Legal Commitments And Religious Commitments, Joseph Vining
Legal Commitments And Religious Commitments, Joseph Vining
San Diego Law Review
Person, individual, purpose, value, authority: Can these be realities for law without making a commitment to law into a religious commitment? Can the affinities between the world of law and the world of religious life be as close as they are without leading one to conclude, empirically or introspectively, that these dimensions of experience are the same? In a comment on Steven Smith's Law's Quandary, this essay suggests law has an ontology of its own. As Smith argues, the language of everyday life does not fully reach what is real for law, and law's ontology is clearly not limited to …
The Social Construction Of Authorship: An Investigation Of Subjectivity And Rhetorical Authority In The College Writing Classroom, Johannah Rodgers
The Social Construction Of Authorship: An Investigation Of Subjectivity And Rhetorical Authority In The College Writing Classroom, Johannah Rodgers
Dissertations, Theses, and Capstone Projects
Although we use the term author on a daily basis to refer to certain individuals, bodies of work, and systems of ideas, as Michel Foucault and other critics have pointed out, attempting to answer the question “What is an Author?” is by no means a simple proposition. And, starting from the position that there is no single, or definitive answer to this complex question, this dissertation seeks to contribute to the ongoing discussion of the genealogy of authorship by investigating the ways in which conceptions of the author have informed models of the writing subject in the field of rhetoric …
The Relationship Between Oral Reading Fluency And Comprehension, Jessica A. Talada
The Relationship Between Oral Reading Fluency And Comprehension, Jessica A. Talada
Doctoral Dissertations and Projects
Oral reading fluency and reading comprehension are identified as components in effectively gaining meaning from text. A reciprocal relationship exists between the two that allows one to comprehend more thoroughly as one reads more fluently. Additionally, as one reads more fluently, one’s ability to comprehend also improves. This is due to the fact that one’s brain is more capable in processing text meaning when one is able to read fluently. Therefore, when one automatically identifies words one is able to comprehend text more completely. The oral reading fluency and comprehension relationship was tested for a second and third grade population …

A Kinematic Analysis Of Sign Language, Chemuttaai C. Koech
A Kinematic Analysis Of Sign Language, Chemuttaai C. Koech
Theses
Signed languages develop among deaf populations and employ manual communication instead of voiced communication. Stokoe attributes classify individual signs in American Sign Language (ASL) and include handshape, hand location, movement, orientation, and facial expression. Signed and oral languages are not mutually understood, and many deaf individuals live in linguistic isolation. This research addresses computer translation between signing and speech, investigating sign duration in sentence context versus in isolation and identifying kinematic sign markers. To date, there has been little study of continuous signing kinematics; it was previously unknown if kinematic markers existed.
Kinematic data were collected from a proficient signer …

Law And Heidegger’S Question Concerning Technology: A Prolegomenon To Future Law Librarianship, Paul D. Callister
Law And Heidegger’S Question Concerning Technology: A Prolegomenon To Future Law Librarianship, Paul D. Callister
ExpressO
Following World War II, the German philosopher Martin Heidegger offered one of the most potent criticisms of technology and modern life. His nightmare is a world whose essence has been reduced to the functional equivalent of “a giant gasoline station, an energy source for modern technology and industry. This relation of man to the world [is] in principle a technical one . . . . [It is] altogether alien to former ages and histories.” For Heidegger, the problem is not technology itself, but the technical mode of thinking that has accompanied it. Such a viewpoint of the world is a …
The Role Of Latinidad In The Worship And Formation Of Identity Of A U.S. Hispanic, Pentecostal Church, Kristina Arellano
The Role Of Latinidad In The Worship And Formation Of Identity Of A U.S. Hispanic, Pentecostal Church, Kristina Arellano
Masters Theses
This case study examines how culture influenced the worship of one U.S. Hispanic church made up of thirteen different nationalities. I examined how Latinidad, a unified Latino identity, assisted in the construction of Iglesia Ebenezer’s collective identity enabling them to worship together despite their diversity. I observed several worship services and interviewed eleven participants during my fieldwork: three pastors, two youth leaders, and six worship-team musicians. I compared and contrasted case studies of the musicians to construct a collective identity of this small group. A final analysis compared my fieldwork observations and the perspectives of all eleven individuals to establish …
"Prisoner Never Gave Me Anything For What He Had Done:" Aboriginal Voices In The Criminal Court, Shelley A.M. Gavigan
"Prisoner Never Gave Me Anything For What He Had Done:" Aboriginal Voices In The Criminal Court, Shelley A.M. Gavigan
Socio-Legal Review
Aboriginal people participated in different ways in the criminal process in the early years of the North-West Territories region of Canada: including, as accused persons, as Informants, and as witnesses. Their physical participation was often mediated by the police, Indian agents and sometimes their Chiefs. Their words were also mediated by interpreters, both linguistic and cultural, and their signatures invariably marked as “X” on their depositions. Scholarship that has examined the relationship of Aboriginal peoples to the criminal law has tended to interrogate the criminalization and moral regulation strategies implicit in the process of colonization and domination of the First …

