection Of Instructional Strategies : Does Pedagogy Lead To Practice?, Roger E. Baker Jan 2007

Use Of Learning Styles In The Selection Of Instructional Strategies : Does Pedagogy Lead To Practice?, Roger E. Baker

Graduate Research Papers

Much has been written about the importance of learning styles in instructional design. Learning styles can be measured by the use of personality profiles such as the Myers-Briggs Type Indicator (MBTI). Learning styles can also be measured by Learning Style Inventories and defined by cognitive theory such as Gardner's multiple intelligences. This literature review explores the different approaches to the study of learning styles and the practical use of learning style indicators as a tool for selecting instructional strategies.

Many challenges exist in designing instruction to the personal level including costs, time, and instructor limits. Philosophical questions on the benefits …

Ready Or Not, Here They Come : A Look At Kindergarten Readiness, Sara J. Swyter Jan 2007

Ready Or Not, Here They Come : A Look At Kindergarten Readiness, Sara J. Swyter

Graduate Research Papers

This study examined the subject of kindergarten readiness. Both socially and academically mature and immature children were included in this study. An intervention model was presented for children who assessed behind their peers socially and academically. It was documented and reported that children who were assessed as below their peers socially and academically were able to make good progress through the intense one-on-one interventions performed; however, their growth was not enough to completely catch them up to their non-struggling peers. Results were shared and recommendations were made for future children academically and socially immature.

Congress’S Under-Appreciated Power To Define And Punish Offenses Against The Law Of Nations, Andrew Kent Jan 2007

Congress’S Under-Appreciated Power To Define And Punish Offenses Against The Law Of Nations, Andrew Kent

Faculty Scholarship

Perhaps no Article I power of Congress is less understood than the power to define and punish . . . Offences against the Law of Nations. There are few scholarly works about the Clause; Congress, the Supreme Court, and the Executive Branch have seldom interpreted the Clause, and even then they have done so in a cursory and contradictory manner. Relying on textual analysis and Founding-era history and political theory to read the Clause in a different mannner than previous commentators, this Article seeks to rescue the Clause from obscurity and thereby enrich current foreign affairs debates. Not only is …

Cross-Linguistic Analysis Of Vietnamese And English With Implications For Vietnamese Language Acquisition And Maintenance In The United States, Giang Tang Jan 2007

Cross-Linguistic Analysis Of Vietnamese And English With Implications For Vietnamese Language Acquisition And Maintenance In The United States, Giang Tang

Journal of Southeast Asian American Education and Advancement

Two overall goals of this paper are a) to provide a linguistic basis for promoting first language maintenance of Vietnamese in a larger United States context and b) to stimulate future research in language acquisition of Vietnamese-English speakers. This paper is divided into three sections. Section 1 discusses previous studies on first language (L1) maintenance among Vietnamese Americans. Section 2 presents a cross-linguistic comparison of Vietnamese and English across speech-sound, word, and grammatical language levels. A cross-linguistic analysis may help educators better understand speaking patterns of Vietnamese American students. Based on this cross-linguistic comparison, Section 3 presents potential bi-directional interactions …

Distanciation And The Recontextualization Of Space: Finding One’S Way In A Small Western Community, Lisa Gabbert Jan 2007

Distanciation And The Recontextualization Of Space: Finding One’S Way In A Small Western Community, Lisa Gabbert

English Faculty Publications

In the 1990s, the city of McCall, Idaho, and the surrounding region implemented the Rural Addressing System. The system assigned a name to every street and a number to every house and erected visible signage for both. Although a seemingly minor bureaucratic operation, the Rural Addressing System is a concrete example of Anthony Giddens's concept of space distanciation, and as such, it is a significant component of modernity and globalization. By investigating the impact of the Rural Addressing System on this region—particularly on the ways in which people give directions and think about space there—this article sheds light on how …

Working Towards Restorative Justice In Ethiopia: Integrating Traditional Conflict Resolution Systems With The Formal Legal System, Julie Macfarlane Jan 2007

Working Towards Restorative Justice In Ethiopia: Integrating Traditional Conflict Resolution Systems With The Formal Legal System, Julie Macfarlane

Cardozo Journal of Conflict Resolution

This paper considers how the multiple realities of dispute resolution in any environment affect the work of conflict resolution practitioners. Conflict resolution practitioners are almost always invited in by representatives of the formal legal system, and their work generally focuses on managing - and perhaps reforming - this system. In practice, they cannot ignore the existence of parallel informal systems of conflict resolution that may undermine or distract from the formal state system. These may include structured alternatives to law, such as religious tribunals or community mediation programs. There may be other, more informal but equally significant family or community-based …

"Khmer Pride": Being And Becoming Khmer-American In An Urban Migrant Education Program, Theresa Ann Mcginnis Jan 2007

"Khmer Pride": Being And Becoming Khmer-American In An Urban Migrant Education Program, Theresa Ann Mcginnis

Journal of Southeast Asian American Education and Advancement

This article focuses on the ways an urban migrant education program becomes a space where middle school Khmer students can explore who they are as Khmer youth living in an urban American context. I discuss how the youth are able to take a transformative, interactional stance to the literacy and sign-making practices within the program. I argue that the Khmer youth's identities are reflected within these literacy and expressive practices. Further, I suggest the experiences of these Khmer middle school children of agricultural workers provide rich examples of how immigrant youth draw on a variety of cultural resources (from urban …

Essential Understandings: Exploring My Personal Relationship With The Multiple Intelligences Through Art, Jeffrey Wardlaw Brown Jan 2007

Essential Understandings: Exploring My Personal Relationship With The Multiple Intelligences Through Art, Jeffrey Wardlaw Brown

Graduate Student Theses, Dissertations, & Professional Papers

The theory of Multiple Intelligences holds that there are an array of different kinds of intelligences in human beings. Howard Gardner has identified 8 multiple intelligences: Verbal/Linguistic, Logical/Mathematical, Spatial, Bodily/Kinesthetic, Musical, Interpersonal, Intrapersonal, and Naturalist. This project was designed to explore the practical applications of the theory through personal experience. A series of five artworks were produced using the artistic mediums of oil and acrylic paints, clay, natural found objects, songwriting and musical performance. The artworks served as external documentation of the inner processes through which the eight intelligences were manifested. A public lecture was held describing the artworks and …