Masking Identity: The French Headscarf Controversy Vis-A-Vis Children's Rehabilitation Homes In Bangalore, Simi Rose George
Masking Identity: The French Headscarf Controversy Vis-A-Vis Children's Rehabilitation Homes In Bangalore, Simi Rose George
Socio-Legal Review
The growing frequency of terrorist attacks and sporadic acts of violence based on cultural and religious differences points towards the need to rethink policies adopted by multicultural societies towards integrating diverse communities into the national fabric. Indeed, creating a sense of belonging amongst individuals from different cultures has always been a challenge for multicultural societies. In order to achieve this end, many European countries have sought to erase markers of cultural identity from the public domain. For instance, in a recent move, France has banned the use of all religious symbols in its schools. Field research in two children’s rehabilitation …
Transactional Economics: John Dewey's Ways Of Knowing And The Radical Subjectivism Of The Austrian School, Robert Mulligan
Transactional Economics: John Dewey's Ways Of Knowing And The Radical Subjectivism Of The Austrian School, Robert Mulligan
Education and Culture
The radical subjectivism of the Austrian school of economics is a special case of Dewey’s ways of knowing. Austrian economists adopted an Aristotelian deductive approach to economic issues such as social behavior and exchange. In Dewey’s contrasting view, the scientist commends new, alternative ways of knowing to the scientific community, offering more profound insight or more efficacious practical applications. Alternative ways of knowing which do not offer practical or intellectual benefits are to be rejected. Dewey’s transactional strategy, asserting knowledge as ways of knowing, suggests a broader and more fundamental critique of the socialist position in the calculation debate. The …
“Back To The Future”: Philosophy Of Education As An Instrument Of Its Time, Walter Feinberg
“Back To The Future”: Philosophy Of Education As An Instrument Of Its Time, Walter Feinberg
Education and Culture
In this 2006 John Dewey Society Invited Address, I place Dewey in a larger philosophical and historical context. My hope is that by doing so we can learn more about the future prospects for the role of philosophy of education. I see Dewey as one of those rare canonical philosophers whose reputation as a philosopher is intricately tied to their writings on education and I want to explore why this tie makes sense with some canonical figures, such as Plato and Rousseau, but not with others, such as Aristotle, Locke, Whitehead, and Russell, who have also contributed to our understanding …
Western Liberal Legalism And Its Discontents: A Persepective From Post- Apartheid South Africa, Narnia Bohler-Muller
Western Liberal Legalism And Its Discontents: A Persepective From Post- Apartheid South Africa, Narnia Bohler-Muller
Socio-Legal Review
Much of the development in human rights is today reflected and understood through the lens of the meta-narrative of western legal liberalism, which inherently inhibits the full progress and utility of the rights discourse. Legalism and formalism work to legitimise the law, and make transformation and alternative formulations of notions of equality and rights impossible, thus perpetuating a status quo that ignores the empowerment of subaltern groups. This article argues in favour of changing the lens through which we appreciate law and legal processes today. Looking at the constitution of post apartheid South Africa, and subsequent case law, the author …

Full-Day Kindergarten: The Families Perspective, Brandy Anfang
Full-Day Kindergarten: The Families Perspective, Brandy Anfang
Theses and Graduate Projects
The purpose of this study is to investigate why parents choose full-day kindergarten programs over half-day kindergarten programs. Five parents of full-day kindergartners elected to participate in this study. Interviews were conducted with each of the five parents in either their home or a local establishment in the spring of 2006. Interviews with their children were also conducted during the child's school day. Parents stated two major factors in deciding which kindergarten program to enroll their child in: daycare and academics.

The Music Of A Kalinga Peace-Pact Celebration: Making Place Through The Soundscape, Glenn Ress Stallsmith
The Music Of A Kalinga Peace-Pact Celebration: Making Place Through The Soundscape, Glenn Ress Stallsmith
Masters Theses
Music and place are two phenomena that have been objectified by researchers in the past. This thesis treats both as social processes created by subjects in local, specific contexts. The Kalinga peace pact system forms an intricate web of bilateral agreements between forty or more culture groups in the northern Philippines. Each agreement is celebrated when it is formed or when a peace pact holder from one group passes the responsibility on to his son. This thesis examines eight musical scenes at one peace pact ceremony celebrated in the Mangali culture area in April 2005. It analyzes the music performances …

Neurophysiologic And Behavioral Measures Of Phonetic Perception In Adult Second Language Speakers Of Spanish, Jaden D. Hellewell
Neurophysiologic And Behavioral Measures Of Phonetic Perception In Adult Second Language Speakers Of Spanish, Jaden D. Hellewell
Theses and Dissertations
Infants 6-8 months old are able to identify nearly every speech sound contrast on which they have been tested, regardless of whether that contrast represents an across-category (two different phonemes) phonetic change in their native language or not. A child's ability to identify non-native consonant contrasts greatly diminishes by 11-12 months of age. The present study examined speech sound discrimination in three groups of listeners. Adult second language (L2) listeners of Spanish were compared with native English listeners with no knowledge of Spanish and native Mexican listeners to determine if they would show the ability to discriminate phonetic distinctions that …
